which was referred to the <committee-name committee-id="HPW00">Committee on Transportation and Infrastructure</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To require the Administrator of the Federal Motor Carrier Safety Administration to establish an advisory board focused on creating opportunities for women in the trucking industry, and for other purposes.</official-title></form><legis-body id="HD5FC9505C7364169A649371D7371E5E6" style="OLC"><section id="H67DE9D7CD752464EBD04F6E26D5BB847" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Promoting Women in Trucking Workforce Act</short-title></quote>.</text></section><section id="H740583F54EAF4A508ADD2B4A0995EB53" section-type="subsequent-section"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds that—</text><paragraph id="HA126C6B508A64B5CAE06595BD690E934"><enum>(1)</enum><text>women make up 47 percent of the workforce of the United States;</text></paragraph><paragraph id="HC3668D148D554433A1CE515AAEDDC233"><enum>(2)</enum><text display-inline="yes-display-inline">women are significantly underrepresented in the trucking industry, holding only 24 percent of all transportation and warehousing jobs and representing only—</text><subparagraph id="HBF1AB5990FD94D0097EEF5C8D418FED6"><enum>(A)</enum><text>6.6 percent of truck drivers;</text></subparagraph><subparagraph id="H5FD765EE798A4322951EE4360E307493"><enum>(B)</enum><text>12.5 percent of all workers in truck transportation; and</text></subparagraph><subparagraph id="HF4D4A113EBC04C3C83C9736B8FDF7E97"><enum>(C)</enum><text>8 percent of freight firm owners;</text></subparagraph></paragraph><paragraph id="HD964D5845A704C18AC653A12AE063AEB"><enum>(3)</enum><text display-inline="yes-display-inline">given the total number of women truck drivers, women are underrepresented in the truck-driving workforce; and</text></paragraph><paragraph id="H5D35E339247844DB8BE2E34BA3D0112E"><enum>(4)</enum><text display-inline="yes-display-inline">women truck drivers have been shown to be 20 percent less likely than male counterparts to be involved in a crash.</text></paragraph></section><section id="H283BA5450B674BA8839D9708085922A2"><enum>3.</enum><header>Sense of Congress regarding women in trucking</header><text display-inline="no-display-inline">It is the sense of Congress that the trucking industry should explore every opportunity to encourage and support the pursuit and retention of careers in trucking by women, including through programs that support recruitment, driver training, and mentorship.</text></section><section id="HF545B66AAECD4CCCAD217DB7FA8E0BD3"><enum>4.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph id="H4ACE39D641F34C98871669BFDDF3D53A"><enum>(1)</enum><header>Administrator</header><text>The term <quote>Administrator</quote> means the Administrator of the Federal Motor Carrier Safety Administration. </text></paragraph><paragraph id="H95942573AFF74D3081AB85AD84F07B47"><enum>(2)</enum><header>Board</header><text>The term <quote>Board</quote> means the Women of Trucking Advisory Board established under section 5(a).</text></paragraph><paragraph id="HCE73B3BDF2D745ECBA7B10B43B33EDCC"><enum>(3)</enum><header>Large trucking company</header><text display-inline="yes-display-inline">The term <quote>large trucking company</quote> means a motor carrier (as defined in section 13102 of title 49, United States Code) with more than 100 power units.</text></paragraph><paragraph id="H433112DCAB6A4E8FA2FD67DA13910FC7"><enum>(4)</enum><header>Mid-size trucking company</header><text display-inline="yes-display-inline">The term <quote>mid-size trucking company</quote> means a motor carrier (as defined in section 13102 of title 49, United States Code) with not fewer than 11 power units and not more than 100 power units.</text></paragraph><paragraph id="H65624C9EFE284C7DB574AFB009F38E15"><enum>(5)</enum><header>Power unit</header><text display-inline="yes-display-inline">The term <quote>power unit</quote> means a self-propelled vehicle under the jurisdiction of the Federal Motor Carrier Safety Administration.</text></paragraph><paragraph id="H6D66CDC6560D474C90AD93A01790FB72"><enum>(6)</enum><header>Small trucking company</header><text display-inline="yes-display-inline">The term <quote>small trucking company</quote> means a motor carrier (as defined in section 13102 of title 49, United States Code) with not fewer than 1 power unit and not more than 10 power units.</text></paragraph></section><section id="H3B3F8844CD5E40AC98CFC89EAFBBA756"><enum>5.</enum><header>Women of trucking advisory board</header><subsection id="HBFE0E68C57034DBBA5D760AD5DED9E19"><enum>(a)</enum><header>Establishment</header><text display-inline="yes-display-inline">To encourage women to enter the field of trucking, the Administrator shall establish and facilitate an advisory board, to be known as the <quote>Women of Trucking Advisory Board</quote>, to promote organizations and programs that—</text><paragraph id="H4820A2E0678F46B09518D7354C650A43"><enum>(1)</enum><text display-inline="yes-display-inline">provide education, training, mentorship, or outreach to women in the trucking industry; and</text></paragraph><paragraph id="HA0916DB9A8724EB487129A4E1F21026C"><enum>(2)</enum><text display-inline="yes-display-inline">recruit, retain, or advance women in the trucking industry.</text></paragraph></subsection><subsection id="H5D30E98DAA2740B4883BBFB8557D589F"><enum>(b)</enum><header>Membership</header><paragraph id="H2A29C887208D49558C10326EF019BDBB"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The Board shall be composed of not fewer than 8 members whose backgrounds, experience, and certifications allow those members to contribute balanced points of view and diverse ideas regarding the strategies and objectives described in subsection (c)(2).</text></paragraph><paragraph id="H90A2F9773BCD4158B44AA972B6F0F0DC"><enum>(2)</enum><header>Appointment</header><subparagraph id="HFA1DC40395A1408888D1C6A56A71E5D9"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 270 days after the date of enactment of this Act, the Administrator shall appoint the members of the Board, of whom—</text><clause id="H71957DDED1CB4BE990CDAD67EB6D2740"><enum>(i)</enum><text>not fewer than 1 shall be a representative of large trucking companies;</text></clause><clause id="HDAA5F208E52D4A13A07E28A39EB979D8"><enum>(ii)</enum><text>not fewer than 1 shall be a representative of mid-sized trucking companies;</text></clause><clause id="H566048FC472243758D2427DE20287446"><enum>(iii)</enum><text>not fewer than 1 shall be a representative of small trucking companies;</text></clause><clause id="H7FF481E61C0645FAB8720BEA801CAD8D"><enum>(iv)</enum><text>not fewer than 1 shall be a representative of nonprofit organizations in the trucking industry;</text></clause><clause id="H9465D0377B5F4DD7B07F93ECB774FFD9"><enum>(v)</enum><text>not fewer than 1 shall be a representative of trucking business associations;</text></clause><clause id="HEA2D429164C84ABFBAA33D0CB1AB6C06"><enum>(vi)</enum><text>not fewer than 1 shall be a representative of independent owner-operators;</text></clause><clause id="HBF48E7E67D7D4A7C9240AA457ED8B660"><enum>(vii)</enum><text>not fewer than 1 shall be a woman who is a professional truck driver; and</text></clause><clause id="HAE7B5B7909F5470FBEE4295EA1807DD5"><enum>(viii)</enum><text>not fewer than 1 shall be a representative of an institution of higher education or trucking trade school.</text></clause></subparagraph><subparagraph id="H4CFC3809F303401EB7700BA72F9DC9FE"><enum>(B)</enum><header>Diversity</header><text display-inline="yes-display-inline">A member of the Board appointed under any of clauses (i) through (viii) of subparagraph (A) may not be appointed under any other clause of that subparagraph.</text></subparagraph></paragraph><paragraph id="HEAD4F64AAEBD4A3785DBC3EE12A3FE2C"><enum>(3)</enum><header>Terms</header><text>Each member shall be appointed for the life of the Board.</text></paragraph><paragraph id="H1E3B8C30437B4D12B2AA3B2C6F0134C9"><enum>(4)</enum><header>Compensation</header><text>A member of the Board shall serve without compensation.</text></paragraph></subsection><subsection id="H483502375B80497E94E8BA7C8808215B"><enum>(c)</enum><header>Duties</header><paragraph id="HAB709CFA83104B86A6AD46AAD2A4E7EA"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The Board shall identify—</text><subparagraph id="HEAC27076D59E4E24A0EF386730637817"><enum>(A)</enum><text>barriers and industry trends that directly or indirectly discourage women from pursuing and retaining careers in trucking, including—</text><clause id="HBDC58DED407A4090861B42DF9497D90F"><enum>(i)</enum><text>any differences between women minority groups;</text></clause><clause id="HBF451042F0F44AC2B4326CB66F86BA70"><enum>(ii)</enum><text>any differences between women who live in rural, suburban, and urban areas; and</text></clause><clause id="H1464B80C5A1B42C79EEB3F4BF645797D"><enum>(iii)</enum><text>any safety risks unique to the trucking industry;</text></clause></subparagraph><subparagraph id="H1D17C0024AC94A258ABE5911059E229F"><enum>(B)</enum><text>ways in which the functions of trucking companies, nonprofit organizations, training and education providers, and trucking associations may be coordinated to facilitate support for women pursuing careers in trucking;</text></subparagraph><subparagraph id="H31E05B92D3044ACC8605D28D306DFB63"><enum>(C)</enum><text>opportunities to expand existing opportunities for women in the trucking industry; and</text></subparagraph><subparagraph id="H016B0242CC854FD6A2739FDFC59C074D"><enum>(D)</enum><text>opportunities to enhance trucking training, mentorship, education, advancement, and outreach programs that are exclusive to women.</text></subparagraph></paragraph><paragraph id="HA56B49C412844BA48825F5D2D80358E9"><enum>(2)</enum><header>Report</header><text>Not later than 2 years after the date of enactment of this Act, the Board shall submit to the Administrator a report describing strategies that the Administrator may adopt—</text><subparagraph id="HC08DBB6E1C974515822B08AED9610E90"><enum>(A)</enum><text>to address any industry trends identified under paragraph (1)(A);</text></subparagraph><subparagraph id="H75C61F52485B4DC1ADCBD5B25EF241B6"><enum>(B)</enum><text>to coordinate the functions of trucking companies, nonprofit organizations, and trucking associations in a manner that facilitates support for women pursuing careers in trucking;</text></subparagraph><subparagraph id="H5842F06DBD6C4058B2F420CC251FFDAF"><enum>(C)</enum><clause commented="no" display-inline="yes-display-inline" id="HFCB85ED0D412497B9D2A6D6D5B7FA748"><enum>(i)</enum><text>to take advantage of any opportunities identified under paragraph (1)(C); and</text></clause><clause id="H2ED7404602AD486FA3091A9E64B181C2" indent="up1"><enum>(ii)</enum><text>to create new opportunities to expand existing scholarship opportunities for women in the trucking industry; and</text></clause></subparagraph><subparagraph id="H932AD71F2B4C4F44B07C1641980326FE"><enum>(D)</enum><text>to enhance trucking training, mentorship, education, and outreach programs that are exclusive to women.</text></subparagraph></paragraph></subsection><subsection id="H5A8CD7BF83BB443D8FA0AD83FDB481B2"><enum>(d)</enum><header>Report to congress</header><paragraph id="H5275B4FFC6A04765BF0C8BC371586F1A"><enum>(1)</enum><header>In general</header><text>Not later than 3 years after the date of enactment of this Act, the Administrator shall submit to the Committee on Commerce, Science, and Transportation of the Senate and the Committee on Transportation and Infrastructure of the House of Representatives a report describing—</text><subparagraph id="HFD3BB1E6EEE746EEAEECEB748AE672AF"><enum>(A)</enum><text>any strategies recommended by the Board under subsection (c)(2); and</text></subparagraph><subparagraph id="H1747FEAED1794A1F9556FA5D60E07754"><enum>(B)</enum><text>any actions taken by the Administrator to adopt the strategies recommended by the Board (or an explanation of the reasons for not adopting the strategies).</text></subparagraph></paragraph><paragraph id="H26920E5769964C60B319C0033068DA7C"><enum>(2)</enum><header>Public availability</header><text>The Administrator shall make the report under paragraph (1) publicly available—</text><subparagraph id="H865ABFBEB5494A9A9BAC7255A0569FBA"><enum>(A)</enum><text>on the website of the Federal Motor Carrier Safety Administration; and</text></subparagraph><subparagraph id="H4322B6BA0B63463D93078B0684C76347"><enum>(B)</enum><text>in appropriate offices of the Federal Motor Carrier Safety Administration.</text></subparagraph></paragraph></subsection><subsection id="H41ECC972ED324408A9675EB9A0C68CE9"><enum>(e)</enum><header>Termination</header><text>The Board shall terminate on submission of the report to Congress under subsection (d).</text></subsection></section></legis-body></bill>
