R. 1326</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20210225">February 25, 2021</action-date><action-desc><sponsor name-id="B001285">Ms. Brownley</sponsor> introduced the following bill; which was referred to the <committee-name committee-id="HIF00">Committee on Energy and Commerce</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To strengthen the Department of Energy’s appliance energy efficiency standards program and promote further energy efficiency gains, and for other purposes.</official-title></form><legis-body id="HB9582F10D37F49B2A081C813D0C7FAB6" style="OLC"><section id="H784595BB37EF4FD09F51F0DC4BFCD501" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Energy Efficient Appliances Act</short-title></quote> .</text></section><section id="H1EBDA25D845F4F65B4881B4821348DE0"><enum>2.</enum><header>Repeals</header><subsection id="HFB33484746FA4B31B7502FC3E7B95929"><enum>(a)</enum><header>Procedures for use in new or revised energy conservation standards and test procedures</header><text display-inline="yes-display-inline">The final rule titled <quote>Energy Conservation Program for Appliance Standards: Procedures for Use in New or Revised Energy Conservation Standards and Test Procedures for Consumer Products and Commercial/Industrial Equipment</quote> (published at 85 Fed. Reg. 8626 (February 14, 2020)) shall have no force or effect and shall be treated as if such rule had never been issued. </text></subsection><subsection id="H83F0A520C85C4C109BB6FFDCB94BAF1F" commented="no"><enum>(b)</enum><header>Procedures for evaluating statutory factors</header><text display-inline="yes-display-inline">The final rule titled <quote>Energy Conservation Program for Appliance Standards: Procedures for Evaluating Statutory Factors for Use in New or Revised Energy Conservation Standards</quote> (published at 85 Fed. Reg. 50937 (August 19, 2020)) shall have no force or effect and shall be treated as if such rule had never been issued. </text></subsection></section><section id="H099A0BBE4CD44A6285448B9CDEF76E5B" commented="no"><enum>3.</enum><header>Multiple metrics</header><text display-inline="no-display-inline">Section 321(6) of the Energy Policy and Conservation Act (<external-xref legal-doc="usc" parsable-cite="usc/42/6291">42 U.S.C. 6291(6)</external-xref>) is amended to read as follows: </text><quoted-block style="OLC" id="H029D9C9B027A45288A7ADFD7B5A99F62" display-inline="no-display-inline"><paragraph id="HE672EFC76E364D30B157CC7644E9786C" commented="no"><enum>(6)</enum><header>Energy conservation standard</header><subparagraph id="H3FC6439B9223439A912AEC9D298A2A6B" commented="no"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">The term <term>energy conservation standard</term> means, with respect to a product, 1 or more performance standards that prescribe—</text><clause id="H21014BA6C7BC4829ABD10DB3437C54EF" commented="no"><enum>(i)</enum><text>a minimum level of energy efficiency or a maximum quantity of energy use, determined in accordance with test procedures prescribed under section 323;</text></clause><clause id="H5A5DB1CC491446D98E8A33A3AF498A1C" commented="no"><enum>(ii)</enum><text>a minimum level of water efficiency or a maximum quantity of water use, determined in accordance with test procedures prescribed under section 323; or</text></clause><clause id="HA16C78306A49429CA5F86624C38FA254" commented="no"><enum>(iii)</enum><text>both (i) and (ii). </text></clause></subparagraph><subparagraph id="HE10610729C11463089A39884271D1991" commented="no"><enum>(B)</enum><header>Inclusions</header><text>The term <term>energy conservation standard</term> includes—</text><clause id="HE512892D99C84F4585CA064680C6BAB1" commented="no"><enum>(i)</enum><text>1 or more design requirements; and</text></clause><clause id="H53B86AD39784484FB44F6EA63DABF771" commented="no"><enum>(ii)</enum><text>any other requirements that the Secretary may prescribe under section 325(r).</text></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="HC069BB43E7554625B9F8DF3C4109E561" commented="no"><enum>4.</enum><header>Expanding the pool of covered products</header><subsection id="H3093F7055AA14F1B92398924467F14D7" commented="no"><enum>(a)</enum><header>Lowering energy threshold levels for consumer products</header><paragraph id="H58D8689439C342809AB8D7E875CC1400" commented="no"><enum>(1)</enum><header>Special classification of consumer product</header><text>Section 322(b)(1)(B) of the Energy Policy and Conservation Act (<external-xref legal-doc="usc" parsable-cite="usc/42/6292">42 U.S.C. 6292(b)(1)(B)</external-xref>) is amended by striking <quote>exceed 100</quote> and inserting <quote>exceed 75</quote>.</text></paragraph><paragraph id="H5CDCB4E7778849FEB3BC5138E808075D" commented="no"><enum>(2)</enum><header>Standards for Other Covered Products</header><text display-inline="yes-display-inline">Section 325(l)(1)(A) of the Energy Policy and Conservation Act (<external-xref legal-doc="usc" parsable-cite="usc/42/6295">42 U.S.C. 6295(l)(1)(A)</external-xref>) is amended by striking <quote>exceeded 150</quote> and inserting <quote>exceeded 75</quote>. </text></paragraph></subsection><subsection id="H2B07AE016153410F821F7229DCC038B8" commented="no"><enum>(b)</enum><header>Industrial equipment</header><text display-inline="yes-display-inline">Section 340(2)(B) of the Energy Policy and Conservation Act (<external-xref legal-doc="usc" parsable-cite="usc/42/6311">42 U.S.C. 6311(2)(B)</external-xref>) is amended— </text><paragraph id="H70EA3CF0150C47FF8DE07697CB4566F4" commented="no"><enum>(1)</enum><text>in clause (xii), by striking <quote>and</quote>; and</text></paragraph><paragraph id="HDA7F3975A410446498D632DE03301A54" commented="no"><enum>(2)</enum><text display-inline="yes-display-inline">by striking clause (xiii) and inserting the following: </text><quoted-block style="OLC" id="HEF2E40917BDE45179F8F12D1B1AB3A56" display-inline="no-display-inline"><clause id="H09C1808CEC574695BA86BAFF01C4F346" indent="up2" commented="no"><enum>(xiii)</enum><text display-inline="yes-display-inline">other motors; and </text></clause><clause id="H42A08CB192D44A7AA7B90D32DF8C3FEC" indent="up2" commented="no"><enum>(xiv)</enum><text>other types of equipment for which the Secretary determines that—</text><subclause id="H905B4C0575EE45D4B4A0063B0D99E67E" commented="no"><enum>(I)</enum><text>classifying equipment of such type as industrial equipment is necessary or appropriate to carry out the purposes of this part; and</text></subclause><subclause id="HC89BE117D6B44F3790007C3476EE5625" commented="no"><enum>(II)</enum><text>average annual energy use by equipment of such type nationwide is likely to exceed 3,000,000,000 kilowatt-hours (or its Btu equivalent) per year.</text></subclause></clause><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection></section><section id="HBBC7F0706DDB455CAF605D03DEC9D675" commented="no"><enum>5.</enum><header>Reducing lead times</header><subsection id="H6979DC6EAE4A42F2AFF59C8BAB700CD8" commented="no"><enum>(a)</enum><header>Standards for Other Covered Products</header><text display-inline="yes-display-inline">Section 325(l)(2) of the Energy Policy and Conservation Act (<external-xref legal-doc="usc" parsable-cite="usc/42/6295">42 U.S.C. 6295(l)(2)</external-xref>) is amended to read as follows: </text><quoted-block style="OLC" id="HF5EDCAA4F488470BA9C363AC91BA9F04" display-inline="no-display-inline"><paragraph id="HF23034E9CD5F4E47903267CE4FEC30F1"><enum>(2)</enum><header>Applicability</header><subparagraph id="HFB6E52FF1D7A42FC8629065A0C61FEE1"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">Except as provided in subparagraph (B), any new or amended standard for covered products of a type specified in paragraph (20) of section 322(a) shall apply to products manufactured after the date that is 3 years after the publication of the final rule establishing such standard.</text></subparagraph><subparagraph id="H4547BC0B7B94445A85F8D488AB427508" commented="no"><enum>(B)</enum><header>Other applicability</header><text display-inline="yes-display-inline">The Secretary may, in prescribing a new or amended standard for covered products of a type specified in paragraph (20) of section 322(a), require that such standard apply to products manufactured not earlier than 1 year after publication of the final rule establishing such standard and not later than 3 years after such publication.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H63A1CF1D5E824929A5767EF66D894EA9" commented="no"><enum>(b)</enum><header>Products receiving updated rules</header><paragraph id="H050B2BD9B59046AEB6F65E2FE18011B4"><enum>(1)</enum><header>Amended standards</header><text>Paragraph (4) of section 325(m) of the Energy Policy and Conservation Act (<external-xref legal-doc="usc" parsable-cite="usc/42/6295">42 U.S.C. 6295(m)(4)</external-xref>) is amended—</text><subparagraph id="H80D79805014846E784B844C6CACE7D88"><enum>(A)</enum><text>in subparagraph (A)—</text><clause id="H309C0A60E99448479F5FF92EC83BF651"><enum>(i)</enum><text>the matter preceding clause (i), by inserting <quote>and subparagraph (C)</quote> after <quote>subparagraph (B)</quote>; and</text></clause><clause id="H0A01F2FC3C6D4083AB1B39021835E7EC"><enum>(ii)</enum><text> in clause (ii), by striking <quote>5 years</quote> and inserting <quote>3 years</quote>; and </text></clause></subparagraph><subparagraph id="H604B981BDD054659B82F3CC6B614E702"><enum>(B)</enum><text>by adding at the end the following subparagraph:</text><quoted-block style="OLC" id="H3AFFBB9BE6F7433384F83D2D9934386C" display-inline="no-display-inline"><subparagraph id="H3D1A29A177C94FEE80F1FD0944F81DC4"><enum>(C)</enum><header>Other applicability</header><text display-inline="yes-display-inline">The Secretary may, in prescribing an amended standard under this subsection, require that such amended standard apply to products manufactured not earlier than 1 year after publication of the final rule establishing such amended standard and not later than 3 years after such publication. </text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="H122FB22E9D10441AAF3267C80BDA228C"><enum>(2)</enum><header>Amended standards resulting from petition</header><text>Paragraph (5) of section 325(n) of the Energy Policy and Conservation Act (<external-xref legal-doc="usc" parsable-cite="usc/42/6295">42 U.S.C. 6295(n)</external-xref>) is amended to read as follows: </text><quoted-block style="OLC" id="H9ABCD9D926C941DDBAD3FCEF7C47CE9C" display-inline="no-display-inline"><paragraph id="HDCEA9C2CA35041C3A5BFB798B8DE04AA"><enum>(5)</enum><header>Applicability</header><subparagraph id="H6684B1D695524D6E8EC9B8191FB90AFA" commented="no"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">Except as provided in subparagraph (B), an amended standard prescribed under this subsection shall apply to products manufactured after the date that is 3 years after the publication of the final rule establishing the amended standard.</text></subparagraph><subparagraph id="HA3E2988B9E934BD1B1D9085DCB15A694"><enum>(B)</enum><header>Other applicability</header><text>The Secretary may, in prescribing an amended standard under this subsection, require that such amended standard apply to products manufactured not earlier than 1 year after publication of the final rule establishing such amended standard and not later than 3 years after such publication. </text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="HBF315C823B2D4A3C881E4BADF2ABA463" commented="no"><enum>(c)</enum><header>Authorization for multiple standards under one rulemaking</header><text display-inline="yes-display-inline">Section 325(o) of the Energy Policy and Conservation Act (<external-xref legal-doc="usc" parsable-cite="usc/42/6295">42 U.S.C. 6295</external-xref>) is amended—</text><paragraph id="H79878D93435E4771934AB0CD79E39AA9"><enum>(1)</enum><text>by redesignating paragraph (6) as paragraph (7); and</text></paragraph><paragraph id="HD995BBE34A6F41EDACD8AD3AEB6AF8EC"><enum>(2)</enum><text>by adding after paragraph (5) the following:</text><quoted-block style="OLC" id="H8CA00E04A2854AAE958254B09D57FB76" display-inline="no-display-inline"><paragraph id="HD913C98358A647E288B6F58AFD45B6A8" commented="no"><enum>(6)</enum><header>Multiple standards</header><text display-inline="yes-display-inline">Notwithstanding subsection (m)(4)(B), in any rulemaking to prescribe a new or amended energy conservation standard for a covered product, or class of covered products, the Secretary may prescribe more than one such standard for such covered product, or class of covered products, provided—</text><subparagraph id="H4E54A17B52454A48938D18C2780E217A" commented="no"><enum>(A)</enum><text display-inline="yes-display-inline">the less stringent standard prescribed shall apply to any such covered product, or class of covered products, manufactured not earlier than 1 year after publication of the final rule prescribing such standards and not later than 3 years after such publication; and </text></subparagraph><subparagraph id="H7DAF7F4369074F0C9C2939C3D7D916B2" commented="no"><enum>(B)</enum><text>the more stringent standard prescribed shall apply to any such covered product, or class of covered products, manufactured not later than 6 years after such publication.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection></section><section id="HA07437B1715A4278A5B2E8F767BA9406" commented="no"><enum>6.</enum><header>Exemption from preemption</header><subsection id="HA4489D2AE7C24AF486B9FB859C071195" commented="no"><enum>(a)</enum><header>Removing barriers to efficiency</header><paragraph id="H05C0F188AA3C4D08AAADBEF9AE4C7A2B" commented="no"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Section 327 of the Energy Policy and Conservation Act (<external-xref legal-doc="usc" parsable-cite="usc/42/6297">42 U.S.C. 6297</external-xref>) is amended by adding at the end the following: </text><quoted-block style="OLC" id="H7B3301FAD6BE4EFFB32DA844FCBAD9E5" display-inline="no-display-inline"><subsection id="H04848BF898824BE5AB5B71F693DB6020" commented="no"><enum>(h)</enum><header>Suspension of preemption</header><text display-inline="yes-display-inline">A State regulation concerning the energy efficiency, energy use, or water use of a covered product that would otherwise be superseded by the provisions of this part in accordance with this section shall not be superseded during any period that—</text><paragraph id="H23111F512D8947529B14BAFFF970081D" commented="no"><enum>(1)</enum><text display-inline="yes-display-inline">begins on the date that is 8 years after the date on which an energy conservation standard is established or revised under section 325 for the covered product; and </text></paragraph><paragraph id="H26F600E3FCB44DDEBDDF71CF3CE46D5F" commented="no"><enum>(2)</enum><text display-inline="yes-display-inline">ends on the date that compliance with an energy conservation standard that is established or revised under section 325 and that is equivalent to or more stringent than the State regulation is required.</text></paragraph></subsection><subsection id="H2F70545760004D9EBC70AE89778B5F22" commented="no"><enum>(i)</enum><header>No preemption absent a Federal standard</header><paragraph id="HF85793B4A6CD407E845AAD32D66C6A6C" commented="no"><enum>(1)</enum><header>Application</header><text display-inline="yes-display-inline">Notwithstanding any other provision of this part, a State regulation concerning the energy efficiency, energy use, or water use of a covered product is not superseded by the provisions of this part if the State applies to any product not subject to an energy conservation standard established under section 325.</text></paragraph><paragraph id="HEB474537AB8E4B81966B7BAC368DFFF0" commented="no"><enum>(2)</enum><header>Compliance period</header><text display-inline="yes-display-inline">Notwithstanding any other provision of this part, any State regulation prescribed or enacted for a covered product before the date on which an energy conservation standard is established under section 325 for the covered product shall not be preempted until the date on which compliance with an energy conservation standard that is established under section 325 and that is equivalent to, or more stringent than, the requirements of the State is required.</text></paragraph></subsection><after-quoted-block>. </after-quoted-block></quoted-block></paragraph><paragraph id="H03270E896BFA4F1FA62E774AC61B473D" commented="no"><enum>(2)</enum><header>ASHRAE Products</header><text display-inline="yes-display-inline">Section 345(b)(2) of the Energy Policy and Conservation Act (<external-xref legal-doc="usc" parsable-cite="usc/42/6316">42 U.S.C. 6316(b)(2)</external-xref>) is amended by adding at the end the following: </text><quoted-block style="OLC" id="H5AD2F16463634744B9587D2E0ABE1F08" display-inline="no-display-inline"><subparagraph id="H3FB3C0674BC749158A5CC93A59D3390D" commented="no"><enum>(E)</enum><text display-inline="yes-display-inline">Notwithstanding subparagraph (A), a standard prescribed or established under section 342(a) shall not supersede any State or local regulation concerning the energy efficiency or energy use of a product for which the standard is prescribed or established during any period that—</text><clause id="HF172651234594B128BB3AD278EB3D88F" commented="no"><enum>(i)</enum><text display-inline="yes-display-inline">begins on the date that is 8 years after the date on which such standard is prescribed or established; and</text></clause><clause id="HDCA57B4E13E240F4B73163D456C4858B" commented="no"><enum>(ii)</enum><text>ends on the effective date of a standard prescribed or established after the date described in clause (i) under section 342(a) for the product, that is equivalent to, or more stringent than, the State or local regulation.</text></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="H4E04926BECD2433EBEC7719CF10AB5C1" commented="no"><enum>(b)</enum><header>Building codes</header><paragraph id="HBD311F8451F7426FAF1A140F118A724A" commented="no"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Section 327(f) of the Energy Policy and Conservation Act (<external-xref legal-doc="usc" parsable-cite="usc/42/6297">42 U.S.C. 6297(f)</external-xref>) is amended to read as follows: </text><quoted-block style="OLC" id="HE10261854C5340F198EA646B8253FB06" display-inline="no-display-inline"><subsection id="HCBB6580083994724A0D95AC4A8A91C40" commented="no"><enum>(f)</enum><header>Exception for certain building code requirements</header><paragraph id="H8C3D7AA0A1A6413C88D1860DBB6CEA55" commented="no"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">A regulation or other requirement that is contained in a State or local building code for new construction concerning the energy efficiency or energy use of a covered product is not superseded by this part if the regulation or other requirement concerning the energy efficiency or energy use of the covered product is more stringent than the corresponding Federal energy conservation standard.</text></paragraph><paragraph id="H346E408DCA0B400597A848440199AEE2" commented="no"><enum>(2)</enum><header>New construction</header><text>For purposes of this subsection, the term <term>new construction</term> includes—</text><subparagraph id="H1D9E78FD8C2F42E5B574A9FAB3916960" commented="no"><enum>(A)</enum><text>new buildings and their systems; and</text></subparagraph><subparagraph id="HC29B209D76BB4076ABEC1DB872BD0EEA" commented="no"><enum>(B)</enum><text>new portions of buildings and their systems.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph><paragraph id="HF17C1CDB54DD48C7B1F9843E842A1D15" commented="no"><enum>(2)</enum><header>Conforming amendments</header><text display-inline="yes-display-inline">Section 327 of the Energy Policy and Conservation Act (<external-xref legal-doc="usc" parsable-cite="usc/42/6297">42 U.S.C. 6297</external-xref>) is amended—</text><subparagraph id="H0217565D5225418898BB85EF349132C9" commented="no"><enum>(A)</enum><text>in subsection (b), by striking paragraph (3); and</text></subparagraph><subparagraph id="H3953C8AF2D5240128ED54DD3FA597F17" commented="no"><enum>(B)</enum><text>in subsection (c), by striking paragraph (3).</text></subparagraph></paragraph><paragraph id="HE35F1AAD3A954A3CB11DD8CAEBA72A45" commented="no"><enum>(3)</enum><header>ASHRAE products</header><text display-inline="yes-display-inline">Section 345(b)(2)(B) of the Energy Policy and Conservation Act (<external-xref legal-doc="usc" parsable-cite="usc/42/6316">42 U.S.C. 6316(b)(2)(B)</external-xref>) is amended by striking <quote>new construction</quote> and all that follows through the end and inserting <quote>new construction.</quote>. </text></paragraph></subsection></section></legis-body></bill>
