penalties, duties, or tariffs applicable only to coastwise voyages, or prohibit otherwise qualified non-United States citizens from serving as crew, on specified vessels transporting passengers between the State of Washington and the State of Alaska, to address a Canadian cruise ship ban and the extraordinary impacts of the COVID–19 pandemic on Alaskan communities, and for other purposes.</official-title></form><legis-body id="H3B96D5DEB6864FE5B4F87B4CB0788DC8" style="OLC"><section id="HF976E4719521468B909138ADA9455C16" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline"> This Act may be cited as the <quote><short-title>Alaska Tourism Restoration Act</short-title></quote>. </text></section><section id="HD402F179DBD242C9AB7D4331E9EACA3F" section-type="subsequent-section"><enum>2.</enum><header>Voyage deemed to be foreign</header><subsection id="H09AA247F1100476A839F37AE5B4AC9BD"><enum>(a)</enum><header>Definition of covered cruise ship</header><paragraph id="HDE0B9317EA3C41D9A234CD491377C10A"><enum>(1)</enum><header>In general</header><text>In this section, the term <term>covered cruise ship</term> means a vessel included on the list under paragraph (2) that—</text><subparagraph id="H169480A2F81349BB873457DA30465B7B"><enum>(A)</enum><text>has been issued, operates in accordance with, and retains a COVID–19 Conditional Sailing Certificate of the Centers for Disease Control and Prevention; and</text></subparagraph><subparagraph id="HC449574EDFF549C292F18C487F7F7336"><enum>(B)</enum><text>operates in accordance with any restrictions or guidance of the Centers for Disease Control and Prevention associated with such Certificate, including any such restrictions or guidance issued after the date of enactment of this Act.</text></subparagraph></paragraph><paragraph roundtrip voyage of a covered cruise ship transporting passengers between a port or place in the State of Alaska and a port or place in the State of Washington shall be deemed to have made a stop in a port or place of Canada, and deemed a foreign voyage, for purposes of the law of the United States, if—</text><paragraph id="H68B3BF7A46A9425A9EA8681FEA69B2DA"><enum>(1)</enum><text display-inline="yes-display-inline">during the voyage, the covered cruise ship sends an email containing the information described in subsection (c) to—</text><subparagraph id="H35B0B8B6A04744ECBDFCE699E53BC61F"><enum>(A)</enum><text display-inline="yes-display-inline">the Canada Border Services Agency;</text></subparagraph><subparagraph id="HB646608E9523460AA00AC2EB4A35E805"><enum>(B)</enum><text>the Commissioner of Customs and Border Protection; and</text></subparagraph><subparagraph id="H167B66CE81DE4D138379BBBE31DA4A7A"><enum>(C)</enum><text>each alien crewman on such voyage who is in possession of a valid, unexpired nonimmigrant visa issued pursuant to subparagraph (C) or (D) of section 101(a)(15) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101(a)(15)</external-xref>); and</text></subparagraph></paragraph><paragraph id="H91B868A9D9BF4B049871236B6A13B93C" commented="no"><enum>(2)</enum><text display-inline="yes-display-inline">the voyage begins not later than February 28, 2022.</text></paragraph></subsection><subsection id="HF542FF9C011B4704A5E2B3CED0C6819E"><enum>(c)</enum><header>Email</header><text>An email described in subsection (b)(1) shall contain the names of each alien crewman described in subparagraph (C) of such subsection.</text></subsection><subsection id="H2D2ED88060044B6980FCE6FC2EA0718D"><enum>(d)</enum><header>Employment of alien crewmen</header><text>On the date on which a covered cruise ship sends an email to the Canada Border Services Agency in accordance with subsection (b)(1), each alien crewman described in subparagraph (C) of such subsection shall be deemed to have departed the United States, entered Canada, and been readmitted to the United States for purposes of complying with, during the applicable voyage described in subsection (b), the 29-day authorized stay pursuant to their nonimmigrant visas issued pursuant to subparagraph (C) or (D) of section 101(a)(15) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101(a)</external-xref>). </text></subsection><subsection id="H17E0E52E34A1423F86D89EDF2A2B80DA"><enum>(e)</enum><header>Exception</header><text>Notwithstanding subsection (b), a voyage described in such subsection shall not be deemed a foreign voyage for purposes of section 446 of the Tariff Act of 1930 (<external-xref legal-doc="usc" parsable-cite="usc/19/1446">19 U.S.C. 1446</external-xref>) or any other provision of law relating to levying duties or taxes on goods, including consumables, purchased for use onboard the covered cruise ship. </text></subsection><subsection id="H65D9BB30FCD7481BB5A03F466E614E40"><enum>(f)</enum><header>Applicability</header><text>This section shall not apply to a roundtrip voyage during any period for which the Director of the Centers for Disease Control and Prevention has issued an order under section 361 or 365 of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/264">42 U.S.C. 264</external-xref> and 268) that requires covered cruise ships to suspend vessel operations.</text></subsection><subsection id="HAEA74359F2714D1A80BC0ADB06695F68"><enum>(g)</enum><header>Duration</header><text>The authority provided under this section shall terminate on the earlier of—</text><paragraph id="HD2027A8F215E4364AE8CBA091C8A9BDE"><enum>(1)</enum><text>the date on which covered cruise ships are no longer prohibited by the Government of Canada, any political subdivision of Canada, or any port or province of Canada, from entering, berthing, or docking in Canadian waters of the Pacific Coast due to the COVID–19 pandemic; or </text></paragraph><paragraph id="H80738CD5265B4A2AA793C96BE75834C1" commented="no" display-inline="no-display-inline"><enum>(2)</enum><text>March 31, 2022.</text></paragraph></subsection></section><section id="H33FC5D6C9E4A4A82990EB03105CBCC50"><enum>3.</enum><header>Medical and safety standards</header><subsection id="H9DA6EE6B8E5045FF93D0A7A4C98059A1"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/46/35">Chapter 35</external-xref> of title 46, United States Code, is amended by adding at the end the following: </text><quoted-block style="USC" display-inline="no-display-inline" id="HA28D06E646F84221ADFCB83198CFAE1D"><section id="HABB56BF9FD1946B1BA26DD76A7C14960"><enum>3510.</enum><header>Additional medical and safety standards</header><subsection id="HBD46E409EE7B46169C34F52DA75E2C12"><enum>(a)</enum><header>Automated external defibrillators</header><text>Not later than 1 year after the date of enactment of this section, the Secretary, in consultation with the Secretary of Health and Human Services and other appropriate Federal agencies, shall promulgate regulations to—</text><paragraph id="HACF120B5DDFF49B681B6BAD0ED91C512"><enum>(1)</enum><text>require that the owner of a vessel to which section 3507 applies install, and maintain in working order, automated external defibrillators on such vessel; </text></paragraph><paragraph id="HE9C092A71C584F78A8CE631BDC8CAC3C"><enum>(2)</enum><text>require that such defibrillators be placed throughout such vessel in clearly designated locations;</text></paragraph><paragraph id="HC9912F8403A440688B75C944F4A80C0F"><enum>(3)</enum><text>require that such defibrillators are available for passenger and crew access in the event of an emergency; and</text></paragraph><paragraph id="H74B9ED1545374E19A028DADEDECB6E4D"><enum>(4)</enum><text>require that automated external defibrillators, or adjacent equipment, allow passengers and crew to easily contact medical staff of the vessel.</text></paragraph></subsection><subsection id="H36420A914D1C4CA1BE44F1D3DC7373F9"><enum>(b)</enum><header>Definition of owner</header><text>In this section, the term <term>owner</term> has the meaning given such term in section 3507.</text><pagebreak></pagebreak></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H7FC9B85EF04D4CA98B33710F915ADAC5"><enum>(b)</enum><header>Clerical amendment</header><text>The analysis for <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/46/35">chapter 35</external-xref> of title 46, United States Code, is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline"
