which was referred to the <committee-name committee-id="HJU00">Committee on the Judiciary</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To require the safe storage of firearms and ammunition, and to require the investigation of reports of improper storage of firearms or ammunition.</official-title></form><legis-body id="H5775A19BC44549D0850E5301DD83D40A" style="OLC"><section id="HA44CBDB3E01C4137991D214119BAC947" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Kimberly Vaughan Firearm Safe Storage Act</short-title></quote>.</text></section><section id="HBB97295D24EB44A88E6F0F60A87BBCF4"><enum>2.</enum><header>Prohibition on improper storage of firearms or ammunition</header><subsection id="HB913B8121A004FBB867D6813982A1C27"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 922 of title 18, United States Code, is amended by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="HFD8E23EE437F475ABC020D3A4D065AB7" style="OLC"><subsection id="H5828CCA23EA94DC3A9C136C42B1484A1"><enum>(aa)</enum><paragraph commented="no" display-inline="yes-display-inline" id="H455D8FF2950C46A6A33C788FE05AA16C"><enum>(1)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="H19A4BB6E7D964346A2584D407C279F96"><enum>(A)</enum><text>It shall be unlawful for a person to store or keep any firearm or ammunition that has moved in, or that has otherwise affected, interstate or foreign commerce, on the premises of a residence under the control of the person if the person knows, or reasonably should know, that—</text><clause id="H58285574E341485EB2BD9DA87EFFAFD5" indent="up2"><enum>(i)</enum><text>an individual who has not attained 18 years of age is likely to gain access to the firearm or ammunition without the permission of the parent or guardian of the individual; or</text></clause><clause id="H45115593033946D1876DB2383C2B9380" indent="up2"><enum>(ii)</enum><text>an individual who resides at the residence is ineligible to possess a firearm under Federal, State, or local law.</text></clause></subparagraph><subparagraph id="H22D3501BBB834655B537A1A3DBB22033" indent="up2"><enum>(B)</enum><text>Subparagraph (A) shall not apply to a person with respect to a firearm or ammunition for the firearm if the person keeps the firearms and ammunition—</text><clause id="HEA39BDE932BA4C2A8372C481845885F3"><enum>(i)</enum><text>secured, unloaded, and separately, in a safe certified by the Attorney General, and locked with a trigger lock certified by the Attorney General; or</text></clause><clause id="HDB5BEA109AFA49BF9E0C2F30CF2AAA28"><enum>(ii)</enum><text>off the premises at a storage facility, or gun range, certified by the Attorney General.</text></clause></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H0F7A060C9C14464CB0D2976B1E6645C8"><enum>(b)</enum><header>Penalties</header><text display-inline="yes-display-inline">Section 924(a) of such title is amended by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="H69719B89567C43F7A333766F089D2328" style="OLC"><paragraph id="H31B2EB0D2E8E41829B1E335AA11E32C8" indent="up1"><enum>(8)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="H67FF1D378FB84B499925E073A5FF01E2"><enum>(A)</enum><clause commented="no" display-inline="yes-display-inline" id="H962CD024016F42CA8BD26CC8D0280ECF"><enum>(i)</enum><text display-inline="yes-display-inline">Whoever, in a civil action, is found to have violated section 922(aa) with respect to a firearm and the violation is not found to have resulted in a discharge of the firearm, shall be fined not more than $5,000.</text></clause><clause id="H42EF5E993EBD414C924BE0C94B0A3FDA" indent="up2"><enum>(ii)</enum><text>Whoever, in a criminal action, is found to have violated section 922(aa) with respect to a firearm and the violation is found to have resulted in a discharge of the firearm, shall be fined not less than $50,000 and not more than $100,000, imprisoned not more than 20 years, or both.</text></clause></subparagraph><subparagraph id="HB8FD603A77F043C5B0D7605132887946" indent="up1"><enum>(B)</enum><text>On conviction of a person for violating section 922(aa) with respect to a firearm or ammunition, the court shall order the Attorney General to seize and store the firearm or ammunition, at the expense of the owner of the firearm or ammunition, at a facility that is—</text><clause id="H7E1C8A70F31043B8A266F6A674A33F95"><enum>(i)</enum><text>certified by the Attorney General for the safe storage of firearms or ammunition; and</text></clause><clause id="H7FE199A8BAF446A9A35B9496BAF628A7"><enum>(ii)</enum><text>not owned, leased, or controlled by the person or the owner of the firearm or ammunition or by any person who is a relative of, or is associated with, the person or the owner.</text></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H54272D6B39A140EDB0C2546A983D8878"><enum>(c)</enum><header>Certification of safes and safe storage facilities</header><text>Within 1 year after the date of the enactment of this Act, the Attorney General shall provide for the certification of safes and safe storage facilities for firearms and ammunition.</text></subsection><subsection id="HF4B5D2B927E84A888C8411E5BD906673"><enum>(d)</enum><header>Effective date</header><text>The amendments made by this section shall take effect 1 year after the date of the enactment of this Act.</text></subsection><subsection id="H536E52A9F03E429B9CE4906F84EAC7AD"><enum>(e)</enum><header>Investigation of reports of improper storage of firearms or ammunition</header><text>Beginning with the effective date of the amendments made by this section, the Attorney General, through the Bureau of Alcohol, Tobacco, Firearms, and Explosives, shall investigate all reports that a person is improperly storing a firearm or ammunition.</text></subsection></section></legis-body></bill>
