which was referred to the <committee-name committee-id="HJU00">Committee on the Judiciary</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend title 18, United States Code, to make the disclosure of the identity of a whistleblower a criminal offense, to provide a civil right of action for the disclosure of the identity of a whistleblower, and for other purposes.</official-title></form><legis-body id="H8BFFF41BF5A74C29A510F19E5A369339" style="OLC"><section id="H841122AEFDE94DEEB4FF484F399A75A5" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Enhancing Protections for Whistleblower Anonymity Act</short-title></quote>.</text></section><section id="H5FB7CE68875C4C77851145B9EA24FBB2"><enum>2.</enum><header>Criminal penalty for the disclosure of the identity of a whistleblower</header><subsection id="H4AD761CA02494CD0A4BD4121146FE0B1"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/18/88">Chapter 88</external-xref> of title 18, United States Code, is amended by adding at the end the following new section:</text><quoted-block style="USC" id="H84F17D20E0464BF3A25274FC92ED5350" display-inline="no-display-inline"><section id="HDE76AD8D95FD4248A1520189445799DA"><enum>1802.</enum><header>Disclosure of whistleblower identity</header><subsection id="HFFF56C5740F64E67915C9450A3F6B6DA"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Except under the circumstances described in subsection (b), whoever, being an employee of the Federal Government or contractor of the Federal Government, knowingly makes a prohibited disclosure shall be fined under this title, imprisoned not more than 1 year, or both.</text></subsection><subsection id="H77F92D2221C34D5198CDCF27DD8034EE"><enum>(b)</enum><header>Exceptions</header><text>The circumstances described in this subsection are the following:</text><paragraph id="HBBFFCEA9A22B499B8BD8DC44833C07D6"><enum>(1)</enum><text display-inline="yes-display-inline">The prohibited disclosure—</text><subparagraph id="HC9A92D80B08D4D4F8175F67434416B25"><enum>(A)</enum><text>is made to—</text><clause id="H793E7264AB45423290AB3CB016F12520"><enum>(i)</enum><text display-inline="yes-display-inline">an employee of the Federal Government;</text></clause><clause id="H46369C1B4B4942C8A4EBF0A3BF3E7BE0"><enum>(ii)</enum><text>an employee of a State government; or</text></clause><clause id="H4B5BDD6976474671AB89F99B2A5663AB"><enum>(iii)</enum><text display-inline="yes-display-inline">an employee of a local government; and</text></clause></subparagraph><subparagraph id="H4AB6493E38F449EC8AE05EB8D72B56D2"><enum>(B)</enum><text>is expressly permitted by any other law.</text></subparagraph></paragraph><paragraph id="H2D3869D9D39244988DC024924332819F"><enum>(2)</enum><text>The whistleblower provides written consent before the prohibited disclosure is made.</text></paragraph></subsection><subsection id="H301E15D85C7542F7BB38786D558858B8"><enum>(c)</enum><header>Applicability</header><text>Subsection (a) shall only apply to a prohibited disclosure that is made after the date of enactment of this section.</text></subsection><subsection id="HD3C6EB87ABA541EFA6BC8B8F13591B1E"><enum>(d)</enum><header>Definitions</header><text>In this section:</text><paragraph id="HA2C00C99F20840C69E314D3AE22A34F9"><enum>(1)</enum><header>Employee of the Federal Government</header><text display-inline="yes-display-inline">The term <term>employee of the Federal Government</term> means an officer or employee of the United States Government, including—</text><subparagraph id="HE1A47C3E927D470ABFEECB0297099A5F" commented="no"><enum>(A)</enum><text display-inline="yes-display-inline">a member of the uniformed service;</text></subparagraph><subparagraph id="HD9451DC8599B4C0493E01F5F96EA66B7"><enum>(B)</enum><text display-inline="yes-display-inline">a Member of Congress; and</text></subparagraph><subparagraph id="HAFCAC1740C9A48E4A6EE417857AB8022"><enum>(C)</enum><text display-inline="yes-display-inline">the President of the United States.</text></subparagraph></paragraph><paragraph id="HF44EB2D0F96E4066859DFAEF0BBF330F"><enum>(2)</enum><header>Member of Congress</header><text>The term <term>Member of Congress</term> has the meaning given such term in section 2106 of title 5. </text></paragraph><paragraph id="H09133AAA434A49D6B14EBD1F7608AABA" commented="no"><enum>(3)</enum><header>Prohibited disclosure</header><text display-inline="yes-display-inline">The term <term>prohibited disclosure</term> means a formal or informal communication or transmission of—</text><subparagraph id="H437AC125CE164D0CA12F45D4BC8F624C"><enum>(A)</enum><text>the identity of a whistleblower; or</text></subparagraph><subparagraph id="H8CCFA788FF784BC8A9DFD4D64BB8174F" commented="no"><enum>(B)</enum><text>identifying information relating to a whistleblower.</text></subparagraph></paragraph><paragraph id="H9A34BBE0AC304FFD9BBB4943E3CF871B"><enum>(4)</enum><header>Whistleblower</header><text>The term <term>whistleblower</term> means each of the following:</text><subparagraph id="HD1D4D25C60F640288B63A73340B794C3" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">An employee, former employee, or applicant for employment (as such terms are used in section 1213(a) of title 5) who makes a disclosure that is described in paragraph (1) or (2) of such section.</text></subparagraph><subparagraph id="H34B9D4CD9B0B4417B8E095E0810ECB90" commented="no"><enum>(B)</enum><text display-inline="yes-display-inline">An employee of an agency or applicant for employment at an agency (as such terms are used in section 2302(b)(8)(C) of title 5) who makes a disclosure as described in such section.</text></subparagraph><subparagraph id="H4C763E20131947518916FF1E80F8076D" commented="no"><enum>(C)</enum><text display-inline="yes-display-inline">A former employee of the Federal Government who makes a disclosure to Congress of information described in section 2302(b)(8)(C) of title 5.</text></subparagraph><subparagraph id="H0CECAD7A33704945B08015AAA04ECB44"><enum>(D)</enum><text display-inline="yes-display-inline">An employee that makes a complaint or otherwise provides information to the Inspector General (as the terms <term>employee</term> and <term>Inspector General</term> are used in the Inspector General Act of 1978 (5 U.S.C. App.)) pursuant to the requirements of section 7 of such Act.</text></subparagraph><subparagraph id="H679AC15DB0BE41578A325600CEB80F2B"><enum>(E)</enum><text>A member of the Armed Forces that—</text><clause id="H3FCFF958C07E4EF6929C55ED994B0F8C"><enum>(i)</enum><text>complains of or discloses information; and</text></clause><clause id="H0F25791F3EA342E8B5B16CF24F19EA35"><enum>(ii)</enum><text>is protected against retaliation for such actions under section 1034 of title 10.</text></clause></subparagraph><subparagraph id="H309F723351E845F8AC1788F00DF69B15"><enum>(F)</enum><text display-inline="yes-display-inline">An employee (as the term <term>employee</term> is used in section 103H of the National Security Act of 1947 (<external-xref legal-doc="usc" parsable-cite="usc/50/3033">50 U.S.C. 3033</external-xref>)) who the Inspector General of the Intelligence Community may not disclose the identity of pursuant to the requirements of section 103H(g)(3)(A) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/50/3033">50 U.S.C. 3033(g)(3)(A)</external-xref>).</text></subparagraph><subparagraph id="H372EFF90756447C98AFBADD68B7FAB6B"><enum>(G)</enum><text display-inline="yes-display-inline">An employee (as the term <term>employee</term> is used in section 4712(a)(3)(A) of title 41) who is deemed to have made a disclosure under such section.</text></subparagraph><subparagraph id="H492813BBDBBD432EAC9BCEE85C0F08F3" commented="no"><enum>(H)</enum><text display-inline="yes-display-inline">A individual not otherwise covered by subparagraphs (A) through (G) who—</text><clause id="H1CCFD3BB73704871B0343F7B1D7D369A" commented="no"><enum>(i)</enum><text>is protected by law to make a disclosure of—</text><subclause id="HB6A3C984095246A09D225CDF8792D4FF" commented="no"><enum>(I)</enum><text>a violation of law or regulation; or</text></subclause><subclause id="H1F6A98D21EF442128C4C37BFC98B5B4B" commented="no"><enum>(II)</enum><text>gross mismanagement, gross waste of funds, abuse of authority, or a substantial and specific danger to public health or the safety of a Federal entity;</text></subclause></clause><clause id="H8E4CF408401D47F19294DAD351E71DB3" commented="no"><enum>(ii)</enum><text>makes such a disclosure;</text></clause><clause id="H3E2909123BEC4ED78635072EEB0BBD05" commented="no"><enum>(iii)</enum><text>is not prohibited by law to make such a disclosure; and</text></clause><clause id="H7CF1D47969424220851DB250FFC45463" commented="no" display-inline="no-display-inline"><enum>(iv)</enum><text display-inline="yes-display-inline">is not disclosing information that is determined pursuant to Executive Order No. 13526 (75 Fed. Reg. 707; relating to classified national security information), or a successor order, or the Atomic Energy Act of 1954 (<external-xref legal-doc="usc" parsable-cite="usc/42/2011">42 U.S.C. 2011</external-xref> et seq.) to require protection against unauthorized disclosure.</text></clause></subparagraph></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H37854A5134D142B2A1B9CA1A2F739C6E"><enum>(b)</enum><header>Clerical amendment</header><text display-inline="yes-display-inline">The table of sections for <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/18/88">chapter 88</external-xref> of title 18, United States Code, is amended by adding at the end the following new item:</text><quoted-block style="USC" id="H9C2C076AB851408DA186A9340C803F9F" display-inline="no-display-inline"><toc regeneration="no-regeneration"><toc-entry level="section">1802. Disclosure of whistleblower identity.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section><section id="HC3002D34FF954FA49FFA4DA90F13A847"><enum>3.</enum><header>Civil right of action against disclosure of whistleblower identity</header><subsection id="H7AA04C3E356544E09B23BA0E0529BA83"><enum>(a)</enum><header>Prohibited disclosure</header><text display-inline="yes-display-inline">A whistleblower may bring a civil action before the appropriate district court—</text><paragraph id="H9620AF8629574292968177328116588A"><enum>(1)</enum><text display-inline="yes-display-inline">for appropriate relief, including injunctive relief, compensatory damages, and punitive damages, against any employee of the Federal Government or contractor of the Federal Government who makes a prohibited disclosure, with respect to such whistleblower; or</text></paragraph><paragraph id="H1632466AC0584E9084368BEB7FE1BADF"><enum>(2)</enum><text display-inline="yes-display-inline">for injunctive relief against any employee of the Federal Government or contractor of the Federal Government who threatens to make a prohibited disclosure, with respect to such whistleblower.</text></paragraph></subsection><subsection id="H3712D0AD0ED44A22A0128280CC03756A"><enum>(b)</enum><header>Jury trial</header><text display-inline="yes-display-inline">A party to an action brought under subsection (a) shall be entitled to trial by jury.</text></subsection><subsection id="HFE821CF97953427F90D9FF25B6722108"><enum>(c)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this section, the terms <term>employee of the Federal Government</term>, <term>prohibited disclosure</term>, and <term>whistleblower</term> have the meanings given such terms in section 1802(d) of title 18, United States Code, as added by this Act.</text></subsection></section></legis-body></bill>
