which was referred to the <committee-name committee-id="HJU00">Committee on the Judiciary</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To discourage the use of payment of money as a condition of pretrial release in criminal cases, and for other purposes.</official-title></form><legis-body id="H35E5372B25F049A7B25109CAC848D158" style="OLC"><section id="HC5572B015CD146AE8D6C4D9CB0FC589D" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>No Money Bail Act of 2021</short-title></quote>.</text></section><section id="HF24A7D7DC4DF48339FC9501E24051C1F"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds the following:</text><paragraph id="H02A8A646246B4A6AA5EE30847436F816"><enum>(1)</enum><text display-inline="yes-display-inline">Nearly 60 percent of the inmates in jails in the United States are pretrial detainees who have not been convicted of a crime, an estimated 75 percent of whom have been charged with nonviolent crimes.</text></paragraph><paragraph id="H1B60D39D3FDD4A5FABACDFDA3F690E6A"><enum>(2)</enum><text display-inline="yes-display-inline">Under current bail systems that use payment of money as a condition of pretrial release, nearly 50 percent of the most dangerous pretrial detainees are released without supervision, according to a study by the Arnold Foundation.</text></paragraph><paragraph id="HAAA9E2E49EF141ED8B58AFA24BD681DB"><enum>(3)</enum><text display-inline="yes-display-inline">Throughout the Nation, those with money can buy their freedom while poor defendants remain incarcerated awaiting trial.</text></paragraph><paragraph id="H68B5FA4440D546408558E4034CD70EA1"><enum>(4)</enum><text display-inline="yes-display-inline">Pretrial detention costs State and local governments an estimated $14,000,000,000 each year.</text></paragraph><paragraph id="H35A7CB59CC824E96A4795A965826D622"><enum>(5)</enum><text display-inline="yes-display-inline">Pretrial detention should be based on whether the accused is likely to fail to appear in court or is a threat to public safety, not the ability to pay money as a condition of pretrial release.</text></paragraph><paragraph id="HCF6479636DCD434084521E0E3682A6B1"><enum>(6)</enum><text display-inline="yes-display-inline">The States, the United States Department of Justice, law enforcement agencies, public officials, and community groups should collaborate to develop pretrial detention systems that improve public safety, reduce costs, and discourage criminal behavior.</text></paragraph></section><section id="H5425036EDA17441386204F674B6A11C4"><enum>3.</enum><header>Eligibility for grants under the Byrne JAG Program</header><text display-inline="no-display-inline">Section 505 of the Omnibus Crime Control and Safe Streets Act of 1968 (<external-xref legal-doc="usc" parsable-cite="usc/42/3755">42 U.S.C. 3755</external-xref>) is amended—</text><paragraph id="HE9BF17B9FD6A47AFA9C7318E65AC05DD"><enum>(1)</enum><text>in subsection (a)—</text><subparagraph id="H477BDC213D9E4FCB9663991B52C93C2E"><enum>(A)</enum><text>by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="H22E7F661E524403484A96056BE0BD7EF" style="OLC"><paragraph id="HF6025E66F8E34D8CAF7D712E7AD010EE"><enum>(3)</enum><header>Eligibility</header><text display-inline="yes-display-inline">Beginning with the third fiscal year beginning after the enactment of the <quote><short-title>No Money Bail Act of 2021</short-title></quote>, the Attorney General shall not allocate any amounts appropriated to carry out this part to any State that uses payment of money as a condition of pretrial release with respect to criminal cases.</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph><subparagraph id="H06A5B6DCFAFF4E60A3F70AF7627C11E5"><enum>(B)</enum><text display-inline="yes-display-inline">in paragraph (1) by striking <quote>in paragraph (2)</quote> and inserting <quote>in paragraphs (2) and (3)</quote>; and</text></subparagraph></paragraph><paragraph id="HA0875B3161F34A109928665D9AF3D5E4"><enum>(2)</enum><text>in subsection (f)—</text><subparagraph id="H16A904E9E5B541C6B4800008203F31AD"><enum>(A)</enum><text>by striking <quote>If the Attorney General</quote> and inserting <quote><header-in-text level="paragraph" style="OLC"><enum-in-header>(1)</enum-in-header> In general.—</header-in-text>If the Attorney General</quote>; and</text></subparagraph><subparagraph id="H8AFEA44567F14B1182B400CEAD1399FF"><enum>(B)</enum><text>by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="H4D864A0FFA3540EE9A2A8066F1F981A3" style="OLC"><paragraph id="H1327F508AA0F4C2C8F64211A21959CF9"><enum>(2)</enum><header>State ineligible due to system of bail</header><text display-inline="yes-display-inline">Notwithstanding paragraph (1), if the Attorney General determines with respect to any grant period that a State is made ineligible by subsection (a)(3), the Attorney General shall reallocate any amounts allocated to or that would have been allocated to such State for such period—</text><subparagraph id="HBDF31F7ED06E40F39B35A8A1B65FD1A3"><enum>(A)</enum><text display-inline="yes-display-inline">among the other eligible States; and</text></subparagraph><subparagraph id="HD06278AF50BE4ED49D938DBA33C22360"><enum>(B)</enum><text>in proportion to allocations among eligible States under subsection (a).</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></section><section id="H3A7F24FDC30F458BB8713B70DA5E8D4B"><enum>4.</enum><header>Prohibition of money bail in Federal criminal cases</header><text display-inline="no-display-inline">Notwithstanding any provision of Federal law, no justice, judge, or other judicial official in any court created by or under article III of the Constitution of the United States may use payment of money as a condition of pretrial release in any criminal case.</text></section></legis-body></bill>
