which was referred to the <committee-name committee-id="HED00">Committee on Education and Labor</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the Child Abuse Prevention and Treatment Act to include an act of unregulated custody transfer in the definition of child abuse and neglect, and for other purposes.</official-title></form><legis-body id="H9FE9B983B6A5465F8F803099C69DC137" style="OLC"><section id="H66B5907C33EE4931BA0E59CBCEA195C5" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Safe Home Act of 2021</short-title></quote>.</text></section><section id="HBF97137A66A44483BEBBCCD28786EF55"><enum>2.</enum><header>Sense of Congress</header><text display-inline="no-display-inline">It is the sense of Congress that:</text><paragraph id="H6A5AE3037DEE4146937BDF53546F756D"><enum>(1)</enum><text display-inline="yes-display-inline">Adopted children may be most at risk of experiencing an unregulated custody transfer because the challenges associated with adoptions, including the child’s mental health needs and the difficulties many families face in acquiring support services, may lead families to seek out unregulated custody transfers.</text></paragraph><paragraph id="H7905D7828861411CA7767D9129E5BA6F"><enum>(2)</enum><text>Many adopted children experience trauma, and the disruption and placement in another home by unregulated custody transfer creates additional trauma and instability for the child.</text></paragraph><paragraph id="HE8FAC54581B043EBBF943757228601DA"><enum>(3)</enum><text>Children who experience an unregulated custody transfer may be placed with families who have not completed required child welfare or criminal background checks or clearances.</text></paragraph><paragraph id="H4C7C922BAAC14F26BA674B0F6AD923E1"><enum>(4)</enum><text>Social services agencies and courts are often unaware of the placement of children through unregulated custody transfer and therefore do not conduct assessments on the child’s safety and well-being in such placements.</text></paragraph><paragraph id="H6C6097074A9C4394A307142C5BB9AB4B"><enum>(5)</enum><text>Such lack of placement oversight places a child at risk for future abuse and increases the likelihood that the child may experience—</text><subparagraph id="HC5F478C896A642DFA71DD8F23F392038"><enum>(A)</enum><text>physical, sexual, or emotional abuse or neglect;</text></subparagraph><subparagraph id="HCC9C6ECD808145CEBD4A51D359389CB1"><enum>(B)</enum><text>contact with unsafe adults or youth; and</text></subparagraph><subparagraph id="H60B6F47C67624DF8B8687DD1EE34CD5F"><enum>(C)</enum><text>exposure to unsafe or isolated environments.</text></subparagraph></paragraph><paragraph id="HA41E85AE7EC34F27BD6766786E3AAD03"><enum>(6)</enum><text>The caregivers with whom a child is placed through unregulated custody transfer often have no legal responsibility with respect to such child, placing the child at risk for additional unregulated custody transfers.</text></paragraph><paragraph id="H08250BCDF6874AC380BAF1B702C105CF"><enum>(7)</enum><text>Such caregivers also may not have complete records, including birth, medical, or immigration records.</text></paragraph><paragraph id="HE8565B34044A4D90886A35C4821D27E5"><enum>(8)</enum><text>A child adopted through intercountry adoption may be at risk of not acquiring United States citizenship if an unregulated custody transfer occurs before the adoptive parents complete all necessary steps to finalize the adoption of such child.</text></paragraph><paragraph id="HFD60186E88DD4AE7B37C386FD269D512"><enum>(9)</enum><text>Engaging in, or offering to engage in, unregulated custody transfer is a form of child abuse.</text></paragraph></section><section id="H658E3468B5B84E5E896EDB89ECD59C7F"><enum>3.</enum><header>Treatment of unregulated custody transfer</header><subsection id="HAB20D722F3534D05A06D1E0D86EBD697"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 3 of the Child Abuse Prevention and Treatment Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5101">42 U.S.C. 5101</external-xref> note) is amended—</text><paragraph id="HF3D700B069EF4953B2934730B2016BE9"><enum>(1)</enum><text>in paragraph (2)—</text><subparagraph id="H00BF44A51ABC415586FF203C781F2EA1"><enum>(A)</enum><text>by striking <quote>or an act or failure</quote> and inserting <quote>an act or failure</quote>; and</text></subparagraph><subparagraph id="HE28E8DFBF99E4322908B2E2B2B7BDC65"><enum>(B)</enum><text>by inserting <quote>, or an unregulated custody transfer</quote> after <quote>serious harm</quote>;</text></subparagraph></paragraph><paragraph id="HD3C1B4A72BA54D919C925F933A32E5D7"><enum>(2)</enum><text>in paragraph (7), by striking <quote>; and</quote> and inserting a semicolon;</text></paragraph><paragraph id="H3AAF202E9ACD4726884E9F00DAF29D84"><enum>(3)</enum><text>in paragraph (8), by striking the period at the end and inserting <quote>; and</quote>; and</text></paragraph><paragraph id="H40527CC7FB2A44EC8BCB8B08FA7E2DB0"><enum>(4)</enum><text>by adding at the end the following new paragraph:</text><quoted-block display-inline="no-display-inline" id="H02F24E22DEFB429FAD009381BB678FAB" style="OLC"><paragraph id="H53041F653DBD453B85A2162B7098C9D1"><enum>(9)</enum><text display-inline="yes-display-inline">the term <quote>unregulated custody transfer</quote> means the abandonment of a child by the child’s parent, legal guardian, or a person or entity acting on behalf, and with the consent, of such parent or guardian—</text><subparagraph id="HEB26D43F003F4C3F86F6CC3ACDB5A73E"><enum>(A)</enum><text display-inline="yes-display-inline">by placing a child with a person who is not—</text><clause id="HABDB47757C8F4007A70B04E49FAD38AF"><enum>(i)</enum><text>the child’s parent, step-parent, grandparent, adult sibling, adult uncle or aunt, legal guardian, or other adult relative;</text></clause><clause id="H19AF69175FFE46DF961E33DCA91CBEDD"><enum>(ii)</enum><text>a friend of the family who is an adult and with whom the child is familiar; or</text></clause><clause id="HB48E6C0A262A4CBBBE68C9B97B32D931"><enum>(iii)</enum><text>a member of the federally recognized Indian tribe of which the child is also a member;</text></clause></subparagraph><subparagraph id="HF76CC23813DC48D39827B3698E181104"><enum>(B)</enum><text display-inline="yes-display-inline">with the intent of severing the relationship between the child and the parent or guardian of such child; and</text></subparagraph><subparagraph id="HEA388B2A42064E4588C58DE3390AD9F8"><enum>(C)</enum><text>without—</text><clause commented="no" id="HF8BCDD2EF40948DAB0F10F40EC718B02"><enum>(i)</enum><text display-inline="yes-display-inline">reasonably ensuring the safety of the child and permanency of the placement of the child, including by conducting an official home study, background check, and supervision; and</text></clause><clause id="HC179086959714AA8A18090D66A7030E3"><enum>(ii)</enum><text display-inline="yes-display-inline">transferring the legal rights and responsibilities of parenthood or guardianship under applicable Federal and State law to a person described in subparagraph (A).</text></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="H1D45AF36505E4D20AA39ECFF25FC4E05"><enum>(b)</enum><header>Technical amendment</header><text display-inline="yes-display-inline">Paragraph (5) of section 3 of the Child Abuse Prevention and Treatment Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5101">42 U.S.C. 5101</external-xref> note) is amended by striking <quote>450b</quote> and inserting <quote>5304</quote>.</text></subsection><subsection id="HAF1B152B94B94C0C8136C9CC77FD1B5A"><enum>(c)</enum><header>Effective date</header><text>The amendments made by this section shall take effect on the date that is 1 year after the date of the enactment of this section.</text></subsection></section><section id="H1D25CC9279E6404986C45DF8C666046E" section-type="subsequent-section"><enum>4.</enum><header>Report and guidance on unregulated custody transfers</header><text display-inline="no-display-inline">Section 204 of the Child Abuse Prevention and Treatment and Adoption Reform Act of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/42/5114">42 U.S.C. 5114</external-xref>) is amended to read as follows:</text><quoted-block id="H9DAC701F9B57421494DE49C73B70C65B"><section id="H9A9189E6E01048F68150733E93D362A3"><enum>204.</enum><header>Report and guidance on unregulated custody transfers</header><subsection id="H22C1D85130A746BDB102A0B2B94476A5"><enum>(a)</enum><header>Report to Congress</header><paragraph id="H620AF15BDDA44DBF917A13D21EA3B4A7"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 180 days after the date of the enactment of this section, the Secretary, in consultation with the Secretary of State, shall provide to the Committee on Education and Labor of the House of Representatives, the Committee on Ways and Means of the House of Representatives, and the Committee on Health, Education, Labor and Pensions of the Senate a report on unregulated custody transfers of children, including of adopted children.</text></paragraph><paragraph id="H71D1458AF8F34559B319B87986D0131D"><enum>(2)</enum><header>Elements</header><text>The report required under paragraph (1) shall include—</text><subparagraph id="HE7C5DE4D0CFF41F9B5582CB98E9FF05C"><enum>(A)</enum><text>the causes, methods, and characteristics of unregulated custody transfers, including the use of social media and the internet;</text></subparagraph><subparagraph id="HE526BEB8CD3749D186C4902ED2DFC95F"><enum>(B)</enum><text>the effects of unregulated custody transfer on children, including the lack of assessment of a child’s safety and well-being by social services agencies and courts due to such unregulated custody transfer;</text></subparagraph><subparagraph id="H44B39025A1F140CF99E45985E6EDF537"><enum>(C)</enum><text>the prevalence of unregulated custody transfers within each State and across all States; and</text></subparagraph><subparagraph id="HA0BC261FC4654B549DA14E501E147FA0"><enum>(D)</enum><text>recommended policies for preventing, identifying, and responding to unregulated custody transfers, including of adopted children, that include—</text><clause id="H12F60991B3904901A18B086A6577A5FA"><enum>(i)</enum><text>amendments to Federal and State law to address unregulated custody transfers;</text></clause><clause id="HE6761007C93841758D7999387430D01F"><enum>(ii)</enum><text>amendments to child protection practices to address unregulated custody transfers; and</text></clause><clause id="H444B81DEE24F47658CC2C001ED7FAF8F"><enum>(iii)</enum><text>methods of providing the public information regarding adoption and child protection.</text></clause></subparagraph></paragraph></subsection><subsection id="H0CCAD38BDBB74BE3B405864BAF75DD38"><enum>(b)</enum><header>Guidance to States</header><paragraph id="HA9AB59DA4FFD4F4FADA38B98DFE22D77"><enum>(1)</enum><header>In general</header><text>Not later than 1 year after the date of the enactment of this section, the Secretary, in consultation with the Secretary of State, shall issue guidance and technical assistance to States related to preventing, identifying, and responding to unregulated custody transfers, including of adopted children.</text></paragraph><paragraph id="HF8AE6428AEFD4238A0E9324204DD53BE"><enum>(2)</enum><header>Elements</header><text>The guidance required under paragraph (1) shall include—</text><subparagraph id="H25F2BE46E81B4840BA6FE72F14B25B15"><enum>(A)</enum><text>education and training materials related to preventing, identifying, and responding to unregulated custody transfers for employees of State, local, and Tribal agencies that provide child welfare services;</text></subparagraph><subparagraph id="HFCCB743AC12D44A88B4843545A56CFDA" commented="no"><enum>(B)</enum><text>model State laws with respect to unregulated custody transfers; and</text></subparagraph><subparagraph id="HFE993F5250CB415683C4F00F726B3EDE"><enum>(C)</enum><text>guidance on appropriate pre-adoption training and post-adoption services for domestic and international adoptive families to promote child permanency.</text></subparagraph></paragraph></subsection><subsection id="HDFFAFB71D2CD42268560FD86D6EB6FB9" commented="no"><enum>(c)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this section:</text><paragraph id="H8A4265C30B8D4EEB92C15674187A865B" commented="no"><enum>(1)</enum><header>State</header><text display-inline="yes-display-inline">The term <quote>State</quote> means each of the several States, the District of Columbia, and any commonwealth, territory, or possession of the United States. </text></paragraph><paragraph id="H933BED9609A14218A28D2964B83381C6" commented="no"><enum>(2)</enum><header>Unregulated custody transfer</header><text display-inline="yes-display-inline">The term <term>unregulated custody transfer</term> has the meaning given the term in section 3 of the Child Abuse Prevention and Treatment Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5101">42 U.S.C. 5101</external-xref> note).</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section></legis-body></bill>
