which was referred to the <committee-name committee-id="HJU00">Committee on the Judiciary</committee-name>, and in addition to the Committee on <committee-name committee-id="HHM00">Homeland Security</committee-name>, for a period to be subsequently determined by the Speaker, in each case for consideration of such provisions as fall within the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To establish the Office of the Ombudsperson for Immigrant Children in Government Custody, and for other purposes.</official-title></form><legis-body id="HF584D1E595B347019D2D9B5A7901DC3C" style="OLC"><section section-type="section-one" id="H31D08E9AE8804C87A5487A1EA42A8505"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Protection of Kids in Immigrant Detention Act</short-title></quote> or <quote><short-title>PROKID Act</short-title></quote>.</text></section><section commented="no" display-inline="no-display-inline" section-type="subsequent-section" id="HF56EF4678691468DB705135BE72A9CEB"><enum>2.</enum><header display-inline="yes-display-inline">Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph commented="no" display-inline="no-display-inline" id="H0D89BA28408D47E2BCEF0FAC10817549"><enum>(1)</enum><header>Committee</header><text>The term <term>Committee</term> means the expert advisory committee established under section 5(a).</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HE415018725C54D82AE0323DEF8FA469E"><enum>(2)</enum><header>Director</header><text>The term <term>Director</term> means the Director of the Office of Refugee Resettlement. </text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H98814BD90E5A4695B8EEB5DB4F2726F1"><enum>(3)</enum><header>Facility</header><text>The term <term>facility</term>—</text><subparagraph commented="no" display-inline="no-display-inline" id="HE44E73E1F6C441649A581664DDED1D7B"><enum>(A)</enum><text>means a location at which 1 or more immigrant children are detained by the Government or held in Government custody; and </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H26F9A3DA7D7B475EAA990DD293A719F0"><enum>(B)</enum><text>includes—</text><clause commented="no" display-inline="no-display-inline" id="H9AB2337EA9804FB2A8A659C50860E61C"><enum>(i)</enum><text>an Office of Refugee Resettlement facility; and</text></clause><clause commented="no" display-inline="no-display-inline" id="H993D0BD5A4D64C0D9D1E78E40A855168"><enum>(ii)</enum><text>a Department of Homeland Security facility, including—</text><subclause commented="no" display-inline="no-display-inline" id="H9182E7BB92A04311A69E77D753C1AB19"><enum>(I)</enum><text>a U.S. Customs and Border Protection temporary holding facility and transportation contractor;</text></subclause><subclause id="HA5D1686D87D44E649AF8569644E034F5"><enum>(II)</enum><text>a U.S. Immigration and Customs Enforcement family detention facility;</text></subclause><subclause id="H2D9A7A9A26854A5E8D80B166A8DF2707"><enum>(III)</enum><text>a U.S. Immigration and Customs Enforcement juvenile facility;</text></subclause><subclause id="H73902DFB9828437BABD95D39D256FA81"><enum>(IV)</enum><text>a location operated by a private entity, including a hotel room; and</text></subclause><subclause id="H1B2A7166A4724A2EAE5E0C085158EB7C" commented="no" display-inline="no-display-inline"><enum>(V)</enum><text>any other location at which the Department of Homeland Security detains or holds in custody an immigrant child. </text></subclause></clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HF9640BE685CD44E2AE0C49EF7EDE0C56"><enum>(4)</enum><header>Flores settlement agreement</header><text>The term <term>Flores settlement agreement</term> means the stipulated settlement agreement filed in the United States District Court for the Central District of California on January 17, 1997 (CV 85–4544–RJK).</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HB5E91B9D563D4EEF82567A1DE4589354"><enum>(5)</enum><header>Immigrant child</header><text>The term <term>immigrant child</term> means an alien (as defined in section 101(a) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101(a)</external-xref>) under the age of 18 years.</text></paragraph><paragraph display-inline="no-display-inline" commented="no" id="HE889D861B1DA4B428B402F467F46A20E"><enum>(6)</enum><header>In-network facility</header><text>The term <term>in-network facility</term> means a facility operated by an Office of Refugee Resettlement grantee, subgrantee, contractor, or subcontractor. </text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H502FA1BE1BD044DE8227569A5D90C469"><enum>(7)</enum><header>Office of Refugee Resettlement facility</header><text>The term <term>Office of Refugee Resettlement facility</term>—</text><subparagraph commented="no" display-inline="no-display-inline" id="H73D4094E0FEF477DBD4FA047CE6413B7"><enum>(A)</enum><text>means—</text><clause commented="no" display-inline="no-display-inline" id="H64F922B8C18546B2B05DAF22CD79D8B1"><enum>(i)</enum><text>a shelter;</text></clause><clause commented="no" display-inline="no-display-inline" id="H0266B97B4D494C36AC8A9BE9B7B34F81"><enum>(ii)</enum><text>staff secure, secure care, or transitional foster care housing; or</text></clause><clause commented="no" display-inline="no-display-inline" id="H563E478BD66B467A84050BFDEE1A8D81"><enum>(iii)</enum><text>any other location operated by the Office of Refugee Resettlement to hold immigrant children; and </text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H8D36E8B756134247A4DE14A0F08DEE7D"><enum>(B)</enum><text>includes an in-network facility and an out-of-network facility.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H9ADAD4F3D1A2402AB97A076989522854"><enum>(8)</enum><header>Ombudsperson</header><text>The term <term>Ombudsperson</term> means the ombudsperson appointed under section 3(c).</text></paragraph><paragraph display-inline="no-display-inline" commented="no" id="H90797B116DB04D29ABD0BF1E161D941E"><enum>(9)</enum><header>Out-of-network facility</header><text>The term <term>out-of-network facility</term> means a facility at which an immigrant child is placed as a result of an Office of Refugee Resettlement determination that there is no care provider available among in-network facilities to provide specialized services required by the immigrant child, such as medical or mental health support. </text></paragraph><paragraph display-inline="no-display-inline" commented="no" id="HE9089CE931644D14A55C2FD6C9840925"><enum>(10)</enum><header>Unobstructed access</header><text>The term <term>unobstructed access</term> means—</text><subparagraph display-inline="no-display-inline" commented="no" id="HBF040BEC246F44509BC91F93DEB90EF0"><enum>(A)</enum><text>with respect to a facility, the ability to enter the facility, including unannounced, to tour and physically visit all areas of the facility; and</text></subparagraph><subparagraph display-inline="no-display-inline" commented="no" id="HCEFDF3D100D94AF1995128BB1EADBEFD"><enum>(B)</enum><text>with respect to information, the ability to obtain requested information in a timely manner and with the full cooperation of the Director or the Secretary of Homeland Security, as applicable. </text></subparagraph></paragraph><paragraph id="H067237E602A14A0FBF940503855E69AE" commented="no" display-inline="no-display-inline"><enum>(11)</enum><header>Working Group</header><text>The term <term>Working Group</term> means the interagency working group established under section 6(b). </text></paragraph></section><section id="HBEE735E0B0E9472888C19E620691A913"><enum>3.</enum><header>Office of the Ombudsperson for Immigrant Children in Government Custody</header><subsection id="HCAE5EF936BF14700B607F839FD21B1BB"><enum>(a)</enum><header>Establishment</header><text>There is established, within the Department of Health and Human Services, an Office of the Ombudsperson for Immigrant Children in Government Custody (referred to in this section as the <quote>Office of the Ombudsperson</quote>)—</text><paragraph id="H67CDC24CBA994941871B81AEA5F84051"><enum>(1)</enum><text>to endorse and support the principle that family separation and detention are generally not in a child’s best interest; and</text></paragraph><paragraph id="HA262AAFFC03B4D3DA755145FF26E44D9"><enum>(2)</enum><text>in cases in which detention or Government custody is required— </text><subparagraph id="H4496308B523F44DAB3D60C8F045563EF"><enum>(A)</enum><text>to ensure that immigrant children are only detained or held in Government custody in the least restrictive setting; </text></subparagraph><subparagraph id="H37371D1058E54D62B1D88E2BD6BE6687"><enum>(B)</enum><text>to advocate for the quick, safe, and efficient release of immigrant children from detention or Government custody whenever possible; and</text></subparagraph><subparagraph id="H8527579CB6B84661AD362D0CF31F5C33"><enum>(C)</enum><text>in any case in which an immigrant child is held in Department of Homeland Security custody together with his or her family unit, to advocate for the release of the child and concurrent release of the parent or legal guardian of the child.</text></subparagraph></paragraph></subsection><subsection id="H293B2D37D1324D85B2BA17A3329CF1D2"><enum>(b)</enum><header>Independence</header><text>The Office of the Ombudsperson shall be an impartial, confidential resource fully independent of—</text><paragraph id="HD92FB4BB6DB249BF87CA3B346F0972F6"><enum>(1)</enum><text>the Office of Refugee Resettlement of the Department of Health and Human Services; and</text></paragraph><paragraph id="H64B4705C9AC64D6AA569AC7F5899DBAD"><enum>(2)</enum><text>the Department of Homeland Security.</text></paragraph></subsection><subsection id="H190DB23D2A674CFAB4ECBA38F2CAD155"><enum>(c)</enum><header>Ombudsperson</header><paragraph id="HC91B9A920B434A2EA93FDE617D65B482"><enum>(1)</enum><header>In general</header><text>The Office of the Ombudsperson shall be headed by an Ombudsperson, who shall be appointed by, and report directly to, the Secretary of Health and Human Services. </text></paragraph><paragraph id="HFCDEC4B3DD1D4B169B7B566ECC2303C0"><enum>(2)</enum><header>Qualifications</header><text>The individual appointed as Ombudsperson shall have demonstrated experience in—</text><subparagraph id="H0A6B786BEB5C46338071D7C8E960A893"><enum>(A)</enum><text>immigration law; and</text></subparagraph><subparagraph id="H266950ADA6CD4EAF923F7F3A3D1C407D"><enum>(B)</enum><text>child advocacy or child welfare. </text></subparagraph></paragraph><paragraph id="H3D0846B09BD44BD8A0D3AA086DEFFA5E"><enum>(3)</enum><header>Duties and authorities</header><subparagraph id="H05BE4626BAC146F08CE5B80160F3BFDC"><enum>(A)</enum><header>Monitoring</header><text>The Ombudsperson shall monitor facilities for compliance with applicable law and standards, including—</text><clause id="H897737478C59446193BF39091708FC3B"><enum>(i)</enum><text>the Flores settlement agreement;</text></clause><clause id="H3CE0D2CCC2FF4254A8A9C0F643C6E3C5"><enum>(ii)</enum><text>section 235 of the William Wilberforce Trafficking Victims Protection Reauthorization Act of 2008 (<external-xref legal-doc="usc" parsable-cite="usc/8/1232">8 U.S.C. 1232</external-xref>); </text></clause><clause id="H4B609FA2090F42258AFDDE046EADFF5F"><enum>(iii)</enum><text>the applicable provisions of the Prison Rape Elimination Act of 2003 (<external-xref legal-doc="usc" parsable-cite="usc/34/30301">34 U.S.C. 30301</external-xref> et seq.);</text></clause><clause id="HA067C98BE2204DE28ED8636589D9A381"><enum>(iv)</enum><text>the standards of U.S. Customs and Border Protection entitled <quote>National Standards on Transport, Escort, Detention, and Search</quote> issued in October 2015; and</text></clause><clause id="H1A53142BF88C4EBDB24A38AF72F72D7C"><enum>(v)</enum><text>internal Office of Refugee Resettlement policy guidance, including the guidance entitled <quote>ORR Policy Guide: Children Entering the United States Unaccompanied</quote> issued on January 30, 2015.</text></clause></subparagraph><subparagraph id="H0CECEADC680D4ECB942380A3404C9867"><enum>(B)</enum><header>Investigations</header><clause id="H93CAB2DD971F4E67AD5F005FAE490A3C"><enum>(i)</enum><header>In general</header><text>The Ombudsperson shall investigate—</text><subclause id="HBC803C3B5E22409DAADF15ED9F0A1444"><enum>(I)</enum><text>claims of abuse, neglect, or mistreatment of immigrant children, by the Government or any other entity, while in Government custody; and</text></subclause><subclause id="H252225B090624097A4039FD8D5669560"><enum>(II)</enum><text>complaints against foster care providers, including foster care providers under State oversight.</text></subclause></clause><clause id="HBA1A560EC088490382A5C9E32350E09B"><enum>(ii)</enum><header>Reporting of State licensing violations</header><text>If in the course of an investigation under clause (i)(II) the Ombudsperson discovers a State licensing violation, the Ombudsperson shall report the violation to the child welfare licensing agency of the applicable State.</text></clause></subparagraph><subparagraph id="H0DF0EF6DAA36449581118E5B597F421B"><enum>(C)</enum><header>Oversight of Office of Refugee Resettlement</header><clause id="HA309B7C8371C48388B39A1B5926DFFCD"><enum>(i)</enum><header>In general</header><text>The Ombudsperson shall provide oversight of the Director by reviewing placement decisions, including sponsor denials, that are contested by an immigrant child or the attorney, child advocate, parent, or prospective sponsor of the immigrant child.</text></clause><clause id="HFBC4A163D79F4E11B54010569D5C0F95"><enum>(ii)</enum><header>Expedited review of contested placement decisions</header><subclause id="HFDB957551B9D4A0DA87A3BC357ABCDF7"><enum>(I)</enum><header>In general</header><text>Not later than 15 days after the date on which review of a placement decision described in clause (i) is requested, the Ombudsperson shall complete the review.</text></subclause><subclause id="H92CBE9DA4A2A4BCD9A17521AFE52754F"><enum>(II)</enum><header>Recommendation to Director</header><text>If, in carrying out such a review, the Ombudsperson determines that such placement decision was erroneous, the Ombudsperson shall—</text><item id="H94069BAE62F745CC8D400795C25EF91D"><enum>(aa)</enum><text>submit to the Director a recommendation for further action; and </text></item><item id="H0A9446AEA5924629B817C3018609C4D5"><enum>(bb)</enum><text>make a copy of the recommendation available to—</text><subitem id="H01A2EEF65AC94724B6D0A7480E3464B8"><enum>(AA)</enum><text>the immigrant child; and</text></subitem><subitem id="H0B8D9AC5957C4A77BF4323763F0B5170"><enum>(BB)</enum><text>if applicable, the immigrant child's attorney and child advocate.</text></subitem></item></subclause><subclause id="HC5D753A0C8D1443783D7E6EB59B87382"><enum>(III)</enum><header>Written statement</header><item id="H5F1B0E2AE91240ECB78DFC1B63A006D1"><enum>(aa)</enum><header>In general</header><text>In any case in which the Director declines to follow a recommendation under subclause (II), not later than 15 days after the date on which the Director receives the recommendation, the Director shall issue a written response, including a detailed justification. </text></item><item id="H015205A0F9DB487C99C5F3024CEE73CB"><enum>(bb)</enum><header>Nondelegation</header><text>The Director may not delegate the requirement to issue a written statement under this subclause. </text></item></subclause></clause><clause id="H1A4D4C6B95F5492BBB074F694EE35BF0"><enum>(iii)</enum><header>Civil action not precluded</header><text>Review by the Ombudsperson under this subparagraph shall not preclude an immigrant child, or the attorney, child advocate, parent, or prospective sponsor of the immigrant child, from simultaneously commencing a civil action in any appropriate district court of the United States. </text></clause></subparagraph><subparagraph commented="no" id="HA2E97BE6E8464978B10A821077949E31"><enum>(D)</enum><header>Stakeholder meetings</header><text>Not less frequently than quarterly, the Ombudsperson shall invite community stakeholders, Flores settlement agreement class counsel, and the Flores settlement agreement court-appointed monitor to participate in a meeting—</text><clause commented="no" id="HD180E7335A984D40A555DDDEA7B38A12"><enum>(i)</enum><text>to ensure that the Ombudsperson is aware of stakeholder concerns and priorities; and</text></clause><clause commented="no" id="H3009B67780ED4C1D8F9EC77702306591"><enum>(ii)</enum><text>to provide feedback on stakeholder requests.</text></clause></subparagraph><subparagraph id="HCAEF2D114CA941D4BB66F4A34023D12D"><enum>(E)</enum><header>Regional offices</header><text>The Ombudsperson shall establish regional offices of the Office of the Ombudsperson—</text><clause id="HB7A7548CD2A744F7B17116D3BB672D26"><enum>(i)</enum><text>to ensure the inclusion of pertinent local and regional issues, trends, and challenges for consideration by the Ombudsperson;</text></clause><clause id="H64F343697B9149198D2B82C41F9BBFC5"><enum>(ii)</enum><text>to strengthen State oversight; </text></clause><clause id="HA4CC1169E6A34E3DAE1C69C0B640D903"><enum>(iii)</enum><text>to coordinate with State licensing entities; and </text></clause><clause commented="no" display-inline="no-display-inline" id="H041890782B16435393987E9026AFFD0E"><enum>(iv)</enum><text>to identify and address differences among State child protection laws. </text></clause></subparagraph><subparagraph commented="no" id="HFDB7E697F3494EA6A565E1785C749962"><enum>(F)</enum><header>Individual case assistance</header><clause commented="no" id="H01157221CD35474CB018BCC2F422D415"><enum>(i)</enum><header>In general</header><text>The Ombudsperson may offer individual case assistance to an immigrant child who is in Government custody if the case of the immigrant child is long-pending or otherwise requires expedited processing or elevated attention, as determined by the Ombudsperson. </text></clause><clause commented="no" id="HE5643E34DE7E4CF0BCE3DDFAC90A1714"><enum>(ii)</enum><header>Communication</header><text>To ensure a complete understanding of the status of a case described in clause (i), the Ombudsperson may communicate with the potential sponsor, family members, child advocate, legal counsel, Office of Refugee Resettlement case manager and Federal field specialist, the General Dynamics Information Technology case coordinator, and any other relevant individual charged with case management of the immigrant child concerned.</text></clause></subparagraph><subparagraph id="H9A7EBA636DE64072AFF7ADFBF277F0A3"><enum>(G)</enum><header>Subpoena authority</header><clause id="H1C267D41DF4345E986A8CAF965FB442C"><enum>(i)</enum><header>In general</header><text>Subject to the approval of the Secretary of Health and Human Services, the Ombudsperson may—</text><subclause id="H6E47475CDA1F4E48A583B6D58D779F78"><enum>(I)</enum><text>issue a subpoena to require the production of all information, reports, and other documentary evidence necessary to carry out the duties of the Ombudsperson; and </text></subclause><subclause id="HC83DEF7FCE7844DA96A9B03AFF165567"><enum>(II)</enum><text>invoke the aid of any appropriate court of the United States.</text></subclause></clause><clause id="H974801383A324A8FB6F013FF523DFD41"><enum>(ii)</enum><header>Timeline for production of information</header><text>To prevent undue delay of the placement of an immigrant child, requirements set forth in a subpoena under clause (i)(I) shall be satisfactorily fulfilled not later than 7 days after the date on which the Ombudsperson issues the subpoena. </text></clause></subparagraph><subparagraph id="H572F5A4986764B99BBD3297C614AC751"><enum>(H)</enum><header>Reporting mechanisms</header><clause id="HF5022A1B93464BB1817BA21FC2237477"><enum>(i)</enum><header>In general</header><text>The Ombudsperson shall establish and maintain—</text><subclause id="H5678CE3F0AF64F08A919C299CDF1DBE9"><enum>(I)</enum><text>a toll-free telephone number to receive complaints and reports of matters for investigation; and </text></subclause><subclause id="HCCAC31F9E9F041BCB59587E5C7B5A969"><enum>(II)</enum><text>an email address to receive complaints, such reports, and requests for review of placement decisions.</text></subclause></clause><clause id="HF82C4FCFD6864AF893884A961BA9FBDF"><enum>(ii)</enum><header>Availability</header><text>The Ombudsperson shall ensure that—</text><subclause id="H3997235E4E1A449F9C8186E21864C7F5"><enum>(I)</enum><text>such telephone number is made available, and a telephone is accessible, to each immigrant child in a facility; and </text></subclause><subclause id="H04CC736E3B60452AB1D00A7725CF1871"><enum>(II)</enum><text>such email address is made available to sponsors, Flores settlement agreement class counsel, and legal services providers and child advocates who serve such immigrant children.</text></subclause></clause></subparagraph><subparagraph commented="no" id="H0375EF5A56F74FBD9C9025B3C0683169"><enum>(I)</enum><header>Report to Congress</header><clause commented="no" id="H0D4F190BB5D34ECC88F12D59F2787F7F"><enum>(i)</enum><header>In general</header><text>Not later than September 30 each year, the Ombudsperson shall submit to Congress a report on the accomplishments and challenges of the Office of the Ombudsperson during the fiscal year ending on that date.</text></clause><clause commented="no" id="HF08BE62082D84364AEA8C627F9593A9A"><enum>(ii)</enum><header>Elements</header><text>Each report required by clause (i) shall include, for the applicable fiscal year, the following:</text><subclause commented="no" id="H05B65142B4CC4ECC83EF7184F6751276"><enum>(I)</enum><text>A summary of the status of immigrant children in Government custody that highlights broader trends and recommendations for future action. </text></subclause><subclause commented="no" id="H4675529A63DB48D6A01091A50FC7E4FA"><enum>(II)</enum><text>Statistical information on immigrant children in Government custody, together with an analysis of such information. </text></subclause><subclause commented="no" id="HA732337BAD5E48EF93408EC20F37322B"><enum>(III)</enum><text>A summary of complaints received and proposed resolutions.</text></subclause><subclause commented="no" id="H0E6825AFD3F54D85AFF4D949C09AF760"><enum>(IV)</enum><text>A detailed description of any investigation into a claim of abuse, neglect, or mistreatment of an immigrant child in Government custody, including a summary of the results of any such investigation.</text></subclause><subclause commented="no" display-inline="no-display-inline" id="H99FA10EFCBC047138F1C31ADB3E14514"><enum>(V)</enum><text>A description of the objectives of the Office of the Ombudsperson for the next fiscal year. </text></subclause></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H25E1493A4B0C424AB73E7D362CADAF4C"><enum>(J)</enum><header>Additional duties</header><text>The Ombudsperson shall—</text><clause commented="no" display-inline="no-display-inline" id="H82A14FE26AE7431AB01F24C7C93D75C0"><enum>(i)</enum><text>conduct a review of data collection, as described in section 4(a);</text></clause><clause commented="no" display-inline="no-display-inline" id="H2AA7BF8246714A478A8E4EC2A911FFF4"><enum>(ii)</enum><text>establish the Committee, as described in section 5; and</text></clause><clause commented="no" display-inline="no-display-inline" id="H9D2B4F24D1464E2D83F20F7EC4F1A6E9"><enum>(iii)</enum><text>enter into a memorandum of understanding, as described in section 6(a).</text></clause></subparagraph></paragraph></subsection><subsection id="H603485B0E067449E9EE2880AAA819EFF"><enum>(d)</enum><header>Access to facilities</header><text>The Secretary of Health and Human Services and the Secretary of Homeland Security shall ensure—</text><paragraph id="H412C8CB5D61841E09CF30ACC9F1AD5F9"><enum>(1)</enum><text>unobstructed access by the Ombudsperson to any facility; and</text></paragraph><paragraph id="HED6E60D55B7B4ED084D9E3FC68C8D0C2"><enum>(2)</enum><text>the ability of the Ombudsperson— </text><subparagraph id="HC627FDB30B1C4E8F9D246586341E77A0"><enum>(A)</enum><text>to monitor any facility; and</text></subparagraph><subparagraph id="HF4AA3274930C400CA6977BCC6FAD5646"><enum>(B)</enum><text>to meet confidentially with—</text><clause id="HEB1C90C58F7748078A077FC86235828C"><enum>(i)</enum><text>staff of any facility; </text></clause><clause id="H9DCF9F70A4444B089A1A1CB35EB6522F"><enum>(ii)</enum><text>employees and contractors of the Office of Refugee Resettlement and the Department of Homeland Security; and</text></clause><clause id="H086D9134434A469BB407CD3CD4C72371"><enum>(iii)</enum><text>any immigrant child in Government custody, after notification of the immigrant child's counsel, as applicable.</text></clause></subparagraph></paragraph></subsection><subsection id="HA14CE35932A54FCF9BE7FE39AF4968FE"><enum>(e)</enum><header>Access to information</header><text>The Secretary of Health and Human Services shall ensure unobstructed access by the Ombudsperson to— </text><paragraph id="HCD8599F761554E19B7417DB68F0717CF"><enum>(1)</enum><text>the case files, records, reports, audits, documents, papers, recommendations, or any other pertinent information relating to the care and custody of an immigrant child; and</text></paragraph><paragraph id="H3B1C8AE82FDA456F8E8997DFF3738C6A"><enum>(2)</enum><text>the written policies and procedures of all Office of Refugee Resettlement facilities.</text></paragraph></subsection></section><section id="H93FF084A473C48779B58110C710F2245"><enum>4.</enum><header>Data collection</header><subsection id="H02989DBE885D4F2C928324C41EC468DD"><enum>(a)</enum><header>Independent review by Ombudsperson</header><paragraph id="HB1A82B37920645FF83591F5C3B05F1FD"><enum>(1)</enum><header>In general</header><text>The Ombudsperson shall regularly review data collected by the Secretary of Health and Human Services and the Secretary of Homeland Security relating to immigrant children in facilities.</text></paragraph><paragraph id="HB0D6004882434AD2A5CC56CF068CFEBE"><enum>(2)</enum><header>Collaboration required</header><text>The Secretary of Health and Human Services and the Secretary of Homeland Security shall provide the Ombudsperson unobstructed access to—</text><subparagraph id="HA52EC44FEA7943209ACE84C3DD0422AE"><enum>(A)</enum><text>real-time custody and detention data for each immigrant child detained by the Government or held in Government custody, including—</text><clause id="HD1F17E07A48944E4BDC91AA608AE64B5"><enum>(i)</enum><text>the location and level of placement;</text></clause><clause id="HFC50261E87B84C169248A6497DDF243B"><enum>(ii)</enum><text> biographical information, including full name, date of birth, country of citizenship, and alien number; </text></clause><clause commented="no" id="H5A86239A99FF471C944F0C0C0A7CD037"><enum>(iii)</enum><text>all locations at which the immigrant child has been detained or held in custody;</text></clause><clause id="H7604D2EA07844EF782ACAF7C3B49EB5B"><enum>(iv)</enum><text>the dates and times the immigrant child is booked in and booked out of any facility; and</text></clause><clause id="H3AAAFA8C467B48FC8DA4C12CB72F226A"><enum>(v)</enum><text>transfer and discharge information; and</text></clause></subparagraph><subparagraph id="HDE3C1FF7B5544D1D9C0A43ACAA073228"><enum>(B)</enum><text>Department of Homeland Security and Department of Health and Human Services data personnel for the purpose of reviewing data collection and integrity issues.</text></subparagraph></paragraph></subsection><subsection id="HF142A7B8E7654B999C109848E512EBF3"><enum>(b)</enum><header>Office of Refugee Resettlement data collection system</header><paragraph id="HFD3D8FDECA734D89B2F383059D2AD06B"><enum>(1)</enum><header>In general</header><text>To support the data collection and monitoring duties of the Ombudsperson and to facilitate public monitoring, the Director shall develop a data collection system that collects and maintains the following information: </text><subparagraph id="HD9914E44E7ED40F38961F61E1DE571CC"><enum>(A)</enum><text>The total number of immigrant children held in custody by the Director, disaggregated by placement level, specific Office of Refugee Resettlement facility, and age.</text></subparagraph><subparagraph id="HF3C5B29ADEEF4716AE2DFB2A8BE8E1C2"><enum>(B)</enum><text>The average and median number of days immigrant children remain in such custody, disaggregated by placement level, specific Office of Refugee Resettlement facility, and age.</text></subparagraph><subparagraph id="HE98715D7F0A149588A982F0ECA61E697"><enum>(C)</enum><text>The average and median number of days immigrant children stay in an Office of Refugee Resettlement facility, disaggregated by placement level, specific Office of Refugee Resettlement facility, and age.</text></subparagraph><subparagraph id="H3ABA27B2C3964C309E83E836B465C2AC"><enum>(D)</enum><text>The number of immigrant children discharged to sponsors, disaggregated by sponsor category, placement level, specific Office of Refugee Resettlement facility, and age. </text></subparagraph><subparagraph id="H63B3B993EFEF4CC79E0FC20B48BA2590"><enum>(E)</enum><text>The sponsor categories of immigrant children held at each Office of Refugee Resettlement facility, disaggregated by placement level and age.</text></subparagraph><subparagraph id="H55B9721EFB0947D9ACBDA4F40EAC09A7"><enum>(F)</enum><text>The number and percentage of immigrant children held in an Office of Refugee Resettlement facility with more than 25 immigrant children, disaggregated by placement level and age. </text></subparagraph><subparagraph id="HC59EEC6D785F4EBE8ABD384E164C71D9"><enum>(G)</enum><text>The percentage of filled capacity across all Office of Refugee Resettlement facilities.</text></subparagraph><subparagraph id="H273436CC180F49F0999EB4CC5B9699F4"><enum>(H)</enum><text>The total number of children held at out-of-network facilities, disaggregated by placement level and age.</text></subparagraph><subparagraph id="H6D29347F1B4743C88E095A732481BF97"><enum>(I)</enum><text>For each Office of Refugee Resettlement facility—</text><clause id="H5BFD546244564982BA2714B11386F7ED"><enum>(i)</enum><text>the percentage of filled capacity;</text></clause><clause id="H8C711BD36AA44CF1A5FE0691BB016956"><enum>(ii)</enum><text>the maximum number of available beds;</text></clause><clause id="HA5C39254F3C04161A32EF3ED7BEB94DE"><enum>(iii)</enum><text>the number and percentage of immigrant children with disabilities, disaggregated by placement level and age; and</text></clause><clause id="H16DEFB025B5346249C1BDE7401A0C52B"><enum>(iv)</enum><text>the number and percentage of immigrant children receiving mandatory home studies, discretionary home studies, and post-release services, disaggregated by placement level and age.</text></clause></subparagraph></paragraph><paragraph id="H7EFAA02F779249E5AD4BF1D5FA567EFA"><enum>(2)</enum><header>Publication</header><text>Not later than the 15th of each month, the Director shall make the data collected under paragraph (1) for the preceding month available to the public on the internet website of the Office of Refugee Resettlement.</text></paragraph></subsection><subsection id="HBE4C137CA69C4AD5AB687C9869E1D137"><enum>(c)</enum><header>Prohibition on certain uses of information</header><text>Information collected under this section may not be used for immigration enforcement or law enforcement purposes. </text></subsection></section><section id="H6D066E45094A4D7ABE29791F8FC182F5"><enum>5.</enum><header>Expert advisory committee</header><subsection id="H03CE5E5BA5EE450F8686292B6671EB9C"><enum>(a)</enum><header>Establishment</header><text>Not later than 90 days after the date of the enactment of this Act, the Ombudsperson shall establish an expert advisory committee to assist the Ombudsperson in—</text><paragraph id="HE2D11F3E922F4C7FAB77612062DEAF33"><enum>(1)</enum><text>identifying relevant trends relating to immigrant children in Government custody;</text></paragraph><paragraph id="HEE84E4B9704F4037BADB6D34C9ADD612"><enum>(2)</enum><text>conducting fact-finding missions and investigations of facilities; and</text></paragraph><paragraph id="H126B4DF0F7874A95AFD2828771AE0EA5"><enum>(3)</enum><text>ensuring Government and private contractor compliance with applicable law and standards for facilities.</text></paragraph></subsection><subsection id="HDEA75BA29672449DA844FE0E9D477FBC"><enum>(b)</enum><header>Membership</header><text>The members of the Committee shall—</text><paragraph id="HBD663D3789CF47148701154079E78E5D"><enum>(1)</enum><text>be appointed by the Ombudsperson; </text></paragraph><paragraph id="H3AA30D831EC2450AACAED04E92164D17"><enum>(2)</enum><text>represent various geographical regions; and</text></paragraph><paragraph id="H0B8FF4EA490F43FCB345DC601CA34CC9"><enum>(3)</enum><text>be comprised of subject matter experts, including—</text><subparagraph id="H2781F77D8A7248698CEC8AA8BBB6EC94"><enum>(A)</enum><text>legal advocates or specialists in the fields of child and family welfare, immigration, and human rights; </text></subparagraph><subparagraph id="HF29AE07231F0438D87BE579324CE227D"><enum>(B)</enum><text>pediatricians or other appropriate pediatric health care experts;</text></subparagraph><subparagraph id="H809CA6408A2C4FB9871F654DF101F39C"><enum>(C)</enum><text>child or adolescent psychiatrists or psychologists; </text></subparagraph><subparagraph id="HA7216F10A15E4D9CA5250B37EC700153"><enum>(D)</enum><text>social workers; </text></subparagraph><subparagraph id="HAE5557426CB94DE889BC6C870A572CDA"><enum>(E)</enum><text>data analysis experts; and </text></subparagraph><subparagraph id="HA45E561FFC0245D383A8A3B5F47D440F"><enum>(F)</enum><text>any other relevant subject matter expert.</text></subparagraph></paragraph></subsection><subsection id="HF0D41199ACDE4E58B6EB8FE504042160"><enum>(c)</enum><header>Meetings</header><text>The Committee shall meet not less frequently than quarterly.</text></subsection><subsection id="H71E0A47E947843DEB647F4E1D5564547"><enum>(d)</enum><header>Duties</header><text>The Committee shall regularly—</text><paragraph id="HA5154FB37F8A4E37A94D6D81B99FB62A"><enum>(1)</enum><text>review facility compliance with applicable law and standards relating to Government detention and custody of immigrant children, including the Flores settlement agreement and section 235 of the William Wilberforce Trafficking Victims Protection Reauthorization Act of 2008 (<external-xref legal-doc="usc" parsable-cite="usc/8/1232">8 U.S.C. 1232</external-xref>); and</text></paragraph><paragraph id="H2DCEBC140D51409488A537B4BD684161"><enum>(2)</enum><text>submit to the Ombudsperson recommendations for improvement. </text></paragraph></subsection><subsection id="H3C2840CB366B40B5845DF214189D8396"><enum>(e)</enum><header>Site visits</header><text>The Committee may designate 1 or more individuals who shall have the authority—</text><paragraph id="HDCCB690E321B42E1B4FE2E857A05EA78"><enum>(1)</enum><text>to carry out facility site visits; and</text></paragraph><paragraph id="H65A0149BAD734E6BB387120076B93CF0"><enum>(2)</enum><text>interview immigrant children held in Government custody, after notification of counsel, as applicable.</text></paragraph></subsection></section><section id="H1F9A0A5BC1944EED8A24AB5DC2A9E88B"><enum>6.</enum><header>Coordination with Department of Homeland Security</header><subsection id="H5476CF236420475A95ABE326244BD0FF"><enum>(a)</enum><header>Memorandum of understanding</header><paragraph id="H027E400F3577422FBF9D3CE4193D6275"><enum>(1)</enum><header>In general</header><text>On the date of the enactment of this Act, the Secretary of Homeland Security and the Ombudsperson shall enter into a memorandum of understanding to coordinate oversight between the Department of Homeland Security and the Department of Health and Human Services. </text></paragraph><paragraph id="H9BB81BA0CF4247A6A81BF867A901B4B5"><enum>(2)</enum><header>Elements</header><text>The memorandum of understanding required by paragraph (1) shall do the following:</text><subparagraph id="H954A6FB2C9FA4718B3CC6F51803ECA4C"><enum>(A)</enum><text>Require the Secretary of Homeland Security to provide information to the Ombudsperson with respect to each immigrant child detained by U.S. Customs and Border Protection or U.S. Immigration and Customs Enforcement, or who is otherwise in the custody of the Secretary of Homeland Security, including—</text><clause id="H61DF71B17D0A4768850A145463C92537"><enum>(i)</enum><text>the location of the immigrant child;</text></clause><clause id="H53A0B42745F6448FA0598FE636A88B6C"><enum>(ii)</enum><text> biographical information, including full name, date of birth, country of citizenship, and alien number; </text></clause><clause id="H65FE18E83828468893B48E5B20E5E7CE"><enum>(iii)</enum><text>all locations at which the immigrant child has been so detained or held in Department of Homeland Security custody;</text></clause><clause id="H822E3A2378DA4FF6A197CA623A52EA75"><enum>(iv)</enum><text>exact times at which the immigrant child was booked in and booked out of such custody;</text></clause><clause id="H4053DFB51BEB4842A827E5FADE07387B"><enum>(v)</enum><text>the date on which the immigrant child is released from such custody or transferred to the custody of the Secretary of Health and Human Services; </text></clause><clause id="H46195425668046A788FC7AE780EF1AD5"><enum>(vi)</enum><text>in the case of an immigrant child who remains in Department of Homeland Security custody for more than 72 hours, the reason for such continued custody; and</text></clause><clause id="HEB189F4996024226A2FA54E04732C661"><enum>(vii)</enum><text>any other information the Ombudsperson considers relevant to the oversight and monitoring duties described in section 3(c)(3).</text></clause></subparagraph><subparagraph id="H253FF08355B94D36B81CDFF6D61A0E0C"><enum>(B)</enum><text>Establish the right of the Ombudsperson and the Committee to monitor Department of Homeland Security facilities for compliance with applicable standards of custody. </text></subparagraph><subparagraph id="H49ABDE5AA4C64504BE9A25FD7A7FD32D"><enum>(C)</enum><text>Provide the Ombudsperson and the Committee full and unobstructed access to—</text><clause id="H5CB8332426074BC8AD1E9107F469B603"><enum>(i)</enum><text>Department of Homeland Security facilities for regular site visits; and </text></clause><clause id="H68AAE1C325FE4F31A95C78996E9F04A1"><enum>(ii)</enum><text>the written policies and procedures of Department of Homeland Security facilities.</text></clause></subparagraph></paragraph><paragraph id="H57910C00D4A0413DA77901D2F045ED32"><enum>(3)</enum><header>Limitation</header><text>The memorandum of understanding may only allow the Ombudsperson to share information with the Secretary of Homeland Security on a case-by-case basis, and with the informed consent of the immigrant child concerned, if the Ombudsperson determines that such information sharing may facilitate the release of the immigrant child from custody. </text></paragraph><paragraph id="H60EA9145D8214829B64237E2E0D77C27"><enum>(4)</enum><header>Evaluation</header><text>Not later than 2 years after the Ombudsperson and the Secretary of Homeland Security enter into the memorandum of understanding required by this subsection, the Comptroller General of the United States shall evaluate the coordination between the Ombudsperson and the Secretary to determine whether such memorandum of understanding is sufficient to ensure the oversight and monitoring required by this Act.</text></paragraph><paragraph id="H94EC583FAB6543CDB42B65B39F8A4FC1"><enum>(5)</enum><header>Recommendations</header><text>If the Comptroller General makes a determination under paragraph (4) that the memorandum of understanding is insufficient, the Comptroller General shall recommend actionable steps to be implemented—</text><subparagraph id="H51DECDBF18B34162BCE1F2EADEC2A2AC"><enum>(A)</enum><text>to improve coordination between the Ombudsperson and the Secretary of Homeland Security; and</text></subparagraph><subparagraph id="HC815485520704A13A9104CE9043B6C04"><enum>(B)</enum><text>to ensure effectiveness of the mandate of the Ombudsperson.</text></subparagraph></paragraph></subsection><subsection id="HE0F61E8BE29F4E46A5799167B714B89D"><enum>(b)</enum><header>Interagency working group</header><paragraph id="H64BD62B418D44F86996277C0C9071754"><enum>(1)</enum><header>Establishment</header><text>There is established an interagency working group to identify and discuss concerns relating to immigrant children in facilities.</text></paragraph><paragraph id="H6E9210B88BA2416E9D85FB0D7E2D9D49"><enum>(2)</enum><header>Membership</header><text>The Working Group shall be composed of representatives of—</text><subparagraph id="H8D353BD5A9FC4A73B9C0442EA5337F0C"><enum>(A)</enum><text>the Department of Justice; </text></subparagraph><subparagraph id="H32D3699A86AC4C7B8FC814298A6D7CF2"><enum>(B)</enum><text>the Department of Health and Human Services, including the Director or a senior representative of the Office of Refugee Resettlement;</text></subparagraph><subparagraph id="H407BA85F05CC4B0BB69215A4EB42CEDE"><enum>(C)</enum><text>U.S. Customs and Border Protection; </text></subparagraph><subparagraph id="HAE5B9F9BA4534CCB8B43CD80AADEF21F"><enum>(D)</enum><text>U.S. Immigration and Customs Enforcement; </text></subparagraph><subparagraph id="HE839FA897DF645F5ACD54F0022147D2C"><enum>(E)</enum><text>relevant oversight offices, including—</text><clause id="H52370D104A4E44CC9BC02DB7BE54D089"><enum>(i)</enum><text>the Immigration Detention Ombudsman of the Department of Homeland Security; and</text></clause><clause id="HEBF431044CE542B797FB5B9CC1B85235"><enum>(ii)</enum><text>the Inspectors General of the Department of Justice, the Department of Health and Human Services, U.S. Customs and Border Protection, and U.S. Immigration and Customs Enforcement; and </text></clause></subparagraph><subparagraph id="H3A3A0E01AAE64EE1B1715B9242D1DD6E"><enum>(F)</enum><text>any other relevant Federal agency or office.</text></subparagraph></paragraph><paragraph id="HC417E8DFAB2E42E38DB4C37829DF1F70"><enum>(3)</enum><header>Meetings</header><text>The Working Group shall—</text><subparagraph id="H7238F7E20644453DAC3CEA72BBADC695"><enum>(A)</enum><text>hold meetings not less frequently than quarterly; </text></subparagraph><subparagraph id="H156AEBEDF3624828B57091744E2D5E09"><enum>(B)</enum><text>invite representatives of nongovernmental organizations that provide services to immigrant children to participate in such meetings as the Ombudsperson considers appropriate; and </text></subparagraph><subparagraph id="HF4CE85FAF97F487981942562EB91673C"><enum>(C)</enum><text>provide to the Ombudsperson a summary of each such meeting.</text></subparagraph></paragraph></subsection></section><section id="H2DBD950C76E3493E9AF894B7B5895134"><enum>7.</enum><header>Rule of construction</header><text display-inline="no-display-inline">Nothing in the Act shall be construed to preclude or limit Flores settlement agreement class counsel from conducting independent investigations or seeking enforcement actions relating to violations of the Flores settlement agreement in any appropriate district court of the United States. </text></section></legis-body></bill>
