Davis of Illinois</cosponsor>, <cosponsor name-id="N000147">Ms. Norton</cosponsor>, <cosponsor name-id="S001168">Mr. Sarbanes</cosponsor>, and <cosponsor name-id="K000389">Mr. Khanna</cosponsor>) introduced the following bill; which was referred to the <committee-name committee-id="HGO00">Committee on Oversight and Reform</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To reauthorize the authority of the Merit Systems Protection Board, and for other purposes.</official-title></form><legis-body id="H6DB95C7B64104BFD9D7C81BC0482F2CA" style="OLC"><section id="H011A1E658817499AB080E1C3AD341FBC" section-type="section-one" commented="no"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Merit Systems Protection Board Empowerment Act of 2021</short-title></quote>. </text></section><section id="H83A00E35EB4D48008F520E2983E74CDE"><enum>2.</enum><header>Reauthorization of Merit Systems Protection Board</header><text display-inline="no-display-inline">Section 8(a)(1) of the Whistleblower Protection Act of 1989 (<external-xref legal-doc="usc" parsable-cite="usc/5/5509">5 U.S.C. 5509</external-xref> note) is amended by striking <quote>2003, 2004, 2005, 2006, and 2007</quote> and inserting <quote>2022, 2023, 2024, 2025, and 2026</quote>.</text></section><section id="H5F8B4542739747E1BA49555A95194A6E"><enum>3.</enum><header>Authorization of Federal employee surveys for merit systems studies</header><text display-inline="no-display-inline">Section 1204(e)(3) of title 5, United States Code, is amended by—</text><paragraph id="H9CB975F6C293440082B7F2BFE7FF5095" commented="no"><enum>(1)</enum><text display-inline="yes-display-inline">striking <quote>(3) In carrying</quote> and inserting <quote>(3)(A) In carrying</quote>; and</text></paragraph><paragraph id="H545D72843FA34CEFA1D21217E97023F9" commented="no"><enum>(2)</enum><text display-inline="yes-display-inline">adding at the end the following:</text><quoted-block style="OLC" id="H8D93FEBA253343C8A4EC8265B8B6308E" display-inline="no-display-inline"><subparagraph id="H346BF809656B46D2828C020B1A4F9E67" indent="up2" commented="no"><enum>(B)</enum><text>The Office of Personnel Management and other agencies shall—</text><clause id="H8A58E4D0E19546838DC486CBDA19B2D5" commented="no"><enum>(i)</enum><text>provide assistance to the Board to facilitate the conduct by the Board of surveys of employees; and</text></clause><clause id="HF12CF9F2E66B44F39CCBF2692DB0060D" commented="no"><enum>(ii)</enum><text>upon request, unless otherwise prohibited by law, provide to the Board records and information concerning applicants for Federal employment.</text></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section id="HC11E3A6B4E3A437190FBB24EC1431F7B"><enum>4.</enum><header>Whistleblower training for MSPB administrative judges</header><text display-inline="no-display-inline">Section 7701(b)(1) of title 5, United States Code, is amended to read as follows:</text><quoted-block style="OLC" id="H7344DAC8C18947BA91823903AF8E977A" display-inline="no-display-inline"><paragraph id="HF62522F307D141A199791202756103B6" commented="no"><enum>(1)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="HF374FF12905D4E30966C1CA2A3FD146D"><enum>(A)</enum><text>The Board may hear any case appealed to it or may refer the case to an administrative law judge appointed under section 3105 or other employee of the Board designated by the Board to hear such cases, except that any case involving—</text><clause id="HEDA6B24BE4ED4F4F8D16BC99557D223F" indent="up1" commented="no"><enum>(i)</enum><text>a removal from the service shall be heard by the Board, an employee experienced in hearing appeals, or an administrative law judge; and</text></clause><clause id="HD20E9F57DC1A4B5FAC1F9F81DDA3184A" indent="up1" commented="no"><enum>(ii)</enum><text display-inline="yes-display-inline">an alleged prohibited personnel practice in violation of section 2302(b)(8), section 2302(b)(9)(A)(i), (B), (C), or (D), or section 2302(b)(13) shall be heard by the Board or an administrative law judge or other employee of the Board designated by the Board to hear such cases who has successfully completed training regarding protections afforded by the Whistleblower Protection Act of 1989.</text></clause></subparagraph><subparagraph id="H8C61EB597F5A4886AE95DE6C88B8A7F2" indent="up1" commented="no"><enum>(B)</enum><text>The Board, administrative law judge, or other employee (as the case may be) shall make a decision after receipt of the written representations of the parties to the appeal and after opportunity for a hearing under subsection (a)(1) of this section. A copy of the decision shall be furnished to each party to the appeal and to the Office of Personnel Management. </text></subparagraph></paragraph><after-quoted-block>. </after-quoted-block></quoted-block></section></legis-body></bill>
