which was referred to the <committee-name committee-id="HFA00">Committee on Foreign Affairs</committee-name>, and in addition to the Committees on <committee-name committee-id="HJU00">the Judiciary</committee-name>, <committee-name committee-id="HBA00">Financial Services</committee-name>, <committee-name committee-id="HWM00">Ways and Means</committee-name>, <committee-name committee-id="HPW00">Transportation and Infrastructure</committee-name>, and <committee-name committee-id="HGO00">Oversight and Reform</committee-name>, for a period to be subsequently determined by the Speaker, in each case for consideration of such provisions as fall within the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To impose sanctions with respect to individuals associated with the Government of the Russian Federation who are complicit in the poisoning and repression of citizens of the Russian Federation for political motives, and for other purposes.</official-title></form><legis-body id="HFBAD32891DF040B2B9AEA87A19780DAA" style="OLC"><section section-type="section-one" id="H236BE56D72614F96BC599ECDFA1EE14F"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Holding Russia Accountable for Malign Activities Act of 2021</short-title></quote>.</text></section><section id="HDEFAADCEF6354EBAA229C5B7D8425D45"><enum>2.</enum><header>Imposition of sanctions with respect to the poisoning of opposition leader Alexei Navalny</header><subsection id="H492EDD2907054019A577C43DF5E4B2C3"><enum>(a)</enum><header>Identification</header><text display-inline="yes-display-inline">Not later than 90 days after the date of the enactment of this Act, the President shall submit to Congress a report identifying any current or former official of, or other individual acting for or on behalf of, the Government of the Russian Federation that the President determines was involved in the poisoning on August 20, 2020, of Russian opposition leader Alexei Navalny or the subsequent cover-up of the poisoning.</text></subsection><subsection id="HC28C8746B8464B26945F8D35263C6562"><enum>(b)</enum><header>Imposition of sanctions</header><text>With respect to each official or other individual identified in the report required by subsection (a), the President shall impose sanctions under the Global Magnitsky Human Rights Accountability Act (subtitle F of title XII of <external-xref legal-doc="public-law" parsable-cite="pl/114/328">Public Law 114–328</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/22/2656">22 U.S.C. 2656</external-xref> note) or the following sanctions:</text><paragraph id="HBA456D6E79EE470BB854D5F905F64B12"><enum>(1)</enum><header>Asset blocking</header><text>The President shall exercise all of the powers granted to the President under the International Emergency Economic Powers Act (<external-xref legal-doc="usc" parsable-cite="usc/50/1701">50 U.S.C. 1701</external-xref> et seq.) to the extent necessary to block and prohibit all transactions in property and interests in property of the official or other individual identified in the report required by subsection (a) if such property and interests in property are in the United States, come within the United States, or are or come within the possession or control of a United States person.</text></paragraph><paragraph id="H885B82DF7EE54FE1863D579F0AC43B2C"><enum>(2)</enum><header>Ineligibility for visas, admission, or parole</header><subparagraph id="H574F490A07A2491EB2C8F1D0FA46654A"><enum>(A)</enum><header>Visas, admission, or parole</header><text>An alien identified in the report required by subsection (a) is—</text><clause id="H98BC39A4D6584C8EBCC0105BF0DB0234"><enum>(i)</enum><text>inadmissible to the United States;</text></clause><clause id="H630D857BF7EF4EC984B4F7783908D2DE"><enum>(ii)</enum><text>ineligible to receive a visa or other documentation to enter the United States; and</text></clause><clause id="HD962D1C59D914F60956E8D9D17418BCB"><enum>(iii)</enum><text>otherwise ineligible to be admitted or paroled into the United States or to receive any other benefit under the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101</external-xref> et seq.).</text></clause></subparagraph><subparagraph id="H03C512F312EE40BE8B23139322055D2E"><enum>(B)</enum><header>Current visas revoked</header><clause id="H93D759AD68F947C6A78D4CDCDAF66A9E"><enum>(i)</enum><header>In general</header><text>An alien identified in the report required by subsection (a) is subject to revocation of any visa or other entry documentation regardless of when the visa or other entry documentation is or was issued.</text></clause><clause id="HEDEE31497C8043FF9383EC490B8899C3"><enum>(ii)</enum><header>Immediate effect</header><text>A revocation under clause (i) shall—</text><subclause id="HD281EFBE92C44804832202344C881BB0"><enum>(I)</enum><text>take effect immediately; and</text></subclause><subclause id="H77B8A4C6F5D84B828DF2D3499F748C7C"><enum>(II)</enum><text>cancel any other valid visa or entry documentation that is in the alien’s possession.</text></subclause></clause></subparagraph></paragraph></subsection><subsection id="H8ED9846E236C40B4AC2BE12669647090"><enum>(c)</enum><header>Waiver; exceptions; implementation of sanctions</header><paragraph id="HE4B71E68181C4061BF40E9E184D3BDAE"><enum>(1)</enum><header>Implementation; penalties</header><subparagraph id="H1DCB3EF647A34A1D867C5E9E7D8AFCC7"><enum>(A)</enum><header>Implementation</header><text>The President may exercise all authorities provided under sections 203 and 205 of the International Emergency Economic Powers Act (<external-xref legal-doc="usc" parsable-cite="usc/50/1702">50 U.S.C. 1702</external-xref> and 1704) to the extent necessary to carry out this section.</text></subparagraph><subparagraph id="H76B771498538449084557A950BBD7911"><enum>(B)</enum><header>Penalties</header><text>A person that violates, attempts to violate, conspires to violate, or causes a violation of subsection (b)(1), or any regulation, license, or order issued to carry out that subsection, shall be subject to the penalties set forth in subsections (b) and (c) of section 206 of the International Emergency Economic Powers Act (<external-xref legal-doc="usc" parsable-cite="usc/50/1705">50 U.S.C. 1705</external-xref>) to the same extent as a person that commits an unlawful act described in subsection (a) of that section.</text></subparagraph></paragraph><paragraph commented="no" id="HF52963B5BDEC4C888674D23C5359371B"><enum>(2)</enum><header>National security waiver</header><text>The President may waive the application of sanctions under this section with respect to a person if the President determines and certifies to Congress that such a waiver is in the national security interests of the United States.</text></paragraph><paragraph id="H2D4DAC34147B418394B546BF420576AF"><enum>(3)</enum><header>Exceptions</header><subparagraph id="H19D436F9C1674DFCA2456C35886CE823"><enum>(A)</enum><header>Exception for intelligence activities</header><text>Sanctions under this section shall not apply to any activity subject to the reporting requirements under title V of the National Security Act of 1947 (<external-xref legal-doc="usc" parsable-cite="usc/50/3091">50 U.S.C. 3091</external-xref> et seq.) or any authorized intelligence activities of the United States.</text></subparagraph><subparagraph id="H85A54E4756C54E7EB4553984BB25E2B2"><enum>(B)</enum><header>Exception to comply with international obligations</header><text>Sanctions under subsection (b)(2) shall not apply with respect to an alien if admitting or paroling the alien into the United States is necessary to permit the United States to comply with the Agreement regarding the Headquarters of the United Nations, signed at Lake Success June 26, 1947, and entered into force November 21, 1947, between the United Nations and the United States, or other applicable international obligations.</text></subparagraph><subparagraph id="H183D4F93B8DB40D1A4B4A9DC53AB89AF"><enum>(C)</enum><header>Exception relating to the importation of goods</header><clause id="H222E6B5C48754D3F892FFADC45CD75ED"><enum>(i)</enum><header>In general</header><text>The authorities and requirements to impose sanctions authorized under this section shall not include the authority or a requirement to impose sanctions on the importation of goods.</text></clause><clause id="H5D20D3FAA0AC44E3A6C23337A4682ECF"><enum>(ii)</enum><header>Good defined</header><text>In this subparagraph, the term <term>good</term> means any article, natural or manmade substance, material, supply, or manufactured product, including inspection and test equipment, and excluding technical data. </text></clause></subparagraph></paragraph></subsection><subsection id="H3EE6CB44BFD646F1A129D3AE47569798"><enum>(d)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this section:</text><paragraph id="H93F981D1D08A4592AF477BE8C62828CA"><enum>(1)</enum><header>Admission; admitted; alien</header><text>The terms <term>admission</term>, <term>admitted</term>, and <term>alien</term> have the meanings given those terms in section 101 of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101</external-xref>).</text></paragraph><paragraph id="HF1F9DECEAD39477B99F905F0D263DB2C"><enum>(2)</enum><header>United states person</header><text>The term <term>United States person</term> means—</text><subparagraph id="HD5122D8A151340F18F1C65279F4BBC2F"><enum>(A)</enum><text>an individual who is a United States citizen or an alien lawfully admitted for permanent residence to the United States;</text></subparagraph><subparagraph id="HC0D5229DDC7B46C09AC8099559F98DF7"><enum>(B)</enum><text>an entity organized under the laws of the United States or any jurisdiction within the United States, including a foreign branch of such an entity; or</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H680BC57D768848D1A3540E94F3EB4B75"><enum>(C)</enum><text>any person in the United States. </text></subparagraph></paragraph></subsection></section><section id="H305CCD12155C4E6380EB90199CBFA8DA"><enum>3.</enum><header>Report on the assassination of Boris Nemtsov</header><text display-inline="no-display-inline">Not later than 180 days after the date of the enactment of this Act, the Secretary of State, in coordination with the Director of National Intelligence, shall submit to Congress a report detailing the circumstances of the assassination on February 27, 2015, of Russian opposition leader Boris Nemtsov, including—</text><paragraph id="H9ECB313208754F52BF1D859E9A86956E"><enum>(1)</enum><text>a list of the individuals the Secretary determines to have been involved in the assassination as perpetrators or as having organized or directed the assassination;</text></paragraph><paragraph id="HADE89B5FCA094C0F9CFC21A307EF5502"><enum>(2)</enum><text>a description of what measures, if any, have been taken by the Government of the Russian Federation to investigate the assassination and bring the individuals described in paragraph (1) to justice; and</text></paragraph><paragraph id="H25684D1203324362878D20D5A864A3BA"><enum>(3)</enum><text>an assessment of the effectiveness of those measures. </text></paragraph></section><section id="H6332F46C0384444487C5B9178A8D37F5"><enum>4.</enum><header>Report on personal wealth of Vladimir Putin and his family members</header><subsection id="H9CEED67F939F412FBCBE510FDA878CD9"><enum>(a)</enum><header>In general</header><text>Not later than 180 days after the date of the enactment of this Act, the President shall submit to Congress a report on the sources and extent of the personal wealth of the President of the Russian Federation, Vladimir Putin, and his family members.</text></subsection><subsection id="H4B07B75BD6FA4744A6568BA762FD4E3A"><enum>(b)</enum><header>Personal wealth</header><text>The report required by subsection (a) shall include an assessment of the assets, investments, bank accounts, other business interests, and relevant beneficial ownership information of Vladimir Putin and his family members.</text></subsection><subsection id="HB05E12BD40C34195BEB4DFD8B542DB86"><enum>(c)</enum><header>Form</header><text>The report required by subsection (a) shall be submitted in unclassified form but may include a classified annex.</text></subsection></section><section id="HA43A5813E4F7481AB5CDB83145D8F525"><enum>5.</enum><header>Diplomatic engagement with Germany with respect to support for Nord Stream 2 pipeline</header><text display-inline="no-display-inline">It is the sense of Congress that the Secretary of State should urge the Government of Germany to withdraw its support for the Nord Stream 2 gas pipeline from the Russian Federation, emphasizing the impropriety of involvement in a project that will support a government that murders its citizens for highlighting corruption and other abuses, while at the same making Europe more reliant on the destabilizing and untrustworthy leadership of the Russian Federation.</text></section><section id="HDC6953207FDC48D185D76F5B39D23902"><enum>6.</enum><header>Sense of Congress on imposition of additional sanctions relating to recent use of Novichok in the Russian Federation</header><text display-inline="no-display-inline">It is the sense of Congress that the President should—</text><paragraph id="H2C8CC557B0A44FDBB7D467CF4437A58B"><enum>(1)</enum><text display-inline="yes-display-inline">make a determination under section 306(a) of the Chemical and Biological Weapons Control and Warfare Elimination Act of 1991 (<external-xref legal-doc="usc" parsable-cite="usc/22/5604">22 U.S.C. 5604(a)</external-xref>) with respect to whether the recent use of Novichok on August 20, 2020, against Russian opposition leader Alexei Navalny by the Government of the Russian Federation constituted the use of chemical or biological weapons in violation of international law or the use of lethal chemical or biological weapons against its own nationals as described in that section; and </text></paragraph><paragraph id="HAEEED520BF0940BBA80A9994CAE508D0"><enum>(2)</enum><text display-inline="yes-display-inline">if the President makes an affirmative determination under paragraph (1), impose the sanctions required by section 307 of that Act (<external-xref legal-doc="usc" parsable-cite="usc/22/5605">22 U.S.C. 5605</external-xref>).</text></paragraph></section><section id="H29F1C90768B9490893428416E8C39159"><enum>7.</enum><header>Calling for release of Alexei Navalny and other political prisoners from politically motivated detention</header><subsection id="H65E027E29F13450F8451AC495A8E4EBC"><enum>(a)</enum><header>Sense of Congress</header><text display-inline="yes-display-inline">It is the sense of Congress that authorities of the Government of the Russian Federation detained opposition leader Alexei Navalny on false charges when he returned to Moscow on January 17, 2021, after receiving treatment for Novichok poisoning in Germany.</text></subsection><subsection id="H839449E2165E4F0B963E8EC7E9355911"><enum>(b)</enum><header>Calling for release of political prisoners</header><text display-inline="yes-display-inline">Congress calls on the Government of the Russian Federation to immediately release Navalny and all other political prisoners in the Russian Federation currently imprisoned for exercising their fundamental rights. </text></subsection></section></legis-body></bill>
