<section id="HD9379225DC89433FB4A591EC5FB1E40A" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Opioid Patients’ Right to Know Act of 2021</short-title></quote>.</text></section> <section id="H93E3DD17004B470785BB624648CFF500"><enum>2.</enum><header>Grant program to inform patients about the risks of opioids and their analogues</header><text display-inline="no-display-inline">Part J of title III of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/280b">42 U.S.C. 280b</external-xref> et seq.) is amended by inserting after section 392A (<external-xref legal-doc="usc" parsable-cite="usc/42/280b-1">42 U.S.C. 280b–1</external-xref>) the following:</text>

<section id="H8363049C63564D50B73F138069A21D1D"><enum>392B.</enum><header> Grant program to inform patients about the risks of opioids and their analogues</header> 
<subsection id="HFA7A409FA81C4B88AEB83D37B73C421B"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary, acting through the Director of the Centers for Disease Control and Prevention, shall award one grant (over the life of the program under this section) to each eligible State to inform covered health care providers about—</text> <paragraph id="H07736DACD0CD4B1F9FA7EE29C2C2667B"><enum>(1)</enum><text display-inline="yes-display-inline">the requirement of the State described in subsection (b); and</text></paragraph> 
<paragraph id="HE48F2181397043AAA29501F59DEE4516"><enum>(2)</enum><text>recommendations for safe opioid prescribing.</text></paragraph></subsection> <subsection id="H6B435791A21541C2BE4E1AF28203A190"><enum>(b)</enum><header>Eligibility</header><text>To be eligible to receive a grant under subsection (a), a State must have in effect a law or regulation requiring covered health care providers, before issuing a new prescription for a covered drug or analogue, to inform the patient involved, and the patient’s guardian if the patient has a guardian, about—</text> 
<paragraph id="H072861F9AA0A4A2C9BEA3D3C9E7539D9"><enum>(1)</enum><text>the risks of such covered drug or analogue;</text></paragraph> <paragraph id="H0CB80112FB4C4AE49F4558650A8C18BD"><enum>(2)</enum><text display-inline="yes-display-inline">the addictive qualities of such covered drug or analogue; and</text></paragraph> 
<paragraph id="H9EAEC95ECC734DC2A193265B51ECAC83"><enum>(3)</enum><text display-inline="yes-display-inline">non-opioid treatments to such covered drug or analogue, as appropriate.</text></paragraph></subsection> <subsection id="H715E91DA7D364AEB978BCA4F26278A1F"><enum>(c)</enum><header>Grant amount</header><text>The amount of a grant to a State under this section—</text> 
<paragraph id="H936180E25D194F1384504B4248BFFF73"><enum>(1)</enum><text>shall be greater than the amount of each grant to a State with a smaller number of covered health providers, as estimated by the Secretary;</text></paragraph> <paragraph id="HDD400DB3A9074D8E8B7FB721F05A2EFB"><enum>(2)</enum><text>shall not exceed $1,000,000; and</text></paragraph> 
<paragraph id="HB28E77FC78B44870ABB2565E15B29D36"><enum>(3)</enum><text>subject to the availability of funds, shall not be less than $750,000.</text></paragraph></subsection> <subsection id="H5E2A8B6C0D2942BA883E76D8D5C7AFD1"><enum>(d)</enum><header>Definitions</header><text display-inline="yes-display-inline">For purposes of this section:</text> 
<paragraph id="HC1C861FE38EF49CC9E66ECE7AA94A5FF"><enum>(1)</enum><header>Covered drug or analogue</header><text display-inline="yes-display-inline">The term <term>covered drug or analogue</term> means a drug that is or contains an opioid (as defined in section 102 of the Controlled Substances Act) or an analogue of an opioid.</text></paragraph> <paragraph id="HDC4244BE4444465C972FD85D7869BD1B"><enum>(2)</enum><header>Covered health care provider</header><text>The term <term>covered health care provider</term> means a health care provider who issues prescriptions for a covered drug or analogue for the relief of acute pain. </text></paragraph></subsection> 
<subsection id="H5EA609D83BA84D68A41B682E2E4AF48A"><enum>(e)</enum><header>Authorization of appropriations</header><text display-inline="yes-display-inline">There is authorized to be appropriated to carry out this section $10,000,000 for each of fiscal years 2022 through 2031.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section> </legis-body></bill>
