which was referred to the <committee-name committee-id="HJU00">Committee on the Judiciary</committee-name>, and in addition to the Committees on <committee-name committee-id="HVR00">Veterans' Affairs</committee-name>, and <committee-name committee-id="HAS00">Armed Services</committee-name>, for a period to be subsequently determined by the Speaker, in each case for consideration of such provisions as fall within the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To establish a military family immigration advisory committee, and for other purposes.</official-title></form><legis-body id="H2C89EF7288234A42B952F26EEEF4359A" style="OLC"><section id="H6D79B378DBE24D71A795C796470706F9" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Honoring the Oath Act of 2021</short-title></quote>.</text></section><section id="H5137A43F70CD4B20B48F0231899DC20A"><enum>2.</enum><header>Sense of Congress</header><text display-inline="no-display-inline">It is the sense of Congress that—</text><paragraph id="HFF089FBC1747460088232D6F53CAA590"><enum>(1)</enum><text>military service to the United States is a sacrifice that demonstrates loyalty to the Nation;</text></paragraph><paragraph id="H6BC6B81ECB6B44C48C605951D09477E3"><enum>(2)</enum><text>a noncitizen who takes an oath of enlistment or an oath of office to join the United States Armed Forces—promising to support and defend the Constitution of the United States against all enemies, foreign and domestic—deserves facilitated access to naturalization;</text></paragraph><paragraph id="H36B829DA968149B1B7A333B6C41ABA9C"><enum>(3)</enum><text>such noncitizen and his or her family members deserve consideration for the exercise of prosecutorial discretion in immigration removal proceedings; and</text></paragraph><paragraph id="HF3FF33898A144B469CC46A7470BB5CF3"><enum>(4)</enum><text>a noncitizen veteran who is deported after consideration under this Act should be provided the same veterans’ benefits to which a similarly situated United States citizen veteran would be entitled.</text></paragraph></section><section id="H867042961C97440AB75FB3743F40D3BE"><enum>3.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph id="H3EEAEA32D49C47A785C20884EFDD595D"><enum>(1)</enum><header>Advisory Committee</header><text>The term <term>Advisory Committee</term> means the Military Family Immigration Advisory Committee established pursuant to section 5.</text></paragraph><paragraph id="H31EA1387D49540259B496546CE6475E2"><enum>(2)</enum><header>Appropriate congressional committees</header><text>The term <term>appropriate congressional committees</term> means—</text><subparagraph id="HF0E96228E6644366BC16E2B460856A83"><enum>(A)</enum><text>the Committee on Armed Services of the Senate;</text></subparagraph><subparagraph id="H54CCC52212764233B51BC1200CBDDC55"><enum>(B)</enum><text>the Committee on Homeland Security and Governmental Affairs of the Senate;</text></subparagraph><subparagraph id="H212BA62F8D8A4BDD9890F0EBFBB01D5E"><enum>(C)</enum><text>the Committee on the Judiciary of the Senate;</text></subparagraph><subparagraph id="H949EAF617BA14AFFADF42F44CD343A7E"><enum>(D)</enum><text>the Committee on Veterans’ Affairs of the Senate;</text></subparagraph><subparagraph id="H106D5BBF9F30406EA6A338D9D11C05D1"><enum>(E)</enum><text>the Committee on Armed Services of the House of Representatives;</text></subparagraph><subparagraph id="H87ACCF3F5F35436792926DDF7E55B4BB"><enum>(F)</enum><text>the Committee on Homeland Security of the House of Representatives;</text></subparagraph><subparagraph id="H2724D43F2116438E82F823EFA3E526F9"><enum>(G)</enum><text>the Committee on the Judiciary of the House of Representatives; and</text></subparagraph><subparagraph id="HDF3574DC19A44228B34584A7D7AFE140"><enum>(H)</enum><text>the Committee on Veterans’ Affairs of the House of Representatives.</text></subparagraph></paragraph><paragraph id="H18475D82B6234A3895D62610A6D64F55"><enum>(3)</enum><header>Armed Forces</header><text>The term <term>Armed Forces</term> has the meaning given that term in section 101 of title 10, United States Code.</text></paragraph><paragraph id="H9FB1967D6519455B9D53F24CE55672F8"><enum>(4)</enum><header>Covered family member</header><text>The term <term>covered family member</term> means the noncitizen spouse or noncitizen minor child of—</text><subparagraph id="H5FBC972D1BBA42B9AC3735DDF0945D0E"><enum>(A)</enum><text>a member of the Armed Forces serving on active duty or in a reserve component; or</text></subparagraph><subparagraph id="HC067E4ED563B479D81291342714A4E0B"><enum>(B)</enum><text>a veteran, as defined in paragraph (4).</text></subparagraph></paragraph><paragraph id="HA747B5C30EA54CD8B630DF4D16A626D1"><enum>(5)</enum><header>Noncitizen</header><text display-inline="yes-display-inline">The term <term>noncitizen</term> means an individual who is not a national of the United States (as defined in section 101(a)(22) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101(a)(22)</external-xref>)).</text></paragraph><paragraph id="HB5617932996C49EF9EFD544D68E5BB15"><enum>(6)</enum><header>Veteran</header><text display-inline="yes-display-inline">The term <term>veteran</term> has the meaning given that term in section 101 of title 38, United States Code.</text></paragraph></section><section id="H2E1EDAF6E19A4724B15CDC8CE70C2059"><enum>4.</enum><header>Identification of members of the Armed Forces, veterans, and covered family members in removal proceedings</header><subsection id="H7D6868CC73DF4EDB92A7A604A81B9649"><enum>(a)</enum><header>In general</header><text>Not later than the time of the Master Calendar Hearing for any individual in removal proceedings, the Director of U.S. Immigration and Customs Enforcement shall identify whether the individual is—</text><paragraph id="H371C162B93694826AB8A6BABB2659C04"><enum>(1)</enum><text>a member of the Armed Forces serving on active duty or in a reserve component;</text></paragraph><paragraph id="H848B54DD980C41548A209459725A7C49"><enum>(2)</enum><text>a veteran; or</text></paragraph><paragraph id="HF3202EFF9E8D419788717E5C3D743B39"><enum>(3)</enum><text>a covered family member.</text></paragraph></subsection><subsection id="HF1381B7BB0354345B9A03C22B38DBF54"><enum>(b)</enum><header>Transfer of case files</header><text>The Director of U.S. Immigration and Customs Enforcement shall transfer a copy of the complete case file of any individual identified under subsection (a), immediately after such identification, to the Advisory Committee.</text></subsection><subsection id="H5A5016B5D1124AB18B18DD956CD96D72"><enum>(c)</enum><header>Limitation on removal</header><text display-inline="yes-display-inline">Notwithstanding any other provision of law, an individual described in subsection (a) may not be removed until the Military Family Immigration Advisory Committee has provided recommendations with respect to that individual to the Secretary of Homeland Security and the Attorney General under section 5.</text></subsection></section><section id="H78BF5502BCBC446BA1ED990DFDA4F58C"><enum>5.</enum><header>Military family immigration advisory committee</header><subsection id="HBD5734CB28984C829FC6D2E084E14FC3"><enum>(a)</enum><header>Establishment</header><text>The Secretary of Homeland Security, in consultation with the Secretary of Defense and in cooperation with the Secretary of the Army, the Secretary of the Navy, the Secretary of the Air Force, and the Commandant of the Coast Guard, shall establish an advisory committee, to be known as the <quote>Military Family Immigration Advisory Committee</quote>, to provide recommendations to the Secretary of Homeland Security and the Attorney General on the exercise of prosecutorial discretion in cases involving removal proceedings of individuals described in section 4(a).</text></subsection><subsection id="H77D3AAE3DF344F0A922A6915F9A04A4C"><enum>(b)</enum><header>Membership</header><text>The Advisory Committee shall be composed of—</text><paragraph id="H44BDA6D0F7324E6C982FDCAAC56003F6"><enum>(1)</enum><text>the Deputy Commanding General of Army Human Resources Command, or designee;</text></paragraph><paragraph id="H34056EA36842433291E28D8EC17043F0"><enum>(2)</enum><text>the Judge Advocate of the Army, or designee;</text></paragraph><paragraph id="HB485544C11D6487DB9E7BBC2AFB009C2"><enum>(3)</enum><text>the Deputy Commander of Navy Personnel Command, or designee;</text></paragraph><paragraph id="HFC7345595E1B454386357B9A47416A80"><enum>(4)</enum><text>the Judge Advocate of the Navy, or designee;</text></paragraph><paragraph id="H67DE461F4AAE4922BCA71CF6E2F90536"><enum>(5)</enum><text>the Vice Chief of Staff of the Air Force;</text></paragraph><paragraph id="H4386447B873C4D808BEDD269650A2FDD"><enum>(6)</enum><text>the Judge Advocate of the Air Force, or designee;</text></paragraph><paragraph id="H0683017767774BD787B542C7E0ED101F"><enum>(7)</enum><text>the Deputy Commandant for Mission Support of the Coast Guard;</text></paragraph><paragraph id="H582ACE7A1E1F4EBA8E3349CEAB935DA9"><enum>(8)</enum><text>the Judge Advocate of the Coast Guard, or designee; and</text></paragraph><paragraph id="H5438E7E325564CC583168296D3C3DD9A"><enum>(9)</enum><text>the Deputy Commandant of Manpower and Reserve Affairs of the Marine Corps, or designee.</text></paragraph></subsection><subsection id="H67C13416DAC14244A70373118FA2FEBE"><enum>(c)</enum><header>Case reviews</header><paragraph id="H11F4C7B680CA43FFB647B39F6359F4AC"><enum>(1)</enum><header>In general</header><text>Not later than 30 days after the Director of U.S. Immigration and Customs Enforcement notifies the Advisory Committee of the case of an individual described in section 4(a), the Advisory Committee shall meet to review the case and to provide a written recommendation to the Secretary of Homeland Security on whether the individual—</text><subparagraph id="HA07335456A3E476EB1EDD7C9F22964AD"><enum>(A)</enum><text>notwithstanding the grounds for removal asserted by U.S. Immigration and Customs Enforcement, should be granted—</text><clause id="H31D6F98DD4C34CF2B74D3B9AAAAA1825"><enum>(i)</enum><text>a stay of removal and allowed to apply for asylum;</text></clause><clause id="HF4C2CE062F2743039EC575F54BBD1134"><enum>(ii)</enum><text>deferred action; or</text></clause><clause id="H23D914BEC38B420D9B88E3FA6929807C"><enum>(iii)</enum><text>parole; or</text></clause></subparagraph><subparagraph id="HAE2728D2C42A414E95BF733F2690887D"><enum>(B)</enum><text>should be removed from the United States.</text></subparagraph></paragraph><paragraph id="H613B6E35E45942598B6A34B1C0D1E899"><enum>(2)</enum><header>Submission of information</header><text>An individual who is the subject of a case review under paragraph (1) may submit information to the Advisory Committee, and the Advisory Committee shall consider such information.</text></paragraph><paragraph id="H3E96384C0BCD4DE78E30959869DE5F5D"><enum>(3)</enum><header>Procedures</header><text>In conducting each case review under paragraph (1), the Advisory Committee shall consider, as factors weighing in favor of a recommendation under paragraph (1)(A)—</text><subparagraph id="H1C3FBC741A4648A1B6D9224E5680A71D"><enum>(A)</enum><text>with respect to a member of the Armed Forces serving on active duty or in a reserve component, whether the individual—</text><clause id="HE571D89D75BC4B04B97755E265665CD0"><enum>(i)</enum><text>took an oath of enlistment or an oath of office;</text></clause><clause id="HB90F829CB461425A89CC3A0AA05391A3"><enum>(ii)</enum><text>received military decorations, campaign medals, or service medals, was deployed, or was otherwise evaluated for merit in service during his or her service in the Armed Forces;</text></clause><clause id="HBA0BE1366A594A98BB779FBD6054AA4A"><enum>(iii)</enum><text>is a national of a country that prohibits repatriation of an individual after any service in the Armed Forces; or</text></clause><clause id="H1ADE7B3C485A4A639BE5990761E81506"><enum>(iv)</enum><text>contributed to his or her local community during his or her service in the Armed Forces;</text></clause></subparagraph><subparagraph id="H09AAE738740F4A489375FC7CF85AB6E7"><enum>(B)</enum><text>with respect to a veteran, whether the individual—</text><clause id="H0F7C2E7903764C7DA9851503AA479D78"><enum>(i)</enum><text>took an oath of enlistment or an oath of office;</text></clause><clause id="H868602B67D424E6690A2E2C37C66DADC"><enum>(ii)</enum><text>completed a term of service in the Armed Forces and was discharged under conditions other than dishonorable;</text></clause><clause id="HF2029C5A568F440EBCA5C22A6E214279"><enum>(iii)</enum><text>received military decorations, campaign medals, or service medals, was deployed, or was otherwise evaluated for merit in service during his or her service in the Armed Forces;</text></clause><clause id="HAA0A081E3C1442DEBD6EE287FDA4CAA5"><enum>(iv)</enum><text>is a national of a country that prohibits repatriation of an individual after any service in the Armed Forces; or</text></clause><clause id="H445B264BA4254C23B7D45FC1501D8D33"><enum>(v)</enum><text>contributed to his or her local community during or after his or her service in the Armed Forces; and</text></clause></subparagraph><subparagraph id="H850E43B73CC44D6C9E87375DD9FFA7FB"><enum>(C)</enum><text>with respect to a covered family member, whether the individual—</text><clause id="H6FD86424395E4A3489144ABAB779C249"><enum>(i)</enum><text>supported a member of the Armed Forces serving on active duty or a veteran, including through financial support, emotional support, or caregiving; or</text></clause><clause id="HB6F5E73E011344A8AC341BC78B1927B5"><enum>(ii)</enum><text>contributed to his or her local community during or after the military service of the member or of the veteran.</text></clause></subparagraph></paragraph></subsection><subsection id="H52D61651FACB4B73A4E69CA346527F19"><enum>(d)</enum><header>Consultation with U.S. Immigration and Customs Enforcement principal legal advisor</header><text>The Principal Legal Advisor of U.S. Immigration and Customs Enforcement, or designee, shall consult with the Advisory Committee at the request of members of the Advisory Committee.</text></subsection><subsection id="HCE8453989D424043AEC52D2B933FD5C7"><enum>(e)</enum><header>Briefings on unsuitability of noncitizen members of the Armed Forces</header><text>The Under Secretary of Defense for Personnel and Readiness shall provide detailed briefings to the Advisory Committee regarding the reasons for determining the unsuitability of noncitizen members of the Armed Forces whose cases are being considered by the Advisory Committee.</text></subsection><subsection id="H4F453987DF6D4B20BE994A9C8C3ECF12"><enum>(f)</enum><header>Briefings on actions in response to recommendations</header><text>Not less frequently than quarterly, the Secretary of Homeland Security shall provide detailed briefings to the Advisory Committee regarding actions taken in response to the recommendations of the Advisory Committee, including detailed explanations for any cases in which a recommendation of the Advisory Committee was not followed.</text></subsection><subsection id="HEBA84549EB4E4E3DA788600FC877B63A"><enum>(g)</enum><header>Authorization of appropriations</header><text>There is authorized to be appropriated such sums as may be necessary to carry out this section.</text></subsection></section><section id="H78AE50DC5547431989330B378C6A0039"><enum>6.</enum><header>List of countries unwilling to repatriate United States veterans</header><text display-inline="no-display-inline">The Secretary of Homeland Security, in consultation with the Secretary of State, shall compile and annually update a list of countries that refuse to repatriate nationals of such country who have enlisted or been appointed in the United States Armed Forces.</text></section><section id="H1809551FCB2B462F9A4BA680BDB0B649"><enum>7.</enum><header>Program of citizenship through military service</header><subsection id="H1ABA4400BB2446A5823178FAB4BB4898"><enum>(a)</enum><header>In general</header><text>The Secretary of Homeland Security, acting through the Director of U.S. Citizenship and Immigration Services, and the Secretary of Defense shall jointly carry out a program under which any individual noncitizen who serves on active duty in the Armed Forces, and the noncitizen spouse and any noncitizen minor child of such individual, shall be naturalized as a United States citizen if such individual, and such spouse or child, is not otherwise ineligible for citizenship under the immigration laws (as that term is defined in section 101(a)(17) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101(a)(17)</external-xref>)).</text></subsection><subsection id="H795BD5722C7F42F89397D6B229A57732"><enum>(b)</enum><header>Jag training</header><text>The Secretary of Defense shall ensure that appropriate members of the judge advocate general corps of the Armed Forces shall receive training to function as liaisons with U.S. Citizenship and Immigration Services with respect to applications for citizenship of noncitizen members of the Armed Forces assigned to units in such areas.</text></subsection><subsection id="H6451CEF0695E4264AED92186A52B43A3"><enum>(c)</enum><header>Training for recruiters</header><text>The Secretary of Defense shall ensure that all recruiters in the Armed Forces receive training regarding—</text><paragraph id="H82058D6F7C004D199219124821094A00"><enum>(1)</enum><text>the steps required for a noncitizen member of the Armed Forces to receive citizenship;</text></paragraph><paragraph id="HC4C2F1E7FEBB47FBBF4600B13F94F05D"><enum>(2)</enum><text>limitations on the path to citizenship for family members of such individuals; and</text></paragraph><paragraph id="HE7EC56CED562478E9977391F4B491BF2"><enum>(3)</enum><text>points of contact at the Department of Homeland Security to resolve emergency immigration-related situations with respect to such individuals and their family members.</text></paragraph></subsection><subsection id="H23A54A77C88343959A52D17DA77B0EC0"><enum>(d)</enum><header>Application for naturalization</header><paragraph id="H8617D577C8D543DD8F08970C8DD5A623"><enum>(1)</enum><header>Biometrics</header><subparagraph id="HD64D2B05F9604DCABC234F1563F66DC3"><enum>(A)</enum><header>Submission of biometric information</header><text>The Secretary of Defense shall ensure that, at the time of accession into the Armed Forces, biometric information of an individual who has applied, or who plans to apply, for naturalization is submitted to U.S. Citizenship and Immigration Services for the purposes of such application.</text></subparagraph><subparagraph id="H26F71CA31C20447B89A13AE50289CA56"><enum>(B)</enum><header>Acceptance of biometric information</header><text>The Director of U.S. Citizenship and Immigration Services shall accept any biometric information submitted pursuant to subparagraph (A).</text></subparagraph></paragraph><paragraph id="H0DF11933B6E64ABF8F0062C512EB6856"><enum>(2)</enum><header>Filing of application</header><text>The Secretary of Homeland Security, in coordination with the Secretary of Defense, shall ensure that each noncitizen individual who accesses into the Armed Forces is permitted to file an application for naturalization as part of the accessions process.</text></paragraph><paragraph id="H26F1AD3EB2D748AE913780C7C29CE398"><enum>(3)</enum><header>Adjudication of application</header><text>The Secretary of Homeland Security, in coordination with the Secretary of Defense, shall ensure that the application for naturalization of any individual who applies for naturalization during the accessions process into the Armed Forces is adjudicated not later than the last day of active service of the individual in the Armed Forces.</text></paragraph></subsection><subsection id="HE6A3A249E071460AA13EB8DD2399B730"><enum>(e)</enum><header>Annual reports</header><text>The Secretary of each military department shall annually submit to the appropriate congressional committees a report on the number of all noncitizens who enlisted or were appointed in their department, all members of the Armed Forces in their department who naturalized, and all members of the Armed Forces in their department who were discharged or released without United States citizenship under the jurisdiction of such Secretary during the preceding year.</text></subsection></section><section id="H2AA7DA83318A47DABE9BECC7074A28DA"><enum>8.</enum><header>Study and report on noncitizen veterans removed from the United States</header><subsection id="H6D1986F3C4104CEBB82B44751ACA87A3"><enum>(a)</enum><header>Study required</header><text>Not later than 1 year after the date of the enactment of this Act, the Secretary of Defense, the Secretary of Homeland Security, and the Secretary of Veterans Affairs shall jointly carry out a study on noncitizen veterans of the Armed Forces who were removed from the United States during the period beginning on January 1, 1990, and ending on the date of the enactment of this Act, which shall include—</text><paragraph id="H7E112D0C226F49C9A5556716AEA453B1"><enum>(1)</enum><text>the number of noncitizens removed by U.S. Immigration and Customs Enforcement or the Immigration and Naturalization Service during the period covered by the report who served on active duty in the Armed Forces or in a reserve component of the Armed Forces for a period of more than 180 days;</text></paragraph><paragraph id="HC6F78405A84D4E4F9EC710BF1203B70A"><enum>(2)</enum><text>for each noncitizen described in paragraph (1)—</text><subparagraph id="HA73F1176FE6E4486B73C161DDF1187F3"><enum>(A)</enum><text>the country of origin of the noncitizen;</text></subparagraph><subparagraph id="HCA283C35F7CC431381376BDD6AC4AF63"><enum>(B)</enum><text>the length of time the noncitizen served as a member of the Armed Forces;</text></subparagraph><subparagraph id="H2D1656E48B1C4ACCA703E209BEF3E069"><enum>(C)</enum><text>the grounds for removal under section 237(a) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1227">8 U.S.C. 1227</external-xref>) or section 212(a) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1182">8 U.S.C. 1182</external-xref>), as applicable; and</text></subparagraph><subparagraph id="H3D8AA28D17544C1292A2C58C093D9582"><enum>(D)</enum><text>whether the noncitizen appealed the removal order;</text></subparagraph></paragraph><paragraph id="H414300E5403546DA8A21CF4133E61141"><enum>(3)</enum><text>the number of noncitizens described in paragraph (1) who—</text><subparagraph id="HBE833AE512E44FB6B4691A794F915700"><enum>(A)</enum><text>were discharged or released from service under honorable conditions;</text></subparagraph><subparagraph id="H2CC4776092B845D58EAE06AF7C8BC175"><enum>(B)</enum><text>were deployed overseas;</text></subparagraph><subparagraph id="HF686CFA7B75946F19770CDB54EAD0B1B"><enum>(C)</enum><text>served on active duty in the Armed Forces in an overseas contingency operation;</text></subparagraph><subparagraph id="H68ABC04BE2D7415182FEC8BF7AB5BB6B"><enum>(D)</enum><text>were awarded military decorations, campaign medals, or service medals;</text></subparagraph><subparagraph id="HDC88FA774C6349718516B7B7D9C26C13"><enum>(E)</enum><text>applied for benefits under laws administered by the Secretary of Veterans Affairs; or</text></subparagraph><subparagraph id="H552DA099B496414C9592654AC6B90C8B"><enum>(F)</enum><text>are receiving benefits described in subparagraph (E); and</text></subparagraph></paragraph><paragraph id="H853E38D054E94519ACAF3AD97010DB49"><enum>(4)</enum><text>a description of the reasons preventing any of the noncitizens who applied for benefits described in paragraph (3)(E) from receiving such benefits.</text></paragraph></subsection><subsection id="H6D49686F1A9F49648272B44BB3C5577A"><enum>(b)</enum><header>Report</header><text>Not later than 90 days after the date of the completion of the study required under subsection (a), the Secretary of Defense, the Secretary of Homeland Security, and the Secretary of Veterans Affairs shall jointly submit a report containing the results of such study to the appropriate congressional committees.</text></subsection></section></legis-body></bill>
