R. 1181</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20210218">February 18, 2021</action-date><action-desc><sponsor name-id="T000472">Mr. Takano</sponsor> introduced the following bill; which was referred to the <committee-name committee-id="HJU00">Committee on the Judiciary</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To ensure due process protections of individuals in the United States against unlawful detention based solely on a protected characteristic.</official-title></form><legis-body id="HB6360FAFDFEB4024AA3F0D53C459B182" style="OLC"><section id="H3B55ADA148694E56B81A827BB9140221" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Korematsu-Takai Civil Liberties Protection Act of 2021</short-title></quote>.</text></section><section id="HA3A28CF6C414458EBB91C4EA09961638"><enum>2.</enum><header>Prohibition against unlawful detention</header><text display-inline="no-display-inline">Section 4001 of title 18, United States Code, is amended—</text><paragraph id="HAA18B8212364485AA519BC7E4D32A166"><enum>(1)</enum><text display-inline="yes-display-inline">by redesignating subsection (b) as subsection (c); and</text></paragraph><paragraph id="H5643B2E7D00945019F14428E0950C89D"><enum>(2)</enum><text>by inserting after subsection (a) the following:</text><quoted-block display-inline="no-display-inline" id="H686211C10C9B4D8485BFBEAFEB7D1E56" style="USC"><subsection id="H835C646D73B44CA7833597A58C5E7789"><enum>(b)</enum><header>Prohibition on detention based on protected characteristics</header><paragraph id="H48A67FEBA1EC48389EB2D4F528AD23F8"><enum>(1)</enum><header>In general</header><text>No individual may be imprisoned or otherwise detained based solely on an actual or perceived protected characteristic of the individual.</text></paragraph><paragraph id="H4D4F0DCF1E9D493CA198E3582DBDA53F"><enum>(2)</enum><header>Definition</header><text>In this subsection, the term <term>protected characteristic</term> includes each of the following:</text><subparagraph id="H1A56D740878949B5994C2F628C99B0F0"><enum>(A)</enum><text>Race.</text></subparagraph><subparagraph id="HBDA68D2D32C64309BEE51E04AB1987D7"><enum>(B)</enum><text>Ethnicity.</text></subparagraph><subparagraph id="H749565105263461695C7C65242DD695F"><enum>(C)</enum><text>National origin.</text></subparagraph><subparagraph id="H32F06509C24547DC88A9F9FCBD0D6CB7"><enum>(D)</enum><text>Religion.</text></subparagraph><subparagraph id="H61F2A026688D4FDA9B59C027BB83D1F9"><enum>(E)</enum><text>Sex.</text></subparagraph><subparagraph id="HA4E5548F82714074A2AF7E195F8522DE"><enum>(F)</enum><text>Gender identity.</text></subparagraph><subparagraph id="H3267A404E9884E9E9A6600DE3B82FF63"><enum>(G)</enum><text>Sexual orientation.</text></subparagraph><subparagraph id="HD5FBA2A4EAAA4A9DB5B6B21E27118637"><enum>(H)</enum><text>Disability.</text></subparagraph><subparagraph id="H9CD9AE82DC74441AA86154FF2D31E39A"><enum>(I)</enum><text>Any additional characteristic that the Attorney General determines to be a protected characteristic.</text></subparagraph></paragraph><paragraph id="H5C51CA7E2A1343DF92EBACA7B31CBF6D"><enum>(3)</enum><header>Rule of construction</header><text>Nothing in this subsection shall be construed to allow the Attorney General to remove a characteristic described in subparagraphs (A) through (H) of paragraph (2) from the definition of the term <term>protected characteristic</term> under this subsection.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section></legis-body></bill>
