R. 1160</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20210218">February 18, 2021</action-date><action-desc><sponsor name-id="M001210">Mr. Murphy of North Carolina</sponsor> (for himself, <cosponsor name-id="R000597">Mr. Rice of South Carolina</cosponsor>, <cosponsor name-id="T000165">Mr. Tiffany</cosponsor>, and <cosponsor name-id="B001305">Mr. Budd</cosponsor>) introduced the following bill; which was referred to the <committee-name committee-id="HED00">Committee on Education and Labor</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the Higher Education Act of 1965 to improve protections against foreign influence at institutions of higher education, and for other purposes.</official-title></form><legis-body id="HF35FD16DBEE84AA7B4A5CF4D4F9B32B7" style="OLC"><section id="HB74E8485B8AA47339E6A01E6BA87C63D" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Intelligence on Nefarious Foreign Leaders Using Education Networks for Corrupt Enrichment Act</short-title></quote> or the <quote><short-title>INFLUENCE Act</short-title></quote>.</text></section><section id="H852C886BA348410EAF011A16EE4D08BC"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds the following:</text><paragraph id="HACAB8C79ECA5437C923F02DD688C6231"><enum>(1)</enum><text display-inline="yes-display-inline">Schools in the United States, especially institutions of higher education overseeing either sensitive research or critical military technology systems, have provided a level of access to the Chinese government that the Chinese government has refused to provide to the United States. </text></paragraph><paragraph id="HB802422660B64D97B07F74A629B18260"><enum>(2)</enum><text>China’s control over the flow of information means the American people have an incomplete picture of Chinese government actions and policies that run counter to the interest of the United States at home and abroad.</text></paragraph><paragraph id="H4A36CACB09624D8DB49FBE4198C57250"><enum>(3)</enum><text>In the last 15 years, the Chinese government has opened over 100 Confucius Institutes on college and university campuses in the United States to increase their cultural standing in popular culture. While there are currently more than 500 Confucius Institutes worldwide, the United States has more Confucius Institutes than any other country. </text></paragraph><paragraph id="H13AF790586684971960938AA7AF0F3A2"><enum>(4)</enum><text>Federal Government officials have expressed concerns about Confucius Institutes. Christopher Wray, Director of the Federal Bureau of Investigation, testified that the FBI is <quote>watching warily</quote> Confucius Institutes and <quote>in certain instances have developed appropriate investigative steps</quote>.</text></paragraph><paragraph id="H0D6406C426A3427C889AF9B6D31CE707"><enum>(5)</enum><text>The Department of Education has not conducted regular oversight of the compliance of institutions of higher education with foreign gift reporting requirements and, until recently, has failed to adequately enforce the requirements of section 117 of the Higher Education Act of 1965 (relating to disclosures of foreign gifts). The Department of Education maintains a database detailing the reporting of foreign gifts received by institutions, but relies solely on the institutions to self-report gifts.</text></paragraph><paragraph id="H52B2D4F99E644170A93D25C1751F7C8B"><enum>(6)</enum><text>The Department of Education is updating the reporting requirements applicable to institutions of higher education. Previously, the Department of Education had not issued guidance on foreign gift reporting by institutions of higher education since 2004. As a result, institution’s informed Congress that the reporting requirements were unclear and confusing. Institutions also informed Congress that the Department of Education website used to report foreign gifts was dated and difficult to use.</text></paragraph><paragraph id="H608EA3C48C4C4837A0A0C6533D450B2D"><enum>(7)</enum><text>Absent full transparency regarding how Confucius Institutes operate and full reciprocity for the cultural outreach efforts of the United States on college campuses in China, Confucius Institutes should not continue in the United States unchecked or unsupervised.</text></paragraph></section><section id="HFEBC38DE3C8F4A66B15368393F7DECA5"><enum>3.</enum><header>Enhanced disclosure of certain foreign gifts and contracts</header><text display-inline="no-display-inline">Section 117 of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1011f">20 U.S.C. 1011f</external-xref>) is amended—</text><paragraph id="H80B53D01BFAC497DA24B8F912C6F1EF7"><enum>(1)</enum><text>by amending subsection (a) to read as follows:</text><quoted-block style="OLC" id="H76F49BE1339D414984DB62384F3C9066" display-inline="no-display-inline"><subsection id="HCA1C982E18C3486C87C65DE9CC03541E"><enum>(a)</enum><header>Disclosure report</header><text display-inline="yes-display-inline">An institution shall file a disclosure report with the Secretary on January 31 or July 31, whichever is sooner, whenever one or more of the following occurs:</text><paragraph id="H1B86BD28EDA84C6782B0EB9A0B7C1A2F"><enum>(1)</enum><text>The institution is owned or controlled by a foreign source.</text></paragraph><paragraph id="H30BDEE6523444206A72E13D26CA86156"><enum>(2)</enum><text display-inline="yes-display-inline">The institution receives a gift from or enters into a contract with a foreign source determined by the Secretary to be acting directly or indirectly on behalf of a foreign government that is adversarial to the United States, regardless of the value of the gift or contract.</text></paragraph><paragraph id="HD631D3DB3CC6470D8869C8B6B92FDC05"><enum>(3)</enum><text>The institution receives a gift from or enters into a contract with a foreign source not described in paragraph (2), the value of which is—</text><subparagraph id="H4F382895BD824C3DB4433FA965EAB06B"><enum>(A)</enum><text>$50,000 considered alone; or</text></subparagraph><subparagraph id="HC290F00E63E94A8B92DE40F130BFA13F"><enum>(B)</enum><text>$100,000 or more in combination with all other gifts from or contracts with that foreign source within a calendar year.</text></subparagraph></paragraph></subsection><after-quoted-block>;</after-quoted-block></quoted-block></paragraph><paragraph id="HF30BE45641814A95A1E7FA66F037D850"><enum>(2)</enum><text>by amending subsection (e) to read as follows:</text><quoted-block style="OLC" id="HE6C0F27491CE4CF992F2FE994B09081A" display-inline="no-display-inline"><subsection id="H791DC9D13E9641319C75BE85B4A9D5E5"><enum>(e)</enum><header>Public availability of information</header><paragraph id="H2F6FDBD499674895A2026EF7FE82EFF2"><enum>(1)</enum><header>Public inspection</header><text display-inline="yes-display-inline">Subject to paragraph (4), all disclosure reports required by this section shall be public records open to inspection and copying during business hours.</text></paragraph><paragraph id="H4A808A5E8AFC43699C261E9B2756738F"><enum>(2)</enum><header>Publication by Department of Education</header><text display-inline="yes-display-inline">Not later than 180 days after the date of enactment of the INFLUENCE Act, and on an annual basis thereafter, the Secretary of Education shall make available, on a publicly accessible website of the Department of Education, a database of the information disclosed to the Secretary under this section during the preceding year.</text></paragraph><paragraph id="H7A46838265E041649DAAC6C75CD9E828"><enum>(3)</enum><header>Publication by institutions</header><text display-inline="yes-display-inline">Not later than 180 days after the date of enactment of the INFLUENCE Act, and on an annual basis thereafter, each institution that receives a gift or enters into a contract described in subsection (a) shall make available, on a publicly accessible website of the institution—</text><subparagraph id="H9FA1DEC458B54342BC4C4BFB6702F457"><enum>(A)</enum><text display-inline="yes-display-inline">in the case of a gift described in such subsection, a detailed explanation of the gift, including the amount of the gift, identification of the source of the gift, and any conditions or restrictions on the gift; and</text></subparagraph><subparagraph id="H2ABA27B874784560953313839997721C"><enum>(B)</enum><text>in the case of a contract described in such subsection, a complete and accurate copy of the contract.</text></subparagraph></paragraph><paragraph id="H8B2696BCEB7E47509C29EF1036EBA559"><enum>(4)</enum><header>Restriction on publication of sensitive information</header><subparagraph id="H615E97101A134FD7BBB6E00A621DC29D"><enum>(A)</enum><header>In general</header><text>Information made publicly available under this section shall not include information that is determined by an institution to be confidential, proprietary, or otherwise prohibited from disclosure by law.</text></subparagraph><subparagraph id="H7B1E2594A0F5490087FB8747A011E15A"><enum>(B)</enum><header>Enforcement authority</header><text display-inline="yes-display-inline">If the Secretary determines that an institution of higher education willfully or negligently disclosed information that is confidential, proprietary, or otherwise prohibited from disclosure by law in violation of subparagraph (A), the Secretary may declare such institution ineligible to participate in programs authorized under title IV of this Act.</text></subparagraph></paragraph></subsection><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph id="HC952CD677F814D159F72F07639A06D75"><enum>(3)</enum><text>in subsection (f)(2), by inserting before the period at the end the following: <quote>, in addition to any other amounts as determined appropriate by the Secretary of Education</quote>. </text></paragraph></section><section id="HF90121420CB8416E85D60BA203A4938C"><enum>4.</enum><header>Foreign involvement in sensitive projects</header><text display-inline="no-display-inline">The Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1001">20 U.S.C. 1001</external-xref> et seq.) is further amended by inserting after section 117 the following:</text><quoted-block style="OLC" id="HFF40648A14214225973FDF55A610BA29" display-inline="no-display-inline"><section id="H0B9BA45592A24618B90FFB208820B24C"><enum>117a.</enum><header>Requirements for certain foreign contracts</header><subsection id="H19C56CF7AA104704AC536BEDCEA0CD77"><enum>(a)</enum><header>Foreign involvement in sensitive projects</header><paragraph id="H1999DC24EF7D401F94C912691FF0B774"><enum>(1)</enum><header>In general</header><text>In a case in which an institution enters into a contract with a foreign individual under which the individual will participate in a sensitive project—</text><subparagraph id="HAA26505566894C6BB3BD562A4FA6483E"><enum>(A)</enum><text>the institution shall disclose to the Secretary—</text><clause id="H000E1691775E44B6A3CB8B5CE2B37F49"><enum>(i)</enum><text>the date on which individual is expected to return to their home country; and</text></clause><clause id="H710B7EA87E274C0A879CD8EC6C7A1D04"><enum>(ii)</enum><text>and the name of the country to which the individual is expected to return; and</text></clause></subparagraph><subparagraph id="H9C29FB44594549B1A864A2C7D2FF4535"><enum>(B)</enum><text>such contract shall provide—</text><clause id="H9F70F095ACEA4A80BE2DAFE9ECA5B0AB"><enum>(i)</enum><text>that the individual may not disclose information derived from such project to a foreign government or any other foreign entity; and</text></clause><clause id="H41E7488D03814DE3A261B789D2956210" commented="no"><enum>(ii)</enum><text display-inline="yes-display-inline">that the penalties for disclosure of such information shall be the cancellation of the contract and a requirement to reimburse the Federal Government as described in paragraph (2).</text></clause></subparagraph></paragraph><paragraph id="H0160EEED220F4B0BB836370BF700F751"><enum>(2)</enum><header>Liability for disclosure</header><text display-inline="yes-display-inline">A foreign individual who knowingly or willfully discloses information in violation of a contract under paragraph (1) shall be required to reimburse the Federal Government for the full costs of any investigation or administrative action resulting from such violation, in addition to any other amounts as determined appropriate by the Secretary.</text></paragraph></subsection><subsection id="HED38D5B920CE426B9421F7C0208C6F73"><enum>(b)</enum><header>China-Affiliated cultural or language program</header><text display-inline="yes-display-inline">In a case in which an institution enters into a contract with an individual or entity under which a China-affiliated cultural or language program will be allowed to operate at the institution, such contract—</text><paragraph id="H1F636AF36E0D4446BC681A86F3DFDC37"><enum>(1)</enum><text>shall include a provision protecting academic freedom at the institution; and</text></paragraph><paragraph id="H2EBE4CE22906445489692C226B60967B"><enum>(2)</enum><text>shall not include any provision that would limit the rights of an individual under the Constitution of the United States.</text></paragraph></subsection><subsection id="H56EC752E38B9484780241A4FD5FC7F60"><enum>(c)</enum><header>Definitions</header><text>In this section:</text><paragraph id="H49B11306E3E04C0B812F029032C5D610"><enum>(1)</enum><text>The term <term>China-affiliated cultural or language program</term> means any project, program, or other activity that—</text><subparagraph id="HACDBC345095745E598A5BB9A77CCA88E"><enum>(A)</enum><text>seeks to familiarize students with Chinese language or culture; and</text></subparagraph><subparagraph id="HDF4AD82B63A14BA9AAFF84CD5A9A16CD"><enum>(B)</enum><text>is directly or indirectly funded by the Government of the People’s Republic of China.</text></subparagraph></paragraph><paragraph id="H24FC058601374D75B5768BC51A8F58C6"><enum>(2)</enum><text>The term <term>sensitive project</term> means any project, program, or other activity carried out by an institution—</text><subparagraph id="H3C80BEFDB471436698BFF25BCB1466E3"><enum>(A)</enum><text display-inline="yes-display-inline">that is funded, in whole or in part, by Federal funds; and</text></subparagraph><subparagraph id="HF4282807C0D7472CACF49DB00031DEAC"><enum>(B)</enum><text>for which a security clearance is required as a condition of participation.</text></subparagraph></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="HC51973B8FE87406FAB259FD865204053" commented="no"><enum>5.</enum><header>Interagency coordination on enforcement of foreign gift and contract requirements</header><text display-inline="no-display-inline">The Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1001">20 U.S.C. 1001</external-xref> et seq.) is further amended by inserting after section 117a (as added by section 4) the following:</text><quoted-block style="OLC" id="HC46686612632418090BD05D81282622E" display-inline="no-display-inline"><section id="H4DA06B94028F4BBABA0C63CB6190A5AD"><enum>117b.</enum><header>Interagency coordination on enforcement of foreign gift and contract requirements</header><subsection id="H4F660E0133844EBFB9F6FAECCC56FA49"><enum>(a)</enum><header>Notification of violations</header><text display-inline="yes-display-inline">The Secretary of Education shall establish a process to notify appropriate Federal agencies of any violation of section 117 or section 117a.</text></subsection><subsection id="HAA4FE0431AE64B9AA97D64EC627816FB"><enum>(b)</enum><header>Consideration of enforcement action</header><text>After receiving notice of a violation under subsection (a), the head of the Federal agency that received such notice shall determine—</text><paragraph id="H4B304E93898D45D8BC026311AA916B99"><enum>(1)</enum><text>whether such violation constitutes a violation of a provision of law over which the agency has enforcement authority; and</text></paragraph><paragraph id="H650E8FB9301F4EC38A7DF7C689972072"><enum>(2)</enum><text>if such a violation occurred, whether to pursue an enforcement action against the individual or entity responsible for the violation.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="H4D174B4AE82B41DAA439F664D1AE3AAF"><enum>6.</enum><header>Reports</header><text display-inline="no-display-inline">Section 636 of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1132-5">20 U.S.C. 1132–5</external-xref>) is amended to read as follows:</text><quoted-block style="OLC" id="HA8A2AABF88F14B89A4529AB89D42D813" display-inline="no-display-inline"><section id="HEAF483ADDAC24E0C976CB3E73650F9C1"><enum>636.</enum><header>Report on foreign and national security issues affecting institutions of higher education</header><subsection id="H54AB6F01206549C092786229D79BEAD8"><enum>(a)</enum><header>Report required</header><text display-inline="yes-display-inline">On an annual basis, the Secretary of Education, in consultation and collaboration with the Secretary of State, the Secretary of Defense, the Director of National Intelligence, the Attorney General, and the heads of other relevant Federal agencies, shall submit to the authorizing committees a report on foreign and national security issues affecting institutions of higher education.</text></subsection><subsection id="HB03F0FE40CAC409B8E66B5E15EA57E20"><enum>(b)</enum><header>Elements</header><text>Each report under subsection (a) shall include—</text><paragraph id="H38C802B4CFBE42E29EF408788125E05D"><enum>(1)</enum><text>identification of areas of national need in foreign language, area, and international studies as such studies relate to government, education, business, and nonprofit needs and a plan to address those needs;</text></paragraph><paragraph id="HC3795943BDEF464D882CE9904ED746AD"><enum>(2)</enum><text display-inline="yes-display-inline">a description of any risks associated with allowing foreign students and other foreign individuals at institutions of higher education to access classified information, protected intellectual property, research and development information, and military technology critical to the national security of the United States;</text></paragraph><paragraph id="H05F9F81125484DE5909B3E52573C4B55"><enum>(3)</enum><text display-inline="yes-display-inline">best practices that may be implemented by the Department of Education, the Department of Defense, and other Federal agencies with responsibilities relating to national security to strengthen the secrecy of grants, projects, and contracts that involve providing foreign individuals at institutions of higher education with access to classified or sensitive information, including recommended enforcement actions to respond to the misuse of such information;</text></paragraph><paragraph id="H2B028C32D21745EC87FA0B8C2240A218"><enum>(4)</enum><text>a description of the ongoing efforts of Federal law enforcement organizations, including the Federal Bureau of Investigation, to address the theft of sensitive information by adversarial foreign actors; and</text></paragraph><paragraph id="H39530867148C4F488E2ED377F1ED7CBE"><enum>(5)</enum><text display-inline="yes-display-inline">a summary of any information from national security-related projects at institutions of higher education that was stolen, misused, or wrongfully disclosed during the period covered by the report and any actions taken to remedy the theft, misuse, or disclosure of such information.</text></paragraph></subsection><subsection id="HFF5C22DD16B2401D8A74397EA6063730"><enum>(c)</enum><header>Form of report</header><text display-inline="yes-display-inline">Each report under subsection (a) shall be submitted in unclassified form, but may include a classified annex.</text></subsection><subsection id="HA4702844B580405A8082ED2DA0D5FC57"><enum>(d)</enum><header>Public availability</header><text>The Secretary of Education shall make each report under subsection (a) available on a publicly accessible website of the Department of Education, except no report published on such website shall contain classified information.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section></legis-body></bill>
