<section id="H62923EABF6314832BD14AFE1CD458B68" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Facilitating the Deployment of Infrastructure with Greater Internet Transactions And Legacy Applications Act</short-title></quote> or the <quote><short-title>Facilitating DIGITAL Applications Act</short-title></quote>. </text></section> <section id="H554B8F3C1CB844FBB822F55C00C8B8B8" section-type="subsequent-section"><enum>2.</enum><header>Barriers to implementation of an online portal for Form 299</header> <subsection id="H6AB0F2C5319949F7AB1B1D31DE53906E"><enum>(a)</enum><header>Definitions</header><text>In this Act:</text> 
<paragraph id="HCD20FDDA618B4C9DACA9E7930C71CB62"><enum>(1)</enum><header>Appropriate committees of congress</header><text>The term <term>appropriate committees of Congress</term> means—</text> <subparagraph id="HBEFFE907A0F840DDA430B9C2A27043FB"><enum>(A)</enum><text>the Committee on Energy and Commerce of the House of Representatives;</text></subparagraph> 
<subparagraph id="H51C0CBDAFDAA4020BA5BCF92ED5AA6F3"><enum>(B)</enum><text>the Committee on Natural Resources of the House of Representatives;</text></subparagraph> <subparagraph id="H7D2FDCA2EA1B4C6F924D8A0CC22A9520"><enum>(C)</enum><text>the Committee on Commerce, Science, and Transportation of the Senate; and</text></subparagraph> 
<subparagraph id="H2060C29EAD834F2681F57C929E390004"><enum>(D)</enum><text>the Committee on Environment and Public Works of the Senate.</text></subparagraph></paragraph> <paragraph id="H7A2C69A553814BDD9E63C483EF6E1469"><enum>(2)</enum><header>Assistant secretary</header><text>The term <term>Assistant Secretary</term> means the Assistant Secretary of Commerce for Communications and Information.</text></paragraph> 
<paragraph id="HE6DBF93B752F46A386F05739721A481A"><enum>(3)</enum><header>Communications facility</header><text>The term <term>communications facility</term> includes—</text> <subparagraph id="H6B0DE3E08E064BCCA38A46F5C0C64FF6"><enum>(A)</enum><text>any infrastructure, including any transmitting device, tower, or support structure, and any equipment, switch, wiring, cabling, power source, shelter, or cabinet, associated with the licensed or permitted unlicensed wireless or wireline transmission of any writing, sign, signal, data, image, picture, and sound of any kind; and</text></subparagraph> 
<subparagraph id="H17A8EE4923A946B88D6FDC2DE249FEEE"><enum>(B)</enum><text>any antenna or apparatus that—</text> <clause id="HBDA36F00034C43189DCD99C0FE824EA1"><enum>(i)</enum><text>is designed for the purpose of emitting radio frequency;</text></clause> 
<clause id="H7F2171B750B0412BA0AEA858CF068D9A"><enum>(ii)</enum><text>is designed to be operated, or is operating, from a fixed location pursuant to authorization by the Commission or is using a duly authorized device that does not require an individual license; and</text></clause> <clause id="H6639558EF54046C0AD8D00EB262E471A"><enum>(iii)</enum><text>is added to a tower, building, or other structure.</text></clause></subparagraph></paragraph> 
<paragraph id="H8643FDBF65CB4103B46CEF80B8641296"><enum>(4)</enum><header>Communications use</header><text>The term <term>communications use</term> means the placement and operation of a communications facility.</text></paragraph> <paragraph id="H9E8E977FC39B40ED94980CD1A2751615"><enum>(5)</enum><header>Communications use authorization</header><text>The term <term>communications use authorization</term> means an easement, right-of-way, lease, license, or other authorization to locate or modify a communications facility on covered land by the Department concerned for the primary purpose of authorizing the occupancy and use of the covered land for communications use.</text></paragraph> 
<paragraph id="H89A449F0C3844E289BD3B7D00819FB03"><enum>(6)</enum><header>Covered land</header><text>The term <term>covered land</term> means—</text> <subparagraph id="H5AD7B55A7B9749CDB267947E95FD3E9B"><enum>(A)</enum><text>public land administered by the Secretary of the Interior; and</text></subparagraph> 
<subparagraph id="HC13A454F425A4B78A2ED4F170FC26566"><enum>(B)</enum><text>National Forest System land.</text></subparagraph></paragraph> <paragraph id="H66775C1CBD524FDE8A00A4B7DCB805C1"><enum>(7)</enum><header>Department concerned</header><text>The term <term>Department concerned</term> means the Department of the Interior or the Department of Agriculture.</text></paragraph> 
<paragraph id="H5E9737E3D5574773AC68D7DBDB244C2C"><enum>(8)</enum><header>Form <enum-in-header>299</enum-in-header></header><text display-inline="yes-display-inline">The term <term>Form 299</term> means the form established under section 6409(b)(2)(A) of the Middle Class Tax Relief and Job Creation Act of 2012 (<external-xref legal-doc="usc" parsable-cite="usc/47/1455">47 U.S.C. 1455(b)(2)(A)</external-xref>), or any successor form.</text></paragraph> <paragraph id="HC2614EE83B6A437AB46BFCC2F4DCFBE8"><enum>(9)</enum><header>Secretary concerned</header><text>The term <term>Secretary concerned</term> means—</text> 
<subparagraph id="HBF77173038874B50B97FF6A9C9F7B281"><enum>(A)</enum><text>the Secretary of the Interior, with respect to land administered by such Secretary; and</text></subparagraph> <subparagraph id="H30556938544348E0AFE3A8F4D702DD7B"><enum>(B)</enum><text>the Secretary of Agriculture, with respect to National Forest System land.</text></subparagraph></paragraph></subsection> 
<subsection id="H2FD02A6EC9894B1BA9A07D4E0F1A3399"><enum>(b)</enum><header>Barriers to implementation</header> 
<paragraph id="H6FB924B5630449089942A28BA37CCDE8"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 90 days after the date of enactment of this section, and every 60 days thereafter until the notification described in paragraph (2), the Assistant Secretary shall submit to the appropriate committees in Congress a report that—</text> <subparagraph id="H78AC4C661B454A2DB3D668E151CA71E1"><enum>(A)</enum><text>describes whether the Department concerned has established an online portal for the acceptance, processing, and disposal of a Form 299; and</text></subparagraph> 
<subparagraph id="H0EFE777A18974FF09247C8FCF9D43CBF"><enum>(B)</enum><text>describes any barrier to the establishment of an online portal for the acceptance, processing, and disposal of a Form 299.</text></subparagraph></paragraph> <paragraph id="H0F45A574D7644DB4ADF95227EDC11109" commented="no"><enum>(2)</enum><header>Notification described</header><text>The Secretary concerned shall notify the Assistant Secretary not later than 3 business days after the Department concerned has established an online portal for the acceptance, processing, and disposal of a Form 299. </text></paragraph></subsection></section>
