<section id="H1610ED0D592D432AA0FF9FA7A06B35FF" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Communities Overregulating Networks Need Economic Competition Today Act</short-title></quote> or the <quote><short-title>CONNECT Act</short-title></quote>.</text></section> <section id="H89AC86D9FFB4449F87EC593A42B99000"><enum>2.</enum><header>Prohibition on government owned broadband networks</header> <subsection id="HD668B8F092DA4474A48E47F9A1514621"><enum>(a)</enum><header>In general</header><text>Except as provided in subsections (b)(1) and (c), a State or political subdivision thereof may not provide or offer for sale to the public, a telecommunications provider, or to a commercial provider of broadband internet access service, retail or wholesale broadband internet access service.</text></subsection> 
<subsection id="H001424987CE24760AC82234D36180D53"><enum>(b)</enum><header>Transitional rule</header><text>Any State or political subdivision thereof providing or offering for sale, either to the public, a telecommunications provider, or to a provider of broadband internet access service, retail or wholesale broadband internet access service, before the date of the enactment of this section—</text> <paragraph id="H7D9D2C12E4C949AABB39E05AC65BEF18" commented="no"><enum>(1)</enum><text display-inline="yes-display-inline">notwithstanding subsection (a), may continue to provide or offer for sale such service if the Commission finds there is no more than one other commercial provider of broadband internet access that provides competition for that service in a particular area;</text></paragraph> 
<paragraph id="H37DFD0C11A8A4C9EAE9CA3A6ED05CC34"><enum>(2)</enum><text>shall notify each subscriber of the State or political subdivision if a commercial provider of retail broadband internet access enters the market; and</text></paragraph> <paragraph id="HDE4F08FC9CFF4156B45661A2AD7FBCF2"><enum>(3)</enum><text>may not construct or extend facilities used to deliver broadband internet access service beyond the geographic area in which the State or political subdivision thereof lawfully operates.</text></paragraph></subsection> 
<subsection id="HE8819650DCBA4CF395F7310DD4682490" commented="no"><enum>(c)</enum><header>Exception</header><text>Notwithstanding subsection (a), this section does not apply to the Tennessee Valley Authority. </text></subsection> <subsection id="H5BEB0F4DD39B42D59B6FEA6EAD92E4E2"><enum>(d)</enum><header>Rules of construction</header> <paragraph id="HD3557E8A91724B2CAE3D0ADA983B1F50"><enum>(1)</enum><header>In general</header><text>This section may not be construed to restrict a State or political subdivision thereof, from allowing the nondiscriminatory use of its rights-of-way, including access to utility poles, conduits, ducts, or similar support structures used for the deployment of facilities necessary to deliver broadband internet access service.</text></paragraph> 
<paragraph id="HAFB8EF2972C447EC82940A24C215CA6B"><enum>(2)</enum><header>Public safety</header><text display-inline="yes-display-inline">This section may not be construed to restrict a State or political subdivision thereof, from providing broadband facilities or services for 9–1–1, enhanced 9–1–1 service, or Next Generation 9–1–1.</text></paragraph></subsection> <subsection id="HF0CEBDC288BD40DE84105F429445B2C5"><enum>(e)</enum><header>Limitation of Commission authority</header><text>Notwithstanding any provision of law, including section 706 of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/706">47 U.S.C. 706</external-xref>), the Commission may not pre-empt State laws to permit a State or political subdivision thereof to provide or offer for sale to the public retail or wholesale broadband internet access service.</text></subsection> 
<subsection id="H5B7FAAC6ABF645909D1E51BC72B2C4CF"><enum>(f)</enum><header>Definitions</header><text>In this section:</text> <paragraph id="H978939967F7646C1A7C2A8D46A1EAC79"><enum>(1)</enum><header>9–1–1 request for emergency assistance</header><text>The term <term>9–1–1 request for emergency assistance</term> means a communication, such as voice, text, picture, multimedia, or any other type of data that is sent to an emergency communications center for the purpose of requesting emergency assistance.</text></paragraph> 
<paragraph id="HB7A884F9A88044C294186FEC2ED3FBD7"><enum>(2)</enum><header>Broadband internet access service</header><text display-inline="yes-display-inline">The term <term>broadband internet access service</term> has the meaning given that term in section 8.1(b) of title 47, Code of Federal Regulations, or any successor regulation.</text></paragraph> <paragraph id="HD2D2873A829447D195EB037BEE1793DF"><enum>(3)</enum><header>Commonly accepted standards</header><text>The term <term>commonly accepted standards</term> means—</text> 
<subparagraph id="H5DDD6D81ED35494295EEB4F6FF4F7DBD"><enum>(A)</enum><text>the technical standards followed by the communications industry for network, device, and Internet Protocol connectivity, including standards developed by the Third Generation Partnership Project, the Institute of Electrical and Electronics Engineers, the Alliance for Telecommunications Industry Solutions, the Internet Engineering Taskforce, and the International Telecommunications Union; and </text></subparagraph> <subparagraph id="H9B053C6280F942E6A68461F68A9ABEF4"><enum>(B)</enum><text>standards that are accredited by a recognized authority such as the American National Standards Institute.</text></subparagraph></paragraph> 
<paragraph id="H361E2DD1DB17433C9E7083CE7F248585"><enum>(4)</enum><header>Emergency communications center</header><text display-inline="yes-display-inline">The term <term>emergency communications center</term> means a facility that is designated to receive a 9–1–1 request for emergency assistance and perform one or more of the following functions: </text> <subparagraph id="HDE0D11C20F434E91B82125513D4223A6"><enum>(A)</enum><text>Process and analyze 9–1–1 requests for emergency assistance and other gathered information. </text></subparagraph> 
<subparagraph id="HA19414FE713D4EA797204F5CDC542D05"><enum>(B)</enum><text>Dispatch appropriate emergency response providers. </text></subparagraph> <subparagraph id="H011DA61E2C714454819E2DA1E933B124"><enum>(C)</enum><text>Transfer or exchange 9–1–1 requests for emergency assistance and other gathered information with other emergency communications centers and emergency response providers. </text></subparagraph> 
<subparagraph id="HB3467CABDF694C9E9AE476440D92FBAD"><enum>(D)</enum><text>Analyze any communications received from emergency response providers. </text></subparagraph> <subparagraph id="H2B4CDFE08AE74BC4884DD57976C95D6F"><enum>(E)</enum><text>Support incident command functions.</text></subparagraph></paragraph> 
<paragraph id="HC21AFBEEDE114BABBF60E2A53186E90A"><enum>(5)</enum><header>Emergency response provider</header><text display-inline="yes-display-inline">The term <term>emergency response provider</term>—</text> <subparagraph id="H9084EAEAC56D480B9655961A986703AB"><enum>(A)</enum><text>has the meaning given that term under section 2 of the Homeland Security Act (<external-xref legal-doc="usc" parsable-cite="usc/47/101">47 U.S.C. 101</external-xref>); and</text></subparagraph> 
<subparagraph id="HBBC7C79700134011974D5EE2EE0206DB"><enum>(B)</enum><text>includes Federal, State, and local governmental and nongovernmental emergency public safety, fire, law enforcement, emergency response, emergency medical (including hospital emergency facilities), and related personnel, agencies, and authorities.</text></subparagraph></paragraph> <paragraph id="H87B10AE5EE284EBFB59BB399D27F2397"><enum>(6)</enum><header>Enhanced 9–1–1 service</header><text display-inline="yes-display-inline">The term <term>enhanced 9–1–1 service</term> has the meaning given that term in section 7(10) of the Wireless Communications and Public Safety Act of 1999 (<external-xref legal-doc="usc" parsable-cite="usc/47/615b">47 U.S.C. 615b(10)</external-xref>).</text></paragraph> 
<paragraph id="H9E966BB1572A4792BBFF18153F487E3C"><enum>(7)</enum><header>Interoperable</header><text display-inline="yes-display-inline">The term <term>interoperable</term> means the capability of emergency communications centers to receive 9–1–1 requests for emergency assistance and related data such as location information and callback numbers from the public, then process and share the 9–1–1 requests for emergency assistance and related data with other emergency communications centers and emergency response providers, regardless of jurisdiction, equipment, device, software, service provider, or other relevant factors, and without the need for proprietary interfaces.</text></paragraph> <paragraph id="H778D81988E1143D6BB10E6136A3DCBD6"><enum>(8)</enum><header>Next Generation 9–1–1</header><text display-inline="yes-display-inline">The term <term>Next Generation 9–1–1</term> means an interoperable, secure, Internet Protocol-based system that—</text> 
<subparagraph id="H19BAFCC82DDC497EAD1D5E57A0F03B51"><enum>(A)</enum><text>employs commonly accepted standards; </text></subparagraph> <subparagraph id="H90C0392AD3FA4DAD9F5AD1B143E8A272"><enum>(B)</enum><text>enables the appropriate emergency communications centers to receive, process, and analyze all types of 9–1–1 requests for emergency assistance;</text></subparagraph> 
<subparagraph id="HC6C598FA280B4EE4BD7F9F6A189B0AAF"><enum>(C)</enum><text>acquires and integrates additional information useful to handling 9–1–1 requests for emergency assistance; and </text></subparagraph> <subparagraph id="H5CB2B436B19249B5B52A1808D38C914D"><enum>(D)</enum><text>supports sharing information related to 9–1–1 requests for emergency assistance among emergency communications centers and emergency response providers.</text></subparagraph></paragraph> 
<paragraph id="H9DAE7FB1C8B8435B9A84FD212FD83483" commented="no"><enum>(9)</enum><header>State</header><text display-inline="yes-display-inline">The term <term>State</term> means any State of the United States, the District of Columbia, Puerto Rico, American Samoa, Guam, the United States Virgin Islands, the Northern Mariana Islands, and any other territory or possession of the United States. </text></paragraph> <paragraph id="H9FCC3A66EDCB48CFA5A5736A690EE027"><enum>(10)</enum><header>Telecommunications provider</header><text display-inline="yes-display-inline">The term <term>telecommunications provider</term> means an eligible telecommunications carrier as designated under section 214(e)(2) of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/214">47 U.S.C. 214(e)(2)</external-xref>).</text></paragraph></subsection></section>
