which was referred to the <committee-name committee-id="HBA00">Committee on Financial Services</committee-name>, and in addition to the Committees on <committee-name committee-id="HJU00">the Judiciary</committee-name>, and <committee-name committee-id="HWM00">Ways and Means</committee-name>, for a period to be subsequently determined by the Speaker, in each case for consideration of such provisions as fall within the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the Truth in Lending Act to modify obligations relating to private education loans due to the disability of a cosigner or borrower of the loan, to amend title 11 of the United States Code to make student loans dischargeable, and for other purposes.</official-title></form><legis-body id="H2A1F7FE246D948AEB2A3FCE3FB737D51" style="OLC"><section id="H9902386E6A3E401B804947A9F131FC8C" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Lenders Offer Assistance Now Act</short-title></quote> or the <quote><short-title>LOAN Act</short-title></quote>.</text></section><section id="HA3FDB485F9B94F5B8847AC306046EE63" section-type="subsequent-section"><enum>2.</enum><header>Disability of a cosigner or a borrower of a private education loan</header><subsection id="H1EB881EB8FC8448CBE78ED91D5D03426"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 140(g) of the Truth in Lending Act (<external-xref legal-doc="usc" parsable-cite="usc/15/1650">15 U.S.C. 1650(g)</external-xref>) is amended—</text><paragraph id="H9D96217562D1443BB82635F42F05B641"><enum>(1)</enum><text>in paragraph (1), by striking <quote>bankruptcy or death</quote> and inserting <quote>bankruptcy, death, or disability</quote>; and</text></paragraph><paragraph id="H4561172004ED421BB2AB0E71F4E2A6B1"><enum>(2)</enum><text>by adding at the end the following new paragraphs:</text><quoted-block style="OLC" id="H6CACE059F1374A148B83D3502D22BC96" display-inline="no-display-inline"><paragraph id="HD998B6E17BA24FB3B28352368E8FA5BF"><enum>(3)</enum><header>Discharge in case of disability</header><text display-inline="yes-display-inline">A lender that extends a private education loan shall discharge the student obligor’s liability on the loan if a student obligor experiences a disability. </text></paragraph><paragraph id="H828626F72B354F98ABA2FA15CFF30A59"><enum>(4)</enum><header>Disability defined</header><text display-inline="yes-display-inline">In this subsection, the term <term>disability</term> means a permanent and total disability, as determined in accordance with the regulations of the Secretary of Education under section 437(a) of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1087">20 U.S.C. 1087(a)</external-xref>), or a determination by the Secretary of Veterans Affairs that the individual is unemployable due to a service-connected condition.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="HB1094781B1F74A0887E770B03614E962" commented="no"><enum>(b)</enum><header>Tax treatment of discharge</header><text><external-xref legal-doc="usc" parsable-cite="usc/26/108">Section 108(f)(5)(A)</external-xref> of the Internal Revenue Code of 1986 is further amended by striking <quote>or</quote> in clause (ii), by redesignating clause (iii) as clause (iv), and by inserting after clause (ii) the following new clause:</text><quoted-block id="H2AD145B11983453BB246998CED08C3C3" style="OLC"><clause id="H708915DDBCDE4E049FBCEEBCAF942E9B" commented="no"><enum>(iii)</enum><text>pursuant to paragraph (3) of section 140(g) of the Truth in Lending Act, or</text></clause><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H5E03A392C1974439950C517A6E34D9C2" commented="no"><enum>(c)</enum><header>Impact on certain programs</header><text display-inline="yes-display-inline">Discharge of a private education loan due to disability of a borrower under paragraph (3) of section 140(g) of the Truth in Lending Act, as added by subsection (a), shall not be regarded as income and shall not be regarded as a resource for purposes of determining the eligibility of the borrower of such loan (or the borrower’s spouse or family) for benefits or assistance, or the amount or extent of benefits or assistance, under any Federal program or under any State or local program financed in whole or in part with Federal funds.</text></subsection><subsection id="H8FCA23B7579E4987AA5A144ABFC2746A"><enum>(d)</enum><header>Applicability</header><text display-inline="yes-display-inline">The amendments made by this section shall apply to private education loan agreements entered into on or after the date that is 180 days after the date of enactment of this Act.</text></subsection><subsection id="H59C5611B96D046D5951B02D833441EEB"><enum>(e)</enum><header>Private education loan defined</header><text display-inline="yes-display-inline">In this section, the term <term>private education loan</term> has the meaning given in section 140(a) of the Truth in Lending Act (<external-xref legal-doc="usc" parsable-cite="usc/15/1650">15 U.S.C. 1650(a)</external-xref>).</text></subsection></section><section id="HF9EB8D5654EC44B386A61A2C17ECA23D"><enum>3.</enum><header>Exception to discharge</header><subsection id="HB00289A9F7E04616AA446723868C8CDE"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 523(a) of title 11, United States Code, is amended—</text><paragraph id="H224C21A0A90A4214BE4581B4EDC87C42"><enum>(1)</enum><text>by striking paragraph (8); and</text></paragraph><paragraph id="HE06C70DAAA2345109D19ABB098464F31"><enum>(2)</enum><text>by redesignating paragraphs (9) through (14B) as paragraphs (8) through (14A), respectively.</text></paragraph></subsection><subsection id="HC0047077F61D4AB2B52B6C0DCDFEDD16"><enum>(b)</enum><header>Conforming amendments</header><text>Title 11, United States Code, is amended—</text><paragraph id="H098E5BC2F3264E67837C7C14D6558253"><enum>(1)</enum><text display-inline="yes-display-inline">in section 704(c)(1)(C)(iv)(I) by striking <quote>(14A)</quote> and inserting <quote>(14)</quote>;</text></paragraph><paragraph id="HA2F5F54B662C47C69A429D7A048F781E"><enum>(2)</enum><text display-inline="yes-display-inline">in section 1106(c)(1)(C)(iv)(I) by striking <quote>(14A)</quote> and inserting <quote>(14)</quote>;</text></paragraph><paragraph id="H6E4687B7BBA5444BA13BB8BE79E08466"><enum>(3)</enum><text display-inline="yes-display-inline">in section 1202(c)(1)(C)(iv)(I) by striking <quote>(14A)</quote> and inserting <quote>(14)</quote>; and</text></paragraph><paragraph id="HDE160E8CF4E341CA87746C28635A7971"><enum>(4)</enum><text>in section 1328(a)(2) by striking <quote>(8), or (9)</quote> and inserting <quote>or (8)</quote>.</text></paragraph></subsection><subsection id="H06298578F0E34B228D6398F8376F81C8" display-inline="no-display-inline"><enum>(c)</enum><header>Effective date; application of amendments</header><paragraph id="HAA51902C6A8745A88604F034B7F7A238"><enum>(1)</enum><header>Effective date</header><text display-inline="yes-display-inline">Except as provided in paragraph (2), this section and the amendments made by this section shall take effect on the date of the enactment of this Act.</text></paragraph><paragraph id="H50B076680DD2430CA5063EF703D63F8E"><enum>(2)</enum><header>Application of amendments</header><text display-inline="yes-display-inline">The amendments made by this section shall apply only with respect to cases commenced under title 11 of the United States Code on or after the date of the enactment of this Act.</text></paragraph></subsection></section></legis-body></bill>
