R. 1141</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20210218">February 18, 2021</action-date><action-desc><sponsor name-id="J000302">Mr. Joyce of Pennsylvania</sponsor> introduced the following bill; which was referred to the <committee-name committee-id="HIF00">Committee on Energy and Commerce</committee-name>, and in addition to the Committee on <committee-name committee-id="HII00">Natural Resources</committee-name>, for a period to be subsequently determined by the Speaker, in each case for consideration of such provisions as fall within the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To provide that a project for the collocation of a telecommunications service facility is not subject to requirements to prepare certain environmental or historical preservation reviews.</official-title></form><legis-body id="H0C22F2475F8A4F4283308DCF174B641E" style="OLC"><section id="HFD106E50CCA2463D90741CDB0B8D6433" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Broadband Competition and Efficient Deployment Act</short-title></quote>.</text></section><section id="H2F08B461B9F74ACE962327774E761410"><enum>2.</enum><header>Application of NEPA and NHPA to collocation of telecommunications service facilities</header><subsection id="HA1C42D3A86AC436DB77819610FD0BCAD"><enum>(a)</enum><header>NEPA exemption</header><text display-inline="yes-display-inline">A covered project shall not be subject to the requirements of section 102(2)(C) of the National Environmental Policy Act of 1969 (<external-xref legal-doc="usc" parsable-cite="usc/42/4332">42 U.S.C. 4332(2)(C)</external-xref>).</text></subsection><subsection id="H9916665163814E4F919710BCA4F774F2"><enum>(b)</enum><header>National Historic Preservation Act exemption</header><text display-inline="yes-display-inline">A covered project shall not be considered an undertaking under section 300320 of title 54, United States Code.</text></subsection><subsection id="H5F65F2B29E3041D99038FE7F2913D672"><enum>(c)</enum><header>Definitions</header><text>In this section: </text><paragraph id="H1E8932A2483C41A8BD929FFEC5EEBB4F"><enum>(1)</enum><header>Commission</header><text>The term <term>Commission</term> means the Federal Communications Commission. </text></paragraph><paragraph id="HC9A71BDB9CAB470798DA4138AAB2B456" commented="no"><enum>(2)</enum><header>Covered project</header><text display-inline="yes-display-inline">The term <term>covered project</term> means a project—</text><subparagraph id="H9136F92F95284AA09FB401FD1D471C0D" commented="no"><enum>(A)</enum><text>for the placement, construction, or modification of a telecommunications service facility in or on eligible support infrastructure; and</text></subparagraph><subparagraph id="H15AFA1D302F34433815656C56238AFF4"><enum>(B)</enum><text display-inline="yes-display-inline">for which a permit, license, or approval from the Commission is required or that is otherwise subject to the jurisdiction of the Commission.</text></subparagraph></paragraph><paragraph id="H44665E95A30742DABBA8A53ABF6F9FE5"><enum>(3)</enum><header>Eligible support infrastructure</header><text>The term <term>eligible support infrastructure</term> means infrastructure that supports or houses a facility for communication by wire (or is designed to and capable of supporting or housing such a facility) at the time when a complete request to a State or local government or instrumentality thereof for authorization to place, construct, or modify a telecommunications service facility in or on the infrastructure is received by the government or instrumentality.</text></paragraph><paragraph id="H9B29BD96A0A140B183D55484EF9BCFCD" commented="no"><enum>(4)</enum><header>State</header><text display-inline="yes-display-inline">The term <term>State</term> means the 50 States, the District of Columbia, the territories and possessions of the United States, and each federally recognized Indian Tribe.</text></paragraph><paragraph id="HFB9AA0008B5647928FDC981337D95EAD"><enum>(5)</enum><header>Telecommunications service</header><text>The term <term>telecommunications service</term> has the meaning given such term in section 3 of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/153">47 U.S.C. 153</external-xref>).</text></paragraph><paragraph id="H17D26700B82E46DF907E4F8E9A93C5FD"><enum>(6)</enum><header>Telecommunications service facility</header><text>The term <term>telecommunications service facility </term>means a facility for the provision of any interstate or intrastate telecommunications service.</text></paragraph></subsection></section></legis-body></bill>
