which was referred to the <committee-name committee-id="HVR00">Committee on Veterans' Affairs</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To make certain improvements in the provision of medical care by the Department of Veterans Affairs, and for other purposes.</official-title></form><legis-body id="H622F237003A14F1E9A4D26A7FE1EBF07" style="OLC"><section id="H737454ECA3A044DAB8E7656DCD5419EC" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Care Veterans Deserve Act of 2021</short-title></quote>.</text></section><section id="HD1B421AE880E4AD187BE57220974D795"><enum>2.</enum><header>Eligibility of certain veterans with service-connected disabilities to receive non-Department of Veterans Affairs medical care under Veterans Community Care Program</header><subsection id="HEA246D3BCF8F421982E29B6D11EDAF90"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Paragraph (1) of subsection (d) of section 1703 of title 38, United States Code, as amended by section 101 of the Caring for Our Veterans Act of 2018 (<external-xref legal-doc="public-law" parsable-cite="pl/115/182">Public Law 115–182</external-xref>) is amended—</text><paragraph id="HCAF74CF7DBC74143BC03355E18B7CCCB"><enum>(1)</enum><text>in subparagraph (D), by striking <quote>or</quote> at the end;</text></paragraph><paragraph id="HDA0990E915EF4B4DA6D973D03F5FC680"><enum>(2)</enum><text>in subparagraph (E), by striking the period and inserting <quote>; or</quote>; and</text></paragraph><paragraph id="H7FA502AAA46848ECB771FE5684C65E0A"><enum>(3)</enum><text>by adding at the end the following new subparagraph:</text><quoted-block display-inline="no-display-inline" id="H6212A32F537942279630A7155A1799EB" style="OLC"><subparagraph id="H117526835CF14E0B872068A2EBDDE1A6"><enum>(F)</enum><text display-inline="yes-display-inline">the covered veteran has a service-connected disability rated at 50 percent or higher and elects to receive care or services through a non-Department provider.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="H0D59646FB3CE4A5084BBB42426AD2B16"><enum>(b)</enum><header>Effective date</header><text display-inline="yes-display-inline">The amendments made by subsection (a) shall apply as if originally enacted in the Caring for Our Veterans Act of 2018 (<external-xref legal-doc="public-law" parsable-cite="pl/115/182">Public Law 115–182</external-xref>).</text></subsection></section><section display-inline="no-display-inline" id="HEF197227B52E4D579C7742328E0303CD" section-type="subsequent-section"><enum>3.</enum><header>Extension of operating hours for pharmacies and medical facilities of the Department of Veterans Affairs</header><subsection id="H4B1D27F3026A427E8431DB1FFE2F7381"><enum>(a)</enum><header>Extension of operating hours for pharmacies</header><text display-inline="yes-display-inline">The Secretary of Veterans Affairs shall extend the operating hours for each pharmacy of the Department of Veterans Affairs during which the pharmacy offers services comparable to retail pharmacies to include—</text><paragraph id="H5A261F884B834F52AD2C2163D552A6DB"><enum>(1)</enum><text>operation on Saturday, Sunday, and Federal holidays; and</text></paragraph><paragraph id="HA5D5E0DC19324DB49BC477ADC32D83D5"><enum>(2)</enum><text>operation until 8:00 p.m. on weekdays that are not Federal holidays.</text></paragraph></subsection><subsection id="H3F62D1920FAD495CA79D2E45692DAB3F"><enum>(b)</enum><header>Contracts with providers during nights and weekends</header><text display-inline="yes-display-inline">The Secretary shall enter into contracts, including through locum tenens arrangements, with physicians and nurses that meet qualifications set forth by the Secretary for purposes of this section under which such physicians and nurses work at medical facilities of the Department during nights and weekends.</text></subsection><subsection id="H0B78B6A3FED84680892FB780252566BE"><enum>(c)</enum><header>Support staff</header><text>The Secretary may obtain additional support staff as necessary to carry out this section, including by hiring employees or contracting for services.</text></subsection></section><section id="HB072B23D1C4040948DEE9D030CAB6724"><enum>4.</enum><header>Conduct of best-practices peer review of each medical center of the Department of Veterans Affairs</header><subsection id="HCA9B5F79E1A34BDC9FA7277D95E408D0"><enum>(a)</enum><header>In general</header><text>The Secretary of Veterans Affairs may provide for the conduct by a nongovernmental hospital organization of a best-practices peer review of each medical center of the Department of Veterans Affairs to evaluate the efficacy of health care delivered at each such medical center.</text></subsection><subsection id="HE1F3A97435DE4BB0954B38D258D091A8"><enum>(b)</enum><header>Priority</header><text>The Secretary shall give priority for peer review conducted under subsection (a) to the medical centers of the Department with the longest wait times for an appointment or the worst health outcomes, as determined by the Secretary.</text></subsection></section></legis-body></bill>
