which was referred to the <committee-name committee-id="HVR00">Committee on Veterans' Affairs</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the VA Choice and Quality Employment Act to direct the Secretary of Veterans Affairs to establish a vacancy and recruitment database to facilitate the recruitment of certain members of the Armed Forces to satisfy the occupational needs of the Department of Veterans Affairs, to establish and implement a training and certification program for intermediate care technicians in that Department, and for other purposes.</official-title></form><legis-body id="HEDCD55174FA64CD8BF79F4F75A62FE49" style="OLC"><section display-inline="no-display-inline" id="HD007D89C6D814AC28217FF0F344939EF" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Veterans Serving Veterans Act of 2021</short-title></quote>.</text></section><section id="HF270870ED90F4F6C931D23A1775FEB95"><enum>2.</enum><header>Recruitment database</header><subsection id="H6D3D5CFBD5EA4F6C991A5D3462767DB0"><enum>(a)</enum><header>Establishment</header><text display-inline="yes-display-inline">Section 208 of the VA Choice and Quality Employment Act (<external-xref legal-doc="public-law" parsable-cite="pl/115/46">Public Law 115–46</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/38/701">38 U.S.C. 701</external-xref> note) is amended as follows:</text><paragraph id="H28898E73A99E49EFB2AFDB5AB5484B04"><enum>(1)</enum><text>In subsection (a)—</text><subparagraph id="HB798AB52044A45AC9B6BB77C046CE47F"><enum>(A)</enum><text display-inline="yes-display-inline">in the matter proceeding paragraph (1), by striking <quote>a single database</quote> and inserting <quote>and maintain a single searchable database (to be known as the <quote>Departments of Defense and Veterans Affairs Recruitment Database</quote>)</quote>;</text></subparagraph><subparagraph id="H60161D47CA77497AB3D2CE07CCAA4CC7"><enum>(B)</enum><text>in paragraph (1), by striking <quote>; and</quote> and inserting a semicolon;</text></subparagraph><subparagraph id="HBD8007FA4324498AAF6EBBCA243416B8"><enum>(C)</enum><text>in paragraph (2), by striking the period at the end and inserting <quote>; and</quote>; and</text></subparagraph><subparagraph id="HE7FD8A1C142A4DC6B2F660D621624106"><enum>(D)</enum><text>by adding after paragraph (2) the following new paragraph:</text><quoted-block display-inline="no-display-inline" id="H00FFAB661BAF4367B3C5F9FE419C1720" style="OLC"><paragraph id="H334BE7DCB039406CAE98B2BCE7E80DAE"><enum>(3)</enum><text display-inline="yes-display-inline">with respect to each vacant position under paragraphs (1) and (2)—</text><subparagraph id="H79916C31114140EEAFDA40A5D9578BE6"><enum>(A)</enum><text>the military occupational specialty or skill that corresponds to the position, as determined by the Secretary, in consultation with the Secretary of Defense; and</text></subparagraph><subparagraph id="H7C111DA6C9F547819871748BAFE82F7F"><enum>(B)</enum><text display-inline="yes-display-inline">each qualified member of the Armed Forces who may be recruited to fill the position before such qualified member of the Armed Forces has been discharged and released from active duty.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="H25284A2BD879444EAB2A1523540BD69D"><enum>(2)</enum><text>By redesignating subsections (b), (c), and (d) as subsections (f), (g), and (h), respectively.</text></paragraph><paragraph id="H169860BC5EC2499B96F55ED603266F54"><enum>(3)</enum><text>By inserting after subsection (a) the following new subsections:</text><quoted-block display-inline="no-display-inline" id="HDFC79EABA19B4847AC0E25ABD50F2306" style="OLC"><subsection display-inline="no-display-inline" id="H14FA20BE1A884BC6953EB634E2A34219"><enum>(b)</enum><header>Additional information</header><text>Subject to subsection (c), the database established under subsection (a) shall include, with respect to each qualified member of the Armed Forces, the following information:</text><paragraph display-inline="no-display-inline" id="H047C54393FBB49D29C3A1A9A46C5C525"><enum>(1)</enum><text display-inline="yes-display-inline">The name and contact information of the qualified member of the Armed Forces.</text></paragraph><paragraph id="HA0F9C10EDB70423788053CAAD3762CA3"><enum>(2)</enum><text display-inline="yes-display-inline">The date on which the qualified member of the Armed Forces is expected to be discharged and released from active duty.</text></paragraph><paragraph id="H1711EBA6EA2942DDAFA3AA82BCAC9FAF"><enum>(3)</enum><text display-inline="yes-display-inline">Each military occupational specialty currently or previously assigned to the qualified member of the Armed Forces.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H9BDC702C9DE24295B4CB86F6F5A16823"><enum>(c)</enum><header>Availability</header><text display-inline="yes-display-inline">Information in the database shall be available to offices, officials, and employees of the Department of Veterans Affairs to the extent the Secretary of Veterans Affairs determines appropriate.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="HBEFE43BB1CD94DACB921FC0C2D96DC72"><enum>(d)</enum><header>Expedited hiring procedures</header><text>The Secretary shall hire qualified members of the Armed Forces who apply for vacant positions listed in the database established under subsection (a) without regard to the provisions of subchapter I of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/33">chapter 33</external-xref> of title 5, United States Code.</text></subsection><subsection id="HFC552525051346CCB9201E6B80FBAD6A"><enum>(e)</enum><header>Relocation bonus</header><text>The Secretary may authorize a relocation bonus, in an amount determined appropriate by the Secretary and subject to the same limitations as in the case of the authority provided under section 5753 of title 5, to any qualified member of the Armed Forces who has accepted a position listed in the database established under subsection (a).</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph><paragraph id="H2B45861931AB4F3CB04B88D0C604793E"><enum>(4)</enum><text>In subsection (g)(1), as redesignated in paragraph (2), by striking <quote>subsection (b)</quote> and inserting <quote>subsection (g)</quote>.</text></paragraph><paragraph id="HFFD1795100304B52BC25E8E48E92A575"><enum>(5)</enum><text>In subsection (h), as redesignated in paragraph (2), by striking <quote>of this Act</quote> and inserting <quote>of the <short-title>Veterans Serving Veterans Act of 2021</short-title>, and annually thereafter</quote>.</text></paragraph><paragraph id="H8EF0355D21944AAD82CC7B16AD445FD2"><enum>(6)</enum><text>By adding after subsection (h), as redesignated in paragraph (2), the following new subsection:</text><quoted-block id="HAF0068C729704D64A2E8FEB01246CEAF"><subsection display-inline="no-display-inline" id="HCAEE187E9C524C3B8D39559FB90DD7F7"><enum>(i)</enum><header>Qualified member of the Armed Forces Defined</header><text>In this section, the term <quote>qualified member of the Armed Forces</quote> means a member of the Armed Forces—</text><paragraph id="H0C8B8503B4474B44860CBCD8BC693403"><enum>(1)</enum><text display-inline="yes-display-inline">described in section 1142(a) of title 10;</text></paragraph><paragraph id="H5BB161F70C274DB49504F1D4DD34BE3A"><enum>(2)</enum><text display-inline="yes-display-inline">who elects to be listed in the database established under subsection (a); and</text></paragraph><paragraph id="H15F25CA53DB842DC910C753A5636185B"><enum>(3)</enum><text display-inline="yes-display-inline">who has been determined by the Secretary, in consultation with the Secretary of Defense, to have a military occupational speciality that corresponds to a vacant position described in subsection (a).</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="H9F5E10F639D84DF5A3C456D264D967EC"><enum>(b)</enum><header>Implementation plan</header><text display-inline="yes-display-inline">Not later than 180 days after the date of the enactment of this Act, the Secretary of Veterans Affairs shall submit to the Committees on Veterans’ Affairs of the House of Representatives and the Senate a plan to implement, including a timeline, section 208 of the VA Choice and Quality Employment Act (<external-xref legal-doc="public-law" parsable-cite="pl/115/46">Public Law 115–46</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/38/701">38 U.S.C. 701</external-xref> note), as amended by this section.</text></subsection></section><section display-inline="no-display-inline" id="H64A54124B4374F1394F5A00BCE82AC95" section-type="subsequent-section"><enum>3.</enum><header>Intermediate Care Technician Training Program</header><subsection id="H89F524261D9A4E07916B9ADA3DE82E73"><enum>(a)</enum><header>Establishment</header><text>The Secretary of Veterans Affairs shall implement a program to train and certify covered veterans to work as intermediate care technicians in the Department of Veterans Affairs.</text></subsection><subsection id="HAF42D67F7E564EB1B575C02DDFC2B89C"><enum>(b)</enum><header>Locations</header><paragraph display-inline="no-display-inline" id="H659C4D70BD5743FDB23CDC97CCB4F944"><enum>(1)</enum><header>Establishment</header><text>The Secretary shall establish centers at medical facilities of the Department selected by the Secretary for the purposes of carrying out the program under subsection (a).</text></paragraph><paragraph display-inline="no-display-inline" id="H7644C1A4E10B43039CDAC5B9857308AB"><enum>(2)</enum><header>Selection of medical facilities</header><text>In selecting a medical facility of the Department under this subsection to serve as a center, the Secretary shall consider—</text><subparagraph id="H8CD2696E7F4F4BB088A452C1BBA78F21"><enum>(A)</enum><text>the experience and success of the facility in training intermediate care technicians; and</text></subparagraph><subparagraph id="HF7E045816BAA423DBFB7394FF9753E23"><enum>(B)</enum><text>the availability of resources of the facility to train intermediate care technicians.</text></subparagraph></paragraph></subsection><subsection id="H4B01582C41C04C20B31122DC3B1FE714"><enum>(c)</enum><header>Covered veteran defined</header><text display-inline="yes-display-inline">In this section, the term <term>covered veteran</term> means a veteran whom the Secretary determines served as a basic health care technician while serving in the Armed Forces.</text></subsection></section><section display-inline="no-display-inline" id="H4ECC47FE2E42418291679E9235149C80" section-type="subsequent-section"><enum>4.</enum><header>No authorization of appropriations</header><text display-inline="no-display-inline">No additional funds are authorized to be appropriated to carry out section 208 of the VA Choice and Quality Employment Act (<external-xref legal-doc="public-law" parsable-cite="pl/115/46">Public Law 115–46</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/38/701">38 U.S.C. 701</external-xref> note), as amended by section 2 of this Act, or to carry out section 3 of this Act. Such sections shall be carried out using amounts otherwise authorized to be appropriated for such purpose.</text></section></legis-body></bill>
