which was referred to the <committee-name committee-id="HJU00">Committee on the Judiciary</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To prohibit the destruction of civil rights memorials, and for other purposes.</official-title></form><legis-body id="H40B290F961AA4795B23CCD87C638D0E4" style="OLC"><section id="H4A190AF69FD147C1B5ED16B2782CAD8D" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Civil Rights Legacy Protection Act</short-title></quote>.</text></section><section id="H874C867F589D4621840C4C9E08203BB0"><enum>2.</enum><header>Prohibition on destruction of certain property</header><subsection id="H21725C7D8BB54D4DBB3DBCD14FA0D851"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/18/65">Chapter 65</external-xref> of title 18, United States Code, is amended by adding at the end the following:</text><quoted-block style="USC" id="H2C672BFC5D0C43FDAC057CE6849ED1DB" display-inline="no-display-inline"><section id="H786553CB5B7C4F478BAECEA8939BD3ED"><enum>1370.</enum><header>Prohibiting destruction of civil rights memorials</header><subsection id="H553BBEE868844503A7595B10E38BE527"><enum>(a)</enum><header>Destruction of property</header><text display-inline="yes-display-inline">Whoever, in a circumstance described in subsection (b), intentionally defaces, damages, or destroys a protected memorial under subsection (c) or any structure, plaque, statue, or monument on public property that commemorates a covered civil rights event or a covered civil rights figure shall—</text><paragraph id="H1C64201601304CD1BC044D53E852C0EF"><enum>(1)</enum><text>in the case that such defacement, damage, or destruction is in an amount that is equal to or less than $5,000, be required to complete up to 300 hours of community service, fined under this title, or imprisoned not more than a year; or</text></paragraph><paragraph id="H084D8C5541164F9AA1985420813E5EC7"><enum>(2)</enum><text display-inline="yes-display-inline">in the case that such defacement, damage, or destruction is in an amount that is more than $5,000, be fined under this title or imprisoned not more than 3 years.</text></paragraph></subsection><subsection id="H6ED0C0936E304EC0BE00792DE776E571"><enum>(b)</enum><header>Circumstances</header><text display-inline="yes-display-inline">A circumstance described in this subsection is that—</text><paragraph id="HDC4D74292A17421CB1D0487DBD1FCF29"><enum>(1)</enum><text display-inline="yes-display-inline">in committing the offense described in subsection (a), the defendant travels or causes another to travel in interstate or foreign commerce, or uses the mail or an instrumentality of interstate or foreign commerce; or</text></paragraph><paragraph id="HDEFE9E7780BA4FE5B96B876B05D93BCF"><enum>(2)</enum><text display-inline="yes-display-inline">the structure, plaque, statue, or monument described in subsection (a) is located on property owned by, or under the jurisdiction of, the Federal Government.</text></paragraph></subsection><subsection id="HE080F5090BF34D949F18546D2157EE6A"><enum>(c)</enum><header>Protected memorials</header><text>The following are protected memorials:</text><paragraph id="H051A518BDAE24C8F8B236362D65F9B1B"><enum>(1)</enum><text display-inline="yes-display-inline">Emmett Till Memorial, Mississippi.</text></paragraph><paragraph id="H3C144B2B8CCB4E938BC5240F92BBEB84"><enum>(2)</enum><text>Mississippi Freedom Trail Markers, Mississippi.</text></paragraph><paragraph id="H1D9AF9AC26134E1FA5F556CF73CA8A2F"><enum>(3)</enum><text>Edmund Pettus Bridge, Alabama.</text></paragraph><paragraph id="H2853B754E33342F7B17C09C21833F24F"><enum>(4)</enum><text>Birmingham Civil Rights National Monument, Alabama.</text></paragraph><paragraph id="H929FF790A7AC45C2A33013DCFA1CB271"><enum>(5)</enum><text>Civil Rights Memorial Center, Memorial to Peace &amp; Justice, Alabama.</text></paragraph><paragraph id="HBB3FDEBCA5F545079AC14D04C7A9CD05"><enum>(6)</enum><text>Virginia Civil Rights Memorial, Virginia.</text></paragraph><paragraph id="H007CDCFFAD7A49CDA32D5272B1B43F80"><enum>(7)</enum><text>Landmark for Peace Memorial in Dr. Martin Luther King Jr. Park, Indiana.</text></paragraph><paragraph id="H7D479AFBCC0244439ED1EB3B82027216"><enum>(8)</enum><text>Harriet Ross Tubman Memorial, Massachusetts.</text></paragraph><paragraph id="HAEAA47F26AF04AB59C738A9E5F4F1024"><enum>(9)</enum><text>National Civil Rights Museum at the Lorraine Motel, Tennessee.</text></paragraph><paragraph id="H8552B158AC134ADA975E8CD9093C14FB"><enum>(10)</enum><text>Dr. Martin Luther King Jr. Monument, Colorado.</text></paragraph><paragraph id="H01C271C3046F4AAE8B0D7C6E42CC0606"><enum>(11)</enum><text>Harriet Tubman Underground Railroad National Monument, Maryland.</text></paragraph><paragraph id="H71A0AB3EA7DD415EA3B4A44C46916DC9"><enum>(12)</enum><text>African American Civil War Memorial, Washington, DC.</text></paragraph><paragraph id="H2419EB3C2C8749769DA30C5C40FF8BA5"><enum>(13)</enum><text>Freedom Riders National Monument, Alabama.</text></paragraph><paragraph id="H8BEAA6A3B93E4E87B645B589C2E880F6"><enum>(14)</enum><text>African Burial Ground National Monument, New York.</text></paragraph><paragraph id="H3D569D0014964F4E88EEB35E52C966E8"><enum>(15)</enum><text>Charles Young Buffalo Soldiers National Monument, Ohio.</text></paragraph><paragraph id="HF554AFE42C0B4C5E9D442E837EA22B37"><enum>(16)</enum><text>Reconstruction Era National Park, South Carolina.</text></paragraph><paragraph id="H5DC1B69219854E3397DC1EDF4BF15EAC"><enum>(17)</enum><text>George Washington Carver National Monument, Missouri.</text></paragraph><paragraph id="H5BBB72FCB7F14B65A1618914E5F636D2"><enum>(18)</enum><text>Medgar and Myrlie Evers National Monument, Mississippi.</text></paragraph><paragraph id="H80F90409A0544781B72D2D6336477481"><enum>(19)</enum><text>Markers on the Civil Rights Trail.</text></paragraph></subsection><subsection id="HBC4663F4224D410E942178C736F24DB6"><enum>(d)</enum><header>Restitution</header><text>Whoever is convicted of an offense under this section shall be ordered to pay restitution.</text></subsection><subsection id="HB1496054AD1647E1BD12D7CEFFD0784E"><enum>(e)</enum><header>Covered events and figures</header><text display-inline="yes-display-inline">In this section—</text><paragraph id="HFF2128B6CA4544789626F0A419ACA8CF"><enum>(1)</enum><text display-inline="yes-display-inline">the term <term>covered civil rights figure</term> means any figure on the list submitted by the United States Commission on Civil Rights pursuant to section 3(a) of the <short-title>Civil Rights Legacy Protection Act</short-title>; and</text></paragraph><paragraph id="H8D4336A450064EAE8F40D690D84EFEEA"><enum>(2)</enum><text display-inline="yes-display-inline">the term <term>covered civil rights event</term> means any event on the list submitted by the United States Commission on Civil Rights pursuant to section 3(a) of the <short-title>Civil Rights Legacy Protection Act</short-title>.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H090716C80B834288AF32251E0310D01A"><enum>(b)</enum><header>Table of sections</header><text>The table of sections for <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/18/65">chapter 65</external-xref> of title 18, United States Code, is amended by adding at the end the following item:</text><quoted-block style="USC" id="H67235C436CB240F4A3C6FC50FB2BBED0" display-inline="no-display-inline"><toc regeneration="no-regeneration"><toc-entry level="section">1370. Prohibiting destruction of civil rights memorials.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section><section id="H9F4F1E2F1BE4460FBD7D6BDCAB89C4CA"><enum>3.</enum><header>United States Commission on Civil Rights</header><subsection id="HBB2AF1738490430390AC6A4A9C2A7D76"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 1 year after the date of enactment of this Act, the United States Commission on Civil Rights shall develop and submit to the Attorney General a list of covered civil rights events and covered civil rights figures as follows:</text><paragraph id="H92ACDC3070CC4B07B73A005BAC733F73"><enum>(1)</enum><header>Covered civil rights event</header><text display-inline="yes-display-inline">For purposes of developing a list of covered civil rights events, the United States Commission on Civil Rights shall include on the list any event that—</text><subparagraph id="H6ACDA4BFF6EF484ABF44E32144ED5501"><enum>(A)</enum><text display-inline="yes-display-inline">memorializes the struggle to secure equal rights for groups suffering from discrimination on the basis of race, religion, disability, gender identity, or sexual orientation during the Civil Rights Movement and other social movements; and</text></subparagraph><subparagraph id="H597B64B33C954E4BAA764429E80515C1"><enum>(B)</enum><text>left a positive impression on a unit of local government, a State, or the United States.</text></subparagraph></paragraph><paragraph id="HF20520F2D8BA4979A372B1CC3568C662"><enum>(2)</enum><header>Covered civil rights figure</header><text display-inline="yes-display-inline">For purposes of developing a list of covered civil rights figures, the United States Commission on Civil Rights shall include on the list any person who—</text><subparagraph id="H5A23619B1B964F37BBA612AF5E42FB6C"><enum>(A)</enum><text>is known for dedication and advocacy toward expanding personal civil liberties and ending racial and other forms of discrimination, disenfranchisement, and segregation; or</text></subparagraph><subparagraph id="HA9D41E57332141FCA6099A9E95511B59"><enum>(B)</enum><clause commented="no" display-inline="yes-display-inline" id="H408430E767654AFC89F3F60EE35AA4AF"><enum>(i)</enum><text>worked to secure equal rights for groups suffering from discrimination on the basis of race, religion, disability, gender identity, or sexual orientation during the Civil Rights Movement and other social movements; and</text></clause><clause id="H49AE78BFA63F4695A16309E6765F14CC" indent="up1"><enum>(ii)</enum><text>has left a positive impression and legacy on a unit of local government, a State, or the United States.</text></clause></subparagraph></paragraph></subsection><subsection id="HD0A648699CD04E2CA60ACF2BEDA6A4E3"><enum>(b)</enum><header>Modifications to list</header><text display-inline="yes-display-inline">The United States Commission on Civil Rights shall review annually and modify as necessary the list submitted by the Commission pursuant to (a).</text></subsection><subsection id="H4700A3CD1B224DD5870E52E2E2AC5ED7"><enum>(c)</enum><header>Publishing list</header><text display-inline="yes-display-inline">The Attorney General shall ensure that the list submitted by the United States Commission on Civil Rights pursuant to subsection (a), and any modifications made by the Commission pursuant to subsection (b), shall be made available to the public on the Department of Justice website.</text></subsection></section></legis-body></bill>
