R. 110</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20210104">January 4, 2021</action-date><action-desc><sponsor name-id="H001067">Mr. Hudson</sponsor> (for himself and <cosponsor name-id="R000602">Miss Rice of New York</cosponsor>) introduced the following bill; which was referred to the <committee-name committee-id="HVR00">Committee on Veterans' Affairs</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend title 38, United States Code, to improve assistance and support services for caregivers of veterans.</official-title></form><legis-body id="HD51C2BD20E58413ABF04E0390049A0F7" style="OLC"><section id="HC940E156DB764DE6A8CB89CCB3D438A5" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Care for the Veteran Caregiver Act</short-title></quote>.</text></section><section id="H64A3418B85D14E7BB9C3F68CA0A6C7AD"><enum>2.</enum><header>Improvements to the program of comprehensive assistance for family caregivers</header><subsection id="HA3459D579EEE4DF2BCA503A0045C6112"><enum>(a)</enum><header>Extended stipend payments</header><text>Subparagraph (C) of paragraph (3) of section 1720G(a) of title 38, United States Code, is amended by inserting after clause (iv) the following new clause:</text><quoted-block id="H4DCCBE7FC60A47D38657AEC6402FDAB9" style="OLC"><clause id="H5B046625CECE42819F40D8A059E125EB" indent="up3"><enum>(v)</enum><text display-inline="yes-display-inline">If an eligible veteran dies during the period in which the Secretary provides to the family caregiver of such veteran assistance under subparagraph (A), the Secretary shall continue to provide to the family caregiver medical care under section 1781 of this title and the monthly personal caregiver stipend for not less than a six-month period following the date of such death. The Secretary may extend such period for all, or groups of, family caregivers of eligible veterans specified in paragraph (2)(C).</text></clause><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="HB880C6DDA3E0484E8A639681F2E022C5"><enum>(b)</enum><header>Eligibility for the program of comprehensive assistance for family caregivers</header><paragraph id="HD6BE6E92321549AB8FA4B591030AF97C"><enum>(1)</enum><header>Standardized evaluation criteria</header><text>Subparagraph (D) of paragraph (3) of such section is amended—</text><subparagraph id="HB26D4D762629474BBD6BDD5CE7F7AE9D"><enum>(A)</enum><text>by striking <quote>In providing</quote> and inserting <quote>(i) In providing</quote>; and</text></subparagraph><subparagraph id="H2467EA2523064A498A3DAE605F902298"><enum>(B)</enum><text>by adding at the end the following new clause:</text><quoted-block id="HF55F3B068DEE4A9CAD9F94FD4B8CF5FC" style="OLC"><clause id="HBEA3027D56BB45F4889CF18CB395F7E8" indent="up3"><enum>(ii)</enum><text display-inline="yes-display-inline">In conducting periodic evaluations under clause (i), the Secretary shall ensure that the criteria used in conducting such evaluations, the methods by which such criteria are assessed, the measurements and standards used, and the evaluation process and review methods used, are standardized across all facilities of the Department and Veteran Integrated Service Networks.</text></clause><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="HEFBF1AE130BD42A1B99B130342389476"><enum>(2)</enum><header>Permanent eligibility</header><text>Subparagraph (C) of such paragraph is amended—</text><subparagraph id="H08D32083CDE543148AB8F1E5717630FB"><enum>(A)</enum><text>by redesignating clause (iv) as clause (v); and</text></subparagraph><subparagraph id="H8E107B2C67EE46C0ACEDFBEB8F0E8139"><enum>(B)</enum><text>by inserting after clause (iii) the following new clause:</text><quoted-block display-inline="no-display-inline" id="H8C3A1843AF594C9A9B4F0A2DF0E96613" style="USC"><clause id="H172F871A06704EA4810A7610FE62853D" indent="up2"><enum>(iv)</enum><text display-inline="yes-display-inline">Based upon the criteria specified in clause (iii), the Secretary shall establish a process by which veterans who are determined to have the most significant need for caregiver assistance are permanently eligible under this subsection.</text></clause><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></subsection><subsection id="HED1023D76CBD4FC1B1E9779A67176962"><enum>(c)</enum><header>Standardized application procedures</header><text display-inline="yes-display-inline">Paragraph (5) of such section is amended to read as follows:</text><quoted-block display-inline="no-display-inline" id="HE2C23A6D155A4903AAEE3BB1CF241468" style="USC"><paragraph id="H89E2AB2A572845FB802F6E1CDE4B5B68" indent="up1"><enum>(5)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="HB3289B77AB1D42D08D5D3A932819852E"><enum>(A)</enum><text display-inline="yes-display-inline">For each application submitted jointly by an eligible veteran and family member, the Secretary shall evaluate (in collaboration with the primary care team for the eligible veteran to the maximum extent practicable)—</text><clause id="HBD391E2B5B97428FBB30785BD2B6FBC2" indent="up1"><enum>(i)</enum><text display-inline="yes-display-inline">the eligible veteran—</text><subclause id="H58E88ADA2E02485F952A26FA6DC3FFB5"><enum>(I)</enum><text display-inline="yes-display-inline">to identify the personal care services required by the eligible veteran; and</text></subclause><subclause id="H33FFE1264BB44833AB8BDFD84BB5B57D"><enum>(II)</enum><text display-inline="yes-display-inline">to determine whether such requirements could be significantly or substantially satisfied through the provision of personal care services from a family member; and</text></subclause></clause><clause id="HD3CE3B4004744869A67000B1FEEFF5F8" indent="up1"><enum>(ii)</enum><text display-inline="yes-display-inline">the family member to determine the amount of instruction, preparation, and training, if any, the family member requires to provide the personal care services required by the eligible veteran—</text><subclause id="H88BAD08333474592BE499BBC1D9134C0"><enum>(I)</enum><text display-inline="yes-display-inline">as a provider of personal care services for the eligible veteran; and</text></subclause><subclause id="H75434FD58B764C32BBD837A9BE4A74A9"><enum>(II)</enum><text display-inline="yes-display-inline">as the primary provider of personal care services for the eligible veteran.</text></subclause></clause></subparagraph><subparagraph id="HB9F910087F0249D79E62B83E41CCDC4D" indent="up1"><enum>(B)</enum><text display-inline="yes-display-inline">In establishing and evaluating the applications under subparagraph (A), the Secretary shall ensure that the criteria used in accepting and evaluating such applications, the methods by which such applications are evaluated, the measurements and standards used, and the evaluation process and review methods used, are standardized across all facilities of the Department and Veteran Integrated Service Networks.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="HA51C5DFF566345908F2E09250B4ACC04"><enum>(d)</enum><header>Conforming amendments</header><text>Such section is further amended—</text><paragraph id="H3D4D54DAD5E64A6696DD098F2E33C60E"><enum>(1)</enum><text>in paragraph (6), by striking <quote>under paragraph (5)(B)</quote> and inserting <quote>under paragraph (5)(A)(ii)</quote>; and</text></paragraph><paragraph id="H04808DA7A4EF43CDB9FF8451C7E2DB86"><enum>(2)</enum><text>in paragraph (7)(B), by striking <quote>under paragraph (5)(A)(i)</quote> and inserting <quote>under paragraph (5)(A)(i)(I)</quote>.</text></paragraph></subsection></section></legis-body></bill>
