which was referred to the <committee-name committee-id="HIF00">Committee on Energy and Commerce</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the Communications Act of 1934 to ensure the ability to enforce State and local law relating to leasing and renting of real property, and for other purposes.</official-title></form><legis-body id="H03CC17619EBF4793B03FC0016DC603E9" style="OLC"><section id="HF9198388F40346FB88F260F88D42E8E6" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Protecting Local Authority and Neighborhoods Act</short-title></quote> or the <quote><short-title>PLAN Act</short-title></quote>.</text></section><section id="H228E029638DE46379133549D9746D63E"><enum>2.</enum><header>Ensuring ability to enforce state and local law relating to leasing and renting of real property</header><subsection id="HE6B0057C84CB4137A669A604AB19E393"><enum>(a)</enum><header>No effect of communications law on claims regarding lease or rental of real property</header><text>Section 230(c) of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/230">47 U.S.C. 230(c)</external-xref>) is amended by adding at the end the following:</text><quoted-block id="HDF9967D5EFB146A6B64DC559F68ADB59" style="OLC"><paragraph id="H6B94DADCB1E14CE5AD5707C07A950E1B"><enum>(3)</enum><header>No effect on claims regarding lease or rental of real property</header><subparagraph id="HC87BDEF152BA4A57B748AC9EC2D2BC91"><enum>(A)</enum><header>In general</header><text>Paragraph (1) shall not apply to any claim in a civil action under State law asserted after the date of enactment of this paragraph against a provider of an interactive computer service if—</text><clause id="HBFF89B34240045ABBB7FCA24E9D9417E"><enum>(i)</enum><text>the claimant alleges that the provider facilitated the lease or rental of real property in a circumstance in which a law or contractual agreement restricts the lease or rental;</text></clause><clause id="H8CFC10AA2F904B9097A01CF2BA2857BC"><enum>(ii)</enum><text>the claimant, or an authorized agent of the claimant, provided written notice to the provider, or a designated agent of the provider, that the lease or rental of the real property described in clause (i) would violate a law or contractual agreement; and</text></clause><clause id="HE21B8F7B92D8449F9E64FD70A7D507F8"><enum>(iii)</enum><text>the provider facilitated the lease or rental of the real property described in clause (i) after receiving the notice under clause (ii).</text></clause></subparagraph><subparagraph id="H647396C7D9524E8982816ACD7ABFFCF4"><enum>(B)</enum><header>Written notice</header><text>For purposes of subparagraph (A)(ii), written notice provided by a claimant, or an authorized agent thereof, to a provider of an interactive computer service, or a designated agent thereof, shall include substantially the following:</text><clause id="H23784B2839574B83AAC7DED0EE5B1939"><enum>(i)</enum><text>Reasonable identification of the real property for which the provider is allegedly facilitating the lease or rental in a circumstance in which a law or contractual agreement restricts the lease or rental.</text></clause><clause id="HE4B8E87A0A424B0782FBBBCD8A81DA12"><enum>(ii)</enum><text>Identification of the law or contractual agreement that restricts the lease or rental of real property facilitated by the provider.</text></clause><clause id="HC3DF6A07B69845559916A0F4E691A23B"><enum>(iii)</enum><text>A statement that describes the manner in which the lease or rental of real property violates a law or contractual agreement.</text></clause><clause id="HDA9F629FACD3486C90D8905EFF124BCE"><enum>(iv)</enum><text>Information reasonably sufficient to permit the provider to contact the claimant or agent thereof, as applicable, such as an address, a telephone number, and, if available, an electronic mail address.</text></clause><clause id="H1226A6DAE03A44CCB00707B24F813E2B"><enum>(v)</enum><text>A statement that the claimant or agent thereof, as applicable, has a good faith belief that the lease or rental of the real property—</text><subclause id="HCCFEA25721724FAC8E387737C4CD2C8A"><enum>(I)</enum><text>would violate a law or contractual agreement; and</text></subclause><subclause id="H529B68CE5F8E4421B79B528CC5799B31"><enum>(II)</enum><text>is not authorized by the claimant.</text></subclause></clause><clause id="HD0F181D345A1405D9D210991731686F4"><enum>(vi)</enum><text>A statement, under penalty of perjury—</text><subclause id="H46698F676821454B8F7DEE5A5F475B52"><enum>(I)</enum><text>that the information in the notice is accurate; and</text></subclause><subclause id="HBAAA6D2F264148D98F3332CB2C5B1DD0"><enum>(II)</enum><text>if the notice is provided by an agent of the claimant, that the agent is authorized to act on behalf of the claimant.</text></subclause></clause><clause id="HDD86506705404A1DB06C8E584B1FFE05"><enum>(vii)</enum><text>A physical or electronic signature of the claimant or authorized agent, as applicable.</text></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="HFAF49620A51247E59465B5830DDAA30E"><enum>(b)</enum><header>No effect of communications law on real property leasing or rental requirements and protection of property rights</header><text>Section 230(e) of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/230">47 U.S.C. 230(e)</external-xref>) is amended by adding at the end the following:</text><quoted-block id="H1A844AB39DCD4EA388B54A6C0982F395" style="OLC"><paragraph id="HBF2ECA9EA7DD40C9A09FC17B10C9D4C2"><enum>(6)</enum><header>No effect on real property leasing or rental requirements and protection of property rights</header><text>Nothing in this section (other than subsection (c)(2)(A)) shall be construed to prevent any State or unit of local government from enforcing a law that restricts any provider of an interactive computer service from booking a transaction for the lease or rental of real property or providing ancillary services for such a transaction.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section></legis-body></bill>
