which was referred to the <committee-name committee-id="HJU00">Committee on the Judiciary</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To exempt certain businesses from liability arising from claims relating to an individual contracting COVID–19 as a result of patronizing a business or healthcare entity.</official-title></form><legis-body id="H18DE85293E214D9F9BEC73CCAF7E3530" style="OLC"><section id="HA53314BAC5314353961F7112A9D063E8" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Protecting Reopening Businesses Recovering from COVID–19 Act</short-title></quote>.</text></section><section id="H068B15D653CA46AFBB2785D429877914"><enum>2.</enum><header>Purpose</header><text display-inline="no-display-inline">The purpose of this Act is to provide for an exemption from liability arising from claims arising from an individual contracting of COVID–19 as a result of patronage of a business or healthcare entity during such time as a national health emergency exists.</text></section><section id="H23ADF2B029DA40C7B40B5A2AE3B1CC0F"><enum>3.</enum><header>Definitions</header><paragraph id="HFC06FDF5456147A9871EAF6D275A6689"><enum>(1)</enum><header>Business</header><text>The term <term>business</term>—</text><subparagraph id="HD5698CD47B7B4A4298C2BC9AF64F2C22"><enum>(A)</enum><text>means any entity organized as corporation, partnership, limited liability corporation, limited liability partnership, sole proprietorship, farming cooperative, or any other corporate structure recognized by the State in which the business is domiciled; and</text></subparagraph><subparagraph id="H46B15148315140DF9B15BDB3FC7CE0FF"><enum>(B)</enum><text>includes any nonprofit organization or educational institution.</text></subparagraph></paragraph><paragraph id="H667F12D7FD8B4BDAB6C436A16E606F0C"><enum>(2)</enum><header>Covered individual</header><text>The term <term>covered individual</term> means—</text><subparagraph id="H57000DD46D6347A88F8B0AA4233A8991"><enum>(A)</enum><text>any invitee or licensee, as defined by the tort law of the State in which the business or COVID–19 medical entity is domiciled or does business;</text></subparagraph><subparagraph id="H10EBC3CFC54B4E09B719AE95653F754B" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text>any employee, contractor, or other individual providing services to a business or COVID–19 medical entity; or </text></subparagraph><subparagraph id="H95E089D5BD224588AACBCF02FB262F3F"><enum>(C)</enum><text>any other person who enters or otherwise visits or avails themselves of the services provided by a business or COVID–19 medical entity.</text></subparagraph></paragraph><paragraph id="HBF0EA05BDA5E4370873A2394A1894A21"><enum>(3)</enum><header>Covered period</header><text>The term <term>covered period</term> means the public health emergency declared by the Secretary of Health and Human Services under section 319 of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/247d">42 U.S.C. 247d</external-xref>) on January 31, 2020, with respect to COVID–19.</text></paragraph><paragraph id="H6B1C1DABF2C94E439C78B8D97E36B69B"><enum>(4)</enum><header>COVID–19 action</header><text>The term <term>COVID–19 action</term>—</text><subparagraph id="H204BF710A1244F6C8665C7DF8D38CB50"><enum>(A)</enum><text>means any civil action commenced in any Federal or State court in which the alleged harm or injury to the plaintiff arises from or is related to the actual or potential contracting infection of COVID–19 or SARS–CoV–2; and</text></subparagraph><subparagraph id="H523E215A4AD344F38C6CDA0E27CA5826"><enum>(B)</enum><text>does not include any action brought by a government entity in a regulatory, supervisory, or enforcement capacity.</text></subparagraph></paragraph><paragraph id="HC911A4B199424F2C9D2BC21719957B70"><enum>(5)</enum><header>COVID–19 medical entity</header><text display-inline="yes-display-inline">The term <term>COVID–19 medical entity</term> means any business or governmental institution that provides healthcare related services for COVID–19, including treating, testing, or transportation of COVID–19 patients, manufacturing or distribution of personal protective equipment, and manufacturing, distributing, or testing of other healthcare equipment. </text></paragraph><paragraph id="HF8BFDD55FDFA4CA08C17000E76244C56"><enum>(6)</enum><header>Damages</header><text>The term <term>damages</term> means any punitive, compensatory, or general damages recoverable under any State or Federal law.</text></paragraph></section><section id="HDE738786979A4B7B9E854CB4218C17B1"><enum>4.</enum><header>Liability exemption for businesses and COVID–19 medical entities</header><subsection id="HD590DF1A07964CBCBD2A3D5E94200F66"><enum>(a)</enum><header>In general</header><text>During the covered period, no business or COVID–19 medical entity shall be liable for any damages arising from a claim arising from or relating from an individual’s contracting of COVID–19 if the business or COVID–19 medical entity was—</text><paragraph id="HE491BF873A4B4CF59796E98A654A0CBA"><enum>(1)</enum><text>operating in a fashion consistent with any applicable State or Federal guidelines or requirements on reopening; and</text></paragraph><paragraph id="HD003E1A3671E454480EB3536729CA850"><enum>(2)</enum><text>using measures outlined by the Centers for Disease Control and Prevention or any other State or Federal agency to mitigate the potential spread of COVID–19, including requiring individuals to wear face coverings, sanitizing the workplace, practicing social distancing, and using temperature checks.</text></paragraph></subsection><subsection id="HC6904A0D36CF466EBBD68DC40581A54E"><enum>(b)</enum><header>Exception</header><text>Subsection (a) shall not apply to a business or COVID–19 medical entity that a court has determined to have acted grossly negligent.</text></subsection></section></legis-body></bill>
