which was referred to the <committee-name committee-id="HVR00">Committee on Veterans' Affairs</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend title 38, United States Code, to establish an advisory committee on the implementation by the Department of Veterans Affairs of an electronic health record.</official-title></form><legis-body id="H54392ACB556645148FF5D8CF456E52C6" style="OLC"><section id="H04A21904ED8C40FE903BDE17FBF6E934" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Department of Veterans Affairs Electronic Health Record Advisory Committee Act</short-title></quote>.</text></section><section id="HA5B0257F656E49BD87DDD56F9C3AC069"><enum>2.</enum><header>Establishment of advisory committee on implementation of electronic health record</header><subsection id="H74AE3CD44E8B4E4FB4CFC566E7169629"><enum>(a)</enum><header>In general</header><text>Subchapter II of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/38/73">chapter 73</external-xref> of title 38, United States Code, is amended by adding at the end the following new section:</text><quoted-block display-inline="no-display-inline" id="H4F8A97E52DBD433594F1807C83DD476B" style="USC"><section id="H1F06558BFA0B455FBC055EB60AF51E2F"><enum>7330D.</enum><header>Electronic Health Record Advisory Committee</header><subsection id="HA1D51810CABA4283B968EE4AAF104F08"><enum>(a)</enum><header>Establishment</header><text>Not later than 180 days after the date of the enactment of this section, the Secretary shall establish the Electronic Health Record Advisory Committee (referred to in this section as the <quote>Committee</quote>) to provide guidance to the Secretary and Congress regarding the implementation of and transition to an electronic health record system of the Department.</text></subsection><subsection id="H76447ED065244D5D993664F86E6D3761"><enum>(b)</enum><header>Membership</header><paragraph commented="no" display-inline="yes-display-inline" id="H8FA4B6C192E04C87B986CFBB8B85F226"><enum>(1)</enum><text>The Committee shall be composed of 11 members appointed by the Secretary as follows:</text><subparagraph id="H51A6CF92FA424EB6A4C2FAAF04774146" indent="up1"><enum>(A)</enum><text>One physician.</text></subparagraph><subparagraph id="HE32426ACD590481EA0DE19CF39C6D0EA" indent="up1"><enum>(B)</enum><text>One nurse.</text></subparagraph><subparagraph id="HB3F9EF3F97B24C76A4AF51F838DBDF5C" indent="up1"><enum>(C)</enum><text>One individual with expertise in clinical support.</text></subparagraph><subparagraph id="H6F8BB54351004038B51F49904D6E3FDA" indent="up1"><enum>(D)</enum><text>One individual with expertise in medical business and administration who is or was in an executive management position at an organization that provides inpatient and outpatient care.</text></subparagraph><subparagraph id="H619226285C3C42B3BAD6FC4DC9FCD714" indent="up1"><enum>(E)</enum><text>Two information technology developers.</text></subparagraph><subparagraph id="HB95E2F1E5BDE417C9B70A83142F4F9A5" indent="up1"><enum>(F)</enum><text>Two individuals with expertise in health care information technology change management.</text></subparagraph><subparagraph id="HA58DA11049DD4859B9228D37314D5A80" indent="up1"><enum>(G)</enum><text>One interoperability specialist.</text></subparagraph><subparagraph id="HF7630514E8934B5D9EFE1A1F259978A4" indent="up1"><enum>(H)</enum><text>Two individuals who are members of a veterans service organization and are enrolled in the system of annual patient enrollment of the Department established and operated under section 1705 of this title.</text></subparagraph></paragraph><paragraph id="H075D03A3306A491B9A68459007A913A5" indent="up1"><enum>(2)</enum><text>No member of the Committee may—</text><subparagraph id="H2D03D6FDBC2646E6957CE4282EA9BD00"><enum>(A)</enum><text>be an employee of the Federal Government;</text></subparagraph><subparagraph id="H88422ABCBE164B24B7D74AE091A11A8D"><enum>(B)</enum><text>have worked during the two-year period before joining the Committee for any company contracted or subcontracted to the Department, the Department of Defense, the Department of State, the Department of Health and Human Services, or the Department of Homeland Security for the delivery of any electronic health record or interoperability software; or</text></subparagraph><subparagraph id="H8505BE9E26F94474A97D2B147A10DB4F"><enum>(C)</enum><text>have provided during the two-year period before joining the Committee any consulting or project management services relating to the delivery of any electronic health record or interoperability software for any of the Federal agencies specified in subparagraph (B).</text></subparagraph></paragraph><paragraph id="HC65E74F687F24E05B608232DD8B52B2A" indent="up1"><enum>(3)</enum><text>No individual who was involved in the procurement of an electronic health record for the Department, or privy to contract information relating to such procurement, may be a member of the Committee.</text></paragraph><paragraph id="H46299E40BD344F7F8C1C042457959600" indent="up1"><enum>(4)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="H7B47372EAB61452CBAA1528281C96A71"><enum>(A)</enum><text>A term for a member of the Committee shall be two years and a member may not serve more than three consecutive terms.</text></subparagraph><subparagraph id="HE7F7E92CDC2A4ABC800086600CFEDE2E" indent="up1"><enum>(B)</enum><text>Initial members, at the election of the Secretary, may be appointed for one or two terms, with six members appointed for two terms and five members appointed for one term.</text></subparagraph><subparagraph id="HCE2F97B2C049409F94801F3A74A42FA8" indent="up1"><enum>(C)</enum><text>Any vacancy in the Committee shall be filled by the Secretary in the same manner as the original appointment and not later than 180 days after the occurrence of the vacancy.</text></subparagraph></paragraph></subsection><subsection id="HCF26721BB5B646E09A8D313C1D7A1AF3"><enum>(c)</enum><header>Chairperson and Vice Chairperson</header><text>The Committee shall select a Chairperson and Vice Chairperson from among the members of the Committee.</text></subsection><subsection id="HE82BB9045366496785C923C8323461BF"><enum>(d)</enum><header>Duties</header><text>The Committee shall carry out the following duties:</text><paragraph id="HA7EA5CF23B7F45238C81A66BB4AC515A"><enum>(1)</enum><text>Analyze the priorities and plans of the Department for implementing the electronic health record of the Department and provide advice on the best strategies to achieve those priorities and plans.</text></paragraph><paragraph id="HC2BC4750C91341BBA52FC4B726084272"><enum>(2)</enum><text>Conduct a risk identification analysis and develop recommendations to best mitigate the most prominent risks.</text></paragraph><paragraph id="HD8526DD8501149DC8C9B9577C78A53EB"><enum>(3)</enum><text>Conduct periodic, informal evaluations of the implementation of the electronic health record and suggest recommendations for such implementation.</text></paragraph><paragraph id="H39560203F47D48FCBCD836872FBE12D8"><enum>(4)</enum><text>Tour facilities of the Department as those facilities begin use of the electronic health record to analyze implementation, including soliciting feedback from employees of the Department.</text></paragraph><paragraph id="H0D89546B12734CFBBA4E4E35FBD1D0F5"><enum>(5)</enum><text>Ensure the voices of stakeholders, veterans, and other participants in the transition process to the electronic health record are elevated.</text></paragraph></subsection><subsection id="HA072E2046F244F4AA7D67F6966205430"><enum>(e)</enum><header>Initial meeting</header><paragraph commented="no" display-inline="yes-display-inline" id="H57D8F2008C134F2DB0D419F66B1188F3"><enum>(1)</enum><text>Not later than 90 days after the establishment of the Committee, the Committee shall hold the initial meeting of the Committee.</text></paragraph><paragraph id="HC09884E26ED1410FBE411AD9BD0A3E69" indent="up1"><enum>(2)</enum><text>The initial meeting under paragraph (1) may be conducted either in person or via telephone conference.</text></paragraph></subsection><subsection id="HA3DF3C0AA90346F2A4F6569C452713A9"><enum>(f)</enum><header>Meetings, hearings, and subcommittees</header><paragraph commented="no" display-inline="yes-display-inline" id="HD0C8DED065F949BB8F00834178AF1EB8"><enum>(1)</enum><text>After the initial meeting under subsection (e), the Committee shall meet at the call of the Chairperson, not less frequently than monthly. Each such meeting may be conducted via telephone conference.</text></paragraph><paragraph id="HAFBBE988FF724B0CA835F288A02E904D" indent="up1"><enum>(2)</enum><text>The Committee shall meet with the Secretary in person, or a designee of the Secretary, not less frequently than twice each year.</text></paragraph><paragraph id="HF915A5BE424C4B56AD1B07F18730471F" indent="up1"><enum>(3)</enum><text>A majority of the members of the Committee shall constitute a quorum, but a lesser number of members may hold hearings.</text></paragraph><paragraph id="H36657631FE684086A13C52B1835F3665" indent="up1"><enum>(4)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="HFAC1FD3A688E47D2A99D433E90897884"><enum>(A)</enum><text>The Committee may establish subcommittees that report to the Committee to enhance the function of the Committee.</text></subparagraph><subparagraph id="H6C1F21305DD847FCACDF558267A9BEAC" indent="up1"><enum>(B)</enum><text>Any subcommittee established under subparagraph (A) may not supersede the authority of the Committee or provide direct advice or work products to the Department.</text></subparagraph><subparagraph id="H34E2B8C88E984F0C9A8D52D8412FD7CD" indent="up1"><enum>(C)</enum><text>The Inspector General of the Department and the Comptroller General of the United States, or a designee of the Inspector General and the Comptroller General, may attend any meeting of the Committee as observers, including the initial meeting under subsection (e), regardless of whether the meeting is open to the public.</text></subparagraph></paragraph></subsection><subsection id="H9B287A041019480390425F3FA470D8D0"><enum>(g)</enum><header>Reports</header><paragraph commented="no" display-inline="yes-display-inline" id="HFD92E2D47B044C61A2598C8A4A207285"><enum>(1)</enum><text>The Committee shall submit to the Secretary, the Committee on Veterans’ Affairs of the Senate, and the Committee on Veterans’ Affairs of the House of Representatives an annual report on the activities of the Committee during the year covered by the report that includes recommendations for activities of the Committee during the following year.</text></paragraph><paragraph id="H85DC1CA210444A1F89234E49326F42E3" indent="up1"><enum>(2)</enum><text>Not later than 90 days after receiving the report submitted under paragraph (1), the Secretary shall submit to the Committee, the Committee on Veterans’ Affairs of the Senate, and the Committee on Veterans’ Affairs of the House of Representatives a written response addressing any recommendations or questions raised by the Committee in such report.</text></paragraph><paragraph id="H8C047DF3C3BF44B9A20D3E4B3EC8D6FF" indent="up1"><enum>(3)</enum><text>Not less frequently than twice each year during the first two years following the establishment of the Committee, and as the Committee determines necessary thereafter, the Committee shall submit to the Committee on Veterans’ Affairs of the Senate and the Committee on Veterans’ Affairs of the House of Representatives such recommendations for legislative or administrative actions relating to the work of the Committee as the Committee considers appropriate.</text></paragraph></subsection><subsection id="H6597A58B97C64DBEBDC5C4E88B0135AD"><enum>(h)</enum><header>Pay and reimbursement for travel expenses</header><paragraph commented="no" display-inline="yes-display-inline" id="H765ACD5A729A41DCBD6731F87C0AEF59"><enum>(1)</enum><text>Members of the Committee shall serve without pay.</text></paragraph><paragraph id="HE7E57A5B56314D27A9582D2C369D2FA6" indent="up1"><enum>(2)</enum><text>A member of the Committee shall be allowed travel expenses, including per diem in lieu of subsistence, at rates authorized for employees of agencies under subchapter I of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/57">chapter 57</external-xref> of title 5, United States Code, while away from their home or regular places of business in the performance of services for the Committee.</text></paragraph></subsection><subsection id="H5861593E46CF4685B7DD5FDBE041EBC1"><enum>(i)</enum><header>Information from contractors</header><text>On and after the date of the enactment of this section, the Secretary shall include in any contract or contract renewal entered into with a person working on the electronic health record of the Department that is not part of the Federal Government a provision requiring that the person provide to the Committee, upon request by the Committee, records relating to the work of the person on the electronic health record.</text></subsection><subsection id="H800B2C7C35F34874954065D2AC6E2A3A"><enum>(j)</enum><header>Veterans service organization defined</header><text>In this section, the term <term>veterans service organization</term> means an organization recognized by the Secretary for the representation of veterans under section 5902 of title 38, United States Code.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H192900305A8441F3B9372511DABC0FFE"><enum>(b)</enum><header>Clerical amendment</header><text>The table of sections at the beginning of chapter 73 of such title is amended by inserting after the item relating to section 7330C the following new item:</text><quoted-block
