such provisions as fall within the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the Intelligence Reform and Terrorism Prevention Act of 2004 to prohibit individuals with security clearances from being employed by certain entities.</official-title></form><legis-body id="H79F03615C1C14FD9BAED1BD15F089F69" style="OLC"><section id="H92577F44399F4C29B79D01D6DCC73856" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Safe Career Transitions for Intelligence and National Security Professionals</short-title></quote>.</text></section><section id="H61202C8119DA4FE5A6AC8D4036C4E6EE" section-type="subsequent-section"><enum>2.</enum><header>Prohibition on individuals with security clearances from being employed by certain entities</header><subsection id="HDA532FB0D316421491FF09E17F6F8EFE"><enum>(a)</enum><header>Prohibition</header><text display-inline="yes-display-inline">Section 3002 of the Intelligence Reform and Terrorism Prevention Act of 2004 (<external-xref legal-doc="usc" parsable-cite="usc/50/3343">50 U.S.C. 3343</external-xref>) is amended by adding at the end the following new subsection:</text><quoted-block style="OLC" id="HAFA5EED9D66E4BC180D52A4CAF82985B" display-inline="no-display-inline"><subsection id="HFBB8D5545B3B4EA7B786A97C0551EBB7"><enum>(e)</enum><header>Prohibition on certain employment</header><paragraph id="HE732E7F2EE8547C6BA0D43373BEAC24E"><enum>(1)</enum><header>Prohibition</header><text display-inline="yes-display-inline">A covered person may not be employed by, contract with, or otherwise receive funding from, any covered entity during the following periods:</text><subparagraph id="HDEB16230DEA64696A6EE53105831B843"><enum>(A)</enum><text>A period in which the person holds a security clearance.</text></subparagraph><subparagraph id="H6FB87632897D46D88D61D704329FF4F8"><enum>(B)</enum><text>The 5-year period beginning on the date that the security clearance of a person becomes inactive.</text></subparagraph></paragraph><paragraph id="HBF286523FDFE452D87432C370BF8DF2E"><enum>(2)</enum><header>Penalties</header><text display-inline="yes-display-inline">Any person who knowingly violates the prohibition in paragraph (1) shall be fined under title 18, United States Code, or imprisoned for not more than 5 years, or both.</text></paragraph><paragraph id="HDC991A28F4724BC0A337C71C56533562"><enum>(3)</enum><header>Notification</header><text display-inline="yes-display-inline">A person who holds a security clearance shall be notified of the prohibition in paragraph (1), including a list of the covered entities, as follows:</text><subparagraph id="HEA4D9D1D5D324B33B81F9E7361A9BE84"><enum>(A)</enum><text>At the time at which the person is issued the security clearance.</text></subparagraph><subparagraph id="H6FA3777BD0164FF8A854DAA688C7A4CB"><enum>(B)</enum><text display-inline="yes-display-inline">At the time at which the security clearance of the person is renewed.</text></subparagraph><subparagraph id="H33EDA01DD38F4A3AA92D4B0EEA4C7B35" commented="no"><enum>(C)</enum><text display-inline="yes-display-inline">At the time at which the security clearance of the person becomes inactive.</text></subparagraph></paragraph><paragraph id="HF60EE2D1B9CC481F902E014C18E101BF"><enum>(4)</enum><header>Covered entity</header><subparagraph id="HA69F8CD9926E4AB8B04EA336BBF95440"><enum>(A)</enum><header>Definition</header><text>Subject to subparagraph (B), in this subsection, the term <term>covered entity</term> means any of the following entities (including any subsidiary or affiliate of such entities):</text><clause id="HF162756573904FDD984054868C03A76E"><enum>(i)</enum><text display-inline="yes-display-inline">Huawei Technologies Company.</text></clause><clause id="HDBE0BB12D9FA4863B3492A4CD2A07BBA"><enum>(ii)</enum><text>ZTE Corporation.</text></clause><clause id="HC7EF91FB1207462EBC2333B5C161A52E"><enum>(iii)</enum><text>Hytera Communications Corporation.</text></clause><clause id="HFC4F30F0B67945D3840B675034CBBFA1"><enum>(iv)</enum><text>Hangzhou Hikvision Digital Technology Company.</text></clause><clause id="H8CD64CFE3A7F4155A21A1495E69C4E28"><enum>(v)</enum><text>Dahua Technology Company.</text></clause><clause id="H45C55D5835D042E38C7D2EBEAB051236"><enum>(vi)</enum><text>Kaspersky Lab.</text></clause></subparagraph><subparagraph id="HBFF780EACF344015B7E28E5B24BF76D4" commented="no"><enum>(B)</enum><header>Modifications</header><text display-inline="yes-display-inline">The Director of National Intelligence, in consultation with the Secretary of Defense or the Director of the Federal Bureau of Investigation, may add or remove entities to the list of covered entities in subparagraph (A) based on whether the Director determines there is reasonable belief that the entity is owned or controlled by, or otherwise connected to or receiving financial support from, the government of the People’s Republic of China, the government of the Russian Federation, the government of the Islamic Republic of Iran, or the government of the Democratic People’s Republic of Korea.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="HA9E2D470B00E4E6DB89A5D8138F050D3"><enum>(b)</enum><header>Application</header><paragraph id="HD7C8DED97ABE458DB4566AF3A036653A"><enum>(1)</enum><header>In general</header><text>Subsection (e) of section 3002 of the Intelligence Reform and Terrorism Prevention Act of 2004 (<external-xref legal-doc="usc" parsable-cite="usc/50/3343">50 U.S.C. 3343</external-xref>) shall apply with respect to an individual who is employed by, contracts with, or otherwise receives funding from, any covered entity under such subsection on or after the date of the enactment of this Act.</text></paragraph><paragraph id="H62501C2651214BA4A552571DBA8B02CD" commented="no"><enum>(2)</enum><header>Notification</header><text display-inline="yes-display-inline">Not later than 30 days after the date of the enactment of this Act, each person who holds a security clearance as of such date shall be notified of the prohibition in such subsection (e), including a list of the covered entities under such subsection.</text></paragraph></subsection></section></legis-body></bill>
