which was referred to the <committee-name committee-id="HBA00">Committee on Financial Services</committee-name>, and in addition to the <committee-name committee-id="HFA00">Committee on Foreign Affairs</committee-name>, for a period to be subsequently determined by the Speaker, in each case for consideration of such provisions as fall within the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To prohibit financial investment by a United States person in foreign industrial defense corporations with substantial contracts with, ties to, or support from, the Chinese military and affiliated entities, and for other purposes.</official-title></form><legis-body id="H3B6E7FA195004585B4C84B23EC4173A3" style="OLC"><section id="H978775B96C4541E791AA6515A58BF161" section-type="section-one" commented="no"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Stop Funding the PLA Act</short-title></quote>. </text></section><section id="HAF1E0ADB24124B4FAFC9C6CEEA1348A9"><enum>2.</enum><header>Specification of prohibited foreign industrial defense corporations</header><subsection id="HA0945D687A4D49E6A6D0E0CF0D21468C"><enum>(a)</enum><header>Specification required</header><text display-inline="yes-display-inline">Not later than 90 days after the date of the enactment of this section, and annually thereafter, the Secretary, in consultation with the Secretary of State, the Secretary of Defense, and the domestic intelligence community, shall submit to the Committee on Banking, Housing, and Urban Affairs of the Senate and the Committee on Financial Services of the House of Representatives a report that specifies each foreign industrial defense corporation with substantial contracts with, ties to, or support from, a PLA entity. </text></subsection><subsection id="H1AB7244A3C544E9BA6F178AF3309A3A0"><enum>(b)</enum><header>Effect of specification</header><paragraph id="H96BD564698AA4AA78995D41714B23D37"><enum>(1)</enum><header>Purchase of securities prohibited</header><text>Beginning on the date that is 180 days after a report is submitted under subsection (a), a United States person may not purchase securities of a foreign industrial defense corporation specified in such report.</text></paragraph><paragraph id="HF277867B6C0B45218D755162E439A7B6"><enum>(2)</enum><header>Divestment required</header><subparagraph id="HFA3A4BFDC59A4ECFBC92C3BBC1DB87BF"><enum>(A)</enum><header>In general</header><text>Except as provided in subparagraph (B), not later than 180 days after a report is submitted under subsection (a), a United States person that owns a security of a foreign industrial defense corporation specified in such report shall divest themselves of such security.</text></subparagraph><subparagraph id="H1886D7A391BD45EEB9901AE537BCF233"><enum>(B)</enum><header>Extended wind-down in case of financial hardship</header><text display-inline="yes-display-inline">The Secretary may allow a United States person a 270-day extension to the 180-day period for compliance under subparagraph (A) if the Secretary determines that such entity—</text><clause id="HC6581FBA931A444DA2EEF80DE68AAC30"><enum>(i)</enum><text>owns a security of a foreign industrial defense corporation specified in a report submitted under subsection (a); and</text></clause><clause id="HF94A139BB7E4425FAD9A3B90C7B7B2C9"><enum>(ii)</enum><text>would experience extreme financial hardship to comply within the 180-day period under subparagraph (A).</text></clause></subparagraph></paragraph></subsection><subsection id="H49A6080A739642D3A9C50D1B1C258248"><enum>(c)</enum><header>Assignment of authority</header><paragraph id="HC495E834495D4503939724393BAEE84F"><enum>(1)</enum><header>Enforcement</header><text>The Secretary shall enforce the provisions of this section. </text></paragraph><paragraph id="H80B787D1A0924A5EBD41CD139B8F06A4"><enum>(2)</enum><header>Regulations</header><text>Not later than 90 days after the date of the enactment of this section, the Secretary shall issue such regulations and guidance as necessary to implement and enforce this section. </text></paragraph></subsection><subsection id="H0F35437C2D824615A6EEC16DF1B4A6D9"><enum>(d)</enum><header>Report</header><text>Not later than 360 days after the date of the enactment of this section, the Secretary shall submit to the Committee on Banking, Housing, and Urban Affairs of the Senate and the Committee on Financial Services of the House of Representatives a report on the progress of the divestments required under subsection (b)(2). </text></subsection><subsection id="H1A83B5FB129F434FBEEE8F7E8C416718"><enum>(e)</enum><header>Petition for removal from designation</header><paragraph id="H20D7F865BDE64F4F8686450CCD248F2D"><enum>(1)</enum><header>In general</header><text>A foreign industrial defense corporation may petition the Secretary to not be included or removed from a report under subsection (a). </text></paragraph><paragraph id="HFF138AA16DAA46229CF8640BA56734DC"><enum>(2)</enum><header>Requirements</header><text display-inline="yes-display-inline">A petition under paragraph (1) shall include such documentation of the assets and liabilities, company financial records, ownership and investor records, and past and current business contracts of the foreign industrial defense corporation submitting such petition that the Secretary determines necessary.</text></paragraph></subsection><subsection id="H0BC1BAC52F5B4894AC9AB75F093B939B"><enum>(f)</enum><header>Final report</header><text display-inline="yes-display-inline">Not later than 8 years after the date of the enactment of this section, the Secretary shall submit to the Committee on Banking, Housing, and Urban Affairs of the Senate and the Committee on Financial Services of the House of Representatives a final report on the implementation of this section, including—</text><paragraph id="H2CDCC72DC6D843CEAE8C27F6E5876BF9"><enum>(1)</enum><text>an analysis of the effectiveness of this section;</text></paragraph><paragraph id="H2C9A4021F18048D0A70DABBF33A46CA5"><enum>(2)</enum><text>the development and maintenance of the reports required under subsection (a); and</text></paragraph><paragraph id="H14FAD0E2ED524C56894E815EB5A248A9"><enum>(3)</enum><text display-inline="yes-display-inline">a description of completed and ongoing civil and criminal cases related to securities of foreign industrial defense corporations.</text></paragraph></subsection><subsection id="H961565672B004DFEA249EE7E2D5DFE0E"><enum>(g)</enum><header>Sunset</header><text>This section and the authority under this section shall expire on the date that is 10 years after the date of the enactment of this section.</text></subsection><subsection id="HF3133D67102840628E113FF147AFA919"><enum>(h)</enum><header>Definitions</header><text>In this section:</text><paragraph id="H0C50C50E5E284BA5A98A5EC7DF723B55"><enum>(1)</enum><header>PLA entity</header><text>The term <term>PLA entity</term> means any entity of the Chinese military, including the People’s Liberation Army, Navy, Air Force, Rocket Force, Strategic Support Force, and Joint Logistics Force, and the Chinese intelligence community.</text></paragraph><paragraph id="H571E77E92A4A4FC7978C9173A78FE8C4"><enum>(2)</enum><header>Foreign industrial defense corporation</header><text>The term <term>foreign industrial defense corporation</term> means any corporation based—</text><subparagraph id="HEB60C5C72EAD43D0B0785BA65285C62B"><enum>(A)</enum><text>outside of the United States; and</text></subparagraph><subparagraph id="H18D116C2F2404C78963C6B540CB91A97"><enum>(B)</enum><text display-inline="yes-display-inline">in a country that the Secretary, in consultation with the Secretary of Defense, the Secretary of State, and the domestic intelligence community, determines does not possess positive economic and military relations with the United States. </text></subparagraph></paragraph><paragraph id="H38633EA362C44391BF2C04DB2FC410BA"><enum>(3)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of the Treasury. </text></paragraph><paragraph id="H123EC03D9C0C4C189B905650A67A034A"><enum>(4)</enum><header>Substantial</header><text display-inline="yes-display-inline">The term <term>substantial</term> shall, with respect to contracts with, ties to, or support from, a PLA entity, have the meaning determined by the Secretary, in consultation with the Secretary of State, the Secretary of Defense, and the domestic intelligence community. </text></paragraph></subsection></section></legis-body></bill>
