BILL</legis-type><official-title display="yes">To establish a program to provide grants to eligible entities to deploy, install, and operate advanced transportation technologies, and for other purposes.</official-title></form><legis-body id="H09CA87A1B62C4B40BCEB77859B88F97F" style="OLC"><section id="H28CE548267944AC7A6D6D0DC34BA03F1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Strengthening Methods to Advance Research and Technology in Transportation Act</short-title></quote> or the <quote><short-title>SMART Transportation Act</short-title></quote>. </text></section><section id="H3EBC972A0B88444F85BEA67D286E06FA" section-type="subsequent-section"><enum>2.</enum><header>Advanced transportation technologies program</header><subsection id="H08444739A48F4BE39CEE795024E6CD15"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/23/5">Chapter 5</external-xref> of title 23, United States Code, is amended by adding at the end the following:</text><quoted-block style="USC" id="H30D253DF5D444A41A9A51446125DBB3D" display-inline="no-display-inline"><section id="HEFBCC835E13A42C2A0B1C433D2F41D80"><enum>520.</enum><header>Advanced transportation technologies program</header><subsection id="HFDC34C3C8EEC47B893A72AE3FF9BA5CE"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary of Transportation shall establish a program to provide grants to eligible entities to deploy, install, and operate advanced transportation technologies to improve safety, efficiency, system performance, mobility, intermodal connectivity, and infrastructure return on investment.</text></subsection><subsection id="H0C9A100805664D5398BF3E53D7269FF4"><enum>(b)</enum><header>Criteria</header><text display-inline="yes-display-inline">In carrying out the program under subsection (a), the Secretary shall develop criteria for selection of an eligible entity to receive a grant, including how the proposed deployment of technology—</text><paragraph id="H90C28E011BD5465E8EF610C204D8200C"><enum>(1)</enum><text>reduces costs and improves return on investments, including through the optimization of existing transportation capacity;</text></paragraph><paragraph id="H26730A71879E4B3AAC5156FD03D1BBF7"><enum>(2)</enum><text>delivers environmental benefits by alleviating congestion and streamlining traffic flow; </text></paragraph><paragraph id="H208947F5024A424BA482388D5F33EE94"><enum>(3)</enum><text>measures and improves the operational performance of the applicable transportation network;</text></paragraph><paragraph id="H5CDD8CC24B184998847FB51345E80A45"><enum>(4)</enum><text>reduces the number and severity of traffic accidents and increases driver, passenger, and pedestrian safety;</text></paragraph><paragraph id="H1A8C9B939E9947FE8488FCFA5503BF73"><enum>(5)</enum><text>collects, disseminates, and uses information on real-time traffic, work zone, weather, transit, paratransit, parking, and other transportation-related information to improve mobility, reduce congestion, and provide for more efficient, accessible, and integrated transportation and transportation services;</text></paragraph><paragraph id="HAA457DCC74BC4E19A974E2129E617639"><enum>(6)</enum><text>monitors transportation assets to improve infrastructure management, reduce maintenance costs, prioritize investment decisions, and ensure a state of good repair;</text></paragraph><paragraph id="HBECC2CFC76A64A3994EE6C5792369CD5"><enum>(7)</enum><text>delivers economic benefits by reducing delays, improving system performance, and providing for the efficient and reliable movement of goods and services; or</text></paragraph><paragraph id="HCF5584964E364355ACBDD7047AD52C26"><enum>(8)</enum><text>accelerates the deployment of vehicle-to-vehicle, vehicle-to-infrastructure, autonomous vehicles, and other technologies.</text></paragraph></subsection><subsection id="HC0CFC9B6A36C4151A27FE4916DE9CC65"><enum>(c)</enum><header>Applications</header><text display-inline="yes-display-inline">An application submitted for a project to be carried out by a grant under this program shall include the following:</text><paragraph id="HDEC3849257214EAA8329FC6317B53F14"><enum>(1)</enum><text display-inline="yes-display-inline">A plan to deploy and provide for the long-term operation and maintenance of advanced transportation technologies to improve safety, efficiency, system performance, and return on investment.</text></paragraph><paragraph id="H9041F18F737D4603A8138DB9D5B8280D"><enum>(2)</enum><text display-inline="yes-display-inline">Objectives for quantifiable system performance improvements, such as—</text><subparagraph id="H5F5A2951FEA1493C9839050A3E6CA2B2"><enum>(A)</enum><text>reducing traffic-related accidents, congestion, and costs;</text></subparagraph><subparagraph id="H909B7B840BF24912BC7E12A853428B50"><enum>(B)</enum><text>optimizing system efficiency; and</text></subparagraph><subparagraph id="H122208A22987438FA2B4842D28C2514F"><enum>(C)</enum><text>improving access to transportation services.</text></subparagraph></paragraph><paragraph id="H2371095F68D74587AA77CAE009FA883C"><enum>(3)</enum><text display-inline="yes-display-inline">Quantifiable safety, mobility, and environmental benefit projections such as data-driven estimates of how the project proposes to improve the applicable transportation system efficiency and how such project proposes to reduce traffic congestion.</text></paragraph><paragraph id="H06BFF24E83EE4B2EA0C94A52A66E00EE"><enum>(4)</enum><text display-inline="yes-display-inline">A plan for any partnerships with private sector entities or public agencies, including multimodal and multijurisdictional entities, research institutions, organizations representing transportation and technology leaders, or other transportation stakeholders.</text></paragraph><paragraph id="HD0C50C82A9744D44A8184DF703F4D7DA"><enum>(5)</enum><text>A plan to leverage and optimize existing local and regional advanced transportation technology investments.</text></paragraph></subsection><subsection id="H547F601A848D4104A5242C757223CA83"><enum>(d)</enum><header>Grant selection</header><paragraph id="H750869023D63497BA84464BA5F07C0A2"><enum>(1)</enum><header>Grant awards</header><text display-inline="yes-display-inline">Each fiscal year for which funding is made available under this section, the Secretary shall award grants to not less than 5 and not more than 10 eligible entities.</text></paragraph><paragraph id="HF847FA85711946AAB757C19464652BE8"><enum>(2)</enum><header>Geographic diversity</header><subparagraph id="HE9C1DAD012FE49858F966B8185F8D11F"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">Subject to subparagraph (B), in awarding a grant under this section, the Secretary shall ensure, to the extent practicable, that grant recipients represent diverse geographic areas of the United States, including urban areas and rural areas.</text></subparagraph><subparagraph id="H0F68E3D1522F438EA47600A3E08ACFEC"><enum>(B)</enum><header>Rural set-aside</header><text>Not less than 20 percent of the amounts made available to carry out this section shall be reserved for projects serving rural areas, to the extent there are sufficient eligible applications.</text></subparagraph></paragraph><paragraph id="HC17B8287906841F7845C9B4E08BE725D"><enum>(3)</enum><header>Technology diversity</header><text display-inline="yes-display-inline">In awarding a grant under this section, the Secretary shall ensure, to the extent practicable, that grant recipients represent a variety of technology solutions.</text></paragraph></subsection><subsection id="H14354E9C1BBF4B7D9096E5844D9B7209"><enum>(e)</enum><header>Use of grant funds</header><text display-inline="yes-display-inline">A grant recipient may use funds awarded under this section to deploy advanced transportation technologies, including—</text><paragraph id="H2A3AAB04ADBB45D7A188EA5455375773"><enum>(1)</enum><text display-inline="yes-display-inline">advanced traveler information systems;</text></paragraph><paragraph id="H314F53950C664BCA81B9851113FB95E5"><enum>(2)</enum><text display-inline="yes-display-inline">advanced transportation management technologies;</text></paragraph><paragraph id="H0A071ACBAB444AE2B1568EB316C4A713"><enum>(3)</enum><text>advanced transportation technologies to improve emergency evacuation and response by Federal, State, and local authorities;</text></paragraph><paragraph id="H7591DDBDF7754D03AFE8A2704B4BC080"><enum>(4)</enum><text>infrastructure maintenance, monitoring, and condition assessment;</text></paragraph><paragraph id="H0D37BBD783AD42FF88F074DED3DC1751"><enum>(5)</enum><text display-inline="yes-display-inline">advanced public transportation systems;</text></paragraph><paragraph id="H90021FD594634144BFD1356F9ED7F9A9"><enum>(6)</enum><text display-inline="yes-display-inline">transportation system performance data collection, analysis, and dissemination systems;</text></paragraph><paragraph id="H01FB77A83EA9432F93221BAA810B495B"><enum>(7)</enum><text display-inline="yes-display-inline">advanced safety systems, including vehicle-to-vehicle, vehicle-to-pedestrian, and vehicle-to-infrastructure communications, technologies associated with autonomous vehicles, and other collision avoidance technologies, including systems using cellular technology;</text></paragraph><paragraph id="H3926C1CD59594B67AE86EF472484657D"><enum>(8)</enum><text>integration of intelligent transportation systems with the Smart Grid and other energy distribution and charging systems;</text></paragraph><paragraph id="HAFE2860C8C9E47A08584C8A882A4FE45"><enum>(9)</enum><text>integrated corridor management systems;</text></paragraph><paragraph id="HC02E34D16FD441A9A964287BB1FE7A55"><enum>(10)</enum><text>advanced parking reservation or variable pricing systems;</text></paragraph><paragraph id="H07FC10E17A9847648D08B8D8699C526A"><enum>(11)</enum><text>electronic pricing, toll collection, and payment systems;</text></paragraph><paragraph id="HB9C579D3B4D24EC0B4B5398FF3DDABBD"><enum>(12)</enum><text>technology that enhances high occupancy vehicle toll lanes, cordon pricing, or congestion pricing; </text></paragraph><paragraph id="HC22926211A324DF29C6A512D1A76A6ED"><enum>(13)</enum><text display-inline="yes-display-inline">advanced mobility and access technologies, such as dynamic ridesharing and information systems to support human services for elderly and disabled individuals;</text></paragraph><paragraph id="H6D8E89B2CA014DE0A4B62B13F3EA2C42" commented="no"><enum>(14)</enum><text display-inline="yes-display-inline">technology that collects and maintains automated driving system safety data and data analysis tools;</text></paragraph><paragraph id="H533A3DDB100D4607B57A7132B03A84A1" commented="no"><enum>(15)</enum><text display-inline="yes-display-inline">cybersecurity protection measures and activities to protect against cybersecurity threats; or</text></paragraph><paragraph id="H052360A180A64F32A94CA39E176B4FDC" commented="no"><enum>(16)</enum><text display-inline="yes-display-inline">advanced vulnerable road user safety information systems.</text></paragraph></subsection><subsection id="HA261609C4F3D4C5BADB664970FB33F0F" commented="no"><enum>(f)</enum><header>Report to Secretary</header><paragraph id="H2304918972FB440EB37C5F0322CDA880" commented="no"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary shall ensure that a recipient of a grant under this section submits, not later than 1 year after the recipient receives a grant and annually thereafter, a report to the Secretary that describes—</text><subparagraph id="HE6F299B1DF634D97ACB13761F142156A" commented="no"><enum>(A)</enum><text>deployment and operational costs of the project compared to the benefits and savings the project provides; and</text></subparagraph><subparagraph id="H97FE83EB60F0421E8F4C7DB2867380EE" commented="no"><enum>(B)</enum><text display-inline="yes-display-inline">how the project has met the original expectations projected in the deployment plan submitted with the application, such as—</text><clause id="HA533F307CCC74E3DB156F0385CD2A4BB" commented="no"><enum>(i)</enum><text>data on how the project has helped reduce traffic accidents, congestion, costs, and other benefits of the deployed systems;</text></clause><clause id="H214DF9D73BF3446F94555B4113571494" commented="no"><enum>(ii)</enum><text>data on the effect of measuring and improving transportation system performance through the deployment of advanced transportation technologies;</text></clause><clause id="H917B27441F5248D7B54F8A8A02FCC62D" commented="no"><enum>(iii)</enum><text>the effectiveness of providing real-time integrated traffic, transit, and multimodal transportation information to the public to make informed travel decisions; and</text></clause><clause id="HFA13AAF11D1347548BE85047E31C2A86" commented="no"><enum>(iv)</enum><text>lessons learned and recommendations for future deployment strategies to optimize transportation mobility, efficiency, and multimodal system performance.</text></clause></subparagraph></paragraph><paragraph id="HBB778E2502754758A8D421615476A9AB" commented="no"><enum>(2)</enum><header>Report Consistency</header><subparagraph id="HB34D55D2DAA445A2B32E4B46E466039B"><enum>(A)</enum><header>Administration</header><text>The Secretary shall provide grant recipients with methods and techniques to support consistent data collection across grant recipients and may update such methods and techniques as appropriate.</text></subparagraph><subparagraph id="H124F86A1465447B3A8B9B15B32C72ED9"><enum>(B)</enum><header>Update</header><text display-inline="yes-display-inline">The Secretary shall provide grant recipients notice of an update described in subparagraph (A) not less than 90 days before carrying out such update.</text></subparagraph></paragraph></subsection><subsection id="HCA5B49926C6245CE8C8B06BB31AF616E"><enum>(g)</enum><header>Report</header><text display-inline="yes-display-inline">Not later than 2 years after the date of enactment of this section, and once every 2 years thereafter, the Secretary shall make available to the public on the website of the Department of Transportation an updated report that describes the effectiveness of grant recipients in meeting projected deployment plans including data described in subsection (f) on how the program has—</text><paragraph id="H917D1AB65A43491893E4B9382C834782"><enum>(1)</enum><text display-inline="yes-display-inline">reduced traffic-related fatalities and injuries;</text></paragraph><paragraph id="HC3D1EF6456E148F380D705024D2B6828"><enum>(2)</enum><text display-inline="yes-display-inline">reduced traffic congestion and improved travel time reliability;</text></paragraph><paragraph id="H6C8195FF865C4B709A73CA83C0CB8653"><enum>(3)</enum><text display-inline="yes-display-inline">reduced transportation-related emissions;</text></paragraph><paragraph id="H94261EEB6BC947E68729328FE09AB71C"><enum>(4)</enum><text display-inline="yes-display-inline">optimized multimodal system performance;</text></paragraph><paragraph id="H14981339C52942748602B1E01AD0754D"><enum>(5)</enum><text display-inline="yes-display-inline">improved access to transportation alternatives;</text></paragraph><paragraph id="HA67D7C7E5F0D4091B3875B1FAD973A8E"><enum>(6)</enum><text display-inline="yes-display-inline">provided the public with access to real-time integrated traffic, transit, and multimodal transportation information to make informed travel decisions;</text></paragraph><paragraph id="HF08CB11BF0AB4D3BA89CB2C949B8EF4F"><enum>(7)</enum><text display-inline="yes-display-inline">provided cost savings to transportation agencies, businesses, and the traveling public; or</text></paragraph><paragraph id="H69E7BC8D0F5F4B10BB19339A2E872616"><enum>(8)</enum><text display-inline="yes-display-inline">provided other benefits to transportation users and the general public.</text></paragraph></subsection><subsection id="HD8D1852616184656816592B0AC7A41BB"><enum>(h)</enum><header>Penalty</header><text display-inline="yes-display-inline">The Secretary may terminate a grant provided under this section and deobligate funds provided by such grant if—</text><paragraph id="H36973414057B4034A08A35832278BA94"><enum>(1)</enum><text>the Secretary determines from a report submitted pursuant to subsection (f) that a recipient of such grant is not carrying out the requirements of the grant; and</text></paragraph><paragraph id="H4C73B25FD67D4C9B83F9B81452BD9571"><enum>(2)</enum><text display-inline="yes-display-inline">the Secretary provides written notice to the Committees on Transportation and Infrastructure and Science, Space, and Technology of the House of Representatives and the Committees on Environment and Public Works and Commerce, Science, and Transportation of the Senate 60 days prior to deobligating funds under this subsection.</text></paragraph></subsection><subsection id="H140E77629EA0435A9C6ED5B145BC4CA4"><enum>(i)</enum><header>Funding</header><text>Of the amounts provided to carry out this section, the Secretary may set aside $2,000,000 each fiscal year for program reporting, evaluation, and administrative costs related to this section.</text></subsection><subsection id="HF8AE100A12ED4F5C8906C14778838BE0"><enum>(j)</enum><header>Federal share</header><text>The Federal share of the cost of a project for which a grant is awarded under this subsection shall not exceed 50 percent of the cost of the project.</text></subsection><subsection id="H9A17DC1BF90B4D4795D653E4259189D5"><enum>(k)</enum><header>Grant limitation</header><text>The Secretary may not award more than 15 percent of the amount described under subsection (i).</text></subsection><subsection id="H05F90F0926B9444F865267EA274C716D"><enum>(l)</enum><header>Expenses for grant recipients</header><text>A grant recipient under this section may use not more than 5 percent of the funds awarded each fiscal year to carry out planning and reporting requirements.</text></subsection><subsection id="HE74AC812ACE14018A5B93F1D3B723BBC"><enum>(m)</enum><header>Grant flexibility</header><paragraph id="HBCD46E47A4494E14A2DAC825B168C63B"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">If, by August 1 of each fiscal year, the Secretary determines that there are not enough grant applications that meet the requirements described in subsection (c) to carry out this section for a fiscal year, the Secretary shall transfer to the programs specified in paragraph (2)—</text><subparagraph id="H74F1E3B37C7B48EC83A932F010F1091F"><enum>(A)</enum><text display-inline="yes-display-inline">any of the funds reserved for the fiscal year under subsection (i) that the Secretary has not yet awarded under this section; and</text></subparagraph><subparagraph id="H15C4CFFD938B4459A11759C9E540F375"><enum>(B)</enum><text display-inline="yes-display-inline">an amount of obligation limitation equal to the amount of funds that the Secretary transfers under subparagraph (A).</text></subparagraph></paragraph><paragraph id="HA2EF3A6FA2C5479098D8BFFC763494F3"><enum>(2)</enum><header>Programs</header><text>The programs referred to in paragraph (1) are—</text><subparagraph id="H0B8CF5BEAB054EC5A2BBF66CC1F33BC9"><enum>(A)</enum><text>the programs under sections 503(b) and 503(c); and </text></subparagraph><subparagraph id="HDDC84F697BE04ACA8DB63093563BBF8D"><enum>(B)</enum><text>the programs under sections 512 through 518.</text></subparagraph></paragraph><paragraph id="HE904D223CD324EB1884590DB460B2DD5"><enum>(3)</enum><header>Distribution</header><text display-inline="yes-display-inline">Any transfer of funds and obligation limitation under paragraph (1) shall be divided among the programs referred to in that paragraph in the same proportions as the Secretary originally reserved funding from the programs for the fiscal year under subsection (i).</text></paragraph></subsection><subsection id="H4E2B5FC4A26F45DF84ADB71FD188B7D7"><enum>(n)</enum><header>Definitions</header><text>In this section, the following definitions apply:</text><paragraph id="H7E8C588E8AF2446DBDFF483B7247990B"><enum>(1)</enum><header>Advanced transportation technologies</header><text display-inline="yes-display-inline">The term <term>advanced transportation technologies</term> means technologies that improve the efficiency, safety, or state of good repair of surface transportation systems, including intelligent transportation systems.</text></paragraph><paragraph id="HCD03B503039145BBBDFF1CB36EBFD215"><enum>(2)</enum><header>Eligible entity</header><text display-inline="yes-display-inline">The term <term>eligible entity</term> means a State or local government, a transit agency, metropolitan planning organization, or a political subdivision of a State or local government, a multijurisdictional group, a public academic institution, public research institution, or a consortia of research institutions or academic institutions.</text></paragraph><paragraph id="HB2D650E7A8354AE5AE1AD7D796D234B5"><enum>(3)</enum><header>Multijurisdictional group</header><text display-inline="yes-display-inline">The term <term>multijurisdictional group</term> means any combination of State governments, local governments, metropolitan planning organizations, transit agencies, or other political subdivisions of a State for which each member of the group—</text><subparagraph id="H837F360BC93140F584D3EC482001E578"><enum>(A)</enum><text>has signed a written agreement to implement a project carried out under this section across jurisdictional boundaries; and</text></subparagraph><subparagraph id="H10D721E2C5EC4C06B9EC9B1E5F33472F"><enum>(B)</enum><text display-inline="yes-display-inline">is an eligible entity under this section.</text></subparagraph></paragraph><paragraph id="H4C79A436D55840CBA096191A11F41714"><enum>(4)</enum><header>Smart Grid</header><text display-inline="yes-display-inline">The term <term>Smart Grid</term> means a system that provides for any of the smart grid functions set forth in section 1306(d) of the Energy Independence and Security Act of 2007 (<external-xref legal-doc="usc" parsable-cite="usc/42/17386">42 U.S.C. 17386(d)</external-xref>). </text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H5C71F45E33D44AE1B3B203FBD3A790FF"><enum>(b)</enum><header>Clerical amendment</header><text>The analysis for <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/23/5">chapter 5</external-xref> of title 23, United States Code, is amended by adding at the end the following new item:</text><quoted-block style="USC" id="HFF739BD1E0824786B781597E41E894AD" display-inline="no-display-inline"><toc regeneration="no-regeneration"><toc-entry level="section">520. Advanced transportation technologies program.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H3426C6BEAEC445B8A22A50F7AA46896B"><enum>(c)</enum><header>Conforming amendment</header><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/23/5">Chapter 5</external-xref> of title 23, United States Code, is amended by striking section 503(c)(4).</text></subsection></section><section id="H0F08F3BA9B6C4F5CA4FA4954BB0ED491"><enum>3.</enum><header>Connected vehicle deployment pilot program</header><subsection id="H6793B658775244A49018186788950612"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/23/5">Chapter 5</external-xref> of title 23, United States Code, is amended by adding at the end the following:</text><quoted-block style="USC" id="H9D09C95BD2804992BD7E2620D87A19A9" display-inline="no-display-inline"><section id="H3300EFE7F124437880331B5AE3CDB454"><enum>521.</enum><header>Connected vehicle deployment pilot program</header><subsection id="H1A6E32421F974897AAE90E517469CC41"><enum>(a)</enum><header>Establishment</header><paragraph id="H739E7583E2FC482482C0A74708D007E8"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary of Transportation shall establish a connected vehicle deployment pilot program to make grants, on a competitive basis, to spur operational deployments to meet the transportation needs of eligible entities through the use of the best available and emerging intelligent transportation systems.</text></paragraph><paragraph id="HCA3C8BEF603545F99A565999ED8F6F26"><enum>(2)</enum><header>Goals</header><text display-inline="yes-display-inline">The goals of the program shall be to—</text><subparagraph id="H80350A25BE2E456C8D8404E8A2067AAD"><enum>(A)</enum><text display-inline="yes-display-inline">spur connected vehicle technology deployment through wirelessly connected vehicles that interact with a connected environment, including mobile devices, infrastructure, and other elements;</text></subparagraph><subparagraph id="H1853C7E2E4914B4F8B1F67EAAED435B6"><enum>(B)</enum><text display-inline="yes-display-inline">realize safety, mobility, and environmental impacts through operational deployments;</text></subparagraph><subparagraph id="HB7CC80099CCA41C6858C2F02120D4758"><enum>(C)</enum><text display-inline="yes-display-inline">capture and use new forms of connected vehicle and mobile device data to support improved surface transportation system performance and enhanced performance-based management;</text></subparagraph><subparagraph id="HE12E82FF9170413DB4CAF5F55B89EE84"><enum>(D)</enum><text display-inline="yes-display-inline">encourage partnerships of multiple stakeholders (including private companies, State and local agencies, transit agencies, commercial vehicle operators, freight shippers, and transportation network companies);</text></subparagraph><subparagraph id="H7C134FCD1DF44CD0B532BEB47EFA699F"><enum>(E)</enum><text display-inline="yes-display-inline">deploy applications using data captured from multiple sources (including vehicles, mobile devices, and infrastructure) across all elements of the surface transportation system (including transit, highway, arterial highways, parking facilities, and toll highways); and</text></subparagraph><subparagraph id="HFCFF9E2C2AB64C85BAD21451A6ED7229"><enum>(F)</enum><text display-inline="yes-display-inline">support deployment sites that create foundations for future expanded and enhanced deployments.</text></subparagraph></paragraph></subsection><subsection id="HEAE833B5358442AC8AFD4F6EAF60BF22"><enum>(b)</enum><header>Grant amount</header><text display-inline="yes-display-inline">Each grant made under this section shall be in an amount that is at least $10,000,000. </text></subsection><subsection id="H9E79BF17233744D6A0DE0C9D68EC4527"><enum>(c)</enum><header>Eligible entities</header><text display-inline="yes-display-inline">The Secretary may make a grant under this section to any of the following entities:</text><paragraph id="H17709153312B4549B4EB3D5085704CCA"><enum>(1)</enum><text display-inline="yes-display-inline">A State or a group of States.</text></paragraph><paragraph id="H1842850E4B0346FB9502D8E59220557C"><enum>(2)</enum><text>A transit agency.</text></paragraph><paragraph id="H713456B8255947B6B510C025F7287F01"><enum>(3)</enum><text display-inline="yes-display-inline">A metropolitan planning organization that serves an urbanized area with a population of more than 200,000 individuals.</text></paragraph><paragraph id="H40CF3A7E8D2741A6950ADF7A1A64DC59"><enum>(4)</enum><text display-inline="yes-display-inline">A unit of local government or a group of local governments.</text></paragraph><paragraph id="H22C09056D2F94279821B9314EDBA74C1"><enum>(5)</enum><text display-inline="yes-display-inline">A political subdivision of a State or local government.</text></paragraph><paragraph id="HBDE703A420A94070A04BE4CC4BCA132A"><enum>(6)</enum><text display-inline="yes-display-inline">A special purpose district or public authority with a transportation function, including a port authority.</text></paragraph><paragraph id="H1FA0C1A160D54D9F98080A69DC1B11FA"><enum>(7)</enum><text display-inline="yes-display-inline">A multijurisdictional group (as defined under section 520) or a consortia of research institutions or academic institutions.</text></paragraph></subsection><subsection id="H3406EAEEA9044F569AB5B92EE130A105"><enum>(d)</enum><header>Eligible projects</header><text>A grant recipient may use funds awarded under this section for a project that deploys connected vehicle applications and technologies, including—</text><paragraph id="HA45705AE43274BD99F9490B1EC181231"><enum>(1)</enum><text display-inline="yes-display-inline">advanced safety systems, including vehicle-to-vehicle and vehicle-to-infrastructure communications, technologies associated with autonomous vehicles, and other collision avoidance technologies, including systems using cellular technology;</text></paragraph><paragraph id="HDC3C3693211C4A06BE2D76F33D72259F"><enum>(2)</enum><text display-inline="yes-display-inline">integration of intelligent transportation systems with the Smart Grid and other energy distribution and charging systems;</text></paragraph><paragraph id="HF292960367084F49A2E36AB96A55F0E0"><enum>(3)</enum><text display-inline="yes-display-inline">electronic pricing and payment systems;</text></paragraph><paragraph id="H87BA0B41EDD842A7B49A8CEE0CABEDD8"><enum>(4)</enum><text display-inline="yes-display-inline">advanced mobility and access technologies, such as dynamic ridesharing and information systems to support human services for elderly and disabled individuals; and</text></paragraph><paragraph id="H4EB234BA113847C09DCC787A56D768B0"><enum>(5)</enum><text display-inline="yes-display-inline">any deployment concept eligible, before the date of enactment of this section, under the connected vehicle pilot deployment program carried out by the Department of Transportation.</text></paragraph></subsection><subsection id="H6991851F97624E03866594A25193A883"><enum>(e)</enum><header>Use of funds</header><text>Grant amounts received for a project under this section may be used for—</text><paragraph id="H047AA0CA569C4A129FF6412979A7D664"><enum>(1)</enum><text display-inline="yes-display-inline">activities in the development phase, including planning, feasibility analysis, revenue forecasting, environmental review process (as defined under section 139), preliminary engineering and design work, and other preconstruction activities;</text></paragraph><paragraph id="HC2BAFEC3A79547F2A56ED2ED8A83C93C"><enum>(2)</enum><text display-inline="yes-display-inline">construction, reconstruction, rehabilitation, acquisition of real property (including land related to the project and improvements to the land), environmental mitigation, construction contingencies, acquisition of equipment, and operational improvement directly related to improving system performance; </text></paragraph><paragraph id="HB27569C0802D479F847494479CC637FC"><enum>(3)</enum><text display-inline="yes-display-inline">providing incentives to attract driver participation; and</text></paragraph><paragraph id="HFF5AC9F585BD49B1A4706D8587CA926A"><enum>(4)</enum><text display-inline="yes-display-inline">purchasing and installing any connected vehicle equipment (including vehicle applications, roadside units, and back-office equipment).</text></paragraph></subsection><subsection id="H6A7C54E62AE64DA3895C24FC03D4F407" commented="no"><enum>(f)</enum><header>Applications</header><paragraph id="H84840E415DBE4A70B014FAAF7629E7ED" commented="no"><enum>(1)</enum><header>In general</header><text>To be eligible for a grant under this section, an entity described under subsection (c) shall submit to the Secretary an application in such form, at such time, and containing such information as the Secretary determines is appropriate, including—</text><subparagraph id="HE258723B1AE2482C999A215E3E009142" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">a plan to deploy and provide for the long-term operation and maintenance of connected vehicle technologies to improve safety, efficiency, and system performance;</text></subparagraph><subparagraph id="H36FD1518B6174B69874231EFA39F39D4" commented="no"><enum>(B)</enum><text>objectives to improve and measure system performance in 1 or more of—</text><clause id="H29BA320A37F146639A512D8445E72B00" commented="no"><enum>(i)</enum><text display-inline="yes-display-inline">system productivity;</text></clause><clause id="H8EC680D6A665432EBFFA1B9F7C2A71A4" commented="no"><enum>(ii)</enum><text>mobility, including impact on freight movements;</text></clause><clause id="H9E41C642D984473BA2500F0A2918FDB4" commented="no"><enum>(iii)</enum><text>livability and accessibility of goods, services, and activities;</text></clause><clause id="H15F90E4AAACE4CB38A4BF03A3A8AF563" commented="no"><enum>(iv)</enum><text>environment and fuel use; and </text></clause><clause id="HA5B849FFB4C243D4ABECBD144CD30411" commented="no"><enum>(v)</enum><text>traveler and system safety, including advising individuals of potentially unsafe conditions and mitigating the impact of events that may cause vehicle accidents; and</text></clause></subparagraph><subparagraph id="H937F4511AF73483FA8D55A29757D6B4A" commented="no"><enum>(C)</enum><text display-inline="yes-display-inline">a plan for partnering with private sector entities or public agencies, including multimodal and multijurisdictional entities, research institutions, organizations representing transportation and technology leaders, or other transportation stakeholders.</text></subparagraph></paragraph><paragraph id="H755EFBBD5F834F24810C86A10534AFCE" commented="no"><enum>(2)</enum><header>Criteria</header><text>When evaluating applications under this section, the Secretary may not require that a pilot deployment under the program be based on research carried out or funded by the Department of Transportation.</text></paragraph></subsection><subsection id="HF6AD3110557448A2A1B7A7B22AB13A57"><enum>(g)</enum><header>Grant selection</header><paragraph id="H1ACBF5E22FFC4F67A77E87DADF4BE17C"><enum>(1)</enum><header>Grant awards</header><text>Not later than 1 year after the date of enactment of this section, and each fiscal year thereafter, the Secretary shall award grants to not less than 3 and not more than 5 eligible entities described in subsection (c). </text></paragraph><paragraph id="HD3F97B68654741AAA3EB0F6B7D7541B3"><enum>(2)</enum><header>Geographic diversity</header><text display-inline="yes-display-inline">In awarding a grant under this section, the Secretary shall ensure, to the extent practicable, that grant recipients represent diverse geographic areas of the United States, including urban areas and rural areas.</text></paragraph></subsection><subsection id="H06123FC1DE4B4876865CC9DB647307E4"><enum>(h)</enum><header>Grant management</header><text>In carrying out the grant program under this section, the Secretary shall—</text><paragraph id="H15281F1AA2E74E7AB87641EFF7B38CCE"><enum>(1)</enum><text display-inline="yes-display-inline">emphasize project sustainability and long-term funding goals;</text></paragraph><paragraph id="H76534D0352A640D1AA6E59382480F1BC"><enum>(2)</enum><text display-inline="yes-display-inline">create a noncompetitive environment and encourage collaboration among project sites;</text></paragraph><paragraph id="HF47C1FDC43F04B84B01A6A01EDB983B1"><enum>(3)</enum><text display-inline="yes-display-inline">balance the privacy of users and secure operations of pilot projects, while maintaining the ability to measure performance factors; and </text></paragraph><paragraph id="HF06476A4B4C14399B5755BB9F4E202C7"><enum>(4)</enum><text display-inline="yes-display-inline">be wary of technological maturity of connected vehicle applications and impact of long-term viability of non-deployment ready applications.</text></paragraph></subsection><subsection id="H0079E5EBE277452CBC90D7691F02A10E"><enum>(i)</enum><header>Smart Grid defined</header><text display-inline="yes-display-inline">In this section, the term <term>Smart Grid</term> means a system that provides for any of the smart grid functions set forth in section 1306(d) of the Energy Independence and Security Act of 2007 (<external-xref legal-doc="usc" parsable-cite="usc/42/17386">42 U.S.C. 17386(d)</external-xref>).</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H2B690CF6B66C458EB2F873B7A056EE6D"><enum>(b)</enum><header>Clerical amendment</header><text display-inline="yes-display-inline">The analysis for <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/23/5">chapter 5</external-xref> of title 23, United States Code, is amended by adding at the end the following new item:</text><quoted-block style="USC" id="HFF952840FA18435FB5587EADFC21ACF3" display-inline="no-display-inline"><toc regeneration="no-regeneration"><toc-entry level="section">521. and</text></clause><clause id="HA386C865737A457A92CCD9930F22F587" commented="no"><enum>(iii)</enum><text>a baseline of roadway characteristics needed for the safe and efficient operation of automated driving system technologies; and</text></clause></subparagraph><subparagraph id="H7E118F159E3B49288895098D3C65CD61" commented="no"><enum>(C)</enum><text>encourage collaboration and partnerships of multiple stakeholders to carry out subparagraphs (A) and (B).</text></subparagraph></paragraph></subsection><subsection id="H6B897375DA5B4DE6B2962CF7D6160739"><enum>(b)</enum><header>Eligible entities</header><text display-inline="yes-display-inline">The Secretary may make a grant under this section to the following:</text><paragraph id="H8390662E97984E569357097FB14784D0"><enum>(1)</enum><text display-inline="yes-display-inline">A State or a group of States.</text></paragraph><paragraph id="H4BCF61E829754E59B0FDE81A41AB05AD"><enum>(2)</enum><text>A transit agency.</text></paragraph><paragraph id="H382D59FD586E4177AB98ADEFB8D3F90F"><enum>(3)</enum><text display-inline="yes-display-inline">A metropolitan planning organization that serves an urbanized area with a population of more than 200,000 individuals.</text></paragraph><paragraph id="HA534B42A6E8D40AEB185A1A5B040E9A5"><enum>(4)</enum><text display-inline="yes-display-inline">A unit of local government or a group of local governments.</text></paragraph><paragraph id="H4D0C7CDBAC064B57B47E8770B9A01A28"><enum>(5)</enum><text display-inline="yes-display-inline">A political subdivision of a State or local government.</text></paragraph><paragraph id="HE900E71B8C7A4057802512CBB82D045C"><enum>(6)</enum><text display-inline="yes-display-inline">A special purpose district or public authority with a transportation function, including a port authority.</text></paragraph><paragraph id="H713380B2D51747D396EE36CE164232D2"><enum>(7)</enum><text display-inline="yes-display-inline">A public academic institution, public research institution, a multijurisdictional group (as such term is defined in section 520), or a consortia of research institutions or academic institutions.</text></paragraph></subsection><subsection id="HB1B8CC833C5142FFA4279F00670745A9"><enum>(c)</enum><header>Applications</header><text display-inline="yes-display-inline">To be eligible for a grant under this section, an entity described under subsection (b) shall submit to the Secretary an application in such form, at such time, and containing such information as the Secretary determines is appropriate.</text></subsection><subsection id="HC523CE401758496092884C95BFFF819F"><enum>(d)</enum><header>Eligible uses</header><paragraph id="H833D4E9C99274826846A81522F45FFB0"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">A grant recipient may use funds awarded under this section to demonstrate automated driving system technologies, including—</text><subparagraph id="HC58B486E46FC4D91A1B4BADD73126A78" commented="no"><enum>(A)</enum><text display-inline="yes-display-inline">advanced safety systems, including vehicle-to-vehicle and vehicle-to-infrastructure communications, technologies associated with autonomous vehicles, and other collision avoidance technologies, including systems using cellular technology;</text></subparagraph><subparagraph id="H2F3342550B8B481F830EBC663BE8BD72"><enum>(B)</enum><text display-inline="yes-display-inline">innovative mobility solutions that involve deployment of automated vehicles;</text></subparagraph><subparagraph id="H662CFEA5E3494ED3BD5B30F90EA033BC"><enum>(C)</enum><text display-inline="yes-display-inline">automated driving systems that enhance safety and mobility for elderly and disabled individuals;</text></subparagraph><subparagraph id="H4BAB60A9A94A4444B3A6279A18CBEAB9"><enum>(D)</enum><text display-inline="yes-display-inline">demonstration of shared interoperable fleet of automated vehicles;</text></subparagraph><subparagraph id="H88648969F7574BADBFAA9D0D5E5A5317"><enum>(E)</enum><text display-inline="yes-display-inline">demonstration and validation of exchanges of data that can support the safe, efficient, and secure interoperable integration of automated driving systems;</text></subparagraph><subparagraph id="H806CEB3102024DD3942828BB6DC3C6B5"><enum>(F)</enum><text display-inline="yes-display-inline">any technology associated with automated driving systems; and</text></subparagraph><subparagraph id="HB9A5C5FA4A1844679D505BB15D8C977D"><enum>(G)</enum><text display-inline="yes-display-inline">any deployment concept eligible under the automated driving system demonstration grant program carried out by the Department of Transportation before the date of enactment of this section.</text></subparagraph></paragraph><paragraph id="HE988855AF0BA42549F0AEA64F187CB47"><enum>(2)</enum><header>Additional uses</header><text display-inline="yes-display-inline">A grant recipient may use funds awarded under this section for infrastructure needs, including capital expenses and maintenance activities, necessary to the proper and safe operation of the automated driving system technology.</text></paragraph></subsection><subsection id="H4CCB452543784B409806E4A522F852C8"><enum>(e)</enum><header>Grant selection</header><paragraph id="HA3087EF0529249BB95EF907EE7E1F4C1"><enum>(1)</enum><header>Grant awards</header><text display-inline="yes-display-inline">The Secretary may award grants to not less than 8 and not more than 10 eligible entities described under subsection (b) in a fiscal year. </text></paragraph><paragraph id="H0AD2092BDBC04DDF8CCE08D64A537F10" commented="no"><enum>(2)</enum><header>Geographic diversity</header><subparagraph id="HE0F0315FF4CC44EFBA56EB15AFFF274C" commented="no"><enum>(A)</enum><header>In general</header><text>In awarding a grant under this section, the Secretary shall ensure, to the maximum extent practicable, that grant recipients represent diverse geographic areas of the United States, including urban areas and rural areas.</text></subparagraph><subparagraph id="HFB05E00079D447B3A126024C8787ED53" commented="no"><enum>(B)</enum><header>Rural set-aside</header><text display-inline="yes-display-inline">Not less than 20 percent of the amounts made available to carry out this section shall be reserved for projects serving rural areas, to the extent there are sufficient eligible applications for such projects.</text></subparagraph></paragraph></subsection><subsection id="HB5CECB5F1A1C47A79B72F35BEEFA384D"><enum>(f)</enum><header>Demonstration requirements</header><text display-inline="yes-display-inline">The Secretary shall ensure that any project carried out with funds provided under this section shall—</text><paragraph id="H0CA2E98038F54DAAA9E488E5C859C8EE"><enum>(1)</enum><text display-inline="yes-display-inline">carry out research and development of automated driving system technologies of Level 3 or greater, as such term is defined pursuant to subsection (h); </text></paragraph><paragraph id="HE5F8B990B95C466CA1959E708D133294" commented="no"><enum>(2)</enum><text>include physical and fully operational demonstrations;</text></paragraph><paragraph id="H2513FE7818CB4FA9BBF59CEECAB9C623"><enum>(3)</enum><text display-inline="yes-display-inline">include gathering and sharing of all relevant data with the Department of Transportation and the relevant State transportation agencies; and</text></paragraph><paragraph id="HD868D91C426940B9A1A83205BBE68FB5"><enum>(4)</enum><text display-inline="yes-display-inline">address scalability to be applicable across the United States to similar road environments.</text></paragraph></subsection><subsection id="H272BAEEB57764BEBBAA3E42CBE6CA848"><enum>(g)</enum><header>Report</header><text display-inline="yes-display-inline">Not later than 1 year after the date on which a grant recipient receives a grant under this section, and annually thereafter until such grant is expended, the recipient shall submit to the Secretary and to the transportation agency of the State in which the project takes place, a report that describes—</text><paragraph id="H77928F17E7E142AEB5D19C9E7FEE24CC"><enum>(1)</enum><text display-inline="yes-display-inline">lessons learned and how the demonstration has met project objectives;</text></paragraph><paragraph id="H2BF9D22DEBB44515BCA8BC7807F43CFD"><enum>(2)</enum><text display-inline="yes-display-inline">a summary of any complications experienced with the project, including complications related to pedestrians, infrastructure, and other vehicles;</text></paragraph><paragraph id="H5306F0676F8B44049E1AFD6A056B698D"><enum>(3)</enum><text display-inline="yes-display-inline">how to use the results of the project to help the public interact and better understand the operations of automated driving system technologies; and</text></paragraph><paragraph id="H769EE5C2CD204BD491286E019C2CBAE7"><enum>(4)</enum><text display-inline="yes-display-inline">recommendations for improving roadway characteristics needed for the safe and efficient operation of automated driving system technologies within the State or jurisdiction in which the project took place.</text></paragraph></subsection><subsection id="HC38329A1ADA64750BA4D83B5FAFC3EDC"><enum>(h)</enum><header>Guidance required</header><text display-inline="yes-display-inline">Not later than 120 days after the date of enactment of this section, the Secretary shall issue guidance defining the term Level 3 or greater by considering industry best practices and standards, including the definition found within <quote>Taxonomy and Definitions for Terms Related to Driving Automation Systems for On-Road Motor Vehicles</quote> published by SAE International on June 15, 2018 (J3016_201806), or subsequent versions.</text></subsection><subsection id="H4F0714EEF24D4B588651A02629882325" commented="no"><enum>(i)</enum><header>Automated driving system technologies defined</header><text display-inline="yes-display-inline">In this section, the term <term>automated driving system technologies</term> means the hardware and software that are collectively capable of performing the entire dynamic driving task on a sustained basis, regardless of whether such capability is limited to a specific operational design domain.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H5D13E14AA3C64BDCBC63F31FB300495F"><enum>(b)</enum><header>Clerical amendment</header><text display-inline="yes-display-inline">The analysis for <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/23/5">chapter 5</external-xref> of title 23, United States Code, is amended by adding at the end the following new item:</text><quoted-block style="USC" id="H27F22B06EC634612AEDBE29683D77FCC" display-inline="no-display-inline"><toc regeneration="no-regeneration"><toc-entry level="section">522. Automated driving system demonstration program.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H49FC6CC75D664829A89552C286EF4B80"><enum>(c)</enum><header>Preparing roadways for automated vehicles</header><text display-inline="yes-display-inline">Section 133(b) of title 23, United States Code, is amended by adding at the end the following:</text><quoted-block style="USC" id="H0F06001A31954628AF75DBC7419F84DC" display-inline="no-display-inline"><paragraph id="HFBDCEDC9104743DB9A54556F2F5EB46B"><enum>(16)</enum><text display-inline="yes-display-inline">Capital and maintenance expenses for infrastructure improvements to ensure the proper and safe operation of automated driving system technologies for which a demonstration project was carried out under section 522.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section><section id="H9D293E68A0654BAD872ED639B52B0401"><enum>5.</enum><header>Accelerated implementation and deployment of advanced digital construction management systems</header><subsection id="H65CA4E2236914044AD1E6CF2DCD578BF"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 503(c) of title 23, United States Code, is amended by adding at the end the following:</text><quoted-block style="USC" id="H117931DE199C414EB39089910EAD0B94" display-inline="no-display-inline"><paragraph id="HD301F5E181674F23A75F81AD09DC0812"><enum>(4)</enum><header>Accelerated implementation and deployment of advanced digital construction management systems</header><subparagraph id="H432F2536D3EB416699E518F8B14DFC71" commented="no"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 6 months after the date of enactment of this paragraph, the Secretary of Transportation shall establish and implement an advanced digital construction management system program under the technology and innovation deployment program established under paragraph (1) and implemented pursuant to paragraph (2) to—</text><clause id="H6B0D5F87657948D8BFE3AA15EA432EBB" commented="no"><enum>(i)</enum><text>deploy advanced digital construction management systems that enable the use of digital technologies on construction sites by contractors and leverage the use of such technologies, including state-of-the-art automated and connected machinery and optimized routing software that allows individuals to perform tasks faster, safer, more accurately, and with minimal supervision;</text></clause><clause id="H110FBF1EC56B4BA7A30C61C220B6E60E" commented="no"><enum>(ii)</enum><text>accelerate State adoption of advanced digital construction management systems applied throughout the design, engineering, construction, and operations phases of a construction project that—</text><subclause id="H3C06F6A404E241A9A802439F3D2A5BF2" commented="no"><enum>(I)</enum><text>maximize interoperability with other systems, products, tools, or applications;</text></subclause><subclause id="HC485C583314F4BD1AED9668C69279D82" commented="no"><enum>(II)</enum><text>increase productivity;</text></subclause><subclause id="HA528F05A54D146B8B446793C687D3923" commented="no"><enum>(III)</enum><text>manage complexity of a construction project;</text></subclause><subclause id="H7CCB2BD15B23468E8BDE4C3CA304E099" commented="no"><enum>(IV)</enum><text>reduce project delays and cost overruns; and</text></subclause><subclause id="H4129934E3C8F453DA89765B16FEA8871" commented="no"><enum>(V)</enum><text>enhance safety of individuals involved and quality of a construction project; </text></subclause></clause><clause id="HA1E4E36EA01B4C0C934C61B492728688" commented="no"><enum>(iii)</enum><text>share information among stakeholders through reduced reliance on paper to manage construction processes and deliverables, including blueprints, design drawings, procurement and supply-chain orders, equipment logs, daily progress reports, and punch lists;</text></clause><clause id="H852C0CBC9C514B968D18FAFD922D48D3" commented="no"><enum>(iv)</enum><text>develop and deploy best practices for use in advanced digital construction management systems;</text></clause><clause id="HDB21C1A5B83147A587BE66BC8E6CBA07" commented="no"><enum>(v)</enum><text>increase the adoption and deployment of technology by States and units of local government that enables entities carrying out construction projects to—</text><subclause id="HCAB7DEFE5B9143C9A53711A0C75BDF02" commented="no"><enum>(I)</enum><text>integrate the adoption of advanced digital construction management systems and technologies in contracts; and</text></subclause><subclause id="H0892E9CD96794846A5F14BA8F124114A" commented="no"><enum>(II)</enum><text>weigh the cost of digitization and technology in setting project budgets;</text></subclause></clause><clause id="HF1C6A0D40E6541D4ADDD87E0BCF76B8D" commented="no"><enum>(vi)</enum><text display-inline="yes-display-inline">implement technology training and workforce development to build the capabilities of entities carrying out construction projects that enables States and units of local government to—</text><subclause id="H5756E5690FDA4892B6FC21CE005F4E0C" commented="no"><enum>(I)</enum><text>better manage projects using advanced digital construction management technologies; and</text></subclause><subclause id="H43864F07A8674215A77B7928CF1110B8" commented="no"><enum>(II)</enum><text>properly measure and reward technology adoption across construction projects carried out by the State or unit of local government;</text></subclause></clause><clause id="H9A22BB985FA9489490B12C90B6F79BE9" commented="no"><enum>(vii)</enum><text display-inline="yes-display-inline">develop guidance to assist States in updating regulations of such States to allow entities carrying out construction projects to—</text><subclause id="HFBCD3A41708D4081BCAB86A35F5CC909" commented="no"><enum>(I)</enum><text>report data relating to the project in digital formats; and</text></subclause><subclause id="HF2C62225AC4D40249E7173155B31217F" commented="no"><enum>(II)</enum><text>fully capture the efficiencies and benefits of advanced digital construction management systems and related technologies;</text></subclause></clause><clause id="H6A5F89F0A6BC4873A9857901E5B391C1" commented="no"><enum>(viii)</enum><text>reduce the environmental footprint of construction projects by using advanced digital construction management systems to eliminate traffic congestion through more efficient projects; and</text></clause><clause id="H0F084E3C6C92476E878E4B1AC83A6A25" commented="no"><enum>(ix)</enum><text>enhance worker and roadway user safety.</text></clause></subparagraph><subparagraph id="H8AEB5398685D411B97799F904139008A"><enum>(B)</enum><header>Funding</header><text display-inline="yes-display-inline">The Secretary shall obligate for each of fiscal years 2022 through 2026 from funds made available to carry out this subsection such funds as may be necessary to carry out this paragraph.</text></subparagraph><subparagraph id="H7EB52B961BCB4B0485AB86CA4A4AE0B8"><enum>(C)</enum><header>Publication</header><clause id="H2E3391B4D87943E2BCDDEE910AC02010"><enum>(i)</enum><header>In general</header><text display-inline="yes-display-inline">At least once every 2 years, the Secretary shall issue and make available to the public on the website of the Department of Transportation a report on—</text><subclause id="H5527C09277C74F15AACF8DC9FBF542B0"><enum>(I)</enum><text display-inline="yes-display-inline">progress made in the implementation of advanced digital construction management systems by States; and</text></subclause><subclause id="H9C4589F89663485CA92CAAD18CCA9AA9"><enum>(II)</enum><text display-inline="yes-display-inline">the costs and benefits of the deployment of technology and innovations resulting from the program established under this paragraph.</text></subclause></clause><clause id="HA9B20AC76B564D9F818C85F7B15CE335"><enum>(ii)</enum><header>Inclusions</header><text>The report required under clause (i) may include an analysis of—</text><subclause id="H2593BF4F7DD441A9801AE72E2A141C50"><enum>(I)</enum><text display-inline="yes-display-inline">Federal, State, and local cost savings;</text></subclause><subclause id="H558908B959534A37B654A47FD3136050"><enum>(II)</enum><text display-inline="yes-display-inline">project delivery time improvements;</text></subclause><subclause id="H27E38075573F4990976F2B81AA026502"><enum>(III)</enum><text display-inline="yes-display-inline">traffic congestion impacts; and</text></subclause><subclause id="HF7E6491740BE46CABADC3DAE7523A76A"><enum>(IV)</enum><text display-inline="yes-display-inline">safety improvements for roadway users and construction workers.</text></subclause></clause></subparagraph><subparagraph id="HB49FDE69449046748AA9C56536234B70" commented="no"><enum>(D)</enum><header>Advanced digital construction management systems defined</header><text display-inline="yes-display-inline">In this paragraph, the term <term>advanced digital construction management systems</term> means commercially proven digital technologies and processes for the management of construction and engineering activities, including—</text><clause id="H55BB6C72A6B340FB9643721B2328EFF6" commented="no"><enum>(i)</enum><text>systems for infrastructure planning, coordination, construction, maintenance, modernization and management; and</text></clause><clause id="H81C953F8787C48579AD26C2E437A3D7B" commented="no"><enum>(ii)</enum><text>asset management systems for machines, site equipment, and personnel.</text></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H5530B458CC0348239E8379CBF652C993"><enum>(b)</enum><header>Report to Congress</header><text display-inline="yes-display-inline">Not later than 1 year after the date of enactment of this Act, the Secretary shall submit to the Committee on Environment and Public Works of the Senate and the Committee on Transportation and Infrastructure of the House of Representatives a report that includes—</text><paragraph id="H46FDD0E581934471A8E4C474AA6FDD86"><enum>(1)</enum><text>a description of—</text><subparagraph id="HAE408C3105EF479EB459CCE13AAF4F91"><enum>(A)</enum><text display-inline="yes-display-inline">the status of the program carried out under section 503(c)(4) of title 23, United States Code, and any other use of advanced digital construction management systems in each State; and </text></subparagraph><subparagraph id="HBDF9D87A201F4EFBB964C7EACE07769D"><enum>(B)</enum><text display-inline="yes-display-inline">the progress of each State toward accelerating the adoption of advanced digital construction management systems; and</text></subparagraph></paragraph><paragraph id="HFADDC7382FEE49D6978E3438E9C6C20F"><enum>(2)</enum><text display-inline="yes-display-inline">an analysis of the savings in project delivery time and project costs that can be achieved through the use of advanced digital construction management systems.</text></paragraph></subsection></section><section id="H17622661ADBB4DCCB7EF2CF9B6A0B441"><enum>6.</enum><header>Innovative project delivery methods</header><text display-inline="no-display-inline">Section 120(c)(3) of title 23, United States Code, is amended—</text><paragraph id="H5B04941400D8457C906A4B1B4389A066"><enum>(1)</enum><text>in subparagraph (B)—</text><subparagraph id="H7CA84D69DE9A43DD9F3CB112F596091C"><enum>(A)</enum><text display-inline="yes-display-inline">in clause (v) by striking <quote>or</quote> at the end;</text></subparagraph><subparagraph id="HF85FFD25329E47D888CFF53DCDF18B14"><enum>(B)</enum><text>in clause (vi) by striking the period and inserting <quote>; or</quote> ; and</text></subparagraph><subparagraph id="H96A8278040024A07AAA480F24D8FE9F6"><enum>(C)</enum><text>by inserting at the end the following:</text><quoted-block style="USC" id="H0B99602C2A654A31BE4C6BA366912FCA" display-inline="no-display-inline"><clause id="H0B73022462F04E79B7EBEAFA58B1989E"><enum>(vii)</enum><text display-inline="yes-display-inline">advanced digital construction management systems as defined in section 503(c)(4). </text></clause><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="HF583BBEBF31C4232AA229AD9A7A59370"><enum>(2)</enum><text>in subparagraph (C)(i) by striking <quote>10 percent</quote> and inserting <quote>25 percent</quote>.</text></paragraph></section></legis-body></bill>
