which was referred to the <committee-name committee-id="HIF00">Committee on Energy and Commerce</committee-name>, and in addition to the Committee on <committee-name committee-id="HII00">Natural Resources</committee-name>, for a period to be subsequently determined by the Speaker, in each case for consideration of such provisions as fall within the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To provide that a project for the deployment or modification of a communications facility entirely within a brownfield site is not subject to requirements to prepare certain environmental or historical preservation reviews.</official-title></form><legis-body id="H7AB0E41013C2450EB791EF3EA1E98F5B" style="OLC"><section id="H8931C6188B1C436C92786434806D3C57" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Brownfields Broad­band Deployment Act</short-title></quote>.­</text></section><section id="HDC90CEBDA43646489442AA652692D5B4"><enum>2.</enum><header>Application of NEPA and NHPA to brown­fields</header><subsection id="HCAFDEB99634F4F3B95F84C6C46CD1435"><enum>(a)</enum><header>NEPA exemption</header><text display-inline="yes-display-inline">A covered project shall not be subject to the requirements of section 102(2)(C) of the National Environmental Policy Act of 1969 (<external-xref legal-doc="usc" parsable-cite="usc/42/4332">42 U.S.C. 4332(2)(C)</external-xref>).</text></subsection><subsection id="HD0F9C505C24B410395039C206E98FD58"><enum>(b)</enum><header>National Historic Preservation Act exemption</header><text display-inline="yes-display-inline">A covered project shall not be considered an undertaking under section 300320 of title 54, United States Code.</text></subsection><subsection id="H947EF0E785CE499C8253B3E3376A09AE"><enum>(c)</enum><header>Definitions</header><text>In this section:</text><paragraph id="H6002E9C82E00498B98B27A23148F1071"><enum>(1)</enum><header>Commission</header><text>The term <term>Commission</term> means the Federal Communications Commission. </text></paragraph><paragraph id="HBD3E229E4F0040D1B332A9C56391A22D"><enum>(2)</enum><header>Communications facility</header><text>The term <term>communications facility</term> includes—</text><subparagraph id="H55E1C62108C74E329C22B5BE7958C398"><enum>(A)</enum><text>any wireless or wireline infrastructure for the transmission of writing, signs, signals, data, images, pictures, or sounds of all kinds;</text></subparagraph><subparagraph id="H032D812AF08840D7808134C05E9EBAB3"><enum>(B)</enum><text display-inline="yes-display-inline">any transmitting device, tower, or support structure, and any equipment, switches, wiring, cabling, power sources, shelters, or cabinets, associated with the provision of communications service; and</text></subparagraph><subparagraph id="HB8F566FF9E0E427F8FAA1A1C7437FE03"><enum>(C)</enum><text>any antenna or apparatus that—</text><clause id="HA5E80B078F6A4BF5A96E71EB266C5224"><enum>(i)</enum><text>is designed for the purpose of emitting radio frequency;</text></clause><clause id="H76860E7DE7E24BF18D3A30AB47508F95"><enum>(ii)</enum><text>is designed to be operated, or is operating, from a fixed location; and</text></clause><clause id="HEC847873CD3A4FC1A1B575017020AFC5"><enum>(iii)</enum><text>is added to a tower, building, or other structure.</text></clause></subparagraph></paragraph><paragraph id="H8553F8D0FE3F4E1A9556826B66323862"><enum>(3)</enum><header>Communications service</header><text>The term <term>communications service</term> means a service for the transmission of writing, signs, signals, data, images, pictures, or sounds of all kinds.</text></paragraph><paragraph id="H6800C2E8DF324DAFB02D8A942F0816EF"><enum>(4)</enum><header>Covered project</header><text display-inline="yes-display-inline">The term <term>covered project</term> means a project—</text><subparagraph id="H41AA082CC7B84A54A3E66A2B1992DD02"><enum>(A)</enum><text>for the deployment or modification of a communications facility that is to be carried out entirely within a brownfield site (as defined in section 101 of the Comprehensive Environmental Response, Compensation, and Liability Act of 1980 (<external-xref legal-doc="usc" parsable-cite="usc/42/9601">42 U.S.C. 9601</external-xref>)); and</text></subparagraph><subparagraph id="H28F1C0F02FBA469797371B7AD20CB9F9"><enum>(B)</enum><text display-inline="yes-display-inline">for which a permit, license, or approval from the Commission is required or that is otherwise subject to the jurisdiction of the Commission.</text></subparagraph></paragraph></subsection></section></legis-body></bill>
