which was referred to the <committee-name committee-id="HIF00">Committee on Energy and Commerce</committee-name>, and in addition to the Committee on <committee-name committee-id="HII00">Natural Resources</committee-name>, for a period to be subsequently determined by the Speaker, in each case for consideration of such provisions as fall within the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To provide that the deployment of a small personal wireless service facility shall not constitute an undertaking under section 300320 of title 54, United States Code, or a major Federal action for the purposes of section 102(2)(C) of the National Environmental Policy Act of 1969, and for other purposes.</official-title></form><legis-body id="H9E78AB19059E473B8B8572DDFAF4D780" style="OLC"><section id="H2AC6CC6AFFDE45F39956C182636E9B90" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Reducing Antiquated Permitting for Infrastructure Deployment Act</short-title></quote> or the <quote><short-title>RAPID Act</short-title></quote>.</text></section><section id="H3604B4BBAF8F4737A0E7C929FB2EBCD2"><enum>2.</enum><header>Rebuttable presumption on shot clock timeline beginning for purposes of NHPA</header><subsection id="H5B08600BAAEB4C568C70D957847DA7C8"><enum>(a)</enum><header>Definitions</header><text>In this section:</text><paragraph id="H5A94852443974E9D8C37B7201504690D" display-inline="no-display-inline"><enum>(1)</enum><header>Personal wireless service</header><text>The term <term>personal wireless service</term> means—</text><subparagraph id="H47A3051F00B24BA3A26A4757DE66A7AB"><enum>(A)</enum><text>commercial mobile service (as defined in section 332(d) of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/332">47 U.S.C. 332(d)</external-xref>));</text></subparagraph><subparagraph id="H6B87F3DBFC7344FAA3DFCD0833EB7D0D"><enum>(B)</enum><text>commercial mobile data service (as defined in section 6001 of the Middle Class Tax Relief and Job Creation Act of 2012 (<external-xref legal-doc="usc" parsable-cite="usc/47/1401">47 U.S.C. 1401</external-xref>));</text></subparagraph><subparagraph id="HFA871C8A68094EB6A0B0DB3BE5B46505"><enum>(C)</enum><text>unlicensed wireless service; and</text></subparagraph><subparagraph id="H61EA6BEC90CF4D2599054A1A18063140" commented="no" display-inline="no-display-inline"><enum>(D)</enum><text>common carrier wireless exchange access service.</text></subparagraph></paragraph><paragraph id="H017F736E8E2D49DA9C164407FB3A6D38"><enum>(2)</enum><header>Personal wireless service facility</header><text display-inline="yes-display-inline">The term <term>personal wireless service facility</term> means a facility for the provision of personal wireless service.</text></paragraph><paragraph id="H3E7761193F1F40CF8D591583D0C9686C"><enum>(3)</enum><header>Small personal wireless service facility</header><text>The term <term>small personal wireless service facility</term>—</text><subparagraph id="H4E81DA567AE74A27B3CB8757E809561C"><enum>(A)</enum><text display-inline="yes-display-inline">means a personal wireless service facility in which each antenna is not more than 3 cubic feet in volume; and</text></subparagraph><subparagraph id="HDA2688AB38E144FB900387889A663302"><enum>(B)</enum><text>does not include a wireline backhaul facility.</text></subparagraph></paragraph><paragraph id="H44E52CE3418644889F30E6B52E921B23"><enum>(4)</enum><header>Wireline backhaul facility</header><text display-inline="yes-display-inline">The term <term>wireline backhaul facility</term> means an above-ground or underground wireline facility used to transport communications service or other electronic communications from a small personal wireless service facility or its adjacent network interface device to a communications network.</text></paragraph></subsection><subsection id="HD8240258EB2546269B97E7C96081AF7F"><enum>(b)</enum><header>In general</header><text display-inline="yes-display-inline">The deployment of a small personal wireless service facility shall not constitute an undertaking under section 300320 of title 54, United States Code, or a major Federal action for the purposes of section 102(2)(C) of the National Environmental Policy Act of 1969 (<external-xref legal-doc="usc" parsable-cite="usc/42/4332">42 U.S.C. 4332</external-xref>). </text></subsection><subsection id="H4868A74D81A943CE85EB9B50E665CE4B"><enum>(c)</enum><header>Rebuttable presumption</header><paragraph id="H649AA8B46AC34E1488F30BD2F6EDF52C"><enum>(1)</enum><header>In general</header><text>If an Indian Tribe or Native Hawaiian Organization is shown to have received a complete Form 620 or Form 621 (or any successor form), or can be reasonably expected to have received a complete Form 620 or Form 621 (or any successor form), and has not acted on a complete request contained in the form within 45 days after such receipt—</text><subparagraph id="HF9489A13A88145A98302320912AB75DE"><enum>(A)</enum><text>the Commission and a court of competent jurisdiction (as the case may be) shall presume the applicant has made a good faith effort to provide the information reasonably necessary for Indian Tribes and Native Hawaiian Organizations to ascertain whether historic properties of religious and cultural significance to them may be affected by the undertaking; and</text></subparagraph><subparagraph id="H51DADD91DBAA4DB1A0BC492BD42D83B3"><enum>(B)</enum><text>the Indian Tribe or Native Hawaiian Organization (as the case may be) shall be presumed to have disclaimed interest in the application.</text></subparagraph></paragraph><paragraph id="H666A089CEC144465AABEB21C2A92AA2E"><enum>(2)</enum><header>Overcoming presumption</header><subparagraph id="HC815094603B545C7A058011B2849FA9E"><enum>(A)</enum><header>In general</header><text>An Indian Tribe or Native Hawaiian Organization may overcome the presumption under paragraph (1) upon favorably demonstrating one or more of the factors to be considered under subparagraph (B).</text></subparagraph><subparagraph id="H8120D9AC5D3E44B0B68396CD55E536D5"><enum>(B)</enum><header>Factors considered</header><text>The review by the Commission or a court of competent jurisdiction under paragraph (1) shall give substantial weight to—</text><clause id="H68DA746081BA487EBE14E5CF0A9879C0"><enum>(i)</enum><text>whether the applicant made a reasonable attempt to follow up with the Indian Tribe or Native Hawaiian Organization not earlier than 30 days, and not later than 50 days, after the applicant submitted a complete Form 620 or Form 621 (as the case may be) to the Indian Tribe or Native Hawaiian Organization; and</text></clause><clause id="H045A858C1D834A0EB7937534D51E3EDA"><enum>(ii)</enum><text display-inline="yes-display-inline">whether the rules of the Commission and Form 620 or Form 621 is found to be in violation of a Nationwide Programmatic Agreement of the Commission.</text></clause></subparagraph></paragraph></subsection></section></legis-body></bill>
