R. 1073</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20210215">February 15, 2021</action-date><action-desc><sponsor name-id="M001159">Mrs. Rodgers of Washington</sponsor> introduced the following bill; which was referred to the <committee-name committee-id="HIF00">Committee on Energy and Commerce</committee-name>, and in addition to the Committee on <committee-name committee-id="HII00">Natural Resources</committee-name>, for a period to be subsequently determined by the Speaker, in each case for consideration of such provisions as fall within the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To provide that construction, rebuilding, or hardening of communications facilities following a major emergency declared by a Governor relating to a wildfire are not subject to requirements to prepare certain environmental or historical preservation reviews.</official-title></form><legis-body id="HB609DAF2975D42E2A83483EF1878EEDD" style="OLC"><section id="HF11BD7E745DB4AE19EC33D12DC9B8CBD" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Wildfire Wireless Resiliency Act</short-title></quote>. </text></section><section id="H87169C3FF5974D1C95D823405245D7D4"><enum>2.</enum><header>Application of NEPA and NHPA to covered communications projects</header><subsection id="HC2104E8394B94719A2EECAB330B1DF7C"><enum>(a)</enum><header>NEPA exemption</header><text display-inline="yes-display-inline">A covered project shall not be subject to the requirements of section 102(2)(C) of the National Environmental Policy Act of 1969 (<external-xref legal-doc="usc" parsable-cite="usc/42/4332">42 U.S.C. 4332(2)(C)</external-xref>).</text></subsection><subsection id="HB07725D822FC4043983CA0807628594F"><enum>(b)</enum><header>National historic preservation act exemption</header><text>A covered project shall not be considered an undertaking under section 300320 of title 54, United States Code.</text></subsection><subsection id="HF7635FDCBCE34400BD881226C9E2FC97"><enum>(c)</enum><header>Definitions</header><text>In this section:</text><paragraph id="HF7AED6D5052F443F86FA265482A5E6B1"><enum>(1)</enum><header>Communications facility</header><text>The term <term>communications facility</term> includes—</text><subparagraph id="HC3A0E664A4954EAE9373D6EA1953CF68"><enum>(A)</enum><text>any wireless or wireline infrastructure for the transmission of writing, sign, signal, data, image, picture, or sound of any kind;</text></subparagraph><subparagraph id="H7B62F188B119435BB3518D46BAF69332"><enum>(B)</enum><text>any transmitting device, tower, or support structure, and any equipment, switch, wiring, cabling, power source, shelter, or cabinet, associated with the provision of communications services; and</text></subparagraph><subparagraph id="HB3AF1D48D5A0426F8FB6DA27F3085441"><enum>(C)</enum><text>any antenna or apparatus that—</text><clause id="H8D971E00C6D446B187A2EB21A8292E13"><enum>(i)</enum><text>is designed for the purpose of emitting radio frequency;</text></clause><clause id="H6F250E7ED73E4F4C8E608AB455670354"><enum>(ii)</enum><text>is designed to be operated, or is operating, from a fixed location; and</text></clause><clause id="HCE5D122956F34D7ABF547FE767A276E6"><enum>(iii)</enum><text>is added to a tower, building, or other structure.</text></clause></subparagraph></paragraph><paragraph id="H6836181DCFE8419EB6203D5BCF5D1868"><enum>(2)</enum><header>Communications service</header><text>The term <term>communications service</term> means a service for the transmission of any writing, sign, signal, data, image, picture, or sound of any kind.</text></paragraph><paragraph id="HAF9359859E1C49F59085331A6EAC4B16"><enum>(3)</enum><header>Covered project</header><text>The term <term>covered project</term> means a project that—</text><subparagraph id="HF14E105BD76549E8B633DAAE07BEA4BA"><enum>(A)</enum><text>is to be carried out entirely within an area for which a Governor has declared a major disaster or an emergency related to a wildfire;</text></subparagraph><subparagraph id="HB9A57BEB83E74ABCA53D59056DF15AF6"><enum>(B)</enum><text>is to be carried out not later than 5 years after the date the Governor made such declaration; and</text></subparagraph><subparagraph id="H2EBD584D6AAE4D819701EF3C33E83B9A"><enum>(C)</enum><text>replaces a communications facility damaged by such disaster or emergency or makes improvements to a communications facility in such area that could reasonably be considered as necessary for recovery from such disaster or emergency or to prevent or mitigate any future disaster or emergency.</text></subparagraph></paragraph></subsection></section></legis-body></bill>
