R. 1071</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20210215">February 15, 2021</action-date><action-desc><sponsor name-id="P000599">Mr. Posey</sponsor> introduced the following bill; which was referred to the <committee-name committee-id="HHA00">Committee on House Administration</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the Help America Vote Act of 2002 to prohibit States from using a voting system which is connected to the Internet in the administration of an election for Federal office.</official-title></form><legis-body id="HC1722EA5E2FF4208BBBEC74868ED0585" style="OLC"><section id="H16D8BDA75A94457AA249D0567DCF3C0E" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Election Technology Integrity and Fraud Prevention Act</short-title></quote>. </text></section><section id="H5ABAFFB534AD4BE79A5B49BC5D09D3CE" section-type="subsequent-section"><enum>2.</enum><header>Prohibiting connection of voting systems to Internet</header><subsection id="H7128E0B4B24C485BAD2BEAFE2B6E49E6"><enum>(a)</enum><header>Prohibition</header><text display-inline="yes-display-inline">Section 301(a) of the Help America Vote Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/52/21081">52 U.S.C. 21081(a)</external-xref>) is amended by adding at the end the following new paragraph:</text><quoted-block style="OLC" id="HDF838BC16D15420BBB216AF367A257A5" display-inline="no-display-inline"><paragraph id="HF05BF9C9FC634C46963F1C655DF8C4D7"><enum>(7)</enum><header>Prohibiting connection of system to the Internet</header><subparagraph id="H1BD0E427D8274B33A8084A091AD429DD"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">No system or device upon which ballots are programmed or votes are cast or tabulated shall be connected to the Internet at any time.</text></subparagraph><subparagraph id="HF8D19E295A534A7EA2FCD2B54308BA61"><enum>(B)</enum><header>Prohibiting acceptance of ballots transmitted online</header><text display-inline="yes-display-inline">The voting system may not directly tabulate any voted ballot which is transmitted to an election official online.</text></subparagraph><subparagraph id="H31DC8B04327546769029CA4AF2704FC6"><enum>(C)</enum><header>Rule of construction</header><text display-inline="yes-display-inline">Nothing contained in this paragraph shall be deemed to prohibit the Commission from conducting the studies under section 242 or to conduct other similar studies under any other provision of law in a manner consistent with this paragraph.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H7CC198FA789B419DBDD3D1D02F12CA5D"><enum>(b)</enum><header>Effective date</header><text>Section 301(d) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/52/21081">52 U.S.C. 21081(d)</external-xref>) is amended by striking the period at the end and inserting the following: <quote>, or, in the case of the requirements of paragraph (7) of subsection (a), on and after January 1, 2022.</quote>.</text></subsection></section></legis-body></bill>
