R. 1070</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20210215">February 15, 2021</action-date><action-desc><sponsor name-id="P000599">Mr. Posey</sponsor> introduced the following bill; which was referred to the <committee-name committee-id="HHA00">Committee on House Administration</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the Help America Vote Act of 2002 to prohibit States from using proprietary voting system hardware or software in the administration of an election for Federal office which prevents the system from meeting the voluntary voting system guidelines for interoperability and auditability issued by the Election Assistance Commission under such Act.</official-title></form><legis-body id="H6CA5EF5AD6A94AE3888F4ACB21720427" style="OLC"><section id="HFF90C1A4CC4E43E998AADF83A7C76CA1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Election Audit Transparency Act</short-title></quote>.</text></section><section id="H66C7B9EE55214D56B8E6420A8635FF69" section-type="subsequent-section"><enum>2.</enum><header>Prohibiting use of proprietary voting system hardware or software not enabling audits</header><subsection id="HBC64BB2F17334185AB35D54F43377D44"><enum>(a)</enum><header>Prohibition</header><text display-inline="yes-display-inline">Section 301(a) of the Help America Vote Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/52/21081">52 U.S.C. 21081(a)</external-xref>) is amended by adding at the end the following new paragraph:</text><quoted-block style="OLC" id="HB62885D29D8B48708BFB08CD3A996ECC" display-inline="no-display-inline"><paragraph id="H85B3B93E21664905A121B61A1240123E"><enum>(7)</enum><header>Prohibiting use of proprietary hardware or software not meeting voluntary guidance for interoperability and auditability</header><text>The voting system may not use any proprietary hardware or software unless the manufacturer of the hardware or software provides the appropriate election official with such information and assistance as the official may require to enable the voting system to be interoperable and auditable in accordance with the most recent voluntary voting system guidelines issued by the Commission under this title.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H30BC94F96BB94328948A7AD2D2E30E24"><enum>(b)</enum><header>Effective date</header><text>Section 301(d) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/52/21081">52 U.S.C. 21081(d)</external-xref>) is amended by striking the period at the end and inserting the following: <quote>, or, in the case of the requirements of paragraph (7) of subsection (a), on and after January 1, 2022.</quote>. </text></subsection></section></legis-body></bill>
