R. 1067</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20210215">February 15, 2021</action-date><action-desc><sponsor name-id="P000609">Mr. Palmer</sponsor> introduced the following bill; which was referred to the <committee-name committee-id="HPW00">Committee on Transportation and Infrastructure</committee-name>, and in addition to the Committee on <committee-name committee-id="HIF00">Energy and Commerce</committee-name>, for a period to be subsequently determined by the Speaker, in each case for consideration of such provisions as fall within the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To streamline the process for consideration of applications for the placement of communications facilities on certain buildings and other property owned by the Federal Government, and for other purposes.</official-title></form><legis-body id="H95E38A98CA0F4AD48079DA5BC87FBBE0" style="OLC"><section id="H4E1AF7E7FC854DBE921C8D8CEA9D0159" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Standard Fees to Expedite Evaluation and Streamlining Act</short-title></quote> or the <quote><short-title>Standard FEES Act</short-title></quote>. </text></section><section id="H9BD2F9A46484452CB2DDDBED1D2458FF"><enum>2.</enum><header>Establishment of common Federal fee schedule</header><subsection id="H8BB2307888A04D74B2BCA109E668E304"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 6409 of the Middle Class Tax Relief and Job Creation Act of 2012 (<external-xref legal-doc="usc" parsable-cite="usc/47/1455">47 U.S.C. 1455</external-xref>) is amended—</text><paragraph id="HA4C1F43F8C3F4D72B1C7A26A5D66C2B9"><enum>(1)</enum><text display-inline="yes-display-inline">by redesignating subsection (d) as subsection (e); and</text></paragraph><paragraph id="H9ED8D6FCA45E4444A1A1CEC8BDD46517"><enum>(2)</enum><text>by inserting after subsection (c) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H7A059094E75440BD92988CD97A1213B2"><subsection id="H0A689E31C27A4C388EA56F980AD0E02E"><enum>(d)</enum><header>Common fee schedule</header><paragraph id="H1CDBEAF0B3254B12A276078587400E2A"><enum>(1)</enum><header>In general</header><text>Notwithstanding any other provision of law, the Administrator of General Services shall establish a common fee schedule for the processing of applications under subsections (b)(1) and (c).</text></paragraph><paragraph id="HB443198CA99A4CE79C724081CA8CF5DA"><enum>(2)</enum><header>Fee guidelines</header><text>The application fees established under paragraph (1) shall be—</text><subparagraph id="HBF39BF46ACA44AC0B29325BDA2CF02F1"><enum>(A)</enum><text>based on direct and actual cost recovery; and</text></subparagraph><subparagraph id="HA3B9F56E49184DB4888B053C9979DB04"><enum>(B)</enum><text>competitively neutral with regard to other users of the building or other property owned by the Federal Government.</text></subparagraph></paragraph><paragraph id="HC6D4D7C8D76F4041A1121F41291F3E48"><enum>(3)</enum><header>Exceptions</header><text>The Administrator of General Services may establish competitively neutral exceptions to the fee amounts established under paragraph (1)—</text><subparagraph id="H12392AD5B64E4CB1BFE3A9A93CE0C732"><enum>(A)</enum><text>in consideration of the public benefit provided by a grant of an easement, right-of-way, or lease; and</text></subparagraph><subparagraph id="H06A09AB7B6B0463D9E948AA080AEC335"><enum>(B)</enum><text>in the interest of expanding wireless and broadband coverage.</text></subparagraph></paragraph><paragraph id="H3C93E20B46994CDCA9DDFD4C33DEF7D3"><enum>(4)</enum><header>Use of fees collected</header><text>Any fee collected by an executive agency under this section shall only be available to the extent, and in such amounts, as are provided in advance in appropriation Acts, to the agency to cover the costs of granting the easement, right-of-way, or lease.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="HFE99D6301CCC4C02898B904ED6E0D6BD"><enum>(b)</enum><header>Deadline</header><text>The Administrator of General Services shall establish the fee schedule required under section 6409(d) of the Middle Class Tax Relief and Job Creation Act of 2012 (<external-xref legal-doc="usc" parsable-cite="usc/47/1455">47 U.S.C. 1455(d)</external-xref>), as added by subsection (a), not later than 30 days after the date of enactment of this Act.</text></subsection></section></legis-body></bill>
