which was referred to the <committee-name committee-id="HIF00">Committee on Energy and Commerce</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the Middle Class Tax Relief and Job Creation Act of 2012 to amend the definition of eligible facilities request, to codify the 60-day time frame for certain eligible facilities requests, and for other purposes.</official-title></form><legis-body id="HCC22B8F2771A435B9F2335001AD01414" style="OLC"><section id="HA250B12705C444F390C1341CA87EFE5E" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Wireless Resiliency and Flexible Investment Act</short-title></quote>. </text></section><section id="H4A3EE1BDAB3C43129EDC8C3A1D661377" section-type="subsequent-section"><enum>2.</enum><header>Codifying 60-day time frame for certain eligible facilities requests</header><text display-inline="no-display-inline"> Section 6409(a) of the Middle Class Tax Relief and Job Creation Act of 2012 (<external-xref legal-doc="usc" parsable-cite="usc/47/1455">47 U.S.C. 1455(a)</external-xref>) is amended—</text><paragraph id="H06F6904F0B3244ED97BC2CBCB6F63B77"><enum>(1)</enum><text display-inline="yes-display-inline">in paragraph (1), by striking <quote>eligible facilities request for a modification of an existing wireless tower or base station that does not substantially change the physical dimensions of such tower or base station</quote> and inserting <quote>complete eligible facilities request for a modification of an existing wireless tower, base station, or eligible support structure that does not substantially change the physical dimensions of such tower, base station, or eligible support structure</quote>; </text></paragraph><paragraph id="H0C7B4432BE6046ED8A1484CFB6C66284"><enum>(2)</enum><text>by amending paragraph (2) to read as follows:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H955155A551F4418CB991336941CDA840"><paragraph id="H1F04AC7F77FA4CA9A3C5AFCE05634BCB"><enum>(2)</enum><header>Time frame</header><subparagraph id="H7E5FC1A4AD894766A14AF00626970048"><enum>(A)</enum><header>In general</header><text>Not later than 60 days after the date on which a State or local government receives a complete eligible facilities request described under paragraph (1), the State or local government shall approve such request.</text></subparagraph><subparagraph id="H644B69EDEB4C4EEC90F29F2ACF4F4F53"><enum>(B)</enum><header>Deemed approval</header><text display-inline="yes-display-inline">If a State or local government does not approve an eligible facilities request by the date required under subparagraph (A), the request is deemed approved on the day after such date.</text></subparagraph><subparagraph id="HF41C7AF1FF7A4BADB1B5CF979C3D138B"><enum>(C)</enum><header>When request considered complete; received</header><clause id="HA2C8BBCDC6FB43DDB4FA680BF5C99A2B"><enum>(i)</enum><header>When request considered complete</header><subclause id="H4E53F9BBEE6B47D69808883AD867EB5A"><enum>(I)</enum><header>In general</header><text>For the purposes of this paragraph, an eligible facilities request to a State or local government shall be considered complete if the requesting party has not received a written notice from the State or local government within 10 business days after the date on which the request is received by the State or local government—</text><item id="HFA92F5EDCA704C5E8CC81E3C87ED364B"><enum>(aa)</enum><text>stating that all the information (including any form or other document) required by the State or local government to be submitted for the request to be considered complete has not been submitted; and </text></item><item id="H2C2C6639DCA343F781135A9FDEFE46B1"><enum>(bb)</enum><text>identifying the information required to be submitted that was not submitted.</text></item></subclause><subclause id="HFBEE7DC1776B470AB40523CF8E4E52F7"><enum>(II)</enum><header>Definition</header><text>In this clause, the term <term>received by the State or local government</term> means—</text><item id="HCD6BDCFF19944A23BC190AC666C3CCBC"><enum>(aa)</enum><text>in the case of an eligible facilities request submitted electronically, on the date on which the request is transmitted; </text></item><item id="H17B9ECCE7252440C9F7CCEEE97E2BEEB"><enum>(bb)</enum><text>in the case of an eligible facilities request submitted in person, on the date on which the request is delivered to the individual or at the location specified by the State or local government for in-person submission; and</text></item><item id="HC8BF8D9B4A2C47E18017C92A3E8D5B69"><enum>(cc)</enum><text>in the case of an eligible facilities request submitted in any other manner, on the date determined under regulations promulgated by the Commission for the manner in which the request is submitted. </text></item></subclause></clause><clause id="HC506474FE9224D63ABEA6638FEEC5BFC"><enum>(ii)</enum><header>When complete request considered received</header><text>For the purposes of this paragraph, a complete eligible facilities request shall be considered received on the date on which the requesting party submits to the State or local government all information (including any form or other document) required by the State or local government to be submitted for the request to be considered complete.</text></clause></subparagraph></paragraph><after-quoted-block>; and </after-quoted-block></quoted-block></paragraph><paragraph id="H218CB95991264CEABB2A012CF9097EE6"><enum>(3)</enum><text>by adding at the end the following: </text><quoted-block id="HA0BCBFF5D28A4F9DB0BDE097ED99FD48" style="OLC"><paragraph id="H70FB29CB59664A41BB302299B71569B1"><enum>(4)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this subsection: </text><subparagraph id="H969EB85EAAE7405DAC6E625929ED9EA7"><enum>(A)</enum><header>Eligible facilities request</header><text>The term <term>eligible facilities request</term> means any request for modification of an existing wireless tower, base station, or eligible support structure that involves—</text><clause id="HC098538714FC46AC8257D371AF25AC45"><enum>(i)</enum><text>collocation of new transmission equipment;</text></clause><clause id="HBDAF3BC713364FD0945C826F5AF980FA"><enum>(ii)</enum><text>removal of transmission equipment;</text></clause><clause id="HF417499921B340A1B98B7196F0DF45D4"><enum>(iii)</enum><text>replacement of transmission equipment; or</text></clause><clause id="H70C21C0431A94B638F668907B6D4AC7B"><enum>(iv)</enum><text>placement, modification, or construction of equipment that—</text><subclause id="H625ADE37617A49F4BB725736BD240E7F"><enum>(I)</enum><text display-inline="yes-display-inline">improves the resiliency of the wireless tower, base station, or eligible support structure; and</text></subclause><subclause id="H0D653ECC1DA941F087CF0373DEE0293B"><enum>(II)</enum><text>provides a direct benefit to public safety, such as—</text><item id="HA7050CDACA674267BA96843F863267BB"><enum>(aa)</enum><text display-inline="yes-display-inline">providing backup power for the wireless tower, base station, or eligible support structure;</text></item><item id="HB03999DA6C284CDD8E60DC761F8A340E"><enum>(bb)</enum><text>hardening the wireless tower, base station, or other eligible support structure; or</text></item><item id="H1EF588DADAA64A139F9ED13BD6E19FC2"><enum>(cc)</enum><text display-inline="yes-display-inline">providing more reliable connection capability using the wireless tower, base station, or eligible support structure.</text></item></subclause></clause></subparagraph><subparagraph id="HD49E9F9F8E104439B42B1FFEEC1290A1"><enum>(B)</enum><header>Eligible support structure</header><text display-inline="yes-display-inline">The term <term>eligible support structure</term> means a structure that supports a personal wireless service facility at the time at which the eligible facilities request is made.</text></subparagraph><subparagraph id="H35A090B270A945D0BB37C87E1A87FDD0"><enum>(C)</enum><header>Personal wireless service facility</header><text>The term <term>personal wireless service facility</term> means a facility necessary for the provision of—</text><clause id="H8C6299DFB97E485F85D00537BB02EB38"><enum>(i)</enum><text display-inline="yes-display-inline">commercial mobile service;</text></clause><clause id="HE0931267BC2345129B962F5133D47910"><enum>(ii)</enum><text>commercial mobile data service (as that term is defined in section 6001 of the Middle Class Tax Relief and Job Creation Act of 2012 (<external-xref legal-doc="usc" parsable-cite="usc/47/1401">47 U.S.C. 1401</external-xref>));</text></clause><clause id="H8FC606D7AAD04B7A91DC38D0DFAE8C40"><enum>(iii)</enum><text>unlicensed wireless service; and </text></clause><clause id="H56C33B9794C942AFA8472B74E60518B3"><enum>(iv)</enum><text>common carrier wireless exchange access service.</text></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section id="H553063EA7E954D8DA90A5E03C7937B54"><enum>3.</enum><header>Implementation</header><text display-inline="no-display-inline">Not later than 180 days after the date of the enactment of this Act, the Federal Communications Commission shall issue final rules implementing section 2 of this Act, and the amendments made by such section.</text></section></legis-body></bill>
