the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To require the Secretary of Education to provide assistance to the immediate family of elementary or secondary school staff members killed in an act of violence while performing school duties.</official-title></form><legis-body id="HDFC84C0B8A914A028DB125E86CC0DE34" style="OLC"><section id="H529E3E68CB384DF19F6490B44C574031" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Teacher Victims’ Family Assistance Act of 2021</short-title></quote>.</text></section><title id="HFBB8C7D239604BE5B5048CCA33239F02"><enum>I</enum><header>Definitions</header><section id="HABF72BEF940645FDB0D0E45C6EA3B544"><enum>101.</enum><header>Definitions</header><text display-inline="no-display-inline">In this title:</text><paragraph id="H2C4B12D17E404C5FB238B800900FAD67"><enum>(1)</enum><header>Cost of attendance</header><text>The term <term>cost of attendance</term> has the meaning given that term in section 472 of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1087ll">20 U.S.C. 1087ll</external-xref>).</text></paragraph><paragraph id="H415B60F8486045DE9276520FD6B97971"><enum>(2)</enum><header>Dependent child</header><text>The term <term>dependent child</term> means a son or daughter of the victim (whether natural or adopted) who is under 25 years old.</text></paragraph><paragraph id="H0060C07A641B4B7B8FED5682931F6CD2"><enum>(3)</enum><header>ESEA terms</header><text>The terms <term>elementary school</term> and <term>secondary school</term> have the meanings given such terms in section 8101 of the Elementary and Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/7801">20 U.S.C. 7801</external-xref>).</text></paragraph><paragraph id="HFAD906F891EF4013AE37067050EE11BD"><enum>(4)</enum><header>Institution of higher education</header><text>The term <term>institution of higher education</term> has the meaning given that term in section 102 of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1002">20 U.S.C. 1002</external-xref>).</text></paragraph><paragraph id="HE5E74E7506B84313AE3B5A60E9A5A1ED"><enum>(5)</enum><header>Surviving spouse</header><text>The term <term>surviving spouse</term> means the spouse of the victim, as determined under applicable State law, at the time of the victim’s death.</text></paragraph><paragraph id="H2E4C37D2068B45A49B50462A62358E32"><enum>(6)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of Education.</text></paragraph><paragraph id="HA4FDC202DD454325AA38BF5D2F7933E7"><enum>(7)</enum><header>Victim</header><text display-inline="yes-display-inline">The term <term>victim</term> means a teacher, administrator, employee, or paid or unpaid staff member of an elementary school or secondary school who was killed by another person as a result of an act of violence while performing duties as such teacher, administrator, employee, or staff member, without regard to whether such performance takes place before, during, or after the school day or on or off school grounds.</text></paragraph></section><section id="H76FB993CD5874C9DBD3D4538C9D5CCC1"><enum>102.</enum><header>Death benefit, funeral assistance, and living allowance for families of victims</header><text display-inline="no-display-inline">In any case in which the Secretary of Education determines that a teacher, administrator, employee, or paid or unpaid staff member meets the definition of victim, the Secretary shall—</text><paragraph id="HDEC41815FB7240219B37D06C5A0B771F"><enum>(1)</enum><text>pay a death benefit of $325,000 and a separate payment of not more than $1,500 to be used for funeral expenses, as follows (if the payee indicated is living on the date on which the determination is made)—</text><subparagraph id="H136D78B16E594895947E81350BC3668A"><enum>(A)</enum><text>if there is no dependent child who survived the victim, to the surviving spouse of the victim;</text></subparagraph><subparagraph id="H1611A87E55F54F47944168CAC46541D2"><enum>(B)</enum><text>if there is at least 1 dependent child who survived the victim and a surviving spouse of the victim, 50 percent to the surviving dependent child (or children, in equal shares) and 50 percent to the surviving spouse;</text></subparagraph><subparagraph id="HFA3DCAF339DE4613B1622ACEFA2D596E"><enum>(C)</enum><text>if there is no surviving spouse of the victim, to the surviving dependent child (or children, in equal shares);</text></subparagraph><subparagraph id="H5D6FAB095D8145DEA3F9DBBA4ADA5251"><enum>(D)</enum><text>if there is no surviving spouse of the victim and no surviving dependent child—</text><clause id="H7EAEF1B7738C44FF8F7A5B10DE8B90BB"><enum>(i)</enum><text>to the surviving individual (or individuals, in shares per the designation, or, otherwise, in equal shares) designated by the victim to receive benefits under this section in the most recently executed designation of beneficiary of the victim on file at the time of death with the victim’s employer, agency, organization, or unit; or</text></clause><clause id="HCCBD8AA5A64940B1B4AA0550C8C08343"><enum>(ii)</enum><text>if there is no individual qualifying under clause (i), to the surviving individual (or individuals, in equal shares) designated by the victim to receive benefits under the most recently executed life insurance policy of the victim on file at the time of death with the victim’s employer, agency, organization, or unit;</text></clause></subparagraph><subparagraph id="H6F9E7DA46F434731932724243F254C67"><enum>(E)</enum><text>if there is no individual qualifying under subparagraph (A), (B), (C), or (D), to the surviving parent (or parents, in equal shares) of the victim; or</text></subparagraph><subparagraph id="HD7A20D525DC5461B9E5FF5F55F604408"><enum>(F)</enum><text>if there is no individual qualifying under subparagraph (A), (B), (C), (D), or (E), to the surviving individual (or individuals, in equal shares) who would qualify under the definition of the term <term>dependent child</term> but for age; and</text></subparagraph></paragraph><paragraph id="H1E839D1BDDCF408CA3C5DCFE96DB3833"><enum>(2)</enum><text>pay a living allowance of $900 per month—</text><subparagraph id="H60C9504E761441F79C5492818454B59D"><enum>(A)</enum><text>to the surviving spouse of the victim, until the earlier of the spouse’s death or remarriage; or</text></subparagraph><subparagraph id="H99ACD5C55841451CAD433668464368A5"><enum>(B)</enum><text display-inline="yes-display-inline">if there is no surviving spouse of the victim, to the surviving dependent child who have not reached the age of 18 (or such children, in equal shares) until such children reach the age of 18.</text></subparagraph></paragraph></section><section id="H3F4E4A7467404A6B8B56DA92041EEA7B"><enum>103.</enum><header>Dependent undergraduate education assistance</header><subsection id="HC17526E2A2EF40C99598277C1D266209"><enum>(a)</enum><header>Annual amount</header><paragraph id="H9ED0589AC2C048C289AF622260C32C91"><enum>(1)</enum><header>In general</header><text>In any case in which the Secretary of Education determines that a teacher, administrator, employee, or paid or unpaid staff member meets the definition of victim, the Secretary shall provide the following educational assistance allowance, for each dependent child of the victim enrolled or accepted for enrollment at a program of undergraduate instruction at an institution of higher education:</text><subparagraph id="HF56BDC72F9584EF183D6FA964F713FE4"><enum>(A)</enum><text display-inline="yes-display-inline">The educational assistance allowance on behalf of a dependent child who is pursuing a program of education consisting of institutional courses shall be paid at the monthly rate of $1,224 for full-time, $967 for three-quarter-time, or $710 for half-time pursuit.</text></subparagraph><subparagraph id="H687E5054F3ED4DFCB7BBA9D3C1693DC6"><enum>(B)</enum><text display-inline="yes-display-inline">The educational assistance allowance on behalf of a dependent child pursuing a program of education on less than a half-time basis shall be paid at the rate of the lesser of—</text><clause id="HE92926B953A9415CA52632097283B6F5"><enum>(i)</enum><text display-inline="yes-display-inline">the established charges for tuition and fees that the educational institution involved requires similarly circumstanced nonveterans enrolled in the same program to pay; or</text></clause><clause id="H5EEBF20B92F64588A0B75E9D5E67B711"><enum>(ii)</enum><text display-inline="yes-display-inline">$1,224 per month for a full-time course.</text></clause></subparagraph><subparagraph id="HB255ED6825CB483B8F725588416F6FB5"><enum>(C)</enum><text display-inline="yes-display-inline">The educational assistance allowance to be paid on behalf of a dependent child who is pursuing a full-time program of education which consists of institutional courses and alternate phases of training in a business or industrial establishment with the training in the business or industrial establishment being strictly supplemental to the institutional portion, shall be computed at the rate of $1,224 per month.</text></subparagraph><subparagraph id="H0E3DA3E6F0FB44DABA15AFD8D10AF7D9"><enum>(D)</enum><text display-inline="yes-display-inline">A dependent child who is enrolled in an educational institution for a “farm cooperative” program consisting of institutional agricultural courses prescheduled to fall within 44 weeks (using “week” as defined under section 205 of the Federal-State Extended Unemployment Compensation Act of 1970 (<external-xref legal-doc="usc" parsable-cite="usc/26/3304">26 U.S.C. 3304</external-xref> note)) of any period of 12 consecutive months and who pursues such program on—</text><clause id="H024BF18C484743FA91829F96D11385F5"><enum>(i)</enum><text display-inline="yes-display-inline">a full-time basis (a minimum of 10 clock hours per week or 440 clock hours in such year prescheduled to provide not less than 80 clock hours in any three-month period);</text></clause><clause id="H04B0CBFD66944257A69F5395C67B61A5"><enum>(ii)</enum><text display-inline="yes-display-inline">a three-quarter-time basis (a minimum of 7 clock hours per week); or</text></clause><clause id="HF5B3D58B111D44A7A8306A786E7A76A6"><enum>(iii)</enum><text display-inline="yes-display-inline">a half-time basis (a minimum of 5 clock hours per week), shall be eligible to receive an educational assistance allowance at the appropriate rate provided in subparagraph (B) of this subsection, if such dependent child is concurrently engaged in agricultural employment which is relevant to such institutional agricultural courses as determined under standards prescribed by the Secretary. In computing the foregoing clock hour requirements there shall be included the time involved in field trips and individual and group instruction sponsored and conducted by the educational institution through a duly authorized instructor of such institution in which the person is enrolled.</text></clause></subparagraph><subparagraph id="H319B8E0620B74F6BBD44CBDDA906F51F"><enum>(E)</enum><text display-inline="yes-display-inline">The monthly educational assistance allowance to be paid on behalf of a dependent child pursuing a farm cooperative program under this section shall be $636 for full-time, $477 for three-quarter-time, or $319 for half-time pursuit.</text></subparagraph><subparagraph commented="no" id="H70EACB225CD74C26853D7A86EA26246D"><enum>(F)</enum><clause commented="no" display-inline="yes-display-inline" id="HC5EB38A299774531ABB143BE0A46CAA2"><enum>(i)</enum><text display-inline="yes-display-inline">Subject to clause (iii), the amount of educational assistance payable under this subsection for a licensing or certification test described below, is the lesser of $2,000 or the fee charged for the test. Qualifying licensing or certification tests shall be determined by the Secretary, which may include—</text><subclause id="HE6EE41A9CFF148C49A128B9054B5794A" indent="up1"><enum>(I)</enum><text>such licensing or certification tests the successful completion of which demonstrates an individual’s possession of the knowledge or skill required to enter into, maintain, or advance in employment in a predetermined and identified vocation or profession, provided such tests and the licensing or credentialing organizations or entities that offer such tests are approved by the Secretary; and</text></subclause><subclause id="H43F07B8D7EEB44E29A4F14EFF0DBA963" indent="up1"><enum>(II)</enum><text>national tests for admission to institutions of higher education (such as the Scholastic Aptitude Test (SAT), Law School Admission Test (LSAT), Graduate Record Exam (GRE), and Graduate Management Admission Test (GMAT)) and national tests providing an opportunity for course credit at institutions of higher education (such as the Advanced Placement (AP) exam and College-Level Examination Program (CLEP)).</text></subclause></clause><clause commented="no" id="H1BF0718F7307428FA46DFC156371A2BA" indent="up1"><enum>(ii)</enum><text>The number of months of educational assistance in the case of any individual for such licensing or certification test is equal to the number (including any fraction) determined by dividing the total amount paid to such individual for such test by the full-time monthly institutional rate of the educational assistance allowance which, except for clause (i), such individual would otherwise be paid under <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/38/35">chapter 35</external-xref> of title 38, United States Code.</text></clause><clause commented="no" id="H1E2AD789588147898BBE8D12877B10B4" indent="up1"><enum>(iii)</enum><text display-inline="yes-display-inline">In no event shall payment of educational assistance under this subsection for such a test exceed the amount of the individual’s available educational assistance as determined by the Secretary and in accordance with this Act.</text></clause></subparagraph><subparagraph commented="no" id="H059D6F6840E642ADB937D23CD35824C8"><enum>(G)</enum><clause commented="no" display-inline="yes-display-inline" id="H86960E53787A4D99B595F457C9B44CD1"><enum>(i)</enum><text>Subject to clause (iii), the amount of educational assistance payable under this section for a national test for admission or national test providing an opportunity for course credit at an institution of higher education, is the amount of the fee charged for the test.</text></clause><clause commented="no" id="HCD84AD3E82B44E38958C2AB5FAA0AD62" indent="up1"><enum>(ii)</enum><text>The number of months of educational assistance provided in the case of any individual for a test described in clause (i) is equal to the number (including any fraction) determined by dividing the total amount of educational assistance paid such individual for such test by the full-time monthly institutional rate of educational assistance, except for clause (i), such individual would otherwise be paid under this section.</text></clause><clause commented="no" id="H7DFB7472E40E4892A8A9C80DAA2DEA4B" indent="up1"><enum>(iii)</enum><text display-inline="yes-display-inline">In no event shall payment of educational assistance under this subsection for a test described in clause (i) exceed the amount of the individual’s available educational assistance as determined by the Secretary and in accordance with this Act.</text></clause></subparagraph></paragraph><paragraph id="HAD457115EAD648C09E1E34D0FA289F5F"><enum>(2)</enum><header>Relation to other assistance</header><text>Assistance provided under this subsection shall not be considered for the purpose of awarding Federal assistance under title IV of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1070">20 U.S.C. 1070</external-xref> et seq.), except that in no case shall the sum of the total amount of student financial assistance awarded to a dependent child under such title and the amount of assistance provided under this subsection exceed the child’s total cost of attendance.</text></paragraph><paragraph id="HDB8866A7802748F48AA1FF08688F60DB"><enum>(3)</enum><header>Duration of assistance</header><text>A dependent child may receive assistance under this subsection for not more than a total of 5 years.</text></paragraph><paragraph id="H84FC7ED1C3DF4EBABCD44CA8BA46F328"><enum>(4)</enum><header>Satisfactory progress</header><text display-inline="yes-display-inline">To be eligible to receive assistance under this subsection, the dependent child shall be considered to be making satisfactory progress, pursuant to section 484(a)(2) of the Higher Education Act of 1965, at the institution of higher education.</text></paragraph><paragraph id="HB7BAD1F60F7F4310AF2015B3251D106D"><enum>(5)</enum><header>Effect of parental death or remarriage</header><text>The death or remarriage of the surviving spouse of the victim shall not affect a dependent child’s eligibility for assistance under this subsection.</text></paragraph></subsection><subsection id="H343CE74E24C540B7BA7FF8C90A9F5BB2"><enum>(b)</enum><header>Pell Grant treatment</header><text>Section 473(b)(2)(B) of the Higher Education Act of 1965 is amended—</text><paragraph id="H1CCF96FEBF9841368F176B289471E14F"><enum>(1)</enum><text>by striking <quote>or</quote> at the end of clause (i);</text></paragraph><paragraph id="H6A092611D2D14A4496F879EFA1458E63"><enum>(2)</enum><text>by striking <quote>; and</quote> at the end of clause (ii) and inserting <quote>; or</quote>; and</text></paragraph><paragraph id="H435F56AFAA0F4CA0940CDC60D30D676A"><enum>(3)</enum><text>by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="H71D35CBF27C341168641FDB2990E4A1C" style="OLC"><clause id="HECD7CEA36D024089802D7378F3D69317"><enum>(iii)</enum><text display-inline="yes-display-inline">a victim (as defined in section 101 of the <short-title>Teacher Victims’ Family Assistance Act of 2021</short-title>); and</text></clause><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="H177ABA82145C48458D603ACB8388ADA7"><enum>(c)</enum><header>Notice of tax treatment</header><text>The Secretary shall provide a notice to each individual receiving assistance under this section, including under the amendments made under subsection (b), that such assistance is excludable from gross income under <external-xref legal-doc="usc" parsable-cite="usc/26/139I">section 139I</external-xref> of the Internal Revenue Code of 1986.</text></subsection></section><section id="H9209653A6C9048D0A333F36BC2796641"><enum>104.</enum><header>Other terms and conditions of benefits</header><text display-inline="no-display-inline">The benefits under section 102 and 103(a) shall have the following terms and conditions:</text><paragraph id="HF34BF4FEDC094044B83B558A96426138"><enum>(1)</enum><text display-inline="yes-display-inline">On October 1 of each fiscal year beginning after the date of enactment of this Act, the Secretary of Education shall adjust the level of each benefit payable immediately before such October 1, to reflect the annual percentage change in the Consumer Price Index for All Urban Consumers, published by the Bureau of Labor Statistics, occurring in the 1-year period ending on June 1 immediately preceding such October 1.</text></paragraph><paragraph id="H5BA6A9E407884A7F9E4933FB784CC746"><enum>(2)</enum><text>The benefits shall be in addition to any other benefit that may be due from any other source.</text></paragraph><paragraph id="HCF1B5A1D2B8343FB938498D791F57CB8"><enum>(3)</enum><text>No benefit paid shall be subject to execution or attachment.</text></paragraph><paragraph id="H6D0A0DF004D245BC880386AEC04C71AA"><enum>(4)</enum><text>Any benefit (other than living expenses) paid with respect to the victim shall be the amount payable as of the date of death of such victim.</text></paragraph></section></title><title id="HA0A6025B2EF145DA92912E7147ED8EF6"><enum>II</enum><header>Tax provisions relating to elementary or secondary school staff members killed in an act of violence while performing school duties</header><section id="H3583FFBF2D974005BDE69CA308E4911C"><enum>201.</enum><header>Tax provisions relating to elementary or secondary school staff members killed in an act of violence while performing school duties</header><subsection id="H3BD598B464B54DC799068C297BDFA852"><enum>(a)</enum><header>Teacher’s wages in year of death excluded from income</header><paragraph id="HEA6BA0E0AA1E4A3982CDBEBC9094E4BE"><enum>(1)</enum><header>In general</header><text>Part II of subchapter J of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/26/1">chapter 1</external-xref> of the Internal Revenue Code of 1986 is amended by adding at the end the following new section:</text><quoted-block id="H7A26C627B4A5465F8EBC46E1A676B021" style="OLC"><section id="H4D81C6444FD240649B326D1343072C8D"><enum>693.</enum><header>Income taxes of elementary or secondary school staff members killed in an act of violence while performing school duties</header><text display-inline="no-display-inline">In the case of any individual who is a victim (as defined by section 101(7) of the <short-title>Teacher Victims’ Family Assistance Act of 2021</short-title>), any tax imposed by this subtitle on any amount received by such individual by reason of school employment shall not apply with respect to the taxable year in which falls the date of death of the individual.</text></section><after-quoted-block>.</after-quoted-block></quoted-block></paragraph><paragraph commented="no" id="H0902D380E1F24304AAF7C60B2A1249B4"><enum>(2)</enum><header>W–2 reporting</header><text display-inline="yes-display-inline">Section 6051(a) of such Code is amended by striking <quote>and</quote> at the end of paragraph (16), by striking the period at the end of paragraph (17) and inserting <quote>, and</quote>, and by inserting after paragraph (17) the following new paragraph:</text><quoted-block display-inline="no-display-inline" id="HAE4835EBEF124C2A9E9348D2F2479A45" style="OLC"><paragraph id="H2E644A0E7A3642BDAB5E07A0D4777589"><enum>(18)</enum><text display-inline="yes-display-inline">the aggregate amount not subject to tax under subtitle A by reason of section 693 (relating to income taxes of elementary or secondary school staff members killed in an act of violence while performing school duties).</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph><paragraph id="H33F70426FA6F4677B97981B43CD09F1C"><enum>(3)</enum><header>Clerical amendment</header><text>The table of sections for part II of subchapter J of chapter 1 of such Code is amended by inserting at the end the following new item:</text><quoted-block id="HB41436C201904B5A8174B341BCBCA4D6" style="OLC"><toc regeneration="no-regeneration"><toc-entry level="section">Sec. 693. Income taxes of elementary or secondary school staff members killed in an act of violence while performing school duties.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="H3C19B13428BE430094FBEE8FF7FFE85A"><enum>(b)</enum><header>Exclusion of teacher victim family assistance</header><paragraph id="HD6C017C30756418185A6C507C013453C"><enum>(1)</enum><header>In general</header><text>Part III of subchapter B of chapter 1 of such Code (relating to items specifically excluded from gross income) is amended by inserting after section 139H the following new section:</text><quoted-block id="HCF4B59BC1D424C918D5D811D3102868D" style="OLC"><section id="H6C69A2556F994BD2BED5213E66DF9513"><enum>139I.</enum><header>Teacher victim family assistance</header><text display-inline="no-display-inline">In the case of an individual, gross income does not include any amount received under title I of the <short-title>Teacher Victims’ Family Assistance Act of 2021</short-title>.</text></section><after-quoted-block>.</after-quoted-block></quoted-block></paragraph><paragraph id="H983E7320C19B45C4AFD3A83FA0C6EE7C"><enum>(2)</enum><header>Clerical amendment</header><text display-inline="yes-display-inline">The table of sections for such part is amended by inserting after the item relating to section 139G the following new item:</text><quoted-block display-inline="no-display-inline" id="H5F78F029C3A744A9A16FFA0EE372243B" style="OLC"><toc container-level="quoted-block-container" idref="HCF4B59BC1D424C918D5D811D3102868D" lowest-bolded-level="division-lowest-bolded" lowest-level="section" quoted-block="no-quoted-block" regeneration="yes-regeneration"><toc-entry idref="H6C69A2556F994BD2BED5213E66DF9513" level="section">Sec. 139I. Teacher victim family assistance.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="H023EBA39DF154935AAB7A83E8C163F7F"><enum>(c)</enum><header>Effective date</header><text>The amendments made by this section shall apply to taxable years ending after the date of the enactment of this Act.</text></subsection></section><section id="HADD76423E04C4FAB8E5F82213C0D06D0"><enum>202.</enum><header>Teacher Victims’ Family fund</header><subsection id="H6C949946969F4BBC9F697E3988306F4A"><enum>(a)</enum><header>Establishment</header><text>Subchapter A of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/26/98">chapter 98</external-xref> of the Internal Revenue Code of 1986 is amended by adding at the end the following:</text><quoted-block id="H3D54327A89DA43EBBC35D9839FF44CD8" style="OLC"><section id="HE941F8F2C5C449D1BF40E0055A7362D5"><enum>9512.</enum><header>Teacher Victims’ Family Trust Fund</header><subsection id="HC534121FBAC642829B61C220DE49D976"><enum>(a)</enum><header>Creation of Trust Fund</header><text display-inline="yes-display-inline">There is established in the Treasury of the United States a trust fund to be known as the <quote>Teacher Victims’ Family Trust Fund</quote> (referred to in this section as the <quote>Trust Fund</quote>), consisting of such amounts as may be appropriated or credited to the Trust Fund as provided in this section or section 9602(b) and any amounts as are or may be appropriated, transferred, or credited to such Trust Fund under any other provisions of law.</text></subsection><subsection id="HD0AAB3E5E0B54AB28463432B123BC8B1"><enum>(b)</enum><header>Transfers to Trust Fund</header><text>There is hereby appropriated to the Trust Fund an amount equivalent to the increase in revenues received in the Treasury by reason of the increase in tax imposed under section 4181 by the <short-title>Teacher Victims’ Family Assistance Act of 2021</short-title>.</text></subsection><subsection id="H54AE318420724749AB146676071F3FC9"><enum>(c)</enum><header>Distribution of amounts in Trust Fund</header><text display-inline="yes-display-inline">Amounts in the Trust Fund shall be available, as provided in appropriation Acts, to carry out title I of the <short-title>Teacher Victims’ Family Assistance Act of 2021</short-title>.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H9E5F9CE932964DC7B9B9240BF5407CF2"><enum>(b)</enum><header>Increase in excise tax on ammunition</header><text>Section 4181 of such Code is amended—</text><paragraph id="HE7CF34936C6740A2B804C0A72A3C0A46"><enum>(1)</enum><text>by striking <quote>Shells, and cartridges.</quote>, and</text></paragraph><paragraph id="H7641795C2DA243C2A7C38F11C717E07B"><enum>(2)</enum><text display-inline="yes-display-inline">by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="HD616A8D9FE3145178C010D72B923934C" style="tax"><paragraph changed="added" id="HA99441F63D304462B354633CBE611DD5" indent="up1" reported-display-style="boldface-roman"><enum/><text>Articles taxable at 13 percent—</text><subparagraph changed="not-changed" id="H0C2F27FCCAFF4A2B8EE87A7099AE2427"><enum/><text display-inline="yes-display-inline">Shells, and cartridges.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="H5FB19E4A91774FA4ABCD8F57462DB485"><enum>(c)</enum><header>Conforming amendments</header><paragraph id="H8F9B8E0CDD1B4753A51C859172A8B8F7"><enum>(1)</enum><text>Subsection (a) of section 3 of the Pittman-Robertson Wildlife Restoration Act (<external-xref legal-doc="usc" parsable-cite="usc/16/669b">16 U.S.C. 669b</external-xref>) is amended by adding at the end the following new paragraph:</text><quoted-block display-inline="no-display-inline" id="HD12365F94A7D4BA7BA6E2DFA48FEE40A" style="OLC"><paragraph id="H23D0BD4DF00F42F091722F65D8D6216A"><enum>(3)</enum><text display-inline="yes-display-inline">Paragraph (1) shall not apply to so much of the revenues accruing under <external-xref legal-doc="usc" parsable-cite="usc/26/4181">section 4181</external-xref> of the Internal Revenue Code of 1986 as are attributable to the increase in tax imposed under section 4181 by the <short-title>Teacher Victims’ Family Assistance Act of 2021</short-title>.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph><paragraph id="H8379A661B0D24F98B36ECF383F8870D8"><enum>(2)</enum><text>The table of sections for subchapter A of chapter 98 of such Code is amended by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="H547EE970ADCA4669B693283683004859" style="OLC"><toc regeneration="no-regeneration"><toc-entry level="section">Sec. 9512. Teacher Victims’ Family Trust Fund.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="HD8EB1177CE78427FB8E1D6A0A02C49AC"><enum>(d)</enum><header>Effective date</header><paragraph id="H8A38A3355295467FACAE517EA7FCB7D3"><enum>(1)</enum><text>Except as provided by paragraph (2), the amendments made by this section shall take effect on the date of the enactment of this Act.</text></paragraph><paragraph id="H5B8D2C2E3C2E472F9AA2DD37769202AA"><enum>(2)</enum><text>The amendment made by subsection (b) shall apply to articles sold after the date of the enactment of this Act.</text></paragraph></subsection></section></title></legis-body></bill>
