R. 104</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20210104">January 4, 2021</action-date><action-desc><sponsor name-id="G000559">Mr. Garamendi</sponsor> (for himself and <cosponsor name-id="Y000033">Mr. Young</cosponsor>) introduced the following bill; which was referred to the <committee-name committee-id="HAS00">Committee on Armed Services</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To authorize the Maritime Administrator to use certain appropriated funds to purchase duplicate medals authorized under Merchant Mariners of World War II Congressional Gold Medal Act of 2020, and for other purposes.</official-title></form><legis-body id="H2D4911385F7A4837B456F3E63DEBC087" style="OLC"><section id="HEFB240DD70A145F59486D78213820430" section-type="section-one"><enum>1.</enum><header>Authorization to purchase duplicate medals</header><subsection id="H68408E63D7664B3EAE6D37DCA5D29565"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary of Transportation, acting through the Administrator, may use funds appropriated for the fiscal year in which the date of the enactment of this Act occurs, or funds appropriated for any prior fiscal year, for the Maritime Administration to purchase duplicate medals authorized under the Merchant Mariners of World War II Congressional Gold Medal Act of 2020 (<external-xref legal-doc="public-law" parsable-cite="pl/116/125">Public Law 116–125</external-xref>) and provide such medals to eligible individuals who engaged in qualified service who submit an application under subsection (b) and were United States merchant mariners of World War II.</text></subsection><subsection id="HAA514497115D43A788CD5FED3EEFA89B"><enum>(b)</enum><header>Application</header><text>To be eligible to receive a medal described in subsection (a), an eligible individual who engaged in qualified service shall submit to the Administrator an application containing such information and assurances as the Administrator may require.</text></subsection><subsection id="H35D2A5B4C54E4E118F5009A41A45F677"><enum>(c)</enum><header>Definitions</header><text>In this Act:</text><paragraph id="H9FE894322D4749A38E27676FCABC1B3C"><enum>(1)</enum><header>Administrator</header><text>The term <term>Administrator</term> means the Maritime Administrator. </text></paragraph><paragraph id="H490703DE0C264AC09E0A3353FA78D89C"><enum>(2)</enum><header>Eligible individual who engaged in qualified service</header><text display-inline="yes-display-inline">The term <term>eligible individual who engaged in qualified service</term> means an individual who, between December 7, 1941, and December 31, 1946—</text><subparagraph id="H36FE0052DC03482ABBC23DE6F346EB42"><enum>(A)</enum><text display-inline="yes-display-inline">was a member of the United States merchant marine, including the Army Transport Service and the Navy Transport Service, serving as a crewmember of a vessel that was—</text><clause id="H61ED147C7F5B4DE7AFC035AA1A0C42E5"><enum>(i)</enum><text>operated by the War Shipping Administration, the Office of Defense Transportation, or an agent of such departments;</text></clause><clause id="HCD4D81665C5E4CD3935EFEF9234F48EF"><enum>(ii)</enum><text>operated in waters other than inland waters, the Great Lakes, and other lakes, bays, or harbors of the United States;</text></clause><clause id="H18B9A6E972614B9B9E48DA2C02216DB6"><enum>(iii)</enum><text>under contract or charter to, or property of, the Government of the United States; and</text></clause><clause id="H7430DE97355940DAB6C6AC0538DEDDF2"><enum>(iv)</enum><text>serving in the Armed Forces; and</text></clause></subparagraph><subparagraph id="H6CD725360B7F4244A6EB04ABB6CBD229"><enum>(B)</enum><text>while so serving, was licensed or otherwise documented for service as a crewmember of such a vessel by an officer or employee of the United States authorized to license or document the person for such service.</text></subparagraph></paragraph></subsection></section></legis-body></bill>
