which was referred to the <committee-name committee-id="HIF00">Committee on Energy and Commerce</committee-name>, and in addition to the Committees on <committee-name committee-id="HII00">Natural Resources</committee-name>, and <committee-name committee-id="HAG00">Agriculture</committee-name>, for a period to be subsequently determined by the Speaker, in each case for consideration of such provisions as fall within the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To require the Federal Communications Commission to provide broadband availability data to the Department of the Interior.</official-title></form><legis-body id="H07DE17FD2FC14E82A6D0A9D3DC5C4CB2" style="OLC"><section id="H0E9125D0C03648E7BADBAA76F228CB66" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Federal Broadband Deployment in Unserved Areas Act</short-title></quote>. </text></section><section id="H0C0A02F880E948CB9C52DE8373C6B05C" section-type="subsequent-section"><enum>2.</enum><header>Locating Federal facilities in unserved areas</header><subsection id="H8E59EEA055744DA88F1C24B432E24FAF"><enum>(a)</enum><header>Definitions</header><text>In this section:</text><paragraph id="H28AFBE3F8ED7478DB09B47CA9A202BC0"><enum>(1)</enum><header>Appropriate committees of Congress</header><text>The term <term>appropriate committees of Congress</term> means—</text><subparagraph id="H9118682364D140C3AE447049A3C866D2"><enum>(A)</enum><text>the Committee on Energy and Commerce of the House of Representatives;</text></subparagraph><subparagraph id="H7D26DF3F1CB949F794D372C379EFEE79"><enum>(B)</enum><text>the Committee on Natural Resources of the House of Representatives;</text></subparagraph><subparagraph id="H428BD8C9CA9343CEBAF8271556C11C70"><enum>(C)</enum><text>the Committee on Commerce, Science, and Transportation of the Senate; and</text></subparagraph><subparagraph id="HE93E54BF005C42429BF259FF06FE68E3"><enum>(D)</enum><text>the Committee on Environment and Public Works of the Senate.</text></subparagraph></paragraph><paragraph id="HBA91877C36A448C48509EA8B52EC7E5C"><enum>(2)</enum><header>Commission</header><text>The term <term>Commission</term> means the Federal Communications Commission.</text></paragraph><paragraph id="H7339C96488AB48E1A304503ED1729F81"><enum>(3)</enum><header>Communications facility</header><text>The term <term>communications facility</term> includes—</text><subparagraph id="H3520E10F0D9E43D7BE928AE4FFF21E96"><enum>(A)</enum><text>any infrastructure, including any transmitting device, tower, or support structure, and any equipment, switch, wiring, cabling, power source, shelter, or cabinet, associated with the licensed or permitted unlicensed wireless or wireline transmission of any writing, sign, signal, data, image, picture, and sound of any kind; and</text></subparagraph><subparagraph id="H62614F80BD10469E9036F1E9115F1219"><enum>(B)</enum><text>any antenna or apparatus that—</text><clause id="HD42D7868DE4A430F98B213D48931546B"><enum>(i)</enum><text>is designed for the purpose of emitting radio frequency;</text></clause><clause id="HE6D9A98988904447BA43CD1FADAA0457"><enum>(ii)</enum><text>is designed to be operated, or is operating, from a fixed location pursuant to authorization by the Commission or is using any duly authorized device that does not require an individual license; and</text></clause><clause id="H38E4448A1BC348B2B5479726AD786402"><enum>(iii)</enum><text>is added to a tower, building, or other structure.</text></clause></subparagraph></paragraph><paragraph id="HA9B6C1EB27EA4BA8BF783ED02973C1E4"><enum>(4)</enum><header>Covered land</header><text>The term <term>covered land</term> means land managed by a Federal land management agency.</text></paragraph><paragraph id="H5E83CFB145A04B7984D6C95700F8A90C"><enum>(5)</enum><header>Department concerned</header><text>The term <term>Department concerned</term> means the Department of the Interior or the Department of Agriculture.</text></paragraph><paragraph id="HBBEC4182ADC44B6A8C17E651F7E09322" display-inline="no-display-inline"><enum>(6)</enum><header>Federal land management agency</header><text display-inline="yes-display-inline">The term <term>Federal land management agency</term> means—</text><subparagraph id="HCF23570BBDA04F759A5C0EBFA3045A63"><enum>(A)</enum><text>the Forest Service;</text></subparagraph><subparagraph id="H5DC9954837E547AEAE70D97907421F59"><enum>(B)</enum><text>the Bureau of Land Management;</text></subparagraph><subparagraph id="H45FDCC79CFD048CAAD455B9618A6AB40"><enum>(C)</enum><text>the National Park Service;</text></subparagraph><subparagraph id="HCD9A7CF7F0154FC3A3CD10C700D06D69"><enum>(D)</enum><text>the Fish and Wildlife Service; and</text></subparagraph><subparagraph id="H6502FA1499554C23A3BF151D3C0083B0"><enum>(E)</enum><text>the Bureau of Reclamation.</text></subparagraph></paragraph><paragraph id="H0E176CAC7E4A4879B7EB059E1D191E56"><enum>(7)</enum><header>Secretary concerned</header><text>The term <term>Secretary concerned</term> means—</text><subparagraph id="HE89733C150E747EA822888959A8EF0F8"><enum>(A)</enum><text>the Secretary of the Interior, with respect to land administered by such Secretary; </text></subparagraph><subparagraph id="H00BE8679ABA7449C991B3079EADC3592"><enum>(B)</enum><text>the Secretary of Agriculture, with respect to National Forest System land; and</text></subparagraph><subparagraph id="H22E4261D7F414764BB7553CF3E25D96E" commented="no"><enum>(C)</enum><text display-inline="yes-display-inline">the Secretary of Commerce. </text></subparagraph></paragraph></subsection><subsection id="HB3427E2A52FD4B9781E5FA79F3769414"><enum>(b)</enum><header>Sharing broadband availability data</header><paragraph id="H531FABC1462E4B09A0F3B891FF7BDA18"><enum>(1)</enum><header>Notification</header><text>Not later than 2 business days after the creation or update of any map required under section 802(c)(1) of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/642">47 U.S.C. 642(c)(1)</external-xref>), the Commission shall notify the Secretary concerned that the map has been created or updated.</text></paragraph><paragraph id="H86D2CEEA18EE48B7AF92A085B3947BDC"><enum>(2)</enum><header>Provision of information</header><text>Not later than 5 business days after the date on which the Secretary concerned is notified under paragraph (1), the Commission shall provide the Secretary concerned any data the Commission has collected pursuant to title VIII of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/641">47 U.S.C. 641</external-xref> et seq.).</text></paragraph><paragraph id="HADF4FE54745B4CF586A2C44964E1ABDB"><enum>(3)</enum><header>Continuation</header><text>The Commission shall provide the Secretary concerned the information described in paragraph (2) every 6 months unless the Commission no longer has such information.</text></paragraph><paragraph id="HF75DFD2FDEC04677895BE92F2E51F846"><enum>(4)</enum><header>Protection of information</header><subparagraph id="H9A4C16C2D00D4315BC4F3C624C5A2FF7"><enum>(A)</enum><header>In general</header><text>The Commission shall specify to the Secretary concerned which information provided under paragraph (2) was collected in a confidential or proprietary manner, and the Secretary concerned may not make such information publicly available.</text></subparagraph><subparagraph id="H2A5E40ACC788491E9A8584B19C65FE28" commented="no"><enum>(B)</enum><header>FOIA</header><text display-inline="yes-display-inline">Information provided under paragraph (2) is exempt from disclosure to the public under section 552(b)(3)(B) of title 5, United States Code.</text></subparagraph></paragraph></subsection><subsection id="HB8025F7AC32E4683A6546110D4C911F5"><enum>(c)</enum><header>Working group</header><paragraph id="HD8266CD8E4D74CC3B87E2222C7C03FB6"><enum>(1)</enum><header>Establishment</header><text display-inline="yes-display-inline">Not later than 30 days after the date of enactment of this section, the Commission and the Secretary concerned shall establish an interagency working group to facilitate the preparation and interoperability of information technology systems for the provision and receipt of the information described in subsection (b)(2).</text></paragraph><paragraph id="H9700E1B0CF564414BBCED01D43B696BF" commented="no"><enum>(2)</enum><header>Nonapplicability of FACA</header><text>The Federal Advisory Committee Act (5 U.S.C. App.) shall not apply to the interagency working group established under paragraph (1).</text></paragraph></subsection><subsection id="H22250CC8C30241A1BDB49E9D4B420E6A"><enum>(d)</enum><header>Reports</header><paragraph id="H5DDE3A794E9543EE9D830529D0C74F80"><enum>(1)</enum><header>Preliminary assessment of potential barriers</header><text>Not later 120 days after the date on which the interagency working group is established pursuant to subsection (c)(1), the Commission and the Secretary concerned shall jointly submit a report to the appropriate committees of Congress with a preliminary assessment of any potential barriers to sharing the information described under subsection (b)(2).</text></paragraph><paragraph id="HA66C8729A4294A27BE6762B090700185"><enum>(2)</enum><header>Assessments</header><text>Not later than 1 year after the date on which the Commission provides the information described under subsection (b)(2) to the Department concerned, the Commission and the Secretary concerned shall jointly submit a report to the appropriate committees of Congress with—</text><subparagraph id="H17554A972D2340488A5638C8F24DF950"><enum>(A)</enum><text>an assessment of the effectiveness of a user’s ability to locate broadband infrastructure on covered land in an area to be determined as unserved by the Commission on the basis of the maps created under section 802(c) of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/642">47 U.S.C. 642(c)</external-xref>); and</text></subparagraph><subparagraph id="H4BC1647811404C55954D26FD58D959BF"><enum>(B)</enum><text>an assessment of whether the Department concerned prioritized the review of applications for a communications use authorization in an area to be determined as unserved by the Commission on the basis of the maps created under such section.</text></subparagraph></paragraph></subsection></section></legis-body></bill>
