which was referred to the <committee-name committee-id="HGO00">Committee on Oversight and Reform</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend title 5, United States Code, to enhance the authority under which Federal agencies may pay cash awards to employees for making cost saving disclosures, and for other purposes.</official-title></form><legis-body id="HDF0F2AF9B2BE482886770F249FA4DBEF" style="OLC"><section id="H20C9A6D064ED4E03A78554BC39BFBB4B" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Bonuses for Cost-Cutters Act of 2021</short-title></quote>.</text></section><section id="HC691907D25A040E08425E0C2C139D0C5"><enum>2.</enum><header>Cost savings enhancements</header><subsection id="HD10D334F030142F2849F77EB3D596091"><enum>(a)</enum><header>Definitions</header><text>Section 4511 of title 5, United States Code, is amended—</text><paragraph id="H82F711DC5B094B8493D3F58756E619A3"><enum>(1)</enum><text>in the section heading, by striking <quote><header-in-text level="section" style="USC">Definition</header-in-text></quote> and inserting <quote><header-in-text level="section" style="USC">Definitions</header-in-text></quote>; and</text></paragraph><paragraph id="HAC75DB797037419E8083401454176EAA"><enum>(2)</enum><text>in subsection (a)—</text><subparagraph id="HE74ECE1FACA644B38D21883DA2FEDE19"><enum>(A)</enum><text>by striking the period at the end and inserting <quote>; and</quote>;</text></subparagraph><subparagraph id="HE0B2A75D025643B9AF0A423DDDC4206C"><enum>(B)</enum><text>by striking <quote>this subchapter, the term</quote> and inserting the following: “this subchapter—</text><quoted-block display-inline="no-display-inline" id="H3A94D0E1888A4474AACC1C13208A5CC3" style="OLC"><paragraph id="H4D7F1A51513343FF822EEAF0C93226BB"><enum>(1)</enum><text>the term</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph><subparagraph id="H0E7893CE912A4764B6EB075761055949"><enum>(C)</enum><text>by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="H7F09C6DEFF0B40FAA577BE6DE55DDB22" style="OLC"><paragraph id="H9101670CCBCE4043B9427871D38C5CD2"><enum>(2)</enum><text display-inline="yes-display-inline">the term <term>wasteful expenses</term> means amounts made available for salaries and expenses accounts, operations and maintenance accounts, or other equivalent accounts—</text><subparagraph id="H8EC977B44F1747DB9DD925A47AA1FF9F"><enum>(A)</enum><text>that are identified by an employee of the agency under section 4512(a) as wasteful; and</text></subparagraph><subparagraph id="H06C36EC4FCE14545A2C7D6936D9DBAC9"><enum>(B)</enum><text>that the Chief Financial Officer of the agency determines are not required for the purpose for which the amounts were made available.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></subsection><subsection id="HB9F2A579493F4E24B5477C6C839F3A88"><enum>(b)</enum><header>Authority</header><text>Section 4512 of title 5, United States Code, is amended—</text><paragraph id="H414321AE1AE3445B89AD324044749F9D"><enum>(1)</enum><text>in subsection (a)—</text><subparagraph id="HD25BE5D99E7845C5B10B1F17DCD5ADBD"><enum>(A)</enum><text>by inserting <quote>The head of an agency may pay a cash award to any employee of such agency whose identification of wasteful expenses to the Chief Financial Officer of the agency has resulted in cost savings for the agency.</quote> after the first sentence;</text></subparagraph><subparagraph id="HC47983002DBC421AAC41A2C3ACB32FD4"><enum>(B)</enum><text>in paragraph (1) by striking <quote>$10,000</quote> and inserting <quote>$20,000</quote>;</text></subparagraph><subparagraph id="HF797EF223C9044B59F05A9D4CC77B0F8"><enum>(C)</enum><text>in paragraph (2)—</text><clause id="H759071BA2FC844859108DDC5CB33E099"><enum>(i)</enum><text>by inserting <quote>Chief Financial Officer,</quote> after <quote>Inspector General,</quote>;</text></clause><clause id="H071DD0394CCA46BA9F59134162BB3CAD"><enum>(ii)</enum><text display-inline="yes-display-inline">by striking <quote>employee designated under subsection (b)</quote> and inserting <quote>designated employee</quote>; and</text></clause><clause id="H11F74169673A44698CFA0908F5D00B19"><enum>(iii)</enum><text>by inserting <quote>or identification</quote> after <quote>disclosure</quote>; and</text></clause></subparagraph><subparagraph id="H91AAEBFE74194FDA9DC3103983315EC4"><enum>(D)</enum><text>in the matter following paragraph (2)—</text><clause id="H7457176B5EE041C39C8B3437BA6F6851"><enum>(i)</enum><text>by inserting <quote>, Chief Financial Officer,</quote> after <quote>Inspector General</quote>; and</text></clause><clause id="HF40C03E1071947BF89469E76457339E4"><enum>(ii)</enum><text>by inserting <quote>or identification</quote> after <quote>disclosure</quote>;</text></clause></subparagraph></paragraph><paragraph id="H59D47C7EBB1241D39997A3605FE9247D"><enum>(2)</enum><text>in subsection (b) by striking <quote>awards permitted under this section</quote> and inserting <quote>awards for the disclosure of fraud, waste, or mismanagement under this section</quote>; and</text></paragraph><paragraph id="HD413500A8C2E4BA3A97F928BEC1C240E"><enum>(3)</enum><text>by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="H4B83C61886CB466B95438C4DB5DFB2B7" style="OLC"><subsection id="H6213CF3CFB834CFF9618AADB0D68612A"><enum>(c)</enum><paragraph commented="no" display-inline="yes-display-inline" id="HF135C56666EC4021ABB54E69E017D64C"><enum>(1)</enum><text display-inline="yes-display-inline">If the Chief Financial Officer of the agency determines that potential wasteful expenses identified by an employee meet the requirements of section 4511(a)(2)(B), the head of the agency shall notify the President for purposes of proposing the expenses for rescission under title X of the Congressional Budget and Impoundment Control Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/2/681">2 U.S.C. 681</external-xref> et seq.).</text></paragraph><paragraph id="HADAADE76FEE64B0B977B6951EFF06C7A" indent="up1"><enum>(2)</enum><text>In the case of an agency for which there is no Chief Financial Officer, the head of the agency shall designate an agency employee who shall have the authority to make the determinations for identification of wasteful expenses under this section.</text></paragraph></subsection><subsection commented="no" id="H0832B91424904263BD6BB2297C76D53B"><enum>(d)</enum><text display-inline="yes-display-inline">The head of each agency shall make available, along with, and in the same manner and form as, the provision of information required under section 1116 of title 31, information on disclosures of wasteful expenses under this section, including—</text><paragraph commented="no" id="H980A589F89374224B93D56A2F7B393FB"><enum>(1)</enum><text display-inline="yes-display-inline">a description of each disclosure of possible wasteful expenses identified by an employee and determined by the agency to have merit; and</text></paragraph><paragraph commented="no" id="H5BB62CE2624740A3AAEA8A6C78876720"><enum>(2)</enum><text display-inline="yes-display-inline">the number and amount of cash awards provided by the agency under subsection (a).</text></paragraph></subsection><subsection commented="no" id="H24B4475857A249569273666EB4F3BEBC"><enum>(e)</enum><text display-inline="yes-display-inline">An individual may not receive a cash award under this subchapter if the individual is—</text><paragraph commented="no" id="H643D510250CB403AAF8068B0DD26382F"><enum>(1)</enum><text>an officer or employee of the Office of the Inspector General of an agency; or</text></paragraph><paragraph commented="no" id="HC8E4594E097E4794B504BFF77B1A4CDA"><enum>(2)</enum><text display-inline="yes-display-inline">ineligible for a cash award under section 4509.</text></paragraph></subsection><subsection id="H9A3CCF98ED6B4B87863263C155FB31DB"><enum>(f)</enum><text>The Director of the Office of Personnel Management shall—</text><paragraph id="H3985F232A78F4F37AEF9CC7104FDAD12"><enum>(1)</enum><text>ensure that the cash award program of each agency complies with this section; and</text></paragraph><paragraph id="HF1EC37FDF3B548D1835FEB48B260CE3F"><enum>(2)</enum><text>submit to Congress an annual certification indicating whether the cash award program of each agency complies with this section.</text></paragraph></subsection><subsection id="H6E092F6CB50644F98826E3465C8BB3EF"><enum>(g)</enum><text>Not later than 3 years after the date of enactment of the <short-title>Bonuses for Cost-Cutters Act of 2021</short-title>, and every 3 years thereafter for 6 years, the Comptroller General of the United States shall submit to Congress a report on the operation of the cost savings and awards program under this section, including any recommendations for legislative changes.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="HA4EBC903471146BA92C7F9F6164F0BFF"><enum>(c)</enum><header>Technical and conforming amendment</header><text>The table of sections for subchapter II of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/45">chapter 45</external-xref> of title 5, United States Code, is amended by striking the item relating to section 4511 and inserting the following:</text><quoted-block id="H98E5BB7B44F34A0FB7DEB0EC3EC41E7F" style="USC"><toc><toc-entry level="section">4511. Definitions and general provisions.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section></legis-body></bill>
