Maloney of New York</cosponsor>, <cosponsor name-id="F000454">Mr. Foster</cosponsor>, <cosponsor name-id="K000382">Ms. Kuster</cosponsor>, <cosponsor name-id="T000193">Mr. Thompson of Mississippi</cosponsor>, <cosponsor name-id="S001185">Ms. Sewell</cosponsor>, <cosponsor name-id="S001201">Mr. Suozzi</cosponsor>, <cosponsor name-id="T000472">Mr. Takano</cosponsor>, <cosponsor name-id="S001165">Mr. Sires</cosponsor>, <cosponsor name-id="W000826">Ms. Wild</cosponsor>, <cosponsor name-id="C001072">Mr. Carson</cosponsor>, and <cosponsor name-id="H000324">Mr. Hastings</cosponsor>) introduced the following bill; which was referred to the <committee-name committee-id="HJU00">Committee on the Judiciary</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To require the Attorney General to issue guidance to law enforcement agencies as they respond to increased levels of domestic violence during the COVID–19 public health emergency, and for other purposes.</official-title></form><legis-body id="H7E0B64B1173D4943A8462BE50877537F" style="OLC"><section id="H89583358FFBD439CB489B3DB7B1D6635" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Domestic Violence Public Health Emergency Guidance Act</short-title></quote>.</text></section><section id="H1B7D990AEB8B4BCC8BE175C97537A173"><enum>2.</enum><header>Guidance on addressing domestic violence during the COVID–19 public health emergency</header><subsection id="HD1E78B8BF0BC4B2ABEC3D15CFF79A02D"><enum>(a)</enum><header>Guidance</header><text display-inline="yes-display-inline">Not later than 30 days after the date of enactment of this Act, the Attorney General, in consultation with the Secretary of Health and Human Services, domestic violence stakeholders, and State, local, and tribal law enforcement stakeholders, shall issue guidance to Federal, State, local, and tribal law enforcement agencies which contain promising and model practices for addressing domestic violence and protecting the safety of law enforcement officers and all other parties involved, during the COVID–19 public health emergency. In issuing the guidance required under this subsection, the Attorney General shall—</text><paragraph id="H3E0E87C1B31C4691BC5DD65CDB51FF0C"><enum>(1)</enum><text display-inline="yes-display-inline">identify law enforcement-centered promising or model practices for—</text><subparagraph id="H01946FBCD4824B8FB841569C310C4701"><enum>(A)</enum><text display-inline="yes-display-inline">addressing domestic violence during the COVID–19 public health emergency;</text></subparagraph><subparagraph id="H54CD6E2F59FD40B2BEF3B68EFC751A46"><enum>(B)</enum><text>adopting and implementing such programs and practices;</text></subparagraph><subparagraph id="H46004B71BEDD4CEFB2DE4A617E2E3DAF"><enum>(C)</enum><text display-inline="yes-display-inline">implementing measures to mitigate exposure to COVID–19, including adequate use of personal protective equipment, when responding to domestic violence incidents that create potential exposure to COVID–19 for all parties involved; and </text></subparagraph><subparagraph id="H944937CAD6ED48BDA769E88F6394B580"><enum>(D)</enum><text display-inline="yes-display-inline">ensuring safety and limiting risk of exposure to COVID–19 for family members of law enforcement officers;</text></subparagraph></paragraph><paragraph id="HAEBEBE6630604B6E9F0EF4BA8A2346FB"><enum>(2)</enum><text>identify victim-centered promising and model practices for—</text><subparagraph id="H5D894A8661E74773B3FE98514E241B1A"><enum>(A)</enum><text display-inline="yes-display-inline">assessing the potential threat of violence to the victim and their children, while ensuring safety and privacy; </text></subparagraph><subparagraph id="HBA5D1FA505EE4E83B5183533C8EA75FA"><enum>(B)</enum><text display-inline="yes-display-inline">safety planning for victims and their children and taking preventive steps to ensure safety for all parties involved during the COVID–19 public health emergency;</text></subparagraph><subparagraph id="H56D83FB0FB84439EA2B17645B6DDC3EA"><enum>(C)</enum><text display-inline="yes-display-inline">timely submission of records for domestic violence protective orders and other related court orders and convictions for crimes related to intimate partner violence;</text></subparagraph><subparagraph id="HC8C5A44E57FD4A0F925AF212BCE42E5A"><enum>(D)</enum><text display-inline="yes-display-inline">enforcing domestic violence protective orders, other related court orders, and child custody orders in the context of domestic violence; and </text></subparagraph><subparagraph id="HD00FABFA679E443D98B3CA23763E8D72"><enum>(E)</enum><text>ensuring community coordinated responses to domestic violence; and </text></subparagraph></paragraph><paragraph id="HE360F0CB6C3B49C78FD1C92675D9B171"><enum>(3)</enum><text display-inline="yes-display-inline">create a resource guide, including—</text><subparagraph id="H1800F8EBFDC541E59F86E306D65E4449"><enum>(A)</enum><text display-inline="yes-display-inline">the promising and model practices identified under paragraphs (1) and (2);</text></subparagraph><subparagraph id="HCAE0CA57FBB24F38BCCCD7A9DE681446"><enum>(B)</enum><text display-inline="yes-display-inline">educational resources on risk factors related to COVID–19 that exacerbate the risk of escalation and lethality of reports of domestic violence, such as fear of illness, drug and alcohol abuse, economic uncertainty, unemployment, and grief; </text></subparagraph><subparagraph id="H7973200E4DED49C586A34640D17DB749"><enum>(C)</enum><text display-inline="yes-display-inline">educational resources on training, including cultural humility and vicarious trauma, for law enforcement officers responding to domestic violence;</text></subparagraph><subparagraph id="H29E62494C4C04A6F8623FA2F4BFECD5C"><enum>(D)</enum><text>educational resources on investigation and prosecutorial tools for law enforcement officers responding to domestic violence;</text></subparagraph><subparagraph id="H511EAA5BFC14485BAE9CD066FF0A59A0"><enum>(E)</enum><text display-inline="yes-display-inline">resources for victims of domestic violence during the COVID–19 public health emergency, including information related to the national domestic violence hotline authorized under section 313 of the Family Violence Prevention and Services Act (<external-xref legal-doc="usc" parsable-cite="usc/42/10413">42 U.S.C. 10413</external-xref>).</text></subparagraph></paragraph></subsection><subsection id="HDCDA03FD09B14DA7999680430906C417"><enum>(b)</enum><header>Dissemination</header><text display-inline="yes-display-inline">Not later than 30 days after the date of enactment of this Act, the Attorney General shall—</text><paragraph id="HC21F13E3BB49441EA5653064606BFE76"><enum>(1)</enum><text display-inline="yes-display-inline">issue the guidance developed under subsection (a) directly to Federal, State, local, and tribal law enforcement agencies; </text></paragraph><paragraph id="H5B2FE37B2E664F42B2380E959992BC35"><enum>(2)</enum><text display-inline="yes-display-inline">make the guidance publicly available by posting the guidance electronically on the website of the Department of Justice;</text></paragraph><paragraph id="HE139672F0FC6446787A0571F402859E6"><enum>(3)</enum><text display-inline="yes-display-inline"> collaborate with the Secretary of Health and Human Services to make the guidance available on the website of the Department of Health and Human Services.</text></paragraph></subsection><subsection id="HFBA913738EBA46B7B4B427736164FBE3"><enum>(c)</enum><header>Extension</header><text>The Attorney General may extend the deadlines under subsections (a) and (b), in the case that meeting such deadlines is impracticable. In the case that the Attorney General extends such a deadline pursuant to this subsection, the Attorney General shall notify Congress, which notification shall include a date before which the Attorney General will complete each such requirement. </text></subsection></section><section id="H8DA7650272A347E0811B707CA72D5635"><enum>3.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph id="H1FB5F165F3364480A42E258C97185B82"><enum>(1)</enum><text display-inline="yes-display-inline">The term <term>domestic violence</term> has the meaning given the term under section 40002(a)(8) of the Violent Crime Control and Law Enforcement Act of 1994 (<external-xref legal-doc="usc" parsable-cite="usc/34/12291">34 U.S.C. 12291(a)(8)</external-xref>).</text></paragraph><paragraph id="HEB42957F9C4E428981459FC8EDA34EFC"><enum>(2)</enum><text display-inline="yes-display-inline">The term <term>COVID–19 public health emergency</term> means the period beginning on the date on which the emergency period under section 1135(g)(1)(B) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1320b-5">42 U.S.C. 1320b–5(g)(1)</external-xref> was declared and ending 90 days after the date on which such period ends.</text></paragraph><paragraph id="HFF9DF20E464D4C77B97D611EB791FE59"><enum>(3)</enum><text display-inline="yes-display-inline">The term <term>COVID–19</term> means the 2019 Novel Coronavirus or 2019–nCoV.</text></paragraph><paragraph id="HE287812D340F4635AC133FE4BBA7B92B"><enum>(4)</enum><text display-inline="yes-display-inline">The term <term>personal protective equipment</term> means any protective equipment required to prevent the wearer from contracting COVID–19, including gloves, N–95 respirator masks, gowns, goggles, face shields, or other equipment required for safety.</text></paragraph><paragraph id="HBA4D16A88A3A474CA8F00F63A14DD72B"><enum>(5)</enum><text display-inline="yes-display-inline">The term <term>State</term> means each of the several States, the District of Columbia, the Commonwealth of Puerto Rico, Guam, American Samoa, the Virgin Islands, and the Northern Mariana Islands.</text></paragraph><paragraph id="H8B853CF4907D4BB4AC2863A8B090ED6A"><enum>(6)</enum><text>The term <term>Federal law enforcement agency</term> includes law enforcement agencies of the Armed Forces. </text></paragraph></section></legis-body></bill>
