which was referred to the <committee-name committee-id="HIF00">Committee on Energy and Commerce</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To establish the Office of COVID–19 Supply Chain Resiliency, and for other purposes.</official-title></form><legis-body id="H14E9ABD778B5450E80294F590A30BB1F" style="OLC"><section id="H189BBCF647924C189ED0B4322F9FC54D" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>COVID–19 Supply Chain Resiliency Act of 2021</short-title></quote>.</text></section><section id="HB507B9E84C2F450C8F7E73E211DC84D7" commented="no"><enum>2.</enum><header>Office of COVID–19 Supply Chain Resiliency</header><subsection id="H15A1C58B867E45DC98BAE623833F0F24" commented="no"><enum>(a)</enum><header>Establishment of office</header><text>There is established in the Executive Office of the President the Office of COVID–19 Supply Chain Resiliency (in this section referred to as <quote>the Office</quote>).</text></subsection><subsection id="HD0CBBC0D96D6461292548C980DD0FEE8" commented="no"><enum>(b)</enum><header>Director</header><paragraph id="H705AF29F855445D1B9BC24B852AAEFD9"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">There shall be at the head of the Office a Director who shall be appointed by the President. </text></paragraph><paragraph id="HED0BD510188646938B1B3A6565AFB87A"><enum>(2)</enum><header>Appointment of First Director</header><text>Not later than 30 days after the date of the enactment of this Act, the President shall appoint an individual to serve as the Director.</text></paragraph><paragraph id="H5A7E25117F9D49C8BC9F0DB16DFC085C"><enum>(3)</enum><header>Vacancy</header><text>A vacancy in the position of Director shall be filled not later than 60 days after the date on which the vacancy occurs and shall be filled in the same manner in which the original appointment was made.</text></paragraph></subsection><subsection id="H4895B968217143A39E0C0F913BADAE69" commented="no"><enum>(c)</enum><header>Deputy Directors</header><paragraph id="H65358E7F78E84C43B0BF6163A3785C81" commented="no"><enum>(1)</enum><header>Types of Deputy Directors</header><text display-inline="yes-display-inline">To assist the Director in carrying out the functions of this Act, the Director shall appoint Deputy Directors as follows:</text><subparagraph id="H3FA5554C46F94EA0B24B531F79773B41" commented="no"><enum>(A)</enum><text>The Deputy Director for the Medical Supply Chain.</text></subparagraph><subparagraph id="H68FA82B3298E488A93C980E83FE56B4B" commented="no"><enum>(B)</enum><text>The Deputy Director for the Food Supply Chain.</text></subparagraph><subparagraph id="H1B69B471B0E44ED29B69F8D3A85D4675" commented="no"><enum>(C)</enum><text>The Deputy Director for the Industrial Supply Chain.</text></subparagraph><subparagraph id="HB36B1B34118F4BE1BB99D3E17DE2AFA8" commented="no"><enum>(D)</enum><text>The Deputy Director for Interagency Coordination.</text></subparagraph></paragraph><paragraph id="HA82462A08E7A4031B62C36E1039FEEE3"><enum>(2)</enum><header>Additional Deputy Directors</header><text>The Director may appoint additional Deputy Directors as the Director determines necessary.</text></paragraph></subsection><subsection id="H4223B04F328C4055892167C55A24E4D3" commented="no"><enum>(d)</enum><header>Functions</header><text display-inline="yes-display-inline">The functions of the Office are to—</text><paragraph id="HF406151BD9534616BEF48F40F02BCB66" commented="no"><enum>(1)</enum><text display-inline="yes-display-inline">identify supply chain issues related the COVID–19 pandemic;</text></paragraph><paragraph id="H9A72E28032FE4CF59475B7B49D93EEED" commented="no"><enum>(2)</enum><text display-inline="yes-display-inline">not later than 60 days after the establishment of the Office, establish a national strategy to address such supply chain issues, in consultation with—</text><subparagraph id="H3E7630B071EE42E9A8F3A1699389AEA6" commented="no"><enum>(A)</enum><text display-inline="yes-display-inline">the heads of other agencies of the Federal Government, including—</text><clause id="H16A93B5D77484FD2807444372E14403B"><enum>(i)</enum><text>the Secretary of Agriculture;</text></clause><clause id="HBE1BB9ACCEE84A7CAFB3F88FE2F777DD"><enum>(ii)</enum><text>the Secretary of Commerce;</text></clause><clause id="H775A18BE3EAE4564824697946F1B6D25"><enum>(iii)</enum><text>the Secretary of Defense;</text></clause><clause id="H5F6C6F59C2D24FAAB86BCB7CE735C798"><enum>(iv)</enum><text>the Secretary of Health and Human Services;</text></clause><clause id="H1691EEDC7D9D47C796C3EF9B39A521BD"><enum>(v)</enum><text>the Secretary of Homeland Security; </text></clause><clause id="H8615F4530CFF4595A265E7F2D29B5F05"><enum>(vi)</enum><text>the Secretary of Labor; </text></clause><clause id="H7561D6DCA1AF4756B827DEACACC5AA0E"><enum>(vii)</enum><text>the Secretary of Transportation; </text></clause><clause id="H4DE2FDFBFB6D406C85F7F32C0141F777"><enum>(viii)</enum><text>the Secretary of the Treasury; </text></clause><clause id="H85CF32457EBC451980B0DE1F3F3B5275"><enum>(ix)</enum><text>the Administrator of the Environmental Protection Agency; </text></clause><clause id="H9C829C548E624DFC9BB748F8EF3340D5"><enum>(x)</enum><text>the Administrator of the Federal Emergency Management Agency;</text></clause><clause id="HE7EB29EEF5E54DD99CDB4EC22FEA33A6"><enum>(xi)</enum><text>the Federal Trade Commission; </text></clause><clause id="H980BD77434064CABAB6B7DDF8E65B139"><enum>(xii)</enum><text>the Administrator of the Small Business Administration; and</text></clause><clause id="H419FEDBA7A5743ECB49AC9600C6E3B9C"><enum>(xiii)</enum><text>the United States Trade Representative;</text></clause></subparagraph><subparagraph id="H621638E23AE24F75B63159F7C8BAA2A7" commented="no"><enum>(B)</enum><text display-inline="yes-display-inline">persons or private sector entities that transport products by air, water, rail, and road;</text></subparagraph><subparagraph id="HF2EA4B257D1244F0BB6F5D84DDD5A166" commented="no" display-inline="no-display-inline"><enum>(C)</enum><text>manufacturers of durable consumer products;</text></subparagraph><subparagraph id="HBEDA360ACC5448EFAECD76FA09E75D32" commented="no"><enum>(D)</enum><text>producers of agricultural products;</text></subparagraph><subparagraph id="HF8AE74BBD8034378B53A4CE69AB44C69" commented="no"><enum>(E)</enum><text>manufacturers and distributors of drugs, devices, and other medical products and supplies; and</text></subparagraph><subparagraph id="HFEE9F1F197CE4472B1169A96FA9DDAB3" commented="no"><enum>(F)</enum><text>manufacturers, producers, and distributors of other supplies critical to national security and the COVID–19 pandemic;</text></subparagraph></paragraph><paragraph id="H835B63765CE944CD9B1C3B8FBA80A1E0" commented="no"><enum>(3)</enum><text display-inline="yes-display-inline">serve as a central point of contact for Federal and non-Federal entities seeking technical assistance with respect to supply chain issues related to the COVID–19 pandemic; </text></paragraph><paragraph id="HE91A15860C2449D791506665F86121C9" commented="no"><enum>(4)</enum><text display-inline="yes-display-inline">provide technical assistance to Federal and non-Federal entities seeking technical assistance with respect to supply chain issues related to the COVID–19 pandemic; and </text></paragraph><paragraph id="HCA6766134EBF4A7A953C483EDF954FD6" commented="no"><enum>(5)</enum><text>develop legislative recommendations to strengthen critical supply chains for pandemics, including the COVID–19 pandemic.</text></paragraph></subsection><subsection id="HF2D3CB654D2E400196D7D33A624FD9E4" commented="no"><enum>(e)</enum><header>Report to Congress</header><text display-inline="yes-display-inline">Not later than 180 days after the date of the enactment of this Act, the Director shall submit a report to Congress on—</text><paragraph id="HD7F19E468E1841FE84E9ECEEF5DE282D"><enum>(1)</enum><text>any supply chain issues identified under paragraph (1) of subsection (d); </text></paragraph><paragraph id="HFCC26360E7FD4F0D8831CE6F94C98D64"><enum>(2)</enum><text>the national strategy established under such subsection; and</text></paragraph><paragraph id="H79C60E5DA05C448E9464ADA128673C27"><enum>(3)</enum><text>any legislative recommendation developed under such subsection.</text></paragraph></subsection><subsection id="H43EA94C2358A47C5940AB7B07BDC18C0"><enum>(f)</enum><header>Termination</header><text>The Office established under this section shall terminate on the date that is 18 months after the date on which the Public Health Emergency declared by the Secretary of Health and Human Services under section 319 of the Public Health Services Act (<external-xref legal-doc="usc" parsable-cite="usc/42/247">42 U.S.C. 247</external-xref>) as a result of COVID–19 pandemic, and any renewal thereof, terminates. </text></subsection></section></legis-body></bill>
