R. 1023</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20210211">February 11, 2021</action-date><action-desc><sponsor name-id="S001205">Ms. Scanlon</sponsor> (for herself, <cosponsor name-id="N000002">Mr. Nadler</cosponsor>, <cosponsor name-id="C001084">Mr. Cicilline</cosponsor>, <cosponsor name-id="D000627">Mrs. Demings</cosponsor>, <cosponsor name-id="R000606">Mr. Raskin</cosponsor>, <cosponsor name-id="C001072">Mr. Carson</cosponsor>, <cosponsor name-id="L000551">Ms. Lee of California</cosponsor>, <cosponsor name-id="A000371">Mr. Aguilar</cosponsor>, <cosponsor name-id="E000296">Mr. Evans</cosponsor>, <cosponsor name-id="B001285">Ms. Brownley</cosponsor>, <cosponsor name-id="J000288">Mr. Johnson of Georgia</cosponsor>, and <cosponsor name-id="J000298">Ms. Jayapal</cosponsor>) introduced the following bill; which was referred to the <committee-name committee-id="HJU00">Committee on the Judiciary</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend title 9 of the United States Code to prohibit predispute arbitration agreements that force arbitration of disputes arising from private education loans, and for other purposes.</official-title></form><legis-body id="H7664B752CDB64387AE81B458C9E5180C" style="OLC"><section id="HE7A8F5F7227B4F588DBEAFBB28A2C394" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Justice for Student Borrowers Act</short-title></quote>.</text></section><section id="HBD1B12C0AA6F4F269D2F7E0424788A5B"><enum>2.</enum><header>Purpose</header><text display-inline="no-display-inline">The purpose of this Act is to—</text><paragraph id="H54B1920E8EB040519F2DF6C14D586D53"><enum>(1)</enum><text>prohibit private educational lenders from using predispute arbitration agreements in their private education loans; and</text></paragraph><paragraph id="H0EABABCA3E244377886B38891BE18990"><enum>(2)</enum><text>to prohibit private educational lenders from using predispute joint-action waivers in their private education loans.</text></paragraph></section><section id="H2D62D899CDC9498B9814D972F28BDE75"><enum>3.</enum><header>Arbitration of private education loan disputes</header><subsection id="H218DC7FADD6E496AB4A718CC880DACF6"><enum>(a)</enum><header>In general</header><text>Title 9 of the United States Code is amended by adding at the end the following:</text><quoted-block id="H1C98BD79E0D34984A1F7C62384B0406C" style="USC"><chapter id="H2CC6620544754EB1840156FD14451F20"><enum>4</enum><header>Arbitration of Private Education Loan Disputes</header><toc container-level="chapter-container" idref="H2CC6620544754EB1840156FD14451F20" lowest-bolded-level="division-lowest-bolded" lowest-level="section" quoted-block="no-quoted-block" regeneration="yes-regeneration"><toc-entry idref="H5D4CF279863143D5809AF96D16B72949" level="section">401. Definitions. </toc-entry><toc-entry idref="HC54CFD259B6147F5A5C0D3DEDFF0DDF9" level="section">402. No validity or enforceability.</toc-entry></toc><section id="H5D4CF279863143D5809AF96D16B72949"><enum>401.</enum><header>Definitions</header><text display-inline="no-display-inline">In this chapter—</text><paragraph id="HD86FAA932F0246AD9B149E9AF3AA06F2"><enum>(1)</enum><text>the term <term>private education loan</term> has the meaning given that term under section 140 of the Truth in Lending Act;</text></paragraph><paragraph id="H3F282D88F3794D0B8E0FBD05F0EB9C8C"><enum>(2)</enum><text>the term <term>predispute arbitration agreement</term> means an agreement to arbitrate a dispute that has not yet arisen at the time of the making of the agreement; and</text></paragraph><paragraph id="HFF22F5BB6DDA449CAADF9A4CC05CC60F"><enum>(3)</enum><text>the term <term>predispute joint-action waiver</term> means an agreement, whether or not part of a predispute arbitration agreement, that would prohibit, or waive the right of, one of the parties to the agreement to participate in a joint, class, or collective action in a judicial, arbitral, administrative, or other forum, concerning a dispute that has not yet arisen at the time of the making of the agreement.</text></paragraph></section><section id="HC54CFD259B6147F5A5C0D3DEDFF0DDF9"><enum>402.</enum><header>No validity or enforceability</header><subsection id="HD2F1879D26A8445F85AE01BF5349E4D6"><enum>(a)</enum><header>In general</header><text>Notwithstanding any other provision of this title, no predispute arbitration agreement or predispute joint-action waiver shall be valid or enforceable with respect to a dispute relating to a private education loan.</text></subsection><subsection id="HAFADAF931BCA4CFBAA318A8615D64F5B"><enum>(b)</enum><header>Applicability</header><paragraph id="HA48430C92DC64A66857FD4DA9F9A7AFD"><enum>(1)</enum><header>In general</header><text>An issue as to whether this chapter applies with respect to a dispute shall be determined under Federal law. The applicability of this chapter to an agreement to arbitrate and the validity and enforceability of an agreement to which this chapter applies shall be determined by a court, rather than an arbitrator, irrespective of whether the party resisting arbitration challenges the arbitration agreement specifically or in conjunction with other terms of the contract containing such agreement, and irrespective of whether the agreement purports to delegate such determinations to an arbitrator.</text></paragraph><paragraph id="H0F6A8BE5FC15410A8A931AA9E5199176"><enum>(2)</enum><header>Collective bargaining agreements</header><text>Nothing in this chapter shall apply to any arbitration provision in a contract between an employer and a labor organization or between labor organizations, except that no such arbitration provision shall have the effect of waiving the right of a worker to seek judicial enforcement of a right arising under a provision of the Constitution of the United States, a State constitution, or a Federal or State statute, or public policy arising therefrom.</text></paragraph></subsection></section></chapter><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H483D3EF78E0343CDA2000A58C22DF566"><enum>(b)</enum><header>Technical and conforming amendments</header><paragraph id="H6B26572E532349489D47D4119E5257D9"><enum>(1)</enum><header>In general</header><text>Title 9 of the United States Code is amended—</text><subparagraph id="H6F9CB966AE334ACCBA668E90BCF63DE8"><enum>(A)</enum><text>in section 1 by striking <quote>of seamen,</quote> and all that follows through <quote>interstate commerce,</quote> and inserting in its place <quote>of individuals, regardless of whether such individuals are designated as employees or independent contractors for other purposes</quote>;</text></subparagraph><subparagraph id="HBA1752FCAA5341F39FFAEDF436095471"><enum>(B)</enum><text>in section 2 by inserting <quote>or as otherwise provided in chapter 4</quote> before the period at the end;</text></subparagraph><subparagraph id="HEB02E7FDCA794542BD6B0C9B70B0784C"><enum>(C)</enum><text>in section 208—</text><clause id="HB2E7E711CF304366AA7D00C829F5589D"><enum>(i)</enum><text>in the section heading by striking <quote><header-in-text level="section" style="OLC">Chapter 1; residual application</header-in-text></quote> and inserting <quote><header-in-text level="section" style="OLC">Application</header-in-text></quote>; and</text></clause><clause id="H0A3123E4E16D4252983146CDF14464F7"><enum>(ii)</enum><text>by adding at the end the following: <quote>This chapter applies to the extent that this chapter is not in conflict with chapter 4.</quote>; and</text></clause></subparagraph><subparagraph id="H6E2017E4319A4E39BE6AA30374DB2277"><enum>(D)</enum><text>in section 307—</text><clause id="H2A9907AE63CB41EA9520847BFE0F38E7"><enum>(i)</enum><text>in the section heading by striking <quote><header-in-text level="section" style="OLC">Chapter 1; residual application</header-in-text></quote> and inserting <quote><header-in-text level="section" style="OLC">Application</header-in-text></quote>; and</text></clause><clause id="HE3970DFEB0224364A8E60112DD928A54"><enum>(ii)</enum><text>by adding at the end the following: <quote>This chapter applies to the extent that this chapter is not in conflict with chapter 4.</quote>.</text></clause></subparagraph></paragraph><paragraph id="HDF6BF398AE4C4A6D84559FCF18EEB61E"><enum>(2)</enum><header>Table of sections</header><subparagraph id="HCA1E290A9B62461DAF730A14BB45C315"><enum>(A)</enum><header>Chapter 2</header><text>The table of sections of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/9/2">chapter 2</external-xref> of title 9, United States Code, is amended by striking the item relating to section 208 and inserting the following:</text><quoted-block id="H5C9F74653DF0439EB08E4BCA760D64F5" style="OLC"><toc regeneration="no-regeneration"><toc-entry level="section">208. Arbitration of private education loan disputes</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection></section><section id="H1611C0DF77A54D268380E787A8D17DCF"><enum>4.</enum><header>Effective date</header><text display-inline="no-display-inline">This Act, and the amendments made by this Act, shall take effect on the date of enactment of this Act and shall apply with respect to any dispute or claim that arises or accrues on or after such date.</text></section></legis-body></bill>
