which was referred to the <committee-name committee-id="HSM00">Committee on Small Business</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the Small Business Act to spur entrepreneurial ecosystems in underserved communities.</official-title></form><legis-body id="H28CA1108AAEA4CA79CB4F62610421BCC" style="OLC"><section id="HD51AD79617714431AFD63B44F6D72BC4" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Ushering Progress by Leveraging Innovation and Future Technology Act of 2021</short-title></quote> or the <quote><short-title>UPLIFT Act of 2021</short-title></quote>. </text></section><section id="H7389A317637E4D85B6D3501DA61CFC41"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds the following:</text><paragraph id="H2871552EF8DA449EB3B0431274B15799"><enum>(1)</enum><text>Studies have found that incubators, accelerators, and other similar models are effective at increasing revenues, the number of employees, and the likelihood that the business venture will be successful for participants.</text></paragraph><paragraph id="H2BDCE6FFDAE34EA3A58927AB8CB2570F"><enum>(2)</enum><text>According to the Kauffman Foundation—</text><subparagraph id="HF6C84122B83D4DDEB795AFC448D670A0"><enum>(A)</enum><text>minority-owned and women-owned businesses are half as likely to employ people than nonminority-owned and men-owned businesses; and</text></subparagraph><subparagraph id="H3A852455FF434D789C3EFB87DDE7853A"><enum>(B)</enum><text>if minorities started businesses at the same rate as nonminorities, approximately 9,500,000 jobs would be added to the economy of the United States.</text></subparagraph></paragraph><paragraph id="H0B775898D008482AB36623E4D962D35A"><enum>(3)</enum><text>The Kauffman Foundation also found that the percentage of startups in rural communities has dropped from 20 percent in the 1980s to 12.2 percent.</text></paragraph><paragraph id="HEE3936D0C41B4BFFBD986E4D954C69A3"><enum>(4)</enum><text>According to the Martin Prosperity Institute, less than 1 percent of all venture capital funding goes to businesses located in rural areas.</text></paragraph><paragraph id="H8856CE3826A946C6B04A84EB71CC84A3"><enum>(5)</enum><text>According to PitchBook, around 2 percent of all venture capital funding goes to businesses with women founders.</text></paragraph><paragraph id="H5EB1359FA80348A9B6377DE166D2DC8F"><enum>(6)</enum><text>According to Crunchbase, less than 3 percent of all venture capital funding goes to businesses with Black and Hispanic founders.</text></paragraph><paragraph id="H7157EA51F83646389EB70641B958FCF5"><enum>(7)</enum><text>Historically Black colleges and universities, minority-serving institutions, and community colleges are anchor institutions that serve populations that tend to be underrepresented in entrepreneurship, particularly in high-growth sectors.</text></paragraph></section><section id="H2C4B8153DF684DBD95124622FDAB2978"><enum>3.</enum><header>Purposes</header><text display-inline="no-display-inline">The purposes of the Innovation Centers Program established under section 49 of the Small Business Act, as added by this Act, are to—</text><paragraph id="H8A8FF08447B24BA7A150CC76EC1A8AF1"><enum>(1)</enum><text>spur economic growth in underserved communities by creating good paying jobs and pathways to prosperity;</text></paragraph><paragraph id="H8D9A2AEE6FA4409A8440F4606B6D9B10"><enum>(2)</enum><text>increase prospects for success for small business concerns in underserved communities, which often suffer from higher business failure rates than the national average;</text></paragraph><paragraph id="HBBDC2CD56E814FB887C2A0FDD724BF97"><enum>(3)</enum><text>help create a pipeline for small business concerns in underserved and rural markets into high-growth sectors, where they are generally underrepresented;</text></paragraph><paragraph id="H90D85DC96FE244CEB35346E4BD453068"><enum>(4)</enum><text>help address the multi-decade decline in the rate of new business creation;</text></paragraph><paragraph id="HA636FE6F1D4C40DE83DCA41EBA9798C1"><enum>(5)</enum><text>close the gaps that underserved small business concerns often have in terms of revenue and number of employees, which represent lost opportunity for the economy of the United States; and</text></paragraph><paragraph id="H8D4F486B868E4707B645E13026F1A1F4"><enum>(6)</enum><text>encourage collaboration between the Small Business Administration and institutions of higher learning that serve low-income and minority communities.</text></paragraph></section><section id="H8DDCAD9213844029890A6AA442C06C71"><enum>4.</enum><header>Innovation centers program</header><subsection id="HDAAE18486C7748E7B1A4E5675BF7340B"><enum>(a)</enum><header>In general</header><text>The Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/631">15 U.S.C. 631</external-xref> et seq.) is amended—</text><paragraph id="H91A1E1D398B241609015C304F753E384"><enum>(1)</enum><text>by redesignating section 49 as section 50; and</text></paragraph><paragraph id="H6A9DF3CB97724CC1ACEBF798100AB120"><enum>(2)</enum><text>by inserting after section 48 the following:</text><quoted-block id="HF70C28CC48C54428B2B5325F69D60E94" style="OLC"><section id="HCD1CB98DBDD8468BBEF913178787C94C"><enum>49.</enum><header>Innovation centers program</header><subsection id="HAFFBDE94AC254DE590EF6775A30E1FA7"><enum>(a)</enum><header>Definitions</header><text>In this section:</text><paragraph id="HE6B156B4FE304119AA4A38F3E6E1AA34"><enum>(1)</enum><header>Accelerator</header><text>The term <quote>accelerator</quote> means an organization—</text><subparagraph id="H232DA1237D674307A5F999332197C800"><enum>(A)</enum><text>that—</text><clause id="HE11D7DB420FB4085ADCEC0A0D3A4EF46"><enum>(i)</enum><text>works with a startup or growing small business concern for a predetermined period; and</text></clause><clause id="HB4F3793010B84FF6A729943C86DFCD3C"><enum>(ii)</enum><text>provides mentorship and instruction to scale businesses; and</text></clause></subparagraph><subparagraph id="H7BDB9BA6B72D46AA85F451168879BC33"><enum>(B)</enum><text>that may—</text><clause id="H2DBE9B1B86954F02980015BAF167B760"><enum>(i)</enum><text>provide, but is not exclusively designed to provide, seed investment in exchange for a small amount of equity; and</text></clause><clause id="H4918C5C66D6F4175B2B2E9DB722B7A8C"><enum>(ii)</enum><text>offer startup capital or the opportunity to raise capital from outside investors.</text></clause></subparagraph></paragraph><paragraph id="H19588100744548D78362AA0B868AFC8B"><enum>(2)</enum><header>Federally recognized area of economic distress</header><text>The term <quote>federally recognized area of economic distress</quote> means—</text><subparagraph id="H7D1ABC8A6B0C4285B08F6672048E9385"><enum>(A)</enum><text>a HUBZone, as that term is defined in section 31(b); or</text></subparagraph><subparagraph id="HB4A46A8994EE4786B5FB0B1180E8606C"><enum>(B)</enum><text>an area that has been designated as—</text><clause id="HF261A59625AC471FA5782D45E6DC984A"><enum>(i)</enum><text>an empowerment zone under <external-xref legal-doc="usc" parsable-cite="usc/26/1391">section 1391</external-xref> of the Internal Revenue Code of 1986;</text></clause><clause id="HED8C330569284083A60474426EFE36B7"><enum>(ii)</enum><text>a Promise Zone by the Secretary of Housing and Urban Development; or</text></clause><clause id="H4A302E13573F496B9C6F51F0B3F5F604"><enum>(iii)</enum><text>a low-income neighborhood or moderate-income neighborhood for purposes of the Community Reinvestment Act of 1977 (<external-xref legal-doc="usc" parsable-cite="usc/12/2901">12 U.S.C. 2901</external-xref> et seq.).</text></clause></subparagraph></paragraph><paragraph id="HA249DE429CF64E409E0A159ECC99914E"><enum>(3)</enum><header>Growing; newly established; startup</header><text>The terms <quote>growing</quote>, <quote>newly established</quote>, and <quote>startup</quote>, with respect to a small business concern, mean growing, newly established, and startup, respectively, within the meaning given those terms under section 7(m).</text></paragraph><paragraph id="H28E1EECB475043E8A4FED273C5E6A099"><enum>(4)</enum><header>Incubator</header><text>The term <quote>incubator</quote> means an organization—</text><subparagraph id="HB877F463D0B045C1887D316E50176109"><enum>(A)</enum><text>that—</text><clause id="HFFC2802E1E7B482884C3C9CF7615AD96"><enum>(i)</enum><text>tends to work with startup and newly established small business concerns; and</text></clause><clause id="H201B2741FF5B4C8A90E595E8A363423D"><enum>(ii)</enum><text>provides mentorship to startup and newly established small business concerns; and</text></clause></subparagraph><subparagraph id="H01B3836C0C024A95A5837D46EEAC8DAF"><enum>(B)</enum><text>that may—</text><clause id="HBC801F24D5694F68A5DEDDE75354C61B"><enum>(i)</enum><text>provide a co-working environment or a month-to-month lease program; and</text></clause><clause id="HA3062E1B98734B87AC6D0F650DA54AF0"><enum>(ii)</enum><text>work with a startup or newly established small business concern for a predetermined period or an open-ended period.</text></clause></subparagraph></paragraph><paragraph id="H52160315E9454F5B9F8D804F9CB4101E"><enum>(5)</enum><header>Individuals with a disability</header><text>The term <quote>individuals with a disability</quote> means more than 1 individual with a disability, as defined in section 3 of the Americans with Disabilities Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/42/12102">42 U.S.C. 12102</external-xref>).</text></paragraph><paragraph id="H4014A9F07857429B8A71DF52E7DC2A85"><enum>(6)</enum><header>Eligible entity</header><text>The term <quote>eligible entity</quote> means—</text><subparagraph id="H7A542E5DB08F4962A9800CCAAE1CEE8E"><enum>(A)</enum><text>an institution described in any of paragraphs (1) through (7) of section 371(a) of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1067q">20 U.S.C. 1067q(a)</external-xref>); or</text></subparagraph><subparagraph id="HE8456DE7311145BB813D3F5AEBAC8B53"><enum>(B)</enum><text>a junior or community college, as defined in section 312 of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1058">20 U.S.C. 1058</external-xref>).</text></subparagraph></paragraph><paragraph id="HC52A217B70EF4E35BDA73A2AB3EE7BFA"><enum>(7)</enum><header>Rural area</header><text>The term <quote>rural area</quote> has the meaning given the term in section 7(m)(11).</text></paragraph><paragraph id="HA623B1A99A0E4F4E8B9E915F536EFB54"><enum>(8)</enum><header>Socially and economically disadvantaged individuals</header><text>The term <quote>socially and economically disadvantaged individual</quote> means a socially and economically disadvantaged individual within the meaning given that term in section 8(d)(3)(C).</text></paragraph></subsection><subsection id="HAEDB851753CA4DE6A94BD78D2C82A45C"><enum>(b)</enum><header>Establishment</header><text>Not later than 1 year after the date of enactment of the Ushering Progress by Leveraging Innovation and Future Technology Act of 2021, the Administrator shall develop and begin implementing a program (to be known as the <quote>Innovation Centers Program</quote>) to enter into cooperative agreements with eligible entities under this section.</text></subsection><subsection id="H75048B415A054914A68CEAF12CCA8A66"><enum>(c)</enum><header>Authority</header><paragraph id="H61096F9BAB374D359027237B1C136E71"><enum>(1)</enum><header>In general</header><text>The Administrator may—</text><subparagraph id="H458756B3601449DCAEFA4CEB1B24C8E2"><enum>(A)</enum><text>enter into cooperative agreements to provide financial assistance to eligible entities to conduct 5-year projects for the benefit of startup, newly established, or growing small business concerns; and</text></subparagraph><subparagraph id="H49AA29B066A84336AA434BD1DDE2525B"><enum>(B)</enum><text>renew a cooperative agreement entered into under this section for additional 3-year periods, in accordance with paragraph (3).</text></subparagraph></paragraph><paragraph id="H0451AE9EE4AA43EA97B38FB67AFCEA5A"><enum>(2)</enum><header>Project requirements</header><text>A project conducted under a cooperative agreement under this section shall—</text><subparagraph id="H0368B3A68A9C419FB521CA460219FC99"><enum>(A)</enum><text>include operating as an accelerator, an incubator, or any other small business innovation-focused project as the Administrator approves;</text></subparagraph><subparagraph id="H26B746A013DF49DCBAA82EBEA6586DB8"><enum>(B)</enum><text>be carried out in such locations as to provide maximum accessibility and benefits to the small business concerns that the project is intended to serve;</text></subparagraph><subparagraph id="H6803A1DC2C564173BC4012BED732CE0C"><enum>(C)</enum><text>have a full-time staff, including a full-time director who shall—</text><clause id="HE66A8E022FB84DAE9D37FFC238365739"><enum>(i)</enum><text>have the authority to make expenditures under the budget of the project; and</text></clause><clause id="H0D09AD90BC8F42BDAEA837C9A05609F2"><enum>(ii)</enum><text>manage the activities carried out under the project;</text></clause></subparagraph><subparagraph id="H47A4A831903745B68DBAFCB7FCC0D203"><enum>(D)</enum><text>include the joint provision of programs and services by the eligible entity and the Administration, which—</text><clause id="H2102FFEE2F8C439C92323FD81A8F582D"><enum>(i)</enum><text>shall be jointly developed, negotiated, and agreed upon, with full participation of both parties, pursuant to an executed cooperative agreement between the eligible entity and the Administration; and</text></clause><clause id="HD58C95267FE34F03AC956802A218B30B"><enum>(ii)</enum><text>shall include—</text><subclause id="HDFFD9A2514B1436AB5BF704A86D30241"><enum>(I)</enum><text>one-to-one individual counseling, as described in section 21(c)(3)(A); and</text></subclause><subclause id="HA453281152CE4EA19F9814F9E9577D8C"><enum>(II)</enum><text>a formal, structured mentorship program;</text></subclause></clause></subparagraph><subparagraph id="HF83EC01991074F2FB8951D18FE598E16"><enum>(E)</enum><text>incorporate continuous upgrades and modifications to the services and programs offered under the project, as needed to meet the changing and evolving needs of the business community;</text></subparagraph><subparagraph id="H38EDC0292C424587973ED3FB7C6BD57A"><enum>(F)</enum><text>involve working with underserved groups, which include—</text><clause id="H991BCB29219E42C9B0D6BA18A960BCAA"><enum>(i)</enum><text>women;</text></clause><clause id="H4DBBB73DDDD14DA1AC729B5DC86C5ED9"><enum>(ii)</enum><text>socially and economically disadvantaged individuals;</text></clause><clause id="H35FAB1D51A8A4AB5B1CB88AD134F0DD9"><enum>(iii)</enum><text>veterans;</text></clause><clause id="HDE7B06E128D0406BBA8DB33CFD9EA637"><enum>(iv)</enum><text>individuals with disabilities; or</text></clause><clause id="H40AD01698C7C4C95A00DA58B91BCA4A7"><enum>(v)</enum><text>startup, newly established, or growing small business concerns located in rural areas;</text></clause></subparagraph><subparagraph id="H2721953642144C049BC67C8CD4F9C392"><enum>(G)</enum><text>not impose or otherwise collect a fee or other compensation in connection with participation in the programs and services described in subparagraph (D)(ii); and</text></subparagraph><subparagraph id="HCEC199CA7AFE4CD0A10D506A6FA11762"><enum>(H)</enum><text>ensure that small business concerns participating in the project have access, including through resource partners, to information concerning Federal, State, and local regulations that affect small business concerns.</text></subparagraph></paragraph><paragraph id="H7FFAD83D86E549B7996916CE7A5F93B4"><enum>(3)</enum><header>Continued funding</header><subparagraph id="H2363587322FC4FDB8AC1D63F425FEC51"><enum>(A)</enum><header>In general</header><text>An eligible entity that enters into an initial cooperative agreement or a renewal of a cooperative under paragraph (1) may submit an application for a 3-year renewal of the cooperative agreement at such time, in such manner, and accompanied by such information as the Administrator may establish.</text></subparagraph><subparagraph id="HCD675B398B80436E8DAF0A6B57E81664"><enum>(B)</enum><header>Application and approval criteria</header><clause id="H2DD8F44767884A6B8F5480F116413B76"><enum>(i)</enum><header>Criteria</header><text>The Administrator shall develop and publish criteria for the consideration and approval of applications for renewals by eligible entities under this paragraph, which shall take into account the structure and the stated goals of the project.</text></clause><clause id="HEF116B7AC1DF42E4BB5E1B62967E7052"><enum>(ii)</enum><header>Notification</header><text>Not later than 60 days after the date of the deadline to submit applications for each fiscal year, the Administrator shall approve or deny any application under this paragraph and notify the applicant for each such application.</text></clause></subparagraph><subparagraph id="HBEC55305EEE942B48BE1341487ECE987"><enum>(C)</enum><header>Priority</header><text>In allocating funds made available for cooperative agreements under this section, the Administrator shall give applications under this paragraph priority over first-time applications for cooperative agreements under paragraph (1)(A).</text></subparagraph></paragraph><paragraph id="H8BE2B6FFD74347978BB8FF0FDB691F2E"><enum>(4)</enum><header>Limit on use of funds</header><text>Amounts received by an eligible entity under a cooperative agreement under this section may not be used to provide capital to a participant in the project carried out under the cooperative agreement.</text></paragraph><paragraph id="HE2C1F1F676874C5898337D881CD99998"><enum>(5)</enum><header>Scope of authority</header><subparagraph id="H2177D3761A6643E5B448B63482C237F9"><enum>(A)</enum><header>Subject to appropriations</header><text>The authority of the Administrator to enter into cooperative agreements under this section shall be in effect for each fiscal year only to the extent and in the amounts as are provided in advance in appropriations Acts.</text></subparagraph><subparagraph id="H0124A867105B4E82A89E6A46EF90F4AD"><enum>(B)</enum><header>Suspension, termination, and failure to renew or extend</header><text>After the Administrator has entered into a cooperative agreement with an eligible entity under this section, the Administrator may not suspend, terminate, or fail to renew or extend the cooperative agreement unless the Administrator provides the eligible entity with written notification setting forth the reasons therefore and affords the eligible entity an opportunity for a hearing, appeal, or other administrative proceeding under <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/5">chapter 5</external-xref> of title 5, United States Code.</text></subparagraph></paragraph></subsection><subsection id="H8CA6793BF8BF46A48E41B3887F9D27C1"><enum>(d)</enum><header>Criteria</header><paragraph id="HD32E7060F71E46148B816C6BC705F081"><enum>(1)</enum><header>In general</header><text>The Administrator shall—</text><subparagraph id="HF45BD23878D640309E492506B3D0DFC9"><enum>(A)</enum><text>establish and rank in terms of relative importance the criteria the Administrator shall use in awarding cooperative agreements under this section, which shall include—</text><clause id="H8762E18B97CF4EA8AFD0E8272F691B81"><enum>(i)</enum><text>whether the proposed project will be located in—</text><subclause id="H43699F4AE70A492FB20082AAD93A8404"><enum>(I)</enum><text>a federally recognized area of economic distress;</text></subclause><subclause id="H05B3E50170AD42D3B47D3B5F852B2061"><enum>(II)</enum><text>a rural area; or</text></subclause><subclause id="HEE800F08E16440328DBC7868044C380E"><enum>(III)</enum><text>an area lacking sufficient entrepreneurial development resources, as determined by the Administrator; and</text></subclause></clause><clause id="HD7894CF0A6424D279ED580612ED03941"><enum>(ii)</enum><text>whether the proposed project demonstrates a commitment to partner with core stakeholders working with small business concerns in the relevant area, including—</text><subclause id="HC57883A1B5D54DAAA530648BFF657110"><enum>(I)</enum><text>investment and lending organizations;</text></subclause><subclause id="H3C03A43CADE84227B1D0B860C6E767D1"><enum>(II)</enum><text>nongovernmental organizations;</text></subclause><subclause id="H7FEFD7E31E624493B61901DB17DA5C42"><enum>(III)</enum><text>programs of State and local governments that are concerned with aiding small business concerns;</text></subclause><subclause id="H098AABE9C0294800868F20E9D1ECC2DF"><enum>(IV)</enum><text>Federal agencies; and</text></subclause><subclause id="H72DBF7C59D4B4843B215FD500E529362"><enum>(V)</enum><text>for-profit organizations with an expertise in small business innovation;</text></subclause></clause></subparagraph><subparagraph id="H4F865BCBBBB746F88F55A8A2E77751D3"><enum>(B)</enum><text>make publicly available, including on the website of the Administration, and state in each solicitation for applications for cooperative agreements under this section, the selection criteria and ranking established under subparagraph (A); and</text></subparagraph><subparagraph id="H88B2ACEEE40E400DB7AB9C5E25DCF967"><enum>(C)</enum><text>evaluate and rank applicants for cooperative agreements under this section in accordance with the selection criteria and ranking established under subparagraph (A).</text></subparagraph></paragraph><paragraph id="H6C5E671FF75741BB83D3E2CC0BFC6E7D"><enum>(2)</enum><header>Contents</header><text>The criteria established under paragraph (1)(A)—</text><subparagraph id="HE8F92F5319A046CCADAEBD7AC8941524"><enum>(A)</enum><text>for eligible entities that have in operation an accelerator, incubator, or other small business innovation-focused project shall include the record of the eligible entity in assisting growing, newly established, and startup small business concerns, including, for each of the 3 full years before the date on which the eligible entity applies for a cooperative agreement under this section, or if the accelerator, incubator, or other small business innovation-focused project has been in operation for less than 3 years, for the most recent full year the accelerator, incubator, or other small business innovation-focused project was in operation—</text><clause id="H90B2E3D6F180479AB7A3D6AFF8DB43AA"><enum>(i)</enum><text>the number and retention rate of growing, newly established, and startup business concerns in the program of the eligible entity;</text></clause><clause id="H518FF36A2AC0455CB0A795B34C41F7E8"><enum>(ii)</enum><text>the average period of participation by growing, newly established, and startup small business concerns in the program of the eligible entity;</text></clause><clause id="H292CE3A43BA0400292811FEC9156AC97"><enum>(iii)</enum><text>the total and median capital raised by growing, newly established, and startup small business concerns participating in the program of the eligible entity;</text></clause><clause id="HFC1DA79DECB3460C89E87FBB9BADD317"><enum>(iv)</enum><text>the number of investments or loans received by growing, newly established, and startup small business concerns participating in the program of the eligible entity; and</text></clause><clause id="H892C228C6A8749DAB79AEE1BBE7E6362"><enum>(v)</enum><text>the total and median number of employees of growing, newly established, and startup small business concerns participating in the program of the eligible entity; and</text></clause></subparagraph><subparagraph id="HF2EF9F61ECBF47B99B6B7C08328A3195"><enum>(B)</enum><text>for all eligible entities—</text><clause id="H64BBE540B1EC4351A9BF29716DFA1315"><enum>(i)</enum><text>shall include whether the eligible entity—</text><subclause id="H8F30A43426EB40ADB7A1B6D84876426A"><enum>(I)</enum><text>indicates the structure and goals of the project;</text></subclause><subclause id="HC7972DFC633C47FC8216BE6739492C39"><enum>(II)</enum><text>demonstrates ties to the business community;</text></subclause><subclause id="H71E7B65A013045CEB64BB027A5C666CE"><enum>(III)</enum><text>identifies the resources available for the project;</text></subclause><subclause id="H0639A5900CD840C5AA65000696BA25E1"><enum>(IV)</enum><text>describes the capabilities of the project, including coordination with local resource partners and local or national lending partners of the Administration;</text></subclause><subclause id="HC4BC2E022A7E4D25A420E25E7A67864F"><enum>(V)</enum><text>addresses the unique business and economic challenges faced by the community in which the eligible entity is located and businesses in that community; or</text></subclause><subclause id="H3D5332D496EE41239614688E3F8288BF"><enum>(VI)</enum><text>provides a proposed budget and plan for use of funds; and</text></subclause></clause><clause id="H8518583041D544F383A8CD2E334EBEA1"><enum>(ii)</enum><text>may include any other criteria determined appropriate by the Administrator.</text></clause></subparagraph></paragraph></subsection><subsection id="H2F7865550F3E429080E1FAC3437A6806"><enum>(e)</enum><header>Program examination</header><paragraph id="H2600AF6F4678499BA0B417C41335942C"><enum>(1)</enum><header>In general</header><text>The Administrator shall—</text><subparagraph id="HE33426F677E5473D90BEE6FEA0D23A99"><enum>(A)</enum><text>develop and implement an annual programmatic and financial examination of each project conducted under this section, under which each eligible entity entering into a cooperative agreement under this section shall provide to the Administrator—</text><clause id="HDF14B1BA6F914BFDA2B73311B403D429"><enum>(i)</enum><text>an itemized cost breakdown of actual expenditures for costs incurred during the preceding year; and</text></clause><clause id="H866C9CFACE2D4935BF4813505096658F"><enum>(ii)</enum><text>documentation regarding—</text><subclause id="HA884E9596CCF4D42993677AF545D9434"><enum>(I)</enum><text>the amount of matching assistance from non-Federal sources obtained and expended by the eligible entity during the preceding year in order to meet the matching requirement; and</text></subclause><subclause id="H28E55EC40F594177BBB2E4FCB5BBB472"><enum>(II)</enum><text>with respect to any in-kind contributions that were used to satisfy the matching requirement, verification of the existence and valuation of those contributions; and</text></subclause></clause></subparagraph><subparagraph id="HA38298BC218940CBA55E5F9E16C6B98C"><enum>(B)</enum><text>analyze the results of each examination conducted under subparagraph (A) and, based on that analysis, make a determination regarding the programmatic and financial viability of each eligible entity.</text></subparagraph></paragraph><paragraph id="H7FC041AA894C47E083E02E2C33EE114E"><enum>(2)</enum><header>Conditions for continued funding</header><text>In determining whether to continue or renew a cooperative agreement under this section, the Administrator—</text><subparagraph id="H2FF0DAE135274C089B0299C957AAFE6A"><enum>(A)</enum><text>shall consider the results of the most recent examination of the project under paragraph (1); and</text></subparagraph><subparagraph id="HDB3D5FC8A43E43EF8B858554B6A1227A"><enum>(B)</enum><text>may terminate or not renew a cooperative agreement, if the Administrator determines that the eligible entity has failed to provide any information required to be provided (including information provide for purpose of the annual report by the Administrator under subsection (m)) or the information provided by the eligible entity is inadequate.</text></subparagraph></paragraph></subsection><subsection id="HC35CD0C4482544889709AD19980DC77B"><enum>(f)</enum><header>Training and technical assistance</header><text>The Administrator—</text><paragraph id="H3B3825FDD74F44C7A9398D8322BC7D6E"><enum>(1)</enum><text>shall provide in person or online training and technical assistance to each eligible entity entering into a cooperative agreement under this section at the beginning of the participation of the eligible entity in the Innovation Centers Program in order to build the capacity of the eligible entity and ensure compliance with procedures established by the Administrator;</text></paragraph><paragraph id="H3984A1B1A93C419D987BC73B286426D5"><enum>(2)</enum><text>shall ensure that the training and technical assistance described in paragraph (1) is provided at no cost or at a low cost; and</text></paragraph><paragraph id="H0702377361FD49D38C0D853F8156DDE0"><enum>(3)</enum><text>may enter into a contract to provide the training or technical assistance described in paragraph (1) with 1 or more organizations with expertise in the entrepreneurial development programs of the Administration, innovation, and entrepreneurial development.</text></paragraph></subsection><subsection id="H0379F335592145B9B2680EAE36537FAB"><enum>(g)</enum><header>Coordination</header><text>In carrying out a project under this section, an eligible entity may coordinate with—</text><paragraph id="H8151139B0D284DDC98248301AAFD01BD"><enum>(1)</enum><text>resource and lending partners of the Administration;</text></paragraph><paragraph id="H61C895384ACB402490E6427E723DF732"><enum>(2)</enum><text>programs of State and local governments that are concerned with aiding small business concerns; and</text></paragraph><paragraph id="H2AE6D9329AE14DC6912D0137E0DBE57D"><enum>(3)</enum><text>other Federal agencies, including to provide services to and assist small business concerns in participating in the SBIR and STTR programs, as defined in section 9(e).</text></paragraph></subsection><subsection id="H6469CAD087A34EEF8B144C63619AAA48"><enum>(h)</enum><header>Funding limit</header><text>The amount of financial assistance provided to an eligible entity under a cooperative agreement entered into under this section shall be not more than $400,000 during each year.</text></subsection><subsection id="H71F23220B3AE42349A465EE276D2FD28"><enum>(i)</enum><header>Matching requirement</header><paragraph id="H045175C5D724417BA0687309CC3B5F79"><enum>(1)</enum><header>In general</header><text>An eligible entity shall contribute toward the cost of the project carried out under the cooperative agreement under this section an amount equal to 50 percent of the amount received under the cooperative agreement.</text></paragraph><paragraph id="H861AB923713E4758896E148C6A3608AC"><enum>(2)</enum><header>In-kind contributions</header><text>Not more than 50 percent of the contribution of an eligible entity under paragraph (1) may be in the form of in-kind contributions.</text></paragraph><paragraph id="H151325BB485440CBB65000C4036F00B5"><enum>(3)</enum><header>Waiver</header><subparagraph id="H96AE32C147FA415B837BED93C83C531E"><enum>(A)</enum><header>In general</header><text>If the Administrator determines that an eligible entity is unable to meet the contribution requirement under paragraph (1), the Administrator may reduce the required contribution.</text></subparagraph><subparagraph id="HD4C66B8A477347A3830C7920F5C9B51D"><enum>(B)</enum><header>Presumption</header><text>An eligible entity shall be presumed to be unable to meet the contribution requirement under paragraph (1) if the eligible entity has—</text><clause id="H8F140B9DABC14E5C84E6E0B00968C5C5"><enum>(i)</enum><text>long-term debt in an amount that is less than $10,000,000;</text></clause><clause id="H5CD6497AB251435F90B582243749B1AC"><enum>(ii)</enum><text>an invested market endowment in an amount that is less than $15,000,000; or</text></clause><clause id="HFDE898CFF25F40E08696BC497C4580D5"><enum>(iii)</enum><text>total net liquid assets in an amount that is less than $15,000,000.</text></clause></subparagraph></paragraph><paragraph id="H94E076F8C382417FB8660933446DD94F"><enum>(4)</enum><header>Failure to obtain non-federal funding</header><text>If an eligible entity fails to obtain the required non-Federal contribution during any project, or the reduced non-Federal contribution as determined by the Administrator—</text><subparagraph id="H3CEF241CFFCD4B06B4D0903E7A7F4EDB"><enum>(A)</enum><text>the eligible entity shall not be eligible thereafter for any other project for which it is or may be funded by the Administration; and</text></subparagraph><subparagraph id="HD1FC9E71958740C89DD1B5D650A01F85"><enum>(B)</enum><text>before approving assistance for the eligible entity for any other projects, the Administrator shall specifically determine whether the Administrator believes that the eligible entity will be able to obtain the requisite non-Federal funding and enter a written finding setting the forth the reasons for making that determination.</text></subparagraph></paragraph><paragraph id="H3F210593657D4B03A6AC0C9881CFF62C"><enum>(5)</enum><header>Rule of construction</header><text>The demonstrated inability of an eligible entity to meet the contribution requirement under paragraph (1) shall not disqualify the eligible entity from entering into a cooperative agreement under this section.</text></paragraph></subsection><subsection id="HDF0E310DC6184864B0282AD64952B5A1"><enum>(j)</enum><header>Contract authority</header><paragraph id="HFDD037507324410E9C233B1F48C5F34C"><enum>(1)</enum><header>In general</header><text>An eligible entity may enter into a contract with a Federal department or agency to provide specific assistance to startup, newly established, or growing small business concerns.</text></paragraph><paragraph id="H9D3A2A6F043B442C96523E8CB7FCFEDC"><enum>(2)</enum><header>Performance</header><text>Performance of a contract entered into under paragraph (1) may not hinder the eligible entity in carrying out the terms of the cooperative agreement under this section.</text></paragraph><paragraph id="HE7DFA52111964147A65CB6518E183A99"><enum>(3)</enum><header>Exemption from matching requirement</header><text>A contract entered into under paragraph (1) shall not be subject to the matching requirement under subsection (i).</text></paragraph><paragraph id="H04351894954D472793D9F9B148B7B72F"><enum>(4)</enum><header>Additional provision</header><text>Notwithstanding any other provision of law, a contract for assistance under paragraph (1) shall not be applied to any Federal department or agency’s small business, woman-owned business, or socially and economically disadvantaged business contracting goal under section 15(g).</text></paragraph></subsection><subsection id="HCC57612C6425438AB9E027FB2163C6A7"><enum>(k)</enum><header>Privacy requirements</header><paragraph id="HE04FD21F8C5B48C8BC0EC3937C727D47"><enum>(1)</enum><header>In general</header><text>An eligible entity may not disclose the name, address, or telephone number of any individual or small business concern receiving assistance under this section without the consent of such individual or small business concern, unless—</text><subparagraph id="HF36C4C4CE0754ED786B2328AB6702CDD"><enum>(A)</enum><text>the Administrator is ordered to make such a disclosure by a court in any civil or criminal enforcement action initiated by a Federal or State agency; or</text></subparagraph><subparagraph id="H60CEEC0A0E274F28B14175D66F614F0A"><enum>(B)</enum><text>the Administrator considers such a disclosure to be necessary for the purpose of conducting a financial audit of an eligible entity, but a disclosure under this subparagraph shall be limited to the information necessary for such audit.</text></subparagraph></paragraph><paragraph id="H458664EE98684F50BD81187000E43047"><enum>(2)</enum><header>Administration use of information</header><text>This subsection shall not—</text><subparagraph id="H4A880CE489C74D229F8E545D1883B4B1"><enum>(A)</enum><text>restrict Administration access to program activity data; or</text></subparagraph><subparagraph id="H06627FA3762A48548573BDF33B54BB52"><enum>(B)</enum><text>prevent the Administration from using client information (other than the information described in subparagraph (A)) to conduct client surveys.</text></subparagraph></paragraph><paragraph id="H19C323EF0FD24471935516AC629634BD"><enum>(3)</enum><header>Regulations</header><text>The Administrator shall issue regulations to establish standards for requiring disclosures during a financial audit under paragraph (1)(B).</text></paragraph></subsection><subsection id="H7226B044C3044A6E8B31554170063A44"><enum>(l)</enum><header>Publication of information</header><text>The Administrator shall—</text><paragraph id="H5705D046211E4AFEB6562831E900DB64"><enum>(1)</enum><text>publish information about the program under this section online, including—</text><subparagraph id="H41BB40D31A6C4F958A05D06FFDCC9D37"><enum>(A)</enum><text>on the website of the Administration; and</text></subparagraph><subparagraph id="HF011161C36BB4870A629A79B9F869EEF"><enum>(B)</enum><text>on the social media of the Administration; and</text></subparagraph></paragraph><paragraph id="HD2B5761E6506476AB48AB32AB7512C6C"><enum>(2)</enum><text>request that the resource and lending partners of the Administration and the district offices of the Administration publicize the program.</text></paragraph></subsection><subsection id="H840FBD69F8344390BB09311A4F9193AB"><enum>(m)</enum><header>Annual reporting</header><text>Not later than 1 year after the date on which the Administrator establishes the program under this section, and annually thereafter, the Administrator shall submit to Congress a report on the activities under the program, including—</text><paragraph id="HEEE9A23E72FC489298B1F043C1248FA9"><enum>(1)</enum><text>the number of startup, newly established, and growing small business concerns participating in the project carried out by each eligible entity under a cooperative agreement under this section (in this paragraph referred to as <quote>participants</quote>), including a breakdown of the owners of the participants by race, gender, veteran status, and urban versus rural location;</text></paragraph><paragraph id="HC02E45FD147140659334A8CDD71E33E8"><enum>(2)</enum><text>the retention rate for participants;</text></paragraph><paragraph id="HC739546532664FEB9C4F4B9B5F81C318"><enum>(3)</enum><text>the total and median amount of capital accessed by participants, including the type of capital accessed;</text></paragraph><paragraph id="H020D565B3BEA4D878BFB00801084CCC9"><enum>(4)</enum><text>the total and median number of employees of participants;</text></paragraph><paragraph id="H3EF86E63CAED4C1FB9B8B8D967ECE4B0"><enum>(5)</enum><text>the number and median wage of jobs created by participants;</text></paragraph><paragraph id="HCC21DF6CB5C143739D6C41E1A51A99A1"><enum>(6)</enum><text>the number of jobs sustained by participants; and</text></paragraph><paragraph id="HA3A0370E01D747189F77A9F149AAFE69"><enum>(7)</enum><text>information regarding such other metrics as the Administrator determines appropriate.</text></paragraph></subsection><subsection id="H3EEC4D41D0D54289835BEF98A3EE28BB"><enum>(n)</enum><header>Funding</header><paragraph id="HC86A3F5579994216A8A16B8C746C6D19"><enum>(1)</enum><header>Authorization of appropriations</header><text>There are authorized to be appropriated such sums as may be necessary to carry out this section.</text></paragraph><paragraph id="H3F5EC1A7E0C548C8993C2A89B8131422"><enum>(2)</enum><header>Administrative expenses</header><text>Of the amount made available to carry out this section for any fiscal year, not more than 10 percent may be used by the Administrator for administrative expenses.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="H1A0C56875394412E8228EDCDB71040BC"><enum>(b)</enum><header>Regulations</header><text display-inline="yes-display-inline">The Administrator of the Small Business Administration shall promulgate regulations to carry out section 49 of the Small Business Act, as added by subsection (a).</text></subsection></section></legis-body></bill>
