Maloney of New York</sponsor> (for herself and <cosponsor name-id="C001072">Mr. Carson</cosponsor>) introduced the following bill; which was referred to the <committee-name committee-id="HJU00">Committee on the Judiciary</committee-name>, and in addition to the Committee on <committee-name committee-id="HIF00">Energy and Commerce</committee-name>, for a period to be subsequently determined by the Speaker, in each case for consideration of such provisions as fall within the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To provide for the development and use of technology for personalized handguns, to require that all handguns manufactured or sold in, or imported into, the United States incorporate such technology, and for other purposes.</official-title></form><legis-body id="H10BD7EA047934C89B69F61C49627BC00" style="OLC"><section id="HD2E15F1697E640569E039BDEFB80DE9F" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Handgun Trigger Safety Act of 2021</short-title></quote>.</text></section><section id="H534E8B994DA84B5A915B581B68A0A6E2"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds as follows:</text><paragraph id="H599F63F7F541453CBF13FD15A484312C"><enum>(1)</enum><text display-inline="yes-display-inline">It is in the interest of the United States to protect its citizens from handgun violence and accidental firearm deaths.</text></paragraph><paragraph id="HFBC2C8AB0C8D4311A1DD7AFB84CB049A"><enum>(2)</enum><text>Personalizing handguns would prevent unauthorized users, whether children, criminals, or others, from misusing the weapons.</text></paragraph><paragraph id="HDA7BCAF9EA05417FB5A9CF4F6B07B4B1"><enum>(3)</enum><text>Personalizing handguns would allow authorized users to continue to lawfully own and use their handguns more safely.</text></paragraph><paragraph id="HAFA5F180F0BA41BB82A18E83ECA61119"><enum>(4)</enum><text display-inline="yes-display-inline">From 2011 to 2015, according to the Centers for Disease Control, an average of 544 Americans died in firearm accidents each year.</text></paragraph><paragraph id="H337F692588FE4316932D205807DADD00"><enum>(5)</enum><text display-inline="yes-display-inline">According to research from Everytown for Gun Safety, an unintentional shooting involving a child happens every 34 hours in the United States.</text></paragraph><paragraph id="H6AC71778295049D19ED965E8DE3AA3E4"><enum>(6)</enum><text>According to the National Crime Victimization Survey, almost 350,000 incidents of firearm theft from private citizens occur each year.</text></paragraph><paragraph id="HF382168BD5EB45438C27EB1068F8A341"><enum>(7)</enum><text display-inline="yes-display-inline">According to the Federal Bureau of Investigation, 24 law enforcement officers were killed with their own weapon between 2006 and 2015.</text></paragraph><paragraph id="H8D48053D3CAD43C08B65419A1F06DCCB"><enum>(8)</enum><text display-inline="yes-display-inline">According to the Federal Bureau of Investigation, almost half of all murders in the United States in 2015 were committed with handguns.</text></paragraph></section><title id="H0C00CDA907A94623BFB03D4C4494D304"><enum>I</enum><header>Technology for Personalized Handguns Grants</header><section id="H86184F7BD0BF4C81AB9E62C4C14C9CAD"><enum>101.</enum><header>Definitions</header><text display-inline="no-display-inline">In this title:</text><paragraph id="H6BF7691F948749108903FBF8C05FD77B"><enum>(1)</enum><header>Authorized user</header><text display-inline="yes-display-inline">The term <term>authorized user</term>, with respect to a firearm, means—</text><subparagraph id="H739AED8730AF49A483CD43C3213CFE91"><enum>(A)</enum><text display-inline="yes-display-inline">the lawful owner of the firearm; and</text></subparagraph><subparagraph id="HA456F64A0AAA42E6AA1F7E3558FC4E0F"><enum>(B)</enum><text display-inline="yes-display-inline">any individual who is—</text><clause id="H8C5A3047F1A64365BF9860132FBE88B6"><enum>(i)</enum><text display-inline="yes-display-inline">authorized by the lawful owner of the firearm to use the firearm; and</text></clause><clause commented="no" display-inline="no-display-inline" id="HAB548AD62B4646D7A47E0C0108DC04FA"><enum>(ii)</enum><text display-inline="yes-display-inline">authorized, under the law of the State where the firearm is being used, to own, carry, or use a firearm in the State.</text></clause></subparagraph></paragraph><paragraph id="H13ABF690D50D412C82DEEA51D3966AC9"><enum>(2)</enum><header>Handgun</header><text>The term <term>handgun</term> has the meaning given the term in section 921(a)(29) of title 18, United States Code.</text></paragraph><paragraph id="H175EEBB2ECB64B74B61E4D9D17180794"><enum>(3)</enum><header>Personalized handgun</header><text display-inline="yes-display-inline">The term <term>personalized handgun</term> means a handgun that—</text><subparagraph id="H1FBA0A092F6C45F784592998B6E4AD8A"><enum>(A)</enum><text>enables only an authorized user of the handgun to fire the handgun; and</text></subparagraph><subparagraph id="H5E8955F200B74388820B96AA9C90FC28"><enum>(B)</enum><text display-inline="yes-display-inline">is manufactured in such a manner that the firing restriction described in subparagraph (A)—</text><clause id="H1F856103A80E49DEAB477D67BAAB6A41"><enum>(i)</enum><text>is incorporated into the design of the handgun;</text></clause><clause id="H46E4D94D161A4FD7BE33294FE5AB344A"><enum>(ii)</enum><text>is not sold as an accessory; and</text></clause><clause id="HEF31B7398B684464BC425BAABBA7E47F"><enum>(iii)</enum><text>cannot be readily removed or deactivated.</text></clause></subparagraph></paragraph><paragraph id="H2E1D879FD8F54082B690ECC5F6386362"><enum>(4)</enum><header>Qualified entity</header><text>The term <term>qualified entity</term> means—</text><subparagraph id="H56826D0A3941486F905BD7352A02F056"><enum>(A)</enum><text>a State or unit of local government;</text></subparagraph><subparagraph id="HC9B1154102E640FEB73A34BDEDD1615A"><enum>(B)</enum><text>a nonprofit or for-profit organization; or</text></subparagraph><subparagraph id="H51BBAF0BD308467B97928591BFECF6A8"><enum>(C)</enum><text display-inline="yes-display-inline">an institution of higher education (as defined in section 101 of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1001">20 U.S.C. 1001</external-xref>)).</text></subparagraph></paragraph><paragraph id="HACFE2768914146B58664B09A7D4A319B"><enum>(5)</enum><header>Retrofitted personalized handgun</header><text>The term <term>retrofitted personalized handgun</term> means a handgun fitted with a device that—</text><subparagraph id="HABF116238F3F4B79B09AF81921AA9BC9"><enum>(A)</enum><text>enables only an authorized user of the handgun to fire the handgun; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H3A6A0B89843D41D9B44D5D74A8D412D0"><enum>(B)</enum><text>cannot be readily removed or deactivated.</text></subparagraph></paragraph></section><section id="HD3D2E022476E41029BDC8869346D5464"><enum>102.</enum><header>Authorization</header><text display-inline="no-display-inline">The Attorney General, acting through the Director of the National Institute of Justice (referred to in this title as the <quote>Director</quote>), shall make grants to qualified entities to develop technology for personalized handguns.</text></section><section id="H887E286449FA4EFABCEE741239C8C54A"><enum>103.</enum><header>Applications</header><text display-inline="no-display-inline">A qualified entity seeking a grant under this title shall submit to the Director an application at such time, in such manner, and containing such information as the Director may reasonably require.</text></section><section id="H0331AD625F6A4040AE0B18389C8D4BA7"><enum>104.</enum><header>Uses of funds</header><text display-inline="no-display-inline">A qualified entity that receives a grant under this title—</text><paragraph id="H05CBFE7088B344F994BAE0C79933A6A0"><enum>(1)</enum><text display-inline="yes-display-inline">shall use not less than 70 percent of the amount of the grant to develop technology for personalized handguns;</text></paragraph><paragraph id="H866E9910E33049278C01357EF5F4B7F0"><enum>(2)</enum><text>may use not more than 20 percent of the amount of the grant to develop technology for retrofitted personalized handguns; and</text></paragraph><paragraph id="HB5A7639A5A1747CA8E1E67931536B45E"><enum>(3)</enum><text>may use not more than 10 percent of the amount of the grant for administrative costs associated with the development of technology funded under this title.</text></paragraph></section><section id="H8DF0E904A10C4C06A8FD9456B8CF6C24"><enum>105.</enum><header>Term; renewal</header><subsection id="H8FD34907CE294FD9926DD4A2496FF487"><enum>(a)</enum><header>Term</header><text display-inline="yes-display-inline">A grant awarded under this title shall be for a term of 1 year.</text></subsection><subsection id="HFFD32F48647E4A438ACE8CC8CB6C89A5"><enum>(b)</enum><header>Renewal</header><text display-inline="yes-display-inline">A qualified entity receiving a grant under this title may renew the grant by submitting to the Director an application for renewal at such time, in such manner, and containing such information as the Director may reasonably require.</text></subsection></section><section id="HF6EE693163FE43EDB2A76CD4BD560E0A"><enum>106.</enum><header>Reports</header><subsection id="HB059DE99C46E4ACEAE382D04AA1554A5"><enum>(a)</enum><header>Reports to Director</header><text display-inline="yes-display-inline">A qualified entity receiving a grant under this title shall submit to the Director such reports, at such time, in such manner, and containing such information as the Director may reasonably require.</text></subsection><subsection id="H497BDD5EAEE94C658FA4422709454B6E"><enum>(b)</enum><header>Reports to Congress</header><text display-inline="yes-display-inline">Each year, the Director shall submit to Congress a report that contains a summary of the information submitted to the Director under subsection (a) during the previous year.</text></subsection></section><section id="HC926BEE79A5B48F1881C5DA69D837428"><enum>107.</enum><header>Regulations</header><text display-inline="no-display-inline">The Director may promulgate such guidelines, rules, regulations, and procedures as may be necessary to carry out this title.</text></section><section id="H76824A7AF5444EAAAFD8FBD7249C2BD4"><enum>108.</enum><header>Authorization of appropriations</header><text display-inline="no-display-inline">There is authorized to be appropriated to carry out this title $2,000,000 for each of the first 2 fiscal years beginning after the date of the enactment of this Act.</text></section></title><title id="H8F217057DECE4B7AA0AE0C4504DF0486"><enum>II</enum><header>Consumer Product Safety Commission safety standard</header><section id="H07C11C87B90849FB820547B1A2CD537F"><enum>201.</enum><header>Definitions</header><text display-inline="no-display-inline">In this title:</text><paragraph id="H8C401F03D1A2490681BE0E381E711B5E"><enum>(1)</enum><header>Antique firearm; firearm; handgun</header><text display-inline="yes-display-inline">The terms <term>antique firearm</term>, <term>firearm</term>, and <term>handgun</term> have the meaning given those terms in section 921 of title 18, United States Code.</text></paragraph><paragraph id="H4ADDFFEC87FE4872B988C09EE77F2238"><enum>(2)</enum><header>Authorized user</header><text display-inline="yes-display-inline">The term <term>authorized user</term>, with respect to a firearm, means—</text><subparagraph id="H1237B77D37624797A82AB6E9B89DB888"><enum>(A)</enum><text display-inline="yes-display-inline">the lawful owner of the firearm; and</text></subparagraph><subparagraph id="H44D799174076414F84BE81FE5871D4BC"><enum>(B)</enum><text display-inline="yes-display-inline">any individual who is—</text><clause id="HAA576A4E970B4AE7B2A054FB4F3308DA"><enum>(i)</enum><text display-inline="yes-display-inline">authorized by the lawful owner of the firearm to use the firearm; and</text></clause><clause id="HE0295F8896CC42BE905557F055899D9D"><enum>(ii)</enum><text display-inline="yes-display-inline">authorized, under the law of the State where the firearm is being used, to own, carry, or use a firearm in the State.</text></clause></subparagraph></paragraph><paragraph id="HD19B723DB35848C0865A24E3061032C9"><enum>(3)</enum><header>Commission</header><text display-inline="yes-display-inline">The term <term>Commission</term> means the Consumer Product Safety Commission.</text></paragraph><paragraph id="HAA970CCF666D4014AA3EA599A886A7C6"><enum>(4)</enum><header>Consumer product safety rule</header><text display-inline="yes-display-inline">The term <term>consumer product safety rule</term> has the meaning given the term in section 3(a) of the Consumer Product Safety Act (<external-xref legal-doc="usc" parsable-cite="usc/15/2052">15 U.S.C. 2052(a)</external-xref>).</text></paragraph><paragraph id="H08499E092CA746CA88A00545D6CADEF4"><enum>(5)</enum><header>Manufactured and manufacturer</header><text display-inline="yes-display-inline">The terms <term>manufactured</term> and <term>manufacturer</term> have the meaning given those terms in section 3(a) of the Consumer Product Safety Act (<external-xref legal-doc="usc" parsable-cite="usc/15/2052">15 U.S.C. 2052(a)</external-xref>).</text></paragraph><paragraph id="HB2DA534F2BC844AE8DB295F0A3809668"><enum>(6)</enum><header>Personalized handgun</header><text display-inline="yes-display-inline">The term <term>personalized handgun</term> means a handgun that—</text><subparagraph id="HE60648DBEC0047EAB05531EF24C95BF8"><enum>(A)</enum><text display-inline="yes-display-inline">enables only an authorized user of a handgun to fire the handgun; and</text></subparagraph><subparagraph id="H64E0A3AE15A64B28A359F87F430BC85F"><enum>(B)</enum><text display-inline="yes-display-inline">is manufactured in such a manner that the firing restriction described in subparagraph (A)—</text><clause id="HCA4F6DEE8AC04E95AD6B823D59551668"><enum>(i)</enum><text display-inline="yes-display-inline">is incorporated into the design of the handgun;</text></clause><clause id="HB0B8EA0DDAFB4C9D9CF2B500D20F6426"><enum>(ii)</enum><text>is not sold as an accessory; and</text></clause><clause id="H00AB987720294DD1A595AD4AD5C9ED8C"><enum>(iii)</enum><text display-inline="yes-display-inline">cannot be readily removed or deactivated.</text></clause></subparagraph></paragraph><paragraph id="H9A93BB9288A54BE1B8891C9987B7AF6F"><enum>(7)</enum><header>Retrofitted personalized handgun</header><text display-inline="yes-display-inline">The term <term>retrofitted personalized handgun</term> means a handgun fitted with a device that—</text><subparagraph id="H7F2259020DE04E309110A9CCFD6926A1"><enum>(A)</enum><text display-inline="yes-display-inline">enables only an authorized user of a handgun to fire the handgun; and</text></subparagraph><subparagraph id="HF4CC3DC8687E4DD9B02AC13CBDC01F42"><enum>(B)</enum><text display-inline="yes-display-inline">cannot be readily removed or deactivated.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H11EB72F41F2D4A24806BA7EB7F59AAD6"><enum>(8)</enum><header>State and United States</header><text>The terms <term>State</term> and <term>United States</term> have the meaning given those terms in section 3(a) of the Consumer Product Safety Act (<external-xref legal-doc="usc" parsable-cite="usc/15/2052">15 U.S.C. 2052(a)</external-xref>).</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HE05233408D2B4BE8B7A652CF297DADB8"><enum>(9)</enum><header>To distribute in commerce and distribution in commerce</header><text>The terms <term>to distribute in commerce</term> and <term>distribution in commerce</term> have the meaning given those terms in section 3(a) of the Consumer Product Safety Act (<external-xref legal-doc="usc" parsable-cite="usc/15/2052">15 U.S.C. 2052(a)</external-xref>).</text></paragraph></section><section id="H21F382C2C2D7472B9007048BD4C30581"><enum>202.</enum><header>Prohibition on manufacturing and distribution of handguns that are not personalized handguns</header><subsection id="H106533A1DCF34AA5B5B0573764FA3FDE"><enum>(a)</enum><header>Prohibition</header><paragraph id="H2D512BCCA5AF4B07ABA7DAFEA13268DD"><enum>(1)</enum><header>Manufacturing</header><text>Beginning on the date that is 5 years after the date of enactment of this Act, no person may manufacture in the United States a handgun that is not a personalized handgun.</text></paragraph><paragraph id="H8F2164D2D79B4739BFB19E72A6FEF048"><enum>(2)</enum><header>Distribution in commerce</header><text>Beginning on the date that is 10 years after the date of enactment of this Act, no person may distribute in commerce any handgun that is not a personalized handgun or a retrofitted personalized handgun.</text></paragraph><paragraph id="H150E879121F94A4591222118F41EFBA6"><enum>(3)</enum><header>Exemptions for antique firearms and military firearms</header><text>Paragraphs (1) and (2) shall not apply to—</text><subparagraph id="H75408498A12743078311B61448EB35FC"><enum>(A)</enum><text>an antique firearm;</text></subparagraph><subparagraph id="H3648EEF0D8304BCABA0191BBC65F7953"><enum>(B)</enum><text display-inline="yes-display-inline">the manufacture of a firearm that is sold to the Department of Defense; or</text></subparagraph><subparagraph id="H749CADC71ADD49938D65F91CA7F6299B"><enum>(C)</enum><text display-inline="yes-display-inline">the sale or distribution of a firearm to the Department of Defense.</text></subparagraph></paragraph></subsection><subsection id="H3B61C382B1CB4464864EA141ACACB0C8"><enum>(b)</enum><header>Enforcement by Consumer Product Safety Commission</header><paragraph id="HA2C9D3E8D6FF40429B71DC793CD4ED96"><enum>(1)</enum><header>Treatment of violation</header><text>Notwithstanding section 3(a)(5)(E) of the Consumer Product Safety Act (<external-xref legal-doc="usc" parsable-cite="usc/15/2052">15 U.S.C. 2052(a)(5)(E)</external-xref>), a violation of subsection (a) or any rule promulgated by the Commission pursuant to paragraph (4) shall be treated as a violation of section 19(a)(1) of the Consumer Product Safety Act (<external-xref legal-doc="usc" parsable-cite="usc/15/2068">15 U.S.C. 2068(a)(1)</external-xref>).</text></paragraph><paragraph id="H82D03D47A9084285906D57C3603E8FF5"><enum>(2)</enum><header>Treatment as consumer product safety standards</header><text>Notwithstanding section 3(a)(5)(E) of the Consumer Product Safety Act (<external-xref legal-doc="usc" parsable-cite="usc/15/2052">15 U.S.C. 2052(a)(5)(E)</external-xref>), subsection (a) and any rule promulgated pursuant to paragraph (4) shall be considered consumer product safety rules.</text></paragraph><paragraph id="HB520E4A7CBC641948256BC901E611727"><enum>(3)</enum><header>Powers of Commission</header><subparagraph id="HB8154CCDA7B04DCD936270BA70B7A96B"><enum>(A)</enum><header>In general</header><text>The Commission shall enforce this section in the same manner, by the same means, and with the same jurisdiction, powers, and duties as though all applicable terms and provisions of the Consumer Product Safety Act (<external-xref legal-doc="usc" parsable-cite="usc/15/2051">15 U.S.C. 2051</external-xref> et seq.) were incorporated into and made a part of this section.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H583818A2D6A240D3B9C8FB8BD38D21DD"><enum>(B)</enum><header>Privileges and immunities</header><text>Any person who violates this section shall be subject to the penalties and entitled to the privileges and immunities provided in the Consumer Product Safety Act (<external-xref legal-doc="usc" parsable-cite="usc/15/2051">15 U.S.C. 2051</external-xref> et seq.).</text></subparagraph></paragraph><paragraph id="HF1D29BD9263841F3AB7132A97F41AC80"><enum>(4)</enum><header>Regulations</header><text>The Commission, in consultation with the Attorney General and the Director of the National Institute of Justice, may promulgate such rules as the Commission considers appropriate to carry out this section.</text></paragraph></subsection><subsection id="H5CA1360F1ED649DEAC658F6434632038"><enum>(c)</enum><header>Enforcement by States</header><paragraph id="HD63A8E030F01489D92E09667143EC7F7"><enum>(1)</enum><header>In general</header><text>In any case in which the attorney general of a State has reason to believe that an interest of the residents of the State has been or is threatened or adversely affected by the engagement of any person in a practice that violates subsection (a), the attorney general of the State may, as parens patriae, bring a civil action on behalf of the residents of the State in an appropriate district court of the United States—</text><subparagraph id="HAD263966ED70493695901B9C7E8DCAF9"><enum>(A)</enum><text>to enjoin further violation of such subsection by such person;</text></subparagraph><subparagraph commented="no" id="H6E3E79E6064F4AC1AC933CF8235E97CB"><enum>(B)</enum><text>to compel compliance with such subsection;</text></subparagraph><subparagraph id="H9B67700B7BCB488DA0C3E9B3D0602A97"><enum>(C)</enum><text>to obtain damages, restitution, or other compensation on behalf of such residents; or</text></subparagraph><subparagraph id="H318E6916A1B84262981795F7FC82EC9C"><enum>(D)</enum><text>to such civil penalties and other relief as the court considers appropriate.</text></subparagraph></paragraph><paragraph id="H3475068539FE44B08402C4E7FD0E4ED5"><enum>(2)</enum><header>Rights of Consumer Product Safety Commission</header><subparagraph id="H0CE9E176978A497290789A785C52EA68"><enum>(A)</enum><header>Notice to Consumer Product Safety Commission</header><clause id="H698CB057C82745EAB4DAB50C05EF0CCE"><enum>(i)</enum><header>In general</header><text>Except as provided in clause (iii), the attorney general of a State shall notify the Commission in writing that the attorney general intends to bring a civil action under paragraph (1) not later than 10 days before initiating the civil action.</text></clause><clause id="H9EA429CB50E24D9C8A12AAC3E6C4336B"><enum>(ii)</enum><header>Contents</header><text>The notification required by clause (i) with respect to a civil action shall include a copy of the complaint to be filed to initiate the civil action.</text></clause><clause id="H32E82A875D1D44B8B4E475B5A7F63818"><enum>(iii)</enum><header>Exception</header><text>If it is not feasible for the attorney general of a State to provide the notification required by clause (i) before initiating a civil action under paragraph (1), the attorney general shall notify the Commission immediately upon instituting the civil action.</text></clause></subparagraph><subparagraph id="H165DA9D2570A4BB6B362A3D5E43AF4E6"><enum>(B)</enum><header>Intervention by Consumer Product Safety Commission</header><text>The Commission may—</text><clause id="H705A7137CF164C45B519280FD4DAD063"><enum>(i)</enum><text>intervene in any civil action brought by the attorney general of a State under paragraph (1); and</text></clause><clause id="HE677A9BF742F4D4A822B27D8A755A73E"><enum>(ii)</enum><text>upon intervening—</text><subclause id="H433EEBEF66964059A453D81598B3321C"><enum>(I)</enum><text>be heard on all matters arising in the civil action; and</text></subclause><subclause id="H58940E655F4D4511B3BCD2E9CD8B9D15"><enum>(II)</enum><text>file petitions for appeal of a decision in the civil action.</text></subclause></clause></subparagraph></paragraph><paragraph id="H8C87BAF7D7594469A287BD90AB029E75"><enum>(3)</enum><header>Investigatory powers</header><text>Nothing in this subsection may be construed to prevent the attorney general of a State from exercising the powers conferred on the attorney general by the laws of the State to conduct investigations, to administer oaths or affirmations, or to compel the attendance of witnesses or the production of documentary or other evidence.</text></paragraph><paragraph id="HE35832D5387C4873ADBC886BC250D9A6"><enum>(4)</enum><header>Preemptive action by Consumer Product Safety Commission</header><text>If the Commission institutes a civil action or an administrative action with respect to a violation of subsection (b), the attorney general of a State may not, during the pendency of such action, bring a civil action under paragraph (1) against any defendant named in the complaint of the Commission for the violation with respect to which the Commission instituted such action.</text></paragraph><paragraph id="H6F13ECB98A4847859668B2FCC45DDA34"><enum>(5)</enum><header>Venue; service of process</header><subparagraph id="H22B7B19AB778408C82F822768357DB2E"><enum>(A)</enum><header>Venue</header><text>Any action brought under paragraph (1) may be brought in—</text><clause id="HD67FB4C6B5C94794B3A5024F0ADC127E"><enum>(i)</enum><text>the district court of the United States that meets applicable requirements relating to venue under section 1391 of title 28, United States Code; or</text></clause><clause id="HAEFDB9AD6A0E4CD9BC5ED6DAB1325F97"><enum>(ii)</enum><text>another court of competent jurisdiction.</text></clause></subparagraph><subparagraph id="HF12960986A854FED9BE2B38B2E3062E7"><enum>(B)</enum><header>Service of process</header><text>In an action brought under paragraph (1), process may be served in any district in which the defendant—</text><clause id="H7210002349254BF8A9E659BF45D64400"><enum>(i)</enum><text>is an inhabitant; or</text></clause><clause id="H646BFA57C84B4714A0F56CD240AADE4F"><enum>(ii)</enum><text>may be found.</text></clause></subparagraph></paragraph><paragraph id="H17E0509C17A945CB8FCDD763E4EB1F27"><enum>(6)</enum><header>Actions by other State officials</header><subparagraph id="H3C5DA05C49F54D058A474402DCEF1F13"><enum>(A)</enum><header>In general</header><text>In addition to civil actions brought by attorneys general under paragraph (1), any other officer of a State who is authorized by the State to do so may bring a civil action under paragraph (1), subject to the same requirements and limitations that apply under this subsection to civil actions brought by attorneys general.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HF7A7FC414303454AA9E92EC23120AF4D"><enum>(B)</enum><header>Savings provision</header><text>Nothing in this subsection may be construed to prohibit an authorized official of a State from initiating or continuing any proceeding in a court of the State for a violation of any civil or criminal law of the State.</text></subparagraph></paragraph></subsection><subsection id="H97FFCF6010EF4033AC9DEF2C5B777EA8"><enum>(d)</enum><header>Cost of retrofitting</header><paragraph id="H4B5DB1287E9F4955906D430008B0B442"><enum>(1)</enum><header>Cost borne by manufacturers</header><text>Upon the request of the owner of a handgun that was manufactured in the United States and that is not a personalized handgun or retrofitted personalized handgun, the manufacturer of the handgun—</text><subparagraph id="H68D7A2EDE20E41E7B8BF83C144FF3032"><enum>(A)</enum><text>shall—</text><clause id="H3C6130D303AD455C9090FD6E142D2216"><enum>(i)</enum><text>retrofit the handgun so that the handgun is a retrofitted personalized handgun; and</text></clause><clause id="H2553B4B0CFC64CB9BCA72FAC52095172"><enum>(ii)</enum><text>return the handgun to the owner within a reasonable period of time; and</text></clause></subparagraph><subparagraph id="HAC92E40A57E04F40AAF0E4D7E2B2114C"><enum>(B)</enum><text>may not request compensation for the retrofit from the owner.</text></subparagraph></paragraph><paragraph id="H076A551C00CD493080960FB578D05078"><enum>(2)</enum><header>Rulemaking</header><text>Not later than 1 year after the date of enactment of this Act, the Commission, in consultation with the Attorney General and the Director of the National Institute of Justice, shall by regulation establish the maximum period of time within which a manufacturer that receives a request from the owner of a handgun under paragraph (1) shall retrofit and return the handgun to the owner.</text></paragraph><paragraph id="H4B35491488644464881A16C3A2044613"><enum>(3)</enum><header>Reimbursement from Department of Justice Assets Forfeiture Fund</header><text>Section 524(c)(1) of title 28, United States Code, is amended—</text><subparagraph id="H638C01D052CB4E57BDA410360DC5079C"><enum>(A)</enum><text>in subparagraph (H), by striking <quote>and</quote> at the end;</text></subparagraph><subparagraph id="H44AB74CFA7324260881DE2374FD4764D"><enum>(B)</enum><text>in subparagraph (I), by striking the period at the end and inserting <quote>; and</quote>; and</text></subparagraph><subparagraph id="H282BA4B5717241C2B958AD8629E60627"><enum>(C)</enum><text>by inserting after subparagraph (I) the following:</text><quoted-block display-inline="no-display-inline" id="H87A15E1B6C4545A1AC4AA9D058D94F9A" style="OLC"><subparagraph id="HAB436CBF865444FA843D4FF20AD9E78B" indent="up1"><enum>(J)</enum><text display-inline="yes-display-inline">payments to reimburse manufacturers of handguns for the costs of retrofitting handguns to comply with the requirement under section 202(d)(1) of the <short-title>Handgun Trigger Safety Act of 2021</short-title>.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H1E6CFD79B37E440F8EB420B765D468BE"><enum>(e)</enum><header>Relation to State law</header><text>This section shall not be construed as superseding, altering, or affecting any provision of law of a State, except to the extent that such provision of law is inconsistent with the provisions of this section, and then only to the extent of the inconsistency.</text></subsection></section></title><title id="H8F0A0EFCC0084E7FBEAC41E3BD588DB6"><enum>III</enum><header>Exemption from the Protection of Lawful Commerce in Arms Act</header><section id="H92FADB7E29CF420C955CF79BD3CD308C"><enum>301.</enum><header>Exemptions from the Protection of Lawful Commerce in Arms Act</header><text display-inline="no-display-inline">Section 4 of the Protection of Lawful Commerce in Arms Act (<external-xref legal-doc="usc" parsable-cite="usc/15/7903">15 U.S.C. 7903</external-xref>) is amended—</text><paragraph id="H5807E7A89F704958873F5466252BB1F2"><enum>(1)</enum><text>in paragraph (4)—</text><subparagraph id="H9F70CA124B1C4B9483E0B21A4CFB78C5"><enum>(A)</enum><text>by striking <quote>The term <term>qualified product</term> means</quote> and inserting the following:</text><quoted-block display-inline="yes-display-inline" id="H9110D736719749BEB276FA912F8855D9" style="OLC"><text>The term <term>qualified product</term>—</text><clause id="H34285EF69B674A648D1EEA2E973F5130"><enum>(i)</enum><text>except as provided in clause (ii), means</text></clause><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph><subparagraph id="H21E6E1EA8B254F5798CCC4C1FB8AF8FE"><enum>(B)</enum><text>by striking the period at the end and inserting <quote>; and</quote>; and</text></subparagraph><subparagraph id="H85A3245E907F4537BB8A4A9765101F13"><enum>(C)</enum><text>by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="H304959FB03A24ABE9A2021ABD53F10D2" style="OLC"><clause id="H8C4461CF499041A1886524101CBC37CD"><enum>(ii)</enum><text>does not include a handgun that—</text><subclause id="H3B562540FB1D4A6B868D8EABE56E3F18"><enum>(I)</enum><text>is manufactured on or after the date that is 5 years after the date of enactment of the <short-title>Handgun Trigger Safety Act of 2021</short-title>; and</text></subclause><subclause id="HB3571B19246049E4B2EBCF6D68E9E858"><enum>(II)</enum><text>is not a—</text><item id="H3F29C54F46474DCB8ECBE90E82E0FC94"><enum>(aa)</enum><text>personalized handgun; or</text></item><item id="H6492F3BDEA1B45E0BDBD4F469010CE79"><enum>(bb)</enum><text>retrofitted personalized handgun.</text></item></subclause></clause><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="H8623FC4BA1F541AD8098B742F1F99C3E"><enum>(2)</enum><text>by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="HF003869E33FB48C5AA395D05D5BF330B" style="OLC"><paragraph display-inline="no-display-inline" id="H4B5B0048C53B4966AF8D802E777AFABE"><enum>(10)</enum><header>Authorized user</header><text display-inline="yes-display-inline">The term <term>authorized user</term>, with respect to a firearm, means—</text><subparagraph id="HBE8CFDF7C0D44B43A113D278B0AC5B00"><enum>(A)</enum><text display-inline="yes-display-inline">the lawful owner of the firearm; and</text></subparagraph><subparagraph id="HD11069A1EB8D42FCA49E2A97515D5662"><enum>(B)</enum><text display-inline="yes-display-inline">any individual who is—</text><clause id="H1445B352517A45E9B5BAB47BB2963724"><enum>(i)</enum><text display-inline="yes-display-inline">authorized by the lawful owner of the firearm to use the firearm; and</text></clause><clause commented="no" display-inline="no-display-inline" id="H100D322121E346FC81285ED0D68BC42E"><enum>(ii)</enum><text display-inline="yes-display-inline">authorized, under the law of the State where the firearm is being used, to own, carry, or use a firearm in the State.</text></clause></subparagraph></paragraph><paragraph display-inline="no-display-inline" id="H369B7CC0C0344CB78CC2F9A7282D85C4"><enum>(11)</enum><header>Handgun</header><text>The term <term>handgun</term> has the meaning given the term in section 921(a)(29) of title 18, United States Code.</text></paragraph><paragraph id="H2126EE97D8F543B9A668425B11D31CE8"><enum>(12)</enum><header>Personalized handgun</header><text display-inline="yes-display-inline">The term <term>personalized handgun</term> means a handgun that—</text><subparagraph id="HD9123BAD9C05431FA4756BEDBD4BE1D4"><enum>(A)</enum><text display-inline="yes-display-inline">enables only an authorized user of the handgun to fire the handgun; and</text></subparagraph><subparagraph id="H48E7C8C714A84988BB25B238ECBB386C"><enum>(B)</enum><text display-inline="yes-display-inline">is manufactured in such a manner that the firing restriction described in subparagraph (A)—</text><clause id="HC8966D6681864CEA8DB53A40EF21B5FF"><enum>(i)</enum><text display-inline="yes-display-inline">is incorporated into the design of the handgun;</text></clause><clause id="HE48883C95AFB4E638DAF47E821BD89B1"><enum>(ii)</enum><text>is not sold as an accessory; and</text></clause><clause id="HE3071EC57724495E8E0BAC015D3AE777"><enum>(iii)</enum><text display-inline="yes-display-inline">cannot be readily removed or deactivated.</text></clause></subparagraph></paragraph><paragraph id="H451700E123034E2D8AC77F1A1009B403"><enum>(13)</enum><header>Retrofitted personalized handgun</header><text display-inline="yes-display-inline">The term <term>retrofitted personalized handgun</term> means a handgun fitted with a device that—</text><subparagraph id="HA60316D723CA4994AA8E1D52A40C4470"><enum>(A)</enum><text display-inline="yes-display-inline">enables only an authorized user of the handgun to fire the handgun; and</text></subparagraph><subparagraph id="H61522561765548E58AFCB3D0F34A03F7"><enum>(B)</enum><text display-inline="yes-display-inline">cannot be readily removed or deactivated.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section></title></legis-body></bill>
