Maloney of New York</sponsor> (for herself and <cosponsor name-id="C001072">Mr. Carson</cosponsor>) introduced the following bill; which was referred to the <committee-name committee-id="HJU00">Committee on the Judiciary</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To prohibit the sale of a firearm to, and the purchase of a firearm by, a person who is not covered by appropriate liability insurance coverage.</official-title></form><legis-body id="HE19AD2F904D64882B3CEA11FFC6CA791" style="OLC"><section id="HC61044B9AE014D02A8273F0F8ADC119F" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Firearm Risk Protection Act of 2021</short-title></quote>.</text></section><section id="H2CE4714741444BB19C51C7C02285D2DE"><enum>2.</enum><header>Prohibitions on sale of firearm to, and purchase of firearm by, a person not covered by appropriate liability insurance</header><subsection id="HA028B2F0635F4F489E81A1174C9F5548"><enum>(a)</enum><header>Prohibitions</header><text display-inline="yes-display-inline">Section 922 of title 18, United States Code, is amended by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="H806A1C98BDDC4DD29043AAF45E68EF3E" style="OLC"><subsection id="HDA4D83AEA8DC4B10A80F70F9B69F8BA3"><enum>(aa)</enum><paragraph commented="no" display-inline="yes-display-inline" id="H1EB0FF83AE15458A9033843E0421C69F"><enum>(1)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="HCD0E640C20994EFA94ACFA8C188D77F1"><enum>(A)</enum><clause commented="no" display-inline="yes-display-inline" id="HE1F053A5736B427D84FD4E45232BE4B1"><enum>(i)</enum><text>It shall be unlawful for a person to purchase a firearm unless, at the time of the purchase, the purchaser presents to the seller proof that the purchaser is covered by a qualified liability insurance policy.</text></clause><clause id="HBF541C97DCCE4630850D01FBCD2C5D68" indent="up3"><enum>(ii)</enum><text>It shall be unlawful for a person to sell a firearm unless, at the time of the sale, the seller verifies that the purchaser is covered by a qualified liability insurance policy.</text></clause><clause id="H4EEF3FF731CC4F61BF7C5BB9413BD68C" indent="up3"><enum>(iii)</enum><text>It shall be unlawful for a person who owns a firearm purchased on or after the effective date of this subsection not to be covered by a qualified liability insurance policy.</text></clause></subparagraph><subparagraph id="H7FA4D322DF254104A023F332AE533E2F" indent="up2"><enum>(B)</enum><text>Subparagraph (A) shall not apply to the purchase or sale of a firearm for the use of the United States or any department or agency of the United States, or any State or any department, agency, or political subdivision of a State.</text></subparagraph></paragraph><paragraph id="H100596D93B1E4B22A1D057A926B82856" indent="up1"><enum>(2)</enum><text>In paragraph (1), the term <term>qualified liability insurance policy</term> means, with respect to the purchaser of a firearm, a policy that—</text><subparagraph id="H2D0EFAC5EFF842F4A257DC3A39EF1C18"><enum>(A)</enum><text display-inline="yes-display-inline">provides liability insurance covering the purchaser specifically for losses resulting from use of the firearm while it is owned by the purchaser; and</text></subparagraph><subparagraph id="H77C6E34E9E0D4386865B9286E5E8208D"><enum>(B)</enum><text display-inline="yes-display-inline">is issued by an insurer licensed or authorized to provide the coverage by the State insurance regulatory authority for the State in which the purchaser resides.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H52343CD810DE4C2BB891F15F5D751A5E"><enum>(b)</enum><header>Penalty</header><text>Section 924 of such title is amended by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="HFFA927678E3F420CB64403D50E1D8643" style="OLC"><subsection id="H1E9944A939A74918B10139664F05FDA4"><enum>(q)</enum><text display-inline="yes-display-inline">Whoever violates section 922(aa) shall be fined not more than $10,000.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H2403C43C9F8E47B0871C9A962926C618"><enum>(c)</enum><header>Effective date</header><text>The amendments made by this section shall apply to conduct engaged in after the 180-day period that begins with the date of the enactment of this Act.</text></subsection></section></legis-body></bill>
