R. 1001</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20210211">February 11, 2021</action-date><action-desc><sponsor name-id="L000566">Mr. Latta</sponsor> introduced the following bill; which was referred to the <committee-name committee-id="HIF00">Committee on Energy and Commerce</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the Community Mental Health Service Block Grant to authorize a set-aside for crisis care services, and for other purposes.</official-title></form><legis-body id="H379DB8A00A3D42B0AA43F3B78531D9B6" style="OLC"><section id="H3E954D6080A84A60AB9776C2566C7597" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Creating Resources to Improve Situations of Inherent Severity Act</short-title></quote> or the <quote><short-title>CRISIS Act</short-title></quote>.</text></section><section id="H6A60A60B80424F97B873ECD61B14CCAF"><enum>2.</enum><header>Set-aside for evidence-based crisis care services</header><text display-inline="no-display-inline">Section 1920 of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300x-9">42 U.S.C. 300x–9</external-xref>) is amended—</text><paragraph id="H5F1D366E779147FA939215BFD603F7FB"><enum>(1)</enum><text>in subsection (a), by striking <quote>$532,571,000 for each of fiscal years 2018 through 2022</quote> and inserting <quote>$532,571,000 for each of fiscal years 2018 through 2021, and $758,000,000 for each of fiscal years 2022 through 2023</quote>; and</text></paragraph><paragraph id="H6F53E11E287549FABA75AD4A36D96D92"><enum>(2)</enum><text>by adding at the end the following:</text><quoted-block id="HC44622E381A44B019D305C387EBD2C2A" style="OLC"><subsection id="HC039A0CC9E6C42BD8ACB939A8454AD02"><enum>(d)</enum><header>Crisis care</header><paragraph id="HAB9C1132E6E94E5FBB4118C306FCE505"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Except as provided in paragraph (3), a State shall expend at least 5 percent of the amount the State receives pursuant to section 1911 for each fiscal year to support evidenced-based programs that address the crisis care needs of individuals with serious mental disorders, and children with serious mental and emotional disturbances.</text></paragraph><paragraph id="H9FFA50BF181749AE80F1C933413A631A"><enum>(2)</enum><header>Core elements</header><text display-inline="yes-display-inline">At the discretion of the single State agency responsible for the administration of the program of the State under a grant under section 1911, funds expended pursuant to paragraph (1) may be used to fund some or all of the core crisis care service components, delivered according to evidence-based principles, including the following:</text><subparagraph id="HBB75ED4340344C0399E2AF697583BE82"><enum>(A)</enum><text>Crisis call centers.</text></subparagraph><subparagraph id="H692DE475D5584F19A3E8D11575A4F06E"><enum>(B)</enum><text>24/7 mobile crisis services.</text></subparagraph><subparagraph id="H8D3B8D6903F8480EBE5A2D09452A34D3"><enum>(C)</enum><text>Crisis stabilization programs offering acute care or subacute care in a hospital or appropriately licensed facility, as determined by the Substance Abuse and Mental Health Services Administration, with referrals to inpatient or outpatient care.</text></subparagraph></paragraph><paragraph id="HA69652513C78443BAF2EDA9A1E894862"><enum>(3)</enum><header>State flexibility</header><text display-inline="yes-display-inline">In lieu of expending 5 percent of the amount the State receives pursuant to section 1911 for a fiscal year to support evidence-based programs as required by paragraph (1), a State may elect to expend not less than 10 percent of such amount to support such programs by the end of two consecutive fiscal years.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section></legis-body></bill>
