 and of Indians.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause" style="OLC"><section commented="no" display-inline="no-display-inline" id="id8e499585-d0d7-4928-8c3a-d12a5242b492" section-type="section-one"><enum>1.</enum><header display-inline="yes-display-inline">Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Not Invisible Act of 2019</short-title></quote>.</text></section><section commented="no" display-inline="no-display-inline" id="id8247efab-280c-4da5-a9f9-95cc40b80c85" section-type="subsequent-section"><enum>2.</enum><header display-inline="yes-display-inline">Definitions</header><text display-inline="no-display-inline">In this Act—</text><paragraph commented="no" display-inline="no-display-inline" id="id569be9a7-b540-49b3-88f7-c2964602d3e1"><enum>(1)</enum><text display-inline="yes-display-inline">the term <term>Commission</term> means the Department of the Interior and the Department of Justice Joint Commission on Reducing Violent Crime Against Indians under section 4;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id5a114d8b-c3c4-4b7b-8935-4f5b1d344787"><enum>(2)</enum><text display-inline="yes-display-inline">the term <term>human trafficking</term> means act or practice described in paragraph (9) or paragraph (10) of section 103 of the Trafficking Victims Protection Act of 2000 (<external-xref legal-doc="usc" parsable-cite="usc/22/7102">22 U.S.C. 7102</external-xref>);</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id0a7e82fc-26de-4b82-94be-77a23d2d0e99"><enum>(3)</enum><text display-inline="yes-display-inline">the term <term>Indian</term> means a member of an Indian tribe;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idfe17c4e3-dc12-4690-8dd5-c5eca8e18069"><enum>(4)</enum><text display-inline="yes-display-inline">the terms <term>Indian lands</term> and <term>Indian tribe</term> have the meanings given the terms in section 3 of the Native American Business Development, Trade Promotion, and Tourism Act of 2000 (<external-xref legal-doc="usc" parsable-cite="usc/25/4302">25 U.S.C. 4302</external-xref>); and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id9385A45C11CD4F3EB7DA5B36DDB93EAA"><enum>(5)</enum><text display-inline="yes-display-inline">the terms <term>urban centers</term> and <term>urban Indian organization</term> have the meanings given the terms in section 4 of the Indian Health Care Improvement Act (<external-xref legal-doc="usc" parsable-cite="usc/25/1603">25 U.S.C. 1603</external-xref>).</text></paragraph></section><section commented="no" display-inline="no-display-inline" id="id7aeeb7c7-f794-4cbc-b2bc-bc36717f5f26" section-type="subsequent-section"><enum>3.</enum><header display-inline="yes-display-inline">Coordinator of Federal efforts to combat violence against Native people</header><subsection commented="no" display-inline="no-display-inline" id="id13A923F90AD6426EBA5D7FA3A66DCBDE"><enum>(a)</enum><header display-inline="yes-display-inline">Coordinator designation</header><text display-inline="yes-display-inline">The Secretary of the Interior shall designate an official within the Office of Justice Services in the Bureau of Indian Affairs who shall—</text><paragraph commented="no" display-inline="no-display-inline" id="idb488f388-4ddb-4d50-8b87-8535c3564954"><enum>(1)</enum><text display-inline="yes-display-inline">coordinate prevention efforts, grants, and programs related to the murder of, trafficking of, and missing Indians across Federal agencies, including—</text><subparagraph commented="no" display-inline="no-display-inline" id="id58CBDA3A9F524D679D4BA0C0203EE799"><enum>(A)</enum><text display-inline="yes-display-inline">the Bureau of Indian Affairs; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id6BA255BAED2F417E80928BFEBB4F5341"><enum>(B)</enum><text display-inline="yes-display-inline">the Department of Justice, including—</text><clause commented="no" display-inline="no-display-inline" id="id9DA2513A79604D9A80BBD516C9D554B1"><enum>(i)</enum><text display-inline="yes-display-inline">the Office of Justice Programs;</text></clause><clause commented="no" display-inline="no-display-inline" id="id94123D7BB9C34B8583B9FED038B2CFF4"><enum>(ii)</enum><text display-inline="yes-display-inline">the Office on Violence Against Women;</text></clause><clause commented="no" display-inline="no-display-inline" id="id6B9741810BF846FC9A51314EB8E0A6C2"><enum>(iii)</enum><text display-inline="yes-display-inline">the Office of Community Oriented Policing Services;</text></clause><clause commented="no" display-inline="no-display-inline" id="id29B37815E3C74B82922E17A3C9F519E1"><enum>(iv)</enum><text display-inline="yes-display-inline">the Federal Bureau of Investigation; and</text></clause><clause commented="no" display-inline="no-display-inline" id="idD8AC4ACDC5164F82A905C9A1E67B10E3"><enum>(v)</enum><text display-inline="yes-display-inline">the Office of Tribal Justice;</text></clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id5a0296b4-6560-4697-9052-9bae53f06a7a"><enum>(2)</enum><text display-inline="yes-display-inline">ensure prevention efforts, grants, and programs of Federal agencies related to the murder of, trafficking of, and missing Indians consider the unique challenges of combating crime, violence, and human trafficking of Indians and on Indian lands faced by Tribal communities, urban centers, the Bureau of Indian Affairs, Tribal law enforcement, Federal law enforcement, and State and local law enforcement;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id5eae967e-8ed9-4753-8702-83c17f67909c"><enum>(3)</enum><text display-inline="yes-display-inline">work in cooperation with outside organizations with expertise in working with Indian tribes and Indian Tribes to provide victim centered and culturally relevant training to tribal law enforcement, Indian Health Service health care providers, urban Indian organizations, Tribal community members and businesses, on how to effectively identify, respond to and report instances of missing persons, murder, and trafficking within Indian lands and of Indians; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ide6a3099d-f075-402f-916b-c7055aea777a"><enum>(4)</enum><text display-inline="yes-display-inline">report directly to the Secretary of the Interior.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id03a0a47c432e4cd7b792794c8980fe0d"><enum>(b)</enum><header display-inline="yes-display-inline">Report</header><text display-inline="yes-display-inline">The official designated in subsection (a) shall submit to the Committee on Indian Affairs and the Committee on the Judiciary of the Senate and the Committee on Natural Resources and the Committee on the Judiciary of the House of Representatives a report to provide information on Federal coordination efforts accomplished over the previous year that includes—</text><paragraph commented="no" display-inline="no-display-inline" id="id56c230bdfaa5488ea0a5d6f3ea55a0e5"><enum>(1)</enum><text display-inline="yes-display-inline">a summary of all coordination activities undertaken in compliance with this section;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id4592acd43ec84e0fa4ce5e3874305b53"><enum>(2)</enum><text display-inline="yes-display-inline">a summary of all trainings completed under subsection (a)(3); and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idc2304903410d4445bd59ade8e8a84139"><enum>(3)</enum><text display-inline="yes-display-inline">recommendations for improving coordination across Federal agencies and of relevant Federal programs.</text></paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="idc513c8e0-1aee-4b14-9aac-8095edfef5d0" section-type="subsequent-section"><enum>4.</enum><header display-inline="yes-display-inline">Establishment of the Department of Interior and the Department of Justice Joint Commission
 on Reducing Violent Crime Against Indians</header><subsection commented="no" display-inline="no-display-inline" id="id7de26f78-6998-449c-8ffe-1d2eba131289"><enum>(a)</enum><header display-inline="yes-display-inline">Establishment</header><text display-inline="yes-display-inline">Not later than 120 days after the date of enactment of this Act, the Secretary of the Interior, in coordination with the Attorney General, shall establish and appoint all members of a joint commission on violent crime on Indian lands and against Indians.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="id57b9cbcd-1299-4208-bb90-f2186da84173"><enum>(b)</enum><header display-inline="yes-display-inline">Membership</header><paragraph commented="no" display-inline="no-display-inline" id="ide147d454-8ad7-4bdf-ac54-226e862730d5"><enum>(1)</enum><header display-inline="yes-display-inline">Composition</header><subparagraph commented="no" display-inline="no-display-inline" id="id29479BAAC3DB468280B0D66196CFAFCD"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The Commission shall be composed of members who represent diverse experiences and backgrounds that provide balanced points of view with regard to the duties of the Commission.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id351B2D6B42CD4E3B84C4A236A4829CDF"><enum>(B)</enum><header display-inline="yes-display-inline">Diversity</header><text display-inline="yes-display-inline">To the greatest extent practicable, the Secretary of the Interior shall ensure the Commission includes Tribal representatives from diverse geographic areas and of diverse sizes.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id8a93c0aa-daa9-47c3-8b19-c9c5e4895349"><enum>(2)</enum><header display-inline="yes-display-inline">Appointment</header><text display-inline="yes-display-inline">The Secretary of the Interior, in coordination with the Attorney General, shall appoint the members to the Commission, including representatives from—</text><subparagraph commented="no" display-inline="no-display-inline" id="idc414b5b8-73ee-4912-903e-60b9126d1707"><enum>(A)</enum><text display-inline="yes-display-inline">tribal law enforcement;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idf0596e8d-3793-45de-8872-b5f1d652be0f"><enum>(B)</enum><text display-inline="yes-display-inline">the Office of Justice Services of the Bureau of Indian Affairs;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idd8f8a33f-94dc-4791-8fe8-66dcb5783b02"><enum>(C)</enum><text display-inline="yes-display-inline">State and local law enforcement in close proximity to Indian lands, with a letter of recommendation from a local Indian Tribe;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id929f142a-0daf-45e3-9b65-66b81eba9dbb"><enum>(D)</enum><text display-inline="yes-display-inline">the Victim Services Division of the Federal Bureau of Investigation;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idd64f68fd-fee5-4884-aaf3-2cd7ee19a213"><enum>(E)</enum><text display-inline="yes-display-inline">the Department of Justice’s Human Trafficking Prosecution Unit;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id869E63DDB09C4D94AF0505F181BA906B"><enum>(F)</enum><text display-inline="yes-display-inline">the Office of Violence Against Women of the Department of Justice;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idA5596801A43341F5944AB681D7F19693"><enum>(G)</enum><text display-inline="yes-display-inline">the Office of Victims of Crime of the Department of Justice;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idF2C8DF07BB9346FF8BFA76B2BB836BAE"><enum>(H)</enum><text display-inline="yes-display-inline">a United States attorney's office with experience in cases related to missing persons, murder, or trafficking of Indians or on Indian land;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ideb28d811-f63b-4681-94f7-b1804811fe78"><enum>(I)</enum><text display-inline="yes-display-inline">the Administration for Native Americans of the Office of the Administration for Children &amp; Families of the Department of Health and Human Services;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id9cd5631ffbf9417abcc91737319d7a24"><enum>(J)</enum><text display-inline="yes-display-inline">the Substance Abuse and Mental Health Services Administration of the Department of Health and Human Services;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id625afea0-fe41-4c4a-b996-b78844d30a98"><enum>(K)</enum><text display-inline="yes-display-inline">a Tribal judge with experience in cases related to missing persons, murder, or trafficking;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idcbdc536b-0704-4bf0-bc83-7aab694341e9"><enum>(L)</enum><text display-inline="yes-display-inline">not fewer than 3 Indian Tribes from diverse geographic areas, including 1 Indian tribe located in Alaska, selected from nominations submitted by the Indian Tribe;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id67a1aa73-c6dc-427d-9748-4459d2df423c"><enum>(M)</enum><text display-inline="yes-display-inline">not fewer than 2 health care and mental health practitioners and counselors and providers with experience in working with Indian survivors of trafficking and sexual assault, with a letter of recommendation from a local tribal chair or tribal law enforcement officer;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id51c94a23-443f-4109-836d-c8db44a9947b"><enum>(N)</enum><text display-inline="yes-display-inline">not fewer than 3 national, regional, or urban Indian organizations focused on violence against women and children on Indian lands or against Indians;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idb34e4453-d8eb-4f96-8002-8dcc3dede82b"><enum>(O)</enum><text display-inline="yes-display-inline">at least 2 Indian survivors of human trafficking;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id6226f125-7b87-4379-ba38-4875f7c361ac"><enum>(P)</enum><text display-inline="yes-display-inline">at least 2 family members of missing Indian people;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id7e2b8c6e-9d4b-4b3c-998e-d321c05a1798"><enum>(Q)</enum><text display-inline="yes-display-inline">at least 2 family members of murdered Indian people;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idc9ab7051-0212-41e5-bd66-3bd5f016b151"><enum>(R)</enum><text display-inline="yes-display-inline">the National Institute of Justice; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id3cdd9c7b-a205-4ea5-8652-2b6644a11641"><enum>(S)</enum><text display-inline="yes-display-inline">the Indian Health Service.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id4f9dcb73-c3fa-48c7-a3b0-778f70ec6467"><enum>(3)</enum><header display-inline="yes-display-inline">Periods of appointment</header><text display-inline="yes-display-inline">Members shall be appointed for the duration of the Commission.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ida14b104c-75b3-46c1-89a5-475768005817"><enum>(4)</enum><header display-inline="yes-display-inline">Vacancies</header><text display-inline="yes-display-inline">A vacancy in the Commission shall be filled in the manner in which the original appointment was made and shall not affect the powers or duties of the Commission.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idcb0a037c-1532-4c4f-8887-71ca6d095110"><enum>(5)</enum><header display-inline="yes-display-inline">Compensation</header><text display-inline="yes-display-inline">Commission members shall serve without compensation.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idecd986bb-4b06-4c20-883c-82d5f11e3105"><enum>(6)</enum><header display-inline="yes-display-inline">Travel expenses</header><text display-inline="yes-display-inline">The Secretary of the Interior, in coordination with the Attorney General, shall consider the provision of travel expenses, including per diem, to Commission members when appropriate.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id4a8ef0b0-f99b-4438-83ac-3aca749d02af"><enum>(c)</enum><header display-inline="yes-display-inline">Duties</header><paragraph commented="no" display-inline="no-display-inline" id="id480688cbb4c249d6806f4461b64d5383"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The Commission may hold such hearings, meet and act at times and places, take such testimony, and receive such evidence as the Commission considers to be advisable to carry out the duties of the Commission under this section.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idfac9ab9b-7dad-4bcc-9733-306159be262b"><enum>(2)</enum><header display-inline="yes-display-inline">Recommendations for the Department of Interior and Department of Justice</header><subparagraph commented="no" display-inline="no-display-inline" id="idEFA25F699F92462E9BE08234364E03E4"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The Commission shall develop recommendations to the Secretary of the Interior and Attorney General on actions the Federal Government can take to help combat violent crime against Indians and within Indian lands, including the development and implementation of recommendations for—</text><clause commented="no" display-inline="no-display-inline" id="idca834cbb-4a2b-43a4-8182-0c046210a2fa"><enum>(i)</enum><text display-inline="yes-display-inline">identifying, reporting, and responding to instances of missing persons, murder, and human trafficking on Indian lands and of Indians;</text></clause><clause commented="no" display-inline="no-display-inline" id="id17a3ea44-da56-4c2b-8b8e-88c5007a10b6"><enum>(ii)</enum><text display-inline="yes-display-inline">legislative and administrative changes necessary to use programs, properties, or other resources funded or operated by the Department of the Interior and Department of Justice to combat the crisis of missing or murdered Indians and human trafficking on Indian lands and of Indians;</text></clause><clause commented="no" display-inline="no-display-inline" id="id0930902b-21f7-4050-bfad-3431fa17302a"><enum>(iii)</enum><text display-inline="yes-display-inline">tracking and reporting data on instances of missing persons, murder, and human trafficking on Indian lands and of Indians;</text></clause><clause commented="no" display-inline="no-display-inline" id="id7ea38d15-8218-436a-809e-f5bb2162b3b6"><enum>(iv)</enum><text display-inline="yes-display-inline">addressing staff shortages and open positions within relevant law enforcement agencies, including issues related to the hiring and retention of law enforcement officers;</text></clause><clause commented="no" display-inline="no-display-inline" id="id5be481a3-3c3b-49c2-8bf9-2f528208cdcb"><enum>(v)</enum><text display-inline="yes-display-inline">coordinating tribal, State, and Federal resources to increase prosecution of murder and human trafficking offenses on Indian lands and of Indians; and</text></clause><clause commented="no" display-inline="no-display-inline" id="id1A9BF2B84C2B4559896C42ACED54FDB0"><enum>(vi)</enum><text display-inline="yes-display-inline">increasing information sharing with tribal governments on violent crime investigations and prosecutions in Indian lands that were terminated or declined.</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id9f132c78d69e4198914bc0c48084bb94"><enum>(B)</enum><header display-inline="yes-display-inline">Submission</header><text display-inline="yes-display-inline">Not later than 18 months after the enactment of this Act, the Commission shall make publicly available and submit all recommendations developed under this paragraph to—</text><clause commented="no" display-inline="no-display-inline" id="ide2d3b7b50526401dadb932a75d972b28"><enum>(i)</enum><text display-inline="yes-display-inline">the Secretary of the Interior;</text></clause><clause commented="no" display-inline="no-display-inline" id="id9d02d03e8eed4a5d986736cb875546e7"><enum>(ii)</enum><text display-inline="yes-display-inline">the Attorney General;</text></clause><clause commented="no" display-inline="no-display-inline" id="idbe8d11108db244caa4bd1a8360413840"><enum>(iii)</enum><text display-inline="yes-display-inline">the Committee on the Judiciary of the Senate;</text></clause><clause commented="no" display-inline="no-display-inline" id="id2a9aea24d77e4fda92e754223cb22ed1"><enum>(iv)</enum><text display-inline="yes-display-inline">the Committee on Indian Affairs of the Senate;</text></clause><clause commented="no" display-inline="no-display-inline" id="id68ddf81e1ab044c48e75f65574676388"><enum>(v)</enum><text display-inline="yes-display-inline">the Committee on Natural Resources of the House of Representatives; and</text></clause><clause commented="no" display-inline="no-display-inline" id="id822a407e0f284c32839ad78afcd0cbc5"><enum>(vi)</enum><text display-inline="yes-display-inline">the Committee on the Judiciary of the House of Representatives.</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idf2ba2c0ff6cc4466b5266417133f8868"><enum>(C)</enum><header display-inline="yes-display-inline">Secretarial response</header><text display-inline="yes-display-inline">Not later than 90 days after the date on which the Secretary of the Interior and the Attorney General receive the recommendations under paragraph (2), the Secretary and the Attorney General shall each make publicly available and submit a written response to the recommendations to—</text><clause commented="no" display-inline="no-display-inline" id="ided5120ad006142c3a5c740554c953f7d"><enum>(i)</enum><text display-inline="yes-display-inline">the Commission;</text></clause><clause commented="no" display-inline="no-display-inline" id="id4c286ff0b16647dc91eb24df8d779ef0"><enum>(ii)</enum><text display-inline="yes-display-inline">the Committee on the Judiciary of the Senate;</text></clause><clause commented="no" display-inline="no-display-inline" id="id2f180af6715b4907b134e6ea5e2ceae3"><enum>(iii)</enum><text display-inline="yes-display-inline">the Committee on Indian Affairs of the Senate;</text></clause><clause commented="no" display-inline="no-display-inline" id="id4ae97f225c00470b925595c46cb388b2"><enum>(iv)</enum><text display-inline="yes-display-inline">the Committee on Natural Resources of the House of Representatives; and</text></clause><clause commented="no" display-inline="no-display-inline" id="idda914efdb52a4dc68abdc375ba1c765f"><enum>(v)</enum><text display-inline="yes-display-inline">the Committee on the Judiciary of the House of Representatives.</text></clause></subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idba77cf6b-e940-48d5-866a-0acf23a31e0e"><enum>(d)</enum><header display-inline="yes-display-inline">FACA exemption</header><text display-inline="yes-display-inline">The Commission shall be exempt from the Federal Advisory Committee Act (5 U.S.C.
