 perfluorinated compounds, and for other purposes.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>PFAS Detection Act of 2019</short-title></quote>.</text></section><section id="idAE1B4CDFDDE54A60821389E3DDCBF8E8"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph id="id968F2A09C1FA49E7917029E509E0AFB8"><enum>(1)</enum><header>Administrator</header><text>The term <quote>Administrator</quote> means the Administrator of the Environmental Protection Agency.</text></paragraph><paragraph id="idB9DB6B44EA1D4D649848CE36DA7014AF"><enum>(2)</enum><header>Director</header><text>The term <quote>Director</quote> means the Director of the United States Geological Survey.</text></paragraph><paragraph commented="no" id="id6D6CC823971D4B6F899D8ECEA43D3FFA"><enum>(3)</enum><header>Perfluorinated compound</header><subparagraph commented="no" id="id9C4C4AF57A594D40BF212CA4CA5D240F"><enum>(A)</enum><header>In general</header><text>The term <quote>perfluorinated compound</quote> means a perfluoroalkyl substance or a polyfluoroalkyl substance that is manmade with at least 1 fully fluorinated carbon atom.</text></subparagraph><subparagraph id="idb3eecf0b92c74480beb5711ddb57a9b7"><enum>(B)</enum><header>Definitions</header><text>In this definition:</text><clause commented="no" display-inline="no-display-inline" id="id42DC2B4509DB42E59EE1EF7B1AB92FBD"><enum>(i)</enum><header display-inline="yes-display-inline">Fully fluorinated carbon atom</header><text display-inline="yes-display-inline">The term <term>fully fluorinated carbon atom</term> means a carbon atom on which all the hydrogen substituents have been replaced by fluorine.</text></clause><clause commented="no" display-inline="no-display-inline" id="id43071A11144C41DB8ADFF076E6E72ECD"><enum>(ii)</enum><header display-inline="yes-display-inline">Nonfluorinated carbon atom</header><text display-inline="yes-display-inline">The term <term>nonfluorinated carbon atom</term> means a carbon atom on which no hydrogen substituents have been replaced by fluorine.</text></clause><clause id="id856eeb7b0e9343fe92f8b4e7416b7b77"><enum>(iii)</enum><header>Partially fluorinated carbon atom</header><text>The term <term>partially fluorinated carbon atom</term> means a carbon atom on which some, but not all, of the hydrogen substituents have been replaced by fluorine.</text></clause><clause id="id9D29B03CD4A54B08AFEA5DF8A279C9A3"><enum>(iv)</enum><header>Perfluoroalkyl substance</header><text>The term <term>perfluoroalkyl substance</term> means a manmade chemical of which all of the carbon atoms are fully fluorinated carbon atoms.</text></clause><clause id="id251e00f1807a4441bb5e6e320633504f"><enum>(v)</enum><header>Polyfluoroalkyl substance</header><text>The term <term>polyfluoroalkyl substance</term> means a manmade chemical containing a mix of fully fluorinated carbon atoms, partially fluorinated carbon atoms, and nonfluorinated carbon atoms.</text></clause></subparagraph></paragraph></section><section id="id003EEF8B9A334C8CBEA463E17EEFD2CE"><enum>3.</enum><header>Performance standard for the detection of perfluorinated compounds</header><subsection id="idAC423D60188E46F084FBE08AC8856DE3"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Director shall establish a performance standard for the detection of perfluorinated compounds.</text></subsection><subsection id="id954C458DD5364B959632989C0E81D228"><enum>(b)</enum><header>Emphasis</header><paragraph id="idB2653F74FE264D4FAC1435A98B768C77"><enum>(1)</enum><header>In general</header><text>In developing the performance standard under subsection (a), the Director shall emphasize the ability to detect as many perfluorinated compounds present in the environment as possible using analytical methods that are as sensitive as is feasible and practicable.</text></paragraph><paragraph id="id89105C5A9BD74488B339DCB72CB6FA0D"><enum>(2)</enum><header>Requirement</header><text>In developing the performance standard under subsection (a), the Director may—</text><subparagraph id="id8C10913E8CB242E586E99F1430C49948"><enum>(A)</enum><text>develop quality assurance and quality control measures to ensure accurate sampling and testing;</text></subparagraph><subparagraph id="idD458BF18DA12461A95F38836EBB00E04"><enum>(B)</enum><text>develop a training program with respect to the appropriate method of sample collection and analysis of perfluorinated compounds; and</text></subparagraph><subparagraph id="id7F467754E78D41A79493EF9CC731BACE"><enum>(C)</enum><text>coordinate as necessary with the Administrator to develop methods to detect individual and different perfluorinated compounds simultaneously.</text></subparagraph></paragraph></subsection></section><section id="idBE44400D02F6495ABB698BBEF3B758F6"><enum>4.</enum><header>Nationwide sampling</header><subsection id="id58AAB771DDE64CD282728E3C7A227335"><enum>(a)</enum><header>In general</header><text>The Director shall carry out a nationwide sampling to determine the concentration of perfluorinated compounds in estuaries, lakes, streams, springs, wells, wetlands, rivers, aquifers, and soil using the performance standard developed under section 3(a).</text></subsection><subsection id="id98C012697CE94800A3E33DEB41950B68"><enum>(b)</enum><header>Requirements</header><text>In carrying out the sampling under subsection (a), the Director shall—</text><paragraph id="id06673C2EBB0145B4B3782C3E4FEB6C72"><enum>(1)</enum><text>first carry out the sampling at sources of drinking water near locations with known or suspected releases of perfluorinated compounds;</text></paragraph><paragraph id="idC8E258E6873749278BF5A79F14D534CD"><enum>(2)</enum><text>when carrying out sampling of sources of drinking water under paragraph (1), carry out the sampling prior to any treatment of the water;</text></paragraph><paragraph id="id291DF9BB643841938AC0CB1C0259022D"><enum>(3)</enum><text>survey for ecological exposure to perfluorinated compounds, with a priority in determining direct human exposure through drinking water; and</text></paragraph><paragraph id="idE87E539044E74F4BAC32B3E2D2288F90"><enum>(4)</enum><text>consult with—</text><subparagraph id="id6120C0C08F30446A81C0F5483B672CEF"><enum>(A)</enum><text>States to determine areas that are a priority for sampling; and</text></subparagraph><subparagraph id="id58252D5C91094E48A72EDD5AF3882F4B"><enum>(B)</enum><text>the Administrator—</text><clause id="idF010428B0FB141A89ED73B9B868511E2"><enum>(i)</enum><text>to enhance coverage of the sampling; and</text></clause><clause id="id21C4B51138FF42749E23F8EE482AE4CC"><enum>(ii)</enum><text>to avoid unnecessary duplication.</text></clause></subparagraph></paragraph></subsection><subsection id="id95C01F94EFD14D03BE51F318C4E6DDE9"><enum>(c)</enum><header>Report</header><text>Not later than 90 days after the completion of the sampling under subsection (a), the Director shall prepare a report describing the results of the sampling and submit the report to—</text><paragraph id="idD05A4F89A55146349EB5D882F2347C1F"><enum>(1)</enum><text>the Committee on Environment and Public Works and the Committee on Energy and Natural Resources of the Senate;</text></paragraph><paragraph id="id4FFA9DE7894D4ED2AC9F652841681AA0"><enum>(2)</enum><text>the Committee on Energy and Commerce of the House of Representatives;</text></paragraph><paragraph id="id3464B8BC74094233B5DD3CDFBDE36234"><enum>(3)</enum><text>the Senators of each State in which the Director carried out the sampling; and</text></paragraph><paragraph id="id35BDE59062C8499BB9FF900F47DBDF17"><enum>(4)</enum><text>each Member of the House of Representatives that represents a district in which the Director carried out the sampling.</text></paragraph></subsection></section><section id="id2E534A8B69BD463CBBA71F9E3E37E293"><enum>5.</enum><header>Data usage</header><subsection id="id1AADBE7DC193439D8F01E0A64CC5AB7A"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Director shall provide the sampling data collected under section 4 to—</text><paragraph id="id7FADC50E9C0D47C594DC81C844B8117C"><enum>(1)</enum><text display-inline="yes-display-inline">the Administrator of the Environmental Protection Agency; and</text></paragraph><paragraph id="id13B20782CAB34EC19449C84A501D6DB4"><enum>(2)</enum><text>other Federal and State regulatory agencies on request.</text></paragraph></subsection><subsection id="idEE635CA5BCD44442A9BFF069A570D025"><enum>(b)</enum><header>Usage</header><text>The sampling data provided under subsection (a) shall be used to inform and enhance assessments of exposure, likely health and environmental impacts, and remediation priorities.</text></subsection></section><section id="idF8721DF413F04EEAB94B585670F045A8"><enum>6.</enum><header>Collaboration</header><text display-inline="no-display-inline">In carrying out this Act, the Director shall collaborate with—</text><paragraph id="id227A8FBDB52E481297D362D1EBF14546"><enum>(1)</enum><text display-inline="yes-display-inline">appropriate Federal and State regulators;</text></paragraph><paragraph id="id28C6862B168E459CB87CAD03C86B4F6D"><enum>(2)</enum><text display-inline="yes-display-inline">institutions of higher education;</text></paragraph><paragraph id="id934D4281B4CB40CBB3FBCE68EFDA75EB"><enum>(3)</enum><text display-inline="yes-display-inline">research institutions; and</text></paragraph><paragraph id="id1A30417DB12A48A891AD5B17191EBB2D"><enum>(4)</enum><text>other expert stakeholders.</text></paragraph></section><section id="idCA1409D4DED94B3AB116702D939DDFC4"><enum>7.</enum><header>Authorization of appropriations</header><text display-inline="no-display-inline">There are authorized to be appropriated to the Director to carry out this Act—</text><paragraph id="idCDA50FA2B4E3449DA78B802A2DE9821B"><enum>(1)</enum><text>$5,000,000 for fiscal year 2020; and</text></paragraph><paragraph id="idF3DDAB685B3048DF8472085EB1E40C11"><enum>(2)</enum><text>$10,000,000 for each of fiscal years 2021 through 2024.</text></paragraph></section></legis-body></bill>
