<section id="d22260e62" identifier="/us/bill/116/s/910/s1" style="-uslm-lc:I650146"><num value="1">SECTION 1. </num><heading>SHORT TITLE.</heading><content style="-uslm-lc:I650120">  This Act may be cited as the “<shortTitle role="act">National Sea Grant College Program Amendments Act of 2020</shortTitle>”.</content></section>
<section id="d22260e72" identifier="/us/bill/116/s/910/s2" style="-uslm-lc:I650141"><num value="2">SEC. 2. </num><heading>REFERENCES TO THE NATIONAL SEA GRANT COLLEGE PROGRAM ACT.</heading><content style="-uslm-lc:I650120">  Except as otherwise expressly provided, wherever in this Act an amendment or repeal is expressed in terms of an amendment to, or repeal of, a section or other provision, the reference shall be considered to be made to a section or other provision of the National Sea Grant College Program Act (<ref href="/us/usc/t33/s1121/etseq">33 U.S.C. 1121 et seq.</ref>).</content></section>
<section id="d22260e82" identifier="/us/bill/116/s/910/s3" style="-uslm-lc:I650141"><num value="3">SEC. 3. </num><heading>MODIFICATION OF DEAN JOHN A. KNAUSS MARINE POLICY FELLOWSHIP.</heading><subsection class="indentUp0 firstIndent1 fontsize10" id="d22260e86" identifier="/us/bill/116/s/910/s3/a" role="instruction" style="-uslm-lc:I650120"><num style="-uslm-lc:emspace2" value="a">(a) </num><heading><inline class="smallCaps">In General</inline>.—</heading><content>Section 208(b) (<ref href="/us/usc/t33/s1127/b">33 U.S.C. 1127(b)</ref>) <amendingAction type="amend">is amended</amendingAction> by <amendingAction type="delete">striking</amendingAction> “<quotedText>may</quotedText>” and <amendingAction type="insert">inserting</amendingAction> “<quotedText>shall</quotedText>”.</content></subsection><subsection class="indentUp0 firstIndent1 fontsize10" id="d22260e107" identifier="/us/bill/116/s/910/s3/b" style="-uslm-lc:I650120"><num style="-uslm-lc:emspace2" value="b">(b) </num><heading><inline class="smallCaps">Placements in Congress</inline>.—</heading><chapeau>Such section is further amended—</chapeau><paragraph class="indentUp1 firstIndent1 fontsize10" id="d22260e115" identifier="/us/bill/116/s/910/s3/b/1" role="instruction" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="1">(1) </num><content>in the first sentence, by <amendingAction type="delete">striking</amendingAction> “<quotedText>The Secretary</quotedText>” and <amendingAction type="insert">inserting</amendingAction> the following:<quotedContent><paragraph class="indentUp1 firstIndent1 fontsize10" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="1">“(1) </num><heading><inline class="smallCaps">In general</inline>.—</heading><content>The Secretary”</content></paragraph></quotedContent>; and</content></paragraph><paragraph class="indentUp1 firstIndent1 fontsize10" id="d22260e136" identifier="/us/bill/116/s/910/s3/b/2" role="instruction" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="2">(2) </num><content>in paragraph (1), as designated by paragraph (1), in the second sentence, by <amendingAction type="delete">striking</amendingAction> “<quotedText>A fellowship</quotedText>” and <amendingAction type="insert">inserting</amendingAction> the following:<quotedContent><paragraph class="indentUp1 firstIndent1 fontsize10" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="2">“(2) </num><heading><inline class="smallCaps">Placement priorities</inline>.—</heading><subparagraph class="indentUp1 firstIndent1 fontsize10" style="-uslm-lc:I650124"><num style="-uslm-lc:emspace2" value="A">“(A) </num><heading><inline class="smallCaps">In general</inline>.—</heading><chapeau>In each year in which the Secretary awards a legislative fellowship under this subsection, when considering the placement of fellows, the Secretary shall prioritize placement of fellows in the following:</chapeau><clause class="indentUp1 firstIndent1 fontsize10" style="-uslm-lc:I650126"><num style="-uslm-lc:emspace2" value="i">“(i) </num><content>Positions in offices of, or with Members on, committees of Congress that have jurisdiction over the National Oceanic and Atmospheric Administration.</content></clause><clause class="indentUp1 firstIndent1 fontsize10" style="-uslm-lc:I650126"><num style="-uslm-lc:emspace2" value="ii">“(ii) </num><content>Positions in offices of Members of Congress that have a demonstrated interest in ocean, coastal, or Great Lakes resources.</content></clause></subparagraph><subparagraph class="indentUp1 firstIndent1 fontsize10" style="-uslm-lc:I650124"><num style="-uslm-lc:emspace2" value="B">“(B) </num><heading><inline class="smallCaps">Equitable distribution</inline>.—</heading><content>In placing fellows in offices described in subparagraph (A), the Secretary shall ensure that placements are equitably distributed among the political parties.</content></subparagraph></paragraph><paragraph class="indentUp1 firstIndent1 fontsize10" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="3">“(3) </num><heading><inline class="smallCaps">Duration</inline>.—</heading><content>A fellowship”</content></paragraph></quotedContent>.</content></paragraph></subsection><subsection class="indentUp0 firstIndent1 fontsize10" id="d22260e188" identifier="/us/bill/116/s/910/s3/c" style="-uslm-lc:I650120"><num style="-uslm-lc:emspace2" value="c">(c) </num><heading><inline class="smallCaps">Effective Date</inline>.—</heading><content>The amendments made by this section shall apply with respect to the first calendar year beginning after the date of the enactment of this Act.</content></subsection><subsection class="indentUp0 firstIndent1 fontsize10" id="d22260e196" identifier="/us/bill/116/s/910/s3/d" style="-uslm-lc:I650120"><num style="-uslm-lc:emspace2" value="d">(d) </num><heading><inline class="smallCaps">Sense of Congress Concerning Federal Hiring of Former Fellows</inline>.—</heading><content>It is the sense of Congress that in recognition of the competitive nature of the fellowship under section 208(b) of the National Sea Grant College Program Act (<ref href="/us/usc/t33/s1127/b">33 U.S.C. 1127(b)</ref>), and of the exceptional qualifications of fellowship awardees, the Secretary of Commerce, acting through the Under Secretary of Commerce for Oceans and Atmosphere, should encourage participating Federal agencies to consider opportunities for fellowship awardees at the conclusion of their fellowships for workforce positions appropriate for their education and experience.</content></subsection></section>
<section id="d22260e210" identifier="/us/bill/116/s/910/s4" style="-uslm-lc:I650141"><num value="4">SEC. 4. </num><heading>MODIFICATION OF AUTHORITY OF SECRETARY OF COMMERCE TO ACCEPT DONATIONS FOR NATIONAL SEA GRANT COLLEGE PROGRAM.</heading><subsection class="indentUp0 firstIndent1 fontsize10" id="d22260e214" identifier="/us/bill/116/s/910/s4/a" role="instruction" style="-uslm-lc:I650120"><num style="-uslm-lc:emspace2" value="a">(a) </num><heading><inline class="smallCaps">In General</inline>.—</heading><content>Section 204(c)(4)(E) (<ref href="/us/usc/t33/s1123/c/4/E">33 U.S.C. 1123(c)(4)(E)</ref>) <amendingAction type="amend">is amended</amendingAction> to read as follows:<quotedContent><subparagraph class="indentUp2 firstIndent1 fontsize10" style="-uslm-lc:I650124"><num style="-uslm-lc:emspace2" value="E">“(E) </num><content>accept donations of money and, notwithstanding <ref href="/us/usc/t31/s1342">section 1342 of title 31, United States Code</ref>, of voluntary and uncompensated services;”</content></subparagraph></quotedContent>.</content></subsection><subsection class="indentUp0 firstIndent1 fontsize10" id="d22260e239" identifier="/us/bill/116/s/910/s4/b" style="-uslm-lc:I650120"><num style="-uslm-lc:emspace2" value="b">(b) </num><heading><inline class="smallCaps">Priorities</inline>.—</heading><content>The Secretary of Commerce, acting through the Under Secretary of Commerce for Oceans and Atmosphere, shall establish priorities for the use of donations accepted under section 204(c)(4)(E) of the National Sea Grant College Program Act (<ref href="/us/usc/t33/s1123/c/4/E">33 U.S.C. 1123(c)(4)(E)</ref>), and shall consider among those priorities the possibility of expanding the Dean John A. Knauss Marine Policy Fellowship’s placement of additional fellows in relevant legislative offices under section 208(b) of that Act (<ref href="/us/usc/t33/s1127/b">33 U.S.C. 1127(b)</ref>), in accordance with the recommendations under subsection (c) of this section.</content></subsection><subsection class="indentUp0 firstIndent1 fontsize10" id="d22260e254" identifier="/us/bill/116/s/910/s4/c" style="-uslm-lc:I650120"><num style="-uslm-lc:emspace2" value="c">(c) </num><heading><inline class="smallCaps">Report</inline>.—</heading><chapeau>Not later than 180 days after the date of the enactment of this Act, the Director of the National Sea Grant College Program, in consultation with the National Sea Grant Advisory Board and the Sea Grant Association, shall—</chapeau><paragraph class="indentUp1 firstIndent1 fontsize10" id="d22260e262" identifier="/us/bill/116/s/910/s4/c/1" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="1">(1) </num><content>develop recommendations for the optimal use of any donations accepted under section 204(c)(4)(E) of the National Sea Grant College Program Act (<ref href="/us/usc/t33/s1123/c/4/E">33 U.S.C. 1123(c)(4)(E)</ref>); and</content></paragraph><paragraph class="indentUp1 firstIndent1 fontsize10" id="d22260e270" identifier="/us/bill/116/s/910/s4/c/2" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="2">(2) </num><content>submit to Congress a report on the recommendations developed under paragraph (1).</content></paragraph></subsection><subsection class="indentUp0 firstIndent1 fontsize10" id="d22260e274" identifier="/us/bill/116/s/910/s4/d" style="-uslm-lc:I650120"><num style="-uslm-lc:emspace2" value="d">(d) </num><heading><inline class="smallCaps">Construction</inline>.—</heading><chapeau>Nothing in this section shall be construed to limit or otherwise affect any other amounts available for marine policy fellowships under section 208(b) of the National Sea Grant College Program Act (<ref href="/us/usc/t33/s1127/b">33 U.S.C. 1127(b)</ref>), including amounts—</chapeau><paragraph class="indentUp1 firstIndent1 fontsize10" id="d22260e286" identifier="/us/bill/116/s/910/s4/d/1" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="1">(1) </num><content>accepted under section 204(c)(4)(F) of that Act (<ref href="/us/usc/t33/s1123/c/4/F">33 U.S.C. 1123(c)(4)(F)</ref>); or</content></paragraph><paragraph class="indentUp1 firstIndent1 fontsize10" id="d22260e294" identifier="/us/bill/116/s/910/s4/d/2" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="2">(2) </num><content>appropriated pursuant to the authorization of appropriations under section 212 of that Act (<ref href="/us/usc/t33/s1131">33 U.S.C. 1131</ref>).</content></paragraph></subsection></section>
<section id="d22260e303" identifier="/us/bill/116/s/910/s5" role="instruction" style="-uslm-lc:I650141"><num value="5">SEC. 5. </num><heading>REDUCTION IN FREQUENCY REQUIRED FOR NATIONAL SEA GRANT ADVISORY BOARD REPORT.</heading><chapeau class="indentUp0 firstIndent1 fontsize10" style="-uslm-lc:I650120">  Section 209(b)(2) (<ref href="/us/usc/t33/s1128/b/2">33 U.S.C. 1128(b)(2)</ref>) <amendingAction type="amend">is amended</amendingAction>—</chapeau><paragraph class="indentUp1 firstIndent1 fontsize10" id="d22260e315" identifier="/us/bill/116/s/910/s5/1" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="1">(1) </num><content>in the paragraph heading, by <amendingAction type="delete">striking</amendingAction> “<quotedText><headingText class="smallCaps">Biennial</headingText></quotedText>” and <amendingAction type="insert">inserting</amendingAction> “<quotedText><headingText class="smallCaps">Periodic</headingText></quotedText>”;</content></paragraph><paragraph class="indentUp1 firstIndent1 fontsize10" id="d22260e332" identifier="/us/bill/116/s/910/s5/2" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="2">(2) </num><content>by <amendingAction type="delete">striking</amendingAction> the first sentence and <amendingAction type="insert">inserting</amendingAction> the following: “<quotedText>The Board shall report to Congress at least once every four years on the state of the national sea grant college program and shall notify Congress of any significant changes to the state of the program not later than two years after the submission of such a report.</quotedText>”; and</content></paragraph><paragraph class="indentUp1 firstIndent1 fontsize10" id="d22260e343" identifier="/us/bill/116/s/910/s5/3" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="3">(3) </num><content>in the second sentence, by <amendingAction type="add">adding</amendingAction> before the end period the following: “<quotedText>and provide a summary of research conducted under the program</quotedText>”.</content></paragraph></section>
<section id="d22260e352" identifier="/us/bill/116/s/910/s6" role="instruction" style="-uslm-lc:I650141"><num value="6">SEC. 6. </num><heading>MODIFICATION OF ELEMENTS OF NATIONAL SEA GRANT COLLEGE PROGRAM.</heading><content style="-uslm-lc:I650120">  Section 204(b) (<ref href="/us/usc/t33/s1123/b">33 U.S.C. 1123(b)</ref>) <amendingAction type="amend">is amended</amendingAction>, in the matter preceding paragraph (1), by <amendingAction type="insert">inserting</amendingAction> “<quotedText>for research, education, extension, training, technology transfer, and public service</quotedText>” after “<quotedText>financial assistance</quotedText>”.</content></section>
<section id="d22260e368" identifier="/us/bill/116/s/910/s7" role="instruction" style="-uslm-lc:I650141"><num value="7">SEC. 7. </num><heading>DESIGNATION OF NEW NATIONAL SEA GRANT COLLEGES AND SEA GRANT INSTITUTES.</heading><chapeau class="indentUp0 firstIndent1 fontsize10" style="-uslm-lc:I650120">  Section 207(b) (<ref href="/us/usc/t33/s1126/b">33 U.S.C. 1126(b)</ref>) <amendingAction type="amend">is amended</amendingAction>—</chapeau><paragraph class="indentUp1 firstIndent1 fontsize10" id="d22260e380" identifier="/us/bill/116/s/910/s7/1" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="1">(1) </num><content>in the subsection heading, by <amendingAction type="delete">striking</amendingAction> “<quotedText><headingText class="smallCaps">Existing Designees</headingText></quotedText>” and <amendingAction type="insert">inserting</amendingAction> “<quotedText><headingText class="smallCaps">Additional Designations</headingText></quotedText>”; and</content></paragraph><paragraph class="indentUp1 firstIndent1 fontsize10" id="d22260e397" identifier="/us/bill/116/s/910/s7/2" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="2">(2) </num><content>by <amendingAction type="delete">striking</amendingAction> “<quotedText>Any institution</quotedText>” and <amendingAction type="insert">inserting</amendingAction> the following:<quotedContent><paragraph class="indentUp1 firstIndent1 fontsize10" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="1">“(1) </num><heading><inline class="smallCaps">Notification to congress of designations</inline>.—</heading><subparagraph class="indentUp1 firstIndent1 fontsize10" style="-uslm-lc:I650124"><num style="-uslm-lc:emspace2" value="A">“(A) </num><heading><inline class="smallCaps">In general</inline>.—</heading><content>Not less than 30 days before designating an institution, or an association or alliance of two or more such institutions, as a sea grant college or sea grant institute under subsection (a), the Secretary shall notify Congress in writing of the proposed designation. The notification shall include an evaluation and justification for the designation.</content></subparagraph><subparagraph class="indentUp1 firstIndent1 fontsize10" style="-uslm-lc:I650124"><num style="-uslm-lc:emspace2" value="B">“(B) </num><heading><inline class="smallCaps">Effect of joint resolution of disapproval</inline>.—</heading><content>The Secretary may not designate an institution, or an association or alliance of two or more such institutions, as a sea grant college or sea grant institute under subsection (a) if, before the end of the 30-day period described in subparagraph (A), a joint resolution disapproving the designation is enacted.</content></subparagraph></paragraph><paragraph class="indentUp1 firstIndent1 fontsize10" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="2">“(2) </num><heading><inline class="smallCaps">Existing designees</inline>.—</heading><content>Any institution”</content></paragraph></quotedContent>.</content></paragraph></section>
<section id="d22260e442" identifier="/us/bill/116/s/910/s8" style="-uslm-lc:I650141"><num value="8">SEC. 8. </num><heading>DIRECT HIRE AUTHORITY; DEAN JOHN A. KNAUSS MARINE POLICY FELLOWSHIP.</heading><subsection class="indentUp0 firstIndent1 fontsize10" id="d22260e446" identifier="/us/bill/116/s/910/s8/a" style="-uslm-lc:I650120"><num style="-uslm-lc:emspace2" value="a">(a) </num><heading><inline class="smallCaps">In General</inline>.—</heading><content>During fiscal year 2021 and any fiscal year thereafter, the head of any Federal agency may appoint, without regard to the provisions of <ref href="/us/usc/t5/ch33/schI">subchapter I of chapter 33 of title 5, United States Code</ref>, other than sections 3303 and 3328 of that title, a qualified candidate described in subsection (b) directly to a position with the Federal agency for which the candidate meets Office of Personnel Management qualification standards.</content></subsection><subsection class="indentUp0 firstIndent1 fontsize10" id="d22260e458" identifier="/us/bill/116/s/910/s8/b" style="-uslm-lc:I650120"><num style="-uslm-lc:emspace2" value="b">(b) </num><heading><inline class="smallCaps">Dean John A. Knauss Marine Policy Fellowship</inline>.—</heading><chapeau>Subsection (a) applies with respect to a former recipient of a Dean John A. Knauss Marine Policy Fellowship under section 208(b) of the National Sea Grant College Program Act (<ref href="/us/usc/t33/s1127/b">33 U.S.C. 1127(b)</ref>) who—</chapeau><paragraph class="indentUp1 firstIndent1 fontsize10" id="d22260e470" identifier="/us/bill/116/s/910/s8/b/1" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="1">(1) </num><content>earned a graduate or post-graduate degree in a field related to ocean, coastal, and Great Lakes resources or policy from an accredited institution of higher education; and</content></paragraph><paragraph class="indentUp1 firstIndent1 fontsize10" id="d22260e474" identifier="/us/bill/116/s/910/s8/b/2" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="2">(2) </num><content>successfully fulfilled the requirements of the fellowship within the executive or legislative branch of the United States Government.</content></paragraph></subsection><subsection class="indentUp0 firstIndent1 fontsize10" id="d22260e478" identifier="/us/bill/116/s/910/s8/c" style="-uslm-lc:I650120"><num style="-uslm-lc:emspace2" value="c">(c) </num><heading><inline class="smallCaps">Limitation</inline>.—</heading><content>The direct hire authority under this section shall be exercised with respect to a specific qualified candidate not later than 2 years after the date that the candidate completed the fellowship described in subsection (b).</content></subsection></section>
<section id="d22260e487" identifier="/us/bill/116/s/910/s9" style="-uslm-lc:I650141"><num value="9">SEC. 9. </num><heading>AUTHORIZATION OF APPROPRIATIONS FOR NATIONAL SEA GRANT COLLEGE PROGRAM.</heading><subsection class="indentUp0 firstIndent1 fontsize10" id="d22260e491" identifier="/us/bill/116/s/910/s9/a" role="instruction" style="-uslm-lc:I650120"><num style="-uslm-lc:emspace2" value="a">(a) </num><heading><inline class="smallCaps">In General</inline>.—</heading><chapeau>Section 212(a) (<ref href="/us/usc/t33/s1131/a">33 U.S.C. 1131(a)</ref>) <amendingAction type="amend">is amended</amendingAction>—</chapeau><paragraph class="indentUp1 firstIndent1 fontsize10" id="d22260e506" identifier="/us/bill/116/s/910/s9/a/1" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="1">(1) </num><content>by <amendingAction type="amend">amending</amendingAction> paragraph (1) to read as follows:<quotedContent><paragraph class="indentUp1 firstIndent1 fontsize10" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="1">“(1) </num><heading><inline class="smallCaps">In general</inline>.—</heading><chapeau>There are authorized to be appropriated to the Secretary to carry out this title—</chapeau><subparagraph class="indentUp1 firstIndent1 fontsize10" style="-uslm-lc:I650124"><num style="-uslm-lc:emspace2" value="A">“(A) </num><content>$87,520,000 for fiscal year 2021;</content></subparagraph><subparagraph class="indentUp1 firstIndent1 fontsize10" style="-uslm-lc:I650124"><num style="-uslm-lc:emspace2" value="B">“(B) </num><content>$91,900,000 for fiscal year 2022;</content></subparagraph><subparagraph class="indentUp1 firstIndent1 fontsize10" style="-uslm-lc:I650124"><num style="-uslm-lc:emspace2" value="C">“(C) </num><content>$96,500,000 for fiscal year 2023;</content></subparagraph><subparagraph class="indentUp1 firstIndent1 fontsize10" style="-uslm-lc:I650124"><num style="-uslm-lc:emspace2" value="D">“(D) </num><content>$101,325,000 for fiscal year 2024; and</content></subparagraph><subparagraph class="indentUp1 firstIndent1 fontsize10" style="-uslm-lc:I650124"><num style="-uslm-lc:emspace2" value="E">“(E) </num><content>$105,700,000 for fiscal year 2025.”</content></subparagraph></paragraph></quotedContent>; and</content></paragraph><paragraph class="indentUp1 firstIndent1 fontsize10" id="d22260e544" identifier="/us/bill/116/s/910/s9/a/2" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="2">(2) </num><content>by <amendingAction type="amend">amending</amendingAction> paragraph (2) to read as follows:<quotedContent><paragraph class="indentUp1 firstIndent1 fontsize10" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="2">“(2) </num><heading><inline class="smallCaps">Priority activities for fiscal years 2021 through 2025</inline>.—</heading><chapeau>In addition to the amounts authorized to be appropriated under paragraph (1), there are authorized to be appropriated $6,000,000 for each of fiscal years 2021 through 2025 for competitive grants for the following:</chapeau><subparagraph class="indentUp1 firstIndent1 fontsize10" style="-uslm-lc:I650124"><num style="-uslm-lc:emspace2" value="A">“(A) </num><content>University research on the biology, prevention, and control of aquatic nonnative species.</content></subparagraph><subparagraph class="indentUp1 firstIndent1 fontsize10" style="-uslm-lc:I650124"><num style="-uslm-lc:emspace2" value="B">“(B) </num><content>University research on oyster diseases, oyster restoration, and oyster-related human health risks.</content></subparagraph><subparagraph class="indentUp1 firstIndent1 fontsize10" style="-uslm-lc:I650124"><num style="-uslm-lc:emspace2" value="C">“(C) </num><content>University research on the biology, prevention, and forecasting of harmful algal blooms.</content></subparagraph><subparagraph class="indentUp1 firstIndent1 fontsize10" style="-uslm-lc:I650124"><num style="-uslm-lc:emspace2" value="D">“(D) </num><content>University research, education, training, and extension services and activities focused on coastal resilience and United States working waterfronts and other regional or national priority issues identified in the strategic plan under section 204(c)(1).</content></subparagraph><subparagraph class="indentUp1 firstIndent1 fontsize10" style="-uslm-lc:I650124"><num style="-uslm-lc:emspace2" value="E">“(E) </num><content>University research and extension on sustainable aquaculture techniques and technologies.</content></subparagraph><subparagraph class="indentUp1 firstIndent1 fontsize10" style="-uslm-lc:I650124"><num style="-uslm-lc:emspace2" value="F">“(F) </num><content>Fishery research and extension activities conducted by sea grant colleges or sea grant institutes to enhance, and not supplant, existing core program funding.”</content></subparagraph></paragraph></quotedContent>.</content></paragraph></subsection><subsection class="indentUp0 firstIndent1 fontsize10" id="d22260e586" identifier="/us/bill/116/s/910/s9/b" role="instruction" style="-uslm-lc:I650120"><num style="-uslm-lc:emspace2" value="b">(b) </num><heading><inline class="smallCaps">Modification of Limitations on Amounts for Administration</inline>.—</heading><content>Paragraph (1) of section 212(b) (<ref href="/us/usc/t33/s1131/b">33 U.S.C. 1131(b)</ref>) <amendingAction type="amend">is amended</amendingAction> to read as follows:<quotedContent><paragraph class="indentUp1 firstIndent1 fontsize10" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="1">“(1) </num><heading><inline class="smallCaps">Administration</inline>.—</heading><subparagraph class="indentUp1 firstIndent1 fontsize10" style="-uslm-lc:I650124"><num style="-uslm-lc:emspace2" value="A">“(A) </num><heading><inline class="smallCaps">In general</inline>.—</heading><chapeau>There may not be used for administration of programs under this title in a fiscal year more than 5.5 percent of the lesser of—</chapeau><clause class="indentUp1 firstIndent1 fontsize10" style="-uslm-lc:I650126"><num style="-uslm-lc:emspace2" value="i">“(i) </num><content>the amount authorized to be appropriated under this title for the fiscal year; or</content></clause><clause class="indentUp1 firstIndent1 fontsize10" style="-uslm-lc:I650126"><num style="-uslm-lc:emspace2" value="ii">“(ii) </num><content>the amount appropriated under this title for the fiscal year.</content></clause></subparagraph><subparagraph class="indentUp1 firstIndent1 fontsize10" style="-uslm-lc:I650124"><num style="-uslm-lc:emspace2" value="B">“(B) </num><heading><inline class="smallCaps">Critical staffing requirements</inline>.—</heading><clause class="indentUp1 firstIndent1 fontsize10" style="-uslm-lc:I650126"><num style="-uslm-lc:emspace2" value="i">“(i) </num><heading><inline class="smallCaps">In general</inline>.—</heading><content>The Director shall use the authority under <ref href="/us/usc/t5/ch33/schVI">subchapter VI of chapter 33 of title 5, United States Code</ref>, and under section 210 of this title, to meet any critical staffing requirement while carrying out the activities authorized under this title.</content></clause><clause class="indentUp1 firstIndent1 fontsize10" style="-uslm-lc:I650126"><num style="-uslm-lc:emspace2" value="ii">“(ii) </num><heading><inline class="smallCaps">Exception from cap</inline>.—</heading><content>For purposes of subparagraph (A), any costs incurred as a result of an exercise of authority as described in clause (i) shall not be considered an amount used for administration of programs under this title in a fiscal year.”</content></clause></subparagraph></paragraph></quotedContent>.</content></subsection><subsection class="indentUp0 firstIndent1 fontsize10" id="d22260e653" identifier="/us/bill/116/s/910/s9/c" style="-uslm-lc:I650120"><num style="-uslm-lc:emspace2" value="c">(c) </num><heading><inline class="smallCaps">Allocation of Funding</inline>.—</heading><paragraph class="indentUp1 firstIndent1 fontsize10" id="d22260e660" identifier="/us/bill/116/s/910/s9/c/1" role="instruction" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="1">(1) </num><heading><inline class="smallCaps">In general</inline>.—</heading><chapeau>Section 204(d)(3) (<ref href="/us/usc/t33/s1123/d/3">33 U.S.C. 1123(d)(3)</ref>) <amendingAction type="amend">is amended</amendingAction>—</chapeau><subparagraph class="indentUp1 firstIndent1 fontsize10" id="d22260e675" identifier="/us/bill/116/s/910/s9/c/1/A" style="-uslm-lc:I650124"><num style="-uslm-lc:emspace2" value="A">(A) </num><content>in the matter preceding subparagraph (A), by <amendingAction type="delete">striking</amendingAction> “<quotedText>With respect to sea grant colleges and sea grant institutes</quotedText>” and <amendingAction type="insert">inserting</amendingAction> “<quotedText>With respect to sea grant colleges, sea grant institutes, sea grant programs, and sea grant projects</quotedText>”; and</content></subparagraph><subparagraph class="indentUp1 firstIndent1 fontsize10" id="d22260e720" identifier="/us/bill/116/s/910/s9/c/2/B" style="-uslm-lc:I650124"><num style="-uslm-lc:emspace2" value="B">(B) </num><content>by <amendingAction type="redesignate">redesignating</amendingAction> subsections (d) and (e) as subsections (c) and (d), respectively.</content></subparagraph></paragraph></subsection></section>
<section id="d22260e730" identifier="/us/bill/116/s/910/s10" role="instruction" style="-uslm-lc:I650142"><num value="10">SEC. 10. </num><heading>REPEAL OF REQUIREMENT FOR REPORT ON COORDINATION OF OCEANS AND COASTAL RESEARCH ACTIVITIES.</heading><content style="-uslm-lc:I650120">  Section 9 of the National Sea Grant College Program Act Amendments of 2002 (<ref href="/us/usc/t33/s857–20">33 U.S.C. 857–20</ref>) is <amendingAction type="repeal">repealed</amendingAction>.</content></section>
<section id="d22260e743" identifier="/us/bill/116/s/910/s11" role="instruction" style="-uslm-lc:I650142"><num value="11">SEC. 11. </num><heading>TECHNICAL CORRECTIONS.</heading><chapeau class="indentUp0 firstIndent1 fontsize10" style="-uslm-lc:I650120">  The National Sea Grant College Program Act (<ref href="/us/usc/t33/s1121/etseq">33 U.S.C. 1121 et seq.</ref>) <amendingAction type="amend">is amended</amendingAction>—</chapeau><paragraph class="indentUp1 firstIndent1 fontsize10" id="d22260e755" identifier="/us/bill/116/s/910/s11/1" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="1">(1) </num><content>in section 204(d)(3)(B) (<ref href="/us/usc/t33/s1123/d/3/B">33 U.S.C. 1123(d)(3)(B)</ref>), by moving clause (vi) 2 ems to the right; and</content></paragraph><paragraph class="indentUp1 firstIndent1 fontsize10" id="d22260e763" identifier="/us/bill/116/s/910/s11/2" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="2">(2) </num><content>in section 209(b)(2) (<ref href="/us/usc/t33/s1128/b/2">33 U.S.C. 1128(b)(2)</ref>), as amended by section 5, in the third sentence, by <amendingAction type="delete">striking</amendingAction> “<quotedText>The Secretary shall</quotedText>” and <amendingAction type="insert">inserting</amendingAction> the following:<quotedContent><paragraph class="indentUp1 firstIndent1 fontsize10" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="3">“(3) </num><heading><inline class="smallCaps">Availability of resources of department of commerce</inline>.—</heading><content>The Secretary shall”</content></paragraph></quotedContent>.</content></paragraph></section>
