<enactingFormula style="-uslm-lc:I650120">  Be it enacted by the Senate and House of Representa­tives of the United States of America in Congress assembled,</enactingFormula>
<section id="d110425e62" identifier="/us/bill/116/s/760/s1" style="-uslm-lc:I650146"><num value="1">SECTION 1. </num><heading>SHORT TITLE.</heading><content style="-uslm-lc:I650120">  This Act may be cited as the “<shortTitle role="act">Support for Veterans in Effective Apprenticeships Act of 2019</shortTitle>”.</content></section>
<section id="d110425e72" identifier="/us/bill/116/s/760/s2" style="-uslm-lc:I650141"><num value="2">SEC. 2. </num><heading>IMPROVED APPRENTICESHIP PROGRAM COORDINATION BETWEEN THE DEPARTMENT OF LABOR AND THE DEPARTMENT OF VETERANS AFFAIRS.</heading><subsection class="indentUp0 firstIndent1 fontsize10" id="d110425e76" identifier="/us/bill/116/s/760/s2/a" style="-uslm-lc:I650120"><num style="-uslm-lc:emspace2" value="a">(a) </num><heading><inline class="smallCaps">Definitions</inline>.—</heading><chapeau>In this Act:</chapeau><paragraph class="indentUp1 firstIndent1 fontsize10" id="d110425e84" identifier="/us/bill/116/s/760/s2/a/1" role="definitions" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="1">(1) </num><heading><inline class="smallCaps">Registered apprenticeship program</inline>.—</heading><content>The term “<term>registered apprenticeship program</term>” means an apprenticeship program registered under the Act of August 16, 1937 (<ref href="/us/stat/50/664">50 Stat. 664</ref>; commonly referred to as the “National Apprenticeship Act”).</content></paragraph><paragraph class="indentUp1 firstIndent1 fontsize10" id="d110425e96" identifier="/us/bill/116/s/760/s2/a/2" role="definitions" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="2">(2) </num><heading><inline class="smallCaps">Secretary</inline>.—</heading><content>The term “<term>Secretary</term>” means the Secretary of Labor.</content></paragraph></subsection><subsection class="indentUp0 firstIndent1 fontsize10" id="d110425e104" identifier="/us/bill/116/s/760/s2/b" style="-uslm-lc:I650120"><num style="-uslm-lc:emspace2" value="b">(b) </num><heading><inline class="smallCaps">Additional Registered Apprenticeship Program Requirements</inline>.—</heading><chapeau>Notwithstanding any other provision of law, for any program applying to become a registered apprenticeship program on or after the date that is 180 days after the date of enactment of this Act, the Secretary shall—</chapeau><paragraph class="indentUp1 firstIndent1 fontsize10" id="d110425e112" identifier="/us/bill/116/s/760/s2/b/1" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="1">(1) </num><chapeau>acquire from the program sponsor a written assurance that the sponsor—</chapeau><subparagraph class="indentUp1 firstIndent1 fontsize10" id="d110425e116" identifier="/us/bill/116/s/760/s2/b/1/A" style="-uslm-lc:I650124"><num style="-uslm-lc:emspace2" value="A">(A) </num><content>is aware of the availability of educational assistance for a veteran or other individual eligible under chapters 30 through 36 of <ref href="/us/usc/t38">title 38, United States Code</ref>, for use in connection with a registered apprenticeship program;</content></subparagraph><subparagraph class="indentUp1 firstIndent1 fontsize10" id="d110425e124" identifier="/us/bill/116/s/760/s2/b/1/B" style="-uslm-lc:I650124"><num style="-uslm-lc:emspace2" value="B">(B) </num><content>will make a good faith effort to obtain approval for educational assistance described in subparagraph (A) for, at a minimum, each program location that employs or recruits a veteran or other individual eligible for educational assistance under chapters 30 through 36 of <ref href="/us/usc/t38">title 38, United States Code</ref>; and</content></subparagraph><subparagraph class="indentUp1 firstIndent1 fontsize10" id="d110425e132" identifier="/us/bill/116/s/760/s2/b/1/C" style="-uslm-lc:I650124"><num style="-uslm-lc:emspace2" value="C">(C) </num><content>will not deny the application of a qualified candidate who is a veteran or other individual eligible for educational assistance described in subparagraph (A) for the purpose of avoiding making a good faith effort to obtain approval as described in subparagraph (B);</content></subparagraph></paragraph><paragraph class="indentUp1 firstIndent1 fontsize10" id="d110425e136" identifier="/us/bill/116/s/760/s2/b/2" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="2">(2) </num><chapeau>in accordance with paragraphs (5) and (12) of <ref href="/us/cfr/t29/s29.5/b">section 29.5(b) of title 29, Code of Federal Regulations</ref> (as in effect on the day before the date of enactment of this Act), require the program sponsor, to the extent practicable, to provide standards that contain provisions to grant advanced standing or credit, and provide increased wages commensurate to such standing or credit, for any veteran or other individual eligible for educational assistance under chapters 30 through 36 of <ref href="/us/usc/t38">title 38, United States Code</ref>, who—</chapeau><subparagraph class="indentUp1 firstIndent1 fontsize10" id="d110425e147" identifier="/us/bill/116/s/760/s2/b/2/A" style="-uslm-lc:I650124"><num style="-uslm-lc:emspace2" value="A">(A) </num><content>is enrolled in the registered apprenticeship program; and</content></subparagraph><subparagraph class="indentUp1 firstIndent1 fontsize10" id="d110425e151" identifier="/us/bill/116/s/760/s2/b/2/B" style="-uslm-lc:I650124"><num style="-uslm-lc:emspace2" value="B">(B)</num><clause class="inline" id="d110425e154" identifier="/us/bill/116/s/760/s2/b/2/B/i"><num value="i">(i) </num><content>has a demonstrated competence applicable to the apprenticeship occupation; or</content></clause><clause class="indentUp0 firstIndent1 fontsize10" id="d110425e158" identifier="/us/bill/116/s/760/s2/b/2/B/ii" style="-uslm-lc:I650124"><num style="-uslm-lc:emspace2" value="ii">(ii) </num><content>has acquired experience, training, or skills through military service that is applicable to the apprenticeship occupation; and</content></clause></subparagraph></paragraph><paragraph class="indentUp1 firstIndent1 fontsize10" id="d110425e162" identifier="/us/bill/116/s/760/s2/b/3" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="3">(3) </num><content>when the Secretary approves the registered apprenticeship program, provide a copy of the program’s certificate of registration to the State approving agency designated under <ref href="/us/usc/t38/ch36">chapter 36 of title 38, United States Code</ref>, in the State where the program is located.</content></paragraph></subsection></section>
